Nature of the Emergency:       Dearborn County Council called a meeting for 9:00 A.M. on the 23rd day of October, 2015 for the sole purpose of approving the 2016 Budget.  However, a quorum was not available at that time.  The 2016 Budget must be approved by October 23, 2015.  Failure to approve the 2016 Budget would be an actual disruption of governmental activity under the jurisdiction of the Dearborn County Council; therefore an Emergency Meeting has been called.

DC Plan Commission October Meeting Cancelled

PUBLIC NOTICE: 
The Dearborn County Plan Commission meeting scheduled for Monday, October 26th has been CANCELLED. The Plan Commission will meet to review all of its (original) business / agenda items from October at its next regularly-scheduled meeting date (of Monday, November 23rd, 2015 at 7:00pm in the Commissioners Room at the Dearborn County Administration Building). Present: Shane McHenry, President, Art Little, and Kevin Lynch

Also present: Andy Baudendistel, Attorney, and Terri Randall, Administrator

ABSENT: Gayle Pennington, Auditor - at conference. Leah Bailey covered.

OLD BUSINESS: none

NEW BUSINESS:
Greendale EMS contract - approved for $20,000 each for 2 units.

Contract wit FSSA Re: Inmate Application for Medicare- Baudendistel said this is mandatory for inmates that are there 30 days or more. Family Social Services Administration is FSSA. It helps the county get reimbursed for medical expenses. Randall repeated what Baudendistel said and added that inmates would be better off when they got out as they would be healthier. McHenry said they should table this to be sure that Sheriff Kreinhop and Lusby want this done. TABLED.

PAWS Agreement- TABLED at Baudendistel’s request a some details needed to be worked out. 

ADMINISTRATOR- Terri Randall- had nothing. 

AUDITOR- Leah Bailey covered for Pennington- Claims and October 6th Minutes- approved. 2016 Payroll Schedule was approved. 

ATTORNEY- Andy Baudendistel- reviewed a couple contracts for microfilm services and digital back up of records for the County Recorder, Glen Wright.This is with CSI. It was in his budget.

COMMISSIONER COMMENTS- Kevin Lynch- congratulated Lawrenceburg and EC have both Men’s and Women’s soccer teams go on to Regionals. They bring this to their school and the county as well. 
He attended the national conference of passenger  railroads in Indy. They want to continue the Chicago train on to Cincinnati possibly. Not an easy project, but one that would be beneficial if it could ever happen.  
The Bright Connector Study had their first meeting with the consultant and advisory board of residents and business owners in that area. He is impressed with turnout. 
He also thanked Randy Lyness for stepping up and putting his hat in the ring to possibly fill the state rep position vacated by Jud McMillin. Randy ran for this prior to Jud McMillin and has been on county council for 15 years - on and off in the past 30 years. 
Lynch also said he did not get a bad haircut- he’s had chemo for the past several months-. he is doing well and the progress is good. 

Little- said we will also keep you in our prayers. And he could go on about other things but it’s too nice outside so we can go out and enjoy this sunshine.

McHenry- Rick Fields passed recently- could go on and on about all he did in the community. They will have  celebration of life. And we will keep you ( Kevin Lynch) in our prayers. I know this is serious and you have been upbeat. I have a lot of respect for you.

PUBLIC COMMENT- Celeste Calvitto- update on the Litter Committee- Arlington, West Countyline and Chesterville done, by Community Corrections. More in D-2 done and starting in D-1 next. Lots of interest in neighborhood groups and churches and cleaned up some Bright roads. The roads done so far did not require any closures.

19 October 2015 Dearborn County Redevelopment Meeting Notes

Present: Dave Deddens, Chairman, Jim Helms, John Rahe, and Randy Lyness.
Absent: Jim Deaton and Gayle Pennington, Auditor and DCRC treasurer.

ABSENT AS USUAL: Dusty Burress (non- voting school board member)

Also present: Terri Randall, county administrator and economic development director, Andrea Ewan, attorney, Sue Hayden, minute taker.

Randy Maxwell was present at the executive session only.

VERIFICATION OF INFO DISCUSSED IN EXECUTIVE SESSION- was approved by the board as sticking to the reasons for the session as posted in the public notice.

ACTION OF EXECUTIVE SESSION- motion to allow Randall to consider land acquisitions along with Ewan and both to draft an agreement for incentives as discussed in executive session were both approved.

APPROVAL OF MINUTES- Sept 16th meeting minutes approved.

UNFINISHED BUSINESS: none

CLAIMS AND FINANCIALS: Approval of regular claims passed.
Review of financials- Pennington had other conferences this week but she sent her records for the financials. Approved.

NEW BUSINESS:
Resolution- West Harrison Plan Amendment- Some changes have to be made on that per Randall- so tabled for this meeting.

Appointment of Appraiser for DCRC Land - West Harrison- needed for property for Skally’s. Land Consultants were hired to get them thru Planning and Zoning process. They have two appraisers that have given verbal quotes- but this has to be tabled to get more on this.

Consideration of Approval for the EDA with Odette,LLC AKA Skally’s Old World Bakery. Tabled to make a few changes to that resolution. 

ECONOMIC DEVELOPMENT OFFICER’S REPORT:
All of the items in this section were tabled.

The corrected Umbaugh Agreement with a name change to DCRC and not just DC. Approved to sign.

Ratify signature for Tom Stone’s USDA agreement for CCC-861 form for Ag risk coverage ARC-CO and or PLC programs. Stone leases the farm land from the county for his soybeans. Approved for signatures on 2014 and 2015 forms. 

Randall wants to use Land Consultants for the 31 acres of the county owned land for Skally’s. Approved. [NOTE: Why is this not bid, if the county surveyor is not doing this? Skally’s is using the SAME company!]

DCRC Special Meeting set for Thursday at 8:30 AM for Skally’s to be ready for Plan Commission meeting on them this month- Oct 26th.

6 October 2015 Dearborn County Commissioners Meeting Notes

Present: Shane McHenry, President, Art Little, and Kevin Lynch

Also present: Gayle Pennington, Auditor, Andy Baudendistel, Attorney, and Terri Randall, Administrator

Shane McHenry- Brief moment of silence for Tim Tyler- teacher mentor and father figure from South Dearborn HS who passed away.

Commissioners certified that the preceding executive session only discussed pending litigation. No decision.

OLD BUSINESS:
Zone Map Amendment Request- Tootles Trust/Maxwell- Baudendistel said they asked for 65.30 acres to be rezoned M-2 included a written commitment to also be signed that excludes sexually oriented businessses. A portion of this is still in the floodway and to be developed will require studies and approval of Army Corps. There was a discussion on this about 3 weeks ago. Commissioners approved and signed commitments. NO further public wanted to discuss.

NEW BUSINESS:
Clerk of Courts- Rick Probst- DOXPOP Contract - they are collecting traffic fines and people can pay online by credit card. It will go into effect Oct 8th. This is in addition for procedures to come in and pay or pay by money order and mail in. Doxpop charges $5/ anything under $100. Then an additional $5 for each $100. Looking at credit card pay for filings and fees next year. They are also looking for an ATM for the public as long as it doesn’t cost the county anything. Baudendistel reviewed the agreement. Commissioners approved the DOXPOP contract.

Elections- legal notice for upcoming election- and identifies the voting places. Approved. 
He said in the fall election they have over 100 requests for mail in voting. Registration is closed for this election as of yesterday. Early voting can be done in the courthouse per Probst.

Manchester EMS Contract- Randall said it was good to go. Approved for $20,000. Signed by commissioners and notarized by Sue Hayden.

Director of Court Services Steve Kelly- Grant signatures- As part of House Bill 1006- counties have to house more offenders than the DOC as of Jan 1st 2016. With the jail expansion and this law we look to have to expand Community Corrections. 20 million in grant funds for the state to help with this. We are asking for additional probation officer. Big thing is evidenced based practices. Probation officer request is $56,545. Also asking for additional staff for JCAP program Additional therapist $79,861. These 2 employees will be hired knowing that this is grant based and if the grant goes away- they lose the job. It is not guaranteed that we get both. Will only do each of these if they get full funds from grant on each. McHenry thinks the jail population will explode here with the new D or Level 6 felonies we sed to DOC. Commissioners approved and signed the form for the grant. Randall went to print the form for their signature as it was not in their packets. 

HIGHWAY DEPT. Todd, Listerman, County Engineer- Revision to Design Contract Bridge #76 Jamison Road- Utility lines would have to be moved and so the redesign by FPBH out of North Vernon will be for $9000 and this saves us $54,900 if we had to move them. 
Schwipps and Kaiser bridges are moving along and should both be open before Thanksgiving per Listerman. 

ADMINISTRATOR- Terri Randall- Commissioners going to Dillsboro Town Council to discuss their EMS missed runs and put a plan together to alleviate this. It was advertised.

Randall provided a letter of support for Jim Jung who is from this community. He is working on a progressive transportation project. ( Turned out to be hydrogen fuel) He is requesting a letter of support for his project. They have all been talking to him for this. He said he was blessed to grow up here- was in Detroit since 1979 and blessed to come back here. He has spoken at major energy conferences. They are working on Hydrogen fuel, made from water. His parents loved this area and he grew up on Ludlow Hill and Greendale and attended LHS. They are trying to tap energy funds out of DC area. Energy -transportation evolution. Lynch said he appreciated the time he has spent here. McHenry asked for approval to sign the Hydrogen Superhighway Project- Signing stopped until it was explained  at my request. He said it was an 8-18 month timeframe to build prototype. They will use safety standards that NASA and Air Force  are developing. Discussion with the present public on the technology.utilizing solar panels along highways and storage for hydrogen every 3 miles or so. Safety design was stressed.Then the Commissioners signed the letter. [NOTE: This was discussed prior to the meeting with commissioners- when and where? Why does this keep happening? There’s a big idea comes in that the board and administrator seem to know about- but no public presentation has occurred. ]

AUDITOR- Gayle Pennington- Sept 15 minutes approved. Claims approved. 

ATTORNEY- Andy Baudendistel- nothing more

COMMISSIONER COMMENTS- Lynch said a whirlwind of a week with McMillin’s resignation. Caucus will appoint his month. He asked for prayers and thoughts to Jud and family through these trying times…

Little- glad we don’t I've in South Carolina this week! Floods.

McHenry- thanked Aurora Lions for the Farmers Fair- and great turnout despite the weather.
