16 July 2019 Dearborn County Council Meeting Notes
Present: Liz Morris, President, Dennis Kraus. Sr., Dan Lansing, Kevin Turner, Tim Doll, Alan Goodman, and Bill Ullrich. 
Also present: Connie Fromhold, Auditor, Jim Thatcher, Commissioner, Sue Hayden, County Administrator, and Andy Baudendistel, County Attorney.
FIRST MEETING- DEARBORN COUNTY LOCAL INCOME TAX COUNCIL- 6:30 PM
The County Council is also the Tax Council for the entire County including the municipalities.
TITLE VI STATEMENT FOR COMPLIANCE- read by Morris as legally required.

LIT - Request for a distribution for the Bright Fire & EMS, Bright Volunteer Fire Company, Inc from Public Safety LIT. - Morris said this is the first year this is available. 
Kendal Eberhardt- they want to purchase a squad- $224,658 for a 911 fleet and fire was what was submitted originally for an ambulance chassis squad. Trying to get to a more easily maintained system for transportation to avoid the issues they have with the diesel chassis. 2011 Dodge chassis ambulance has 98,000 miles on it. $18,274 in maintenance on this since 2017. It has broken down with a patient in it and it has caught fire also. Had to put in a transmission and $6,000 for suspension. Can get $10,000 for it in trade in. 
Morris said that whatever money is granted it won’t happen until January and then it comes in in twelfths- each month. 
They did 3 bids based on multiple chassis. Had one for $204,000. Its an E450 chassis- and ambulance chassis. They are really considering the Ford version that is prebuilt with the entire ambulance setup.
The idling seems to cause the maintenance issues on the diesels.
Bill Ullrich praised them for all the work they do and getting their research done.  
Tim Doll commended them on doing their homework and asked some questions regarding the share of county population they cover- 33%. 
Eberhardt said they try not to touch Festival funds for anything other than protective gear. 
Getting away from the diesel- too much expense on maintenance and exhaust repairs. 

Ullrich moved to accepted the $224,658 to do it right the first time. Kraus Sr. seconded. All ayes.
Baudendistel said the actual resolution will be approved on August 12th at another meeting.

SECOND MEETING - DEARBORN COUNTY COUNCIL- 7 PM

Steve Kelly Grant Application Approvals: - Connie Fromhold presented- they already have the money so they made them fill out the grant forms. No county match. Ullrich motioned and Turner 2nded. Council approved all 3 below.
Veterans Treatment Court grant - $126,589
Drug Court Grant- $10,000
Veterans Treatment Court Grant - $10,000

Discussion on President of Council signing grant applications outside of a meeting with no county match. They feel that the commissioners already have to look at this first- so they are covering the review of matches or not etc. So Council decided that Morris could be allowed to sign off on them prior to the meeting and then notify council at their next meeting, 

TREASURER- Barb Scherzinger, Resolution Authorizing the Investment of Public Funds. Connie Fromhold presented this for the treasurer. This also still allows banks outside the county to be used for deposit of public funds. Approved. 

SHERIFF- Shane McHenry- Grant application for Stop Arm Violation Enforcement (SAVE)- Connie Fromhold presented for the sheriff. This is for extra patrol during bus hours on county roads per Kevin Turner. No match on this grant for $11,000. Approved.

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

OLD BUSINESS- none

NEW BUSINESS

Jack’s Forever 3 Still Running 5 K Run/Walk- Beth Fox- asking for the road closure for Sept 14 a Saturday. Ok with Sheriff McHenry. This is year 9 for the Run/Walk. Commissioners Little said he gets a complaint from the same guy every year- but is usually OK with the road closures after they talk a bit. Commissioners approved. 

YES Home Request to approach Council Tamara Taylor- YES Board Member- Roof needing to be replaced and shingles seen on the ground. Commissioners approved going to Council with request.

NRCS Grant Assurances Required Document- Sue Hayden for Tim Grieve, Highway Superintendent- a formality that goes on wit the awarded grant from Natural Resources Conservation Service for 3 slips with cost of $2,528,770. The grant  is for $1,896,578  and our portion is $632,192

ADMINISTRATOR – Sue Hayden
OKI 2020 Agreement-This is the annual agreement we do every year for $16,357. We are the lone Indiana county in OKI. Probst said he was there today for an information briefing. They are forward  thinking and they bring us along in that direction. Commissioners approved the agreement. 

Nextiva Service Agreement- for phone trunk or dial tone coming in to us. Replaces Centurylink. Jeff Bitner  is present to explain. Savings is $18,000 a year. Andy has reviewed the agreement. There is 3 month free there as the contracts overlap. Commissioners agreed to the change - approved. 

AUDITOR – Connie Fromhold  -Claims and July 2nd Minutes approved. Probst looked thru all claims. 

ATTORNEY – Andy Baudendistel- Bridge 5 on East Laughery with $1,250 appraisal for land needed. Slattery will agree with the appraised amount. There will be more for some future road and bridge work.

COMMISSIONER COMMENTS:
Probst- had 45 volunteers in spring cleaned it up. The Gulford flood 6-8 weeks ago destroyed what they had done. Terry and Vicki Stephens were out there to get the park back open. Needs the media to support the to get volunteers this Sat the 20th at 9 AM to get mulch spread etc. He noted there are ore Ohio license plates out there often than Indiana ones.

Little- always good to have volunteers. It is a nice park with etc baseball and the covered bridge. Thank the volunteers.

Thatcher- started at top of Yorkridge down to Guilford with litter cleanup this past weekend.

11 July 2019 Dearborn County Redevelopment Meeting Notes

Present: Jim Deaton, Chairman, Dave Deddens, Jim Helms, Diane Bender, and Alan Goodman. 
ABSENT: Jamie Graf (non- voting school board member)

Also present:Sue Hayden, county administrator and minute taker, Andrea Ewan, attorney.
ABSENT: Connie Fromhold, Auditor and DCRC treasurer.
Title VI statement read as legally required by Deaton.
APPROVAL OF MINUTES- June 24 Minutes were approved.
CLAIMS AND FINANCIALS - $10,000 for One Dearborn 2nd quarter taken equally out of the four TIF accounts approved. 
Financials were passed out for review. 
UNFINISHED BUSINESS:
Status of Agreements with Crossdock Development- Randall said that this has been a waiting game with Barnes and Thornburg due to attorneys being on vacation. The license agreement economic development and purchase agreement have been sent to Wilburn (Crossdocks) for his approval. His attorney still has to review it. There is some minor item they are working on. Wilburn is still moving forward as if these are all signed and approved. 
They needed some surveys done- an ulta survey makes sure all the utilities are there etc. JDJ Surveying and Rob Seig and Land Consultants responded and Land Consultants is the lowest for $2100 and$1000 for their Ulta totaling $3100 for this to be done. Land Consultants has all that info on file so they can do Ulta’s more economically. DCRC approved Land Consultants or the surveys for $3100.
Randall said finalizing the deal will be a lot of work. They got a marketing piece with an image and square footage which will be used on Zoom prospector and other sites. Randall took Crossdocks team to Mark McCormack at Planning and Zoning to get all the approvals from their boards.
Status of Billboards- Crossdocks wants to use one of the county Billoards and there are 3 that sit along the property. 2 owned by DCRC. The other owned by Norton, whose lease is being worked on as DCRC grants the lease. Crossdocks wants to have control over that lease. There is a 60 day notice requirement on that lease. Randall is letting Crossdocks decide what they want to do about the option. They may want to remove the sign. From Hilinger toward east. First one is Norton’s and 2nd is DCRC and is not leased and the 3rd is $2700 per year from 2012 - Board wants to use current market rates. Crossdocks can have two of the signs per DCRC Board so they don’t have to manage these further. The 3rd sign is needing more research and needs a landscape permit to clear trees from State Highway Dept. DCRC Board decided to offer the Best Western and Shelton sign for a minimum of 6 months to pay for the wraps but not the electricity to market his site. Approved.
NEW BUSINESS:
2020 Service Agreement with One Dearborn- same terms as before per Deaton. EG McLaughlin and Mike Schwebler were present from One Dearborn. Housing and amenities are necessary to getting business here per Deaton. Approved the 2020 Agreement. Deaton thanked them for being here in case there were questions. Randall said it was a pleasure to work for them and the spec building has generated more proposal and REDI Cincinnati is engaged again. Spoke to the developer to get the press release out in the Cincinnati market. 
ONE DEARBORN REPORT: Randall said the residential structure that is adjacent to the Stone existing farm is not easily demolished. They had to pay $2500 for asbestos check. Windows have to be done separately for asbestos and the ductwork. Three septic tanks on the site  have to be filled and leave the leach lines.there. She got the process for this from Health Dept. She also checked her list of demo contractors with Mario Todd form Lawrenceburg for his experience. There is $9000 from Duke Readiness Fund for that. Deddens asked if they had checked Tom Klump on asbestos removal. Randall still checking on the mowing services. Stone mowed last week for them. We are about over that part. Also getting a bill for the first 20 acres. 
Deaton asked about the rail on the Tootles property. Randall said that on the shovel ready sites. Closed on Project Scorpion on that portion of Tootles site and the railroad. West Harrison LLC which is Maxwell was asked by Randall if they would consider selling some of that. 30 acres for sure and maybe up to 40 acres per Maxwell. She’s talking to Railroad and INDOT to see what the cost would be to fill from the flood plain. The total amount of acreage would be a draw. the Whitewater Mill needs more traffic on the rail to keep it maintained by Gennessee and Wyoming. It would be a shame to not have the railroad be used for a potential owner of that site.

Grant Application Approval- Court Services- Steve Kelly- Fromhold presented for Kelly-Commissioners approved the following three:
$126,589 for SE Indiana Veterans Court
$10,000 for Drug Court 
$10,000 for Veterans treatment program

ADMINISTRATOR – Sue Hayden- Lift in the tunnel for handicapped inmates to get to court. finished Wheelchair lifts for bth sets of stairs. Used the annex money to pay for that. John Lee found this solution that also provided the security for this. 

AUDITOR – Connie Fromhold  -Claims and Minutes from June 18th approved. In claims Probst and Hayden said they had saved $120 pn a single toner purchase in one dept. 
Sheriff’s Dept Grant Application Approval Stop Arm Violation enforcement act for $11,000 -Approved
Ordinance Adopting Supplement to Code of Ordinances- Baudendistel said this updates the ordinance book for state code compliance. This does the ordinance book and digital version on the internet - Approved. 
Ordinance for Real Property Endorsement Fee- Baudendistel comes from new legislation- This is now $10 fee for deeds etc. This will be effective October 1, 2019 to allow people to get notified of this change - Approved. 

ATTORNEY – Andy Baudendistel- Senate act 522 for Building Commissioner where a conflict of interest might exist. Solved by having Carl Fryman in Lawrenceburg review Bill Shelton and vice versa for Lawrenceburg when Fryman has a conflict of interest. They are working with Lawrenceburg on setting this up. Also had some conversation about Fryman doing the inspections for the county areas that LMU ( Lawrenceburg Municipal Utilities) serves.Commissioners were concerned about unintended consequences of liabilities and lost fees for this.

COMMISSIONER COMMENTS
Probst- the towboat Elizabeth Lee sits on Laughery Creek and the owner got is approved on the list of historic places. Nice addition to the county. Can put on tourist brochures and it runs. 
Little- has been out driving the roads that are being improved in the county- slowly gaining on the roads. Working on Sneakville. All asphalt plants at capacity. Bridge to be ready when slip is done.
Thatcher- read something on July 4th holiday. Reflection to look at the nations values and recommit selves to those ideals.
