20 February 2024 DEARBORN COUNTY COMMISSIONERS MEETING NOTES


Present: Jim Thatcher, President, Alan Goodman, and Rick Probst


Also present: Connie Fromhold, Auditor, Andy Baudendistel, Attorney, and Sue Hayden, Administrator


TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

Proposed Ordinance to Amend the Dearborn County Zoning Ordinance Pursuant to Indiana Code § 36-7-4-607

Proposed Ordinance to Amend the Dearborn County Zoning Map Pursuant to Indiana Code § 36-7-4-608

Daily said she is bringing the request for approvals for zone change map and text. She said we are in the 4th year of working on these. The Plan Commission voted to give a favorable recommendation with 7 out of 9  in attendance  last month and had 2 abstentions in the vote. (Thatcher abstained and Kraus, Jr. (Chairman)  did not need to vote as it was not a tie.) 

We created an Ag district and Ag Homestead which is like the current Ag district. And R1,2 and 3 with low to high density. 

Daily also showed the texts and definitions and said there were new definitions based on new texts too.

Baudendistel said Ordinance 2024-003 is in front of them. They do not need to have a public hearing as the Plan Commission already did. 


Goodman moved and Probst 2nded to approve the texts. Approved. 


Thatcher went over what he called Ag Residential (he means Ag Homestead???) as being like the current Ag, etc.  

Board also approved the Zoning Map as presented.  


Yearly Update – Dave Currence, Veteran’s Service Officer- presented the services that the Veterans office provides. He wants them to be treated with dignity and respect. They go to the American Legion Posts and presented to them- it’s a big step in explaining the benefits they have. The new clinic is open and he encouraged them to check it out. He gets his accreditation renewed by attending trining in Indy. He put together a small set of metrics each year. Transports about 43 per month. Growth - 21% increase in office visits and 28% in claims processed. He is the only person in the office and he thanked the staff and commissioners for their support. The new facility has an eye clinic now. They have more medical professionals. They have Benn open about 6 months. They have suicide prevention education, homelessness, etc that they educate veterans and tech community on. 

Probst asked about his “ugly” flag. It was an Air Force Flag. So Probst gave him an ARMY flag too. Laughter and applause. 


Resolution to Accept Transfer from Dearborn Co. Jail Holding Corp.- Former Commissioner Rocky Schroeder is the only surviving member. He helped them by executing the warranty deed. Commissioners approved and signed a resolution accepting the land from the Dearborn County Jail Holding Company. 


Proclamation for LUCKY RACER DAY, February 24, 2024 - Sue Hayden- said Chris Shearer (sp?)and this is from her father. It’s a scholarship program with skiers. It is to build champions on and off the slope. She wants to have proclamation presented to her on that day. Approved and signed. Thatcher will present it too her on that day he said. 


Acceptance / Completion of Lower Dillsboro Rd Slide Project - Approved.

ATTORNEY – Andy Baudendistel- Sheriffs dept is donating old laptops to Moores Hill Fire and EMS- approved  the resolution to allow this. 


COMMISSIONER COMMENTS: Probst- HWY did a good job with recent storm. Hats off to them. Goodman and Thatcher both agreed with him on that. We have 525 miles of Rd and less than 25 people get the roads cleared per Thatcher.  


LATE ARRIVAL INFORMATION- none


PUBLIC COMMENT- Tom Gaynor and Steve and Mike Kuhn - his sons. Discussion was on the problem of their farm which was AG now shows up as R1 on this map. They were at the last PC meeting but did not see that their land was R1. Commissioners and Baudendistel stressed that they can still farm for 200years in R1. They do not want to be grandfathered use. They want what they had. Ended up with Gainers saying they will have to get a rezone.  [NOTE: One of the things to be learned from this entire rezone process is that the maps were confusing to many citizens as they said they could not locate their specific properties because the maps used at workshops etc did not have landmarks or enough street and road names. The second thing to be considered is that when a citizen or developer asks for a zone change, they are required to notify the adjacent property owners of the request. That same courtesy (dare I say right?) is apparently not the case when a county redoes the zoning map. The Gaynors are long time farmers on their land. It was previously zoned Ag. This process changed that. It seems we might need to consider a process that would not require these people to pay for a zone change themselves to get back what the county took away from them.]


Ron Rourke - McCann Rd- They have a woods parcel and right of way issue. They are considering some hard questions due to family health issues. He wants to know what it is now. It’s Ag Homestead. He wants to know the process on changing it if he needs to. Will visit Plan office with Nicole.


Christian Vesper- Logan Township- thanks for updating maps with roads so I can tell where my property is. Ag Homestead- Why can’t they raise bees or insects and worms? Discussed all the  things he might want to do- would Ag be better?


Greg Hyland- 5th generation of Hylands. It’s hard to please all the people. Nicole has done a yeoman job putting the puzzle together.

Steve Renihan - President, Brett Fehrman - Vice President, Russell Beiersdorfer, Bill Shelton, Doug Baer, and Steward Cline

ABSENT: Jeff Stenger and Russell Beiersdorfer

Also present: Christy and Bob Hrezo, Rick Probst and Jim Thatcher- County Commissioners and Tamara Taylor, The Beacon

Renihan read the Public Access Statement as legally required.

Minutes: January 18th Minutes -  Approved.

Treasurers Report: none 

Public Comment: John Lewis- property owner in Lake Dildear area. Wants info. His property is one lot on the lake. Renihan told him that it is in the engineering phase- he is staying to hear the update on that later. 

Project Updates: Christy from Hrezo Engineering

Guilford- Mr. Chafee is working on specifications and drawings are pretty much completed. Lift station  details worked out. It takes 2 months for IDEM to review. The low pressure sewer side is what she is working up too. Cline wanted to get the final RR approval done and also know when they could get out to bids- hopefully May 1st. The easement from Fox is done also.Thatcher said they had to get everything appropriated in 2024. You have to have some deal in place. An ARPA meeting can be scheduled in a matter of a couple of days notice. Renihan wanted to know if they needed to light a fire under Chaffee to get things moving. Christy said she had already talked to him about that this morning. There is area for future bathroom in the building should they need it at a later date.     

High Ridge WWTP- none

High Ridge west Expansion - Texas Gas Rd- Meyers- 10860-Texas Gas- new customer. The fix will be installed on the pumps as they are done. 

Wilson Creek Project- none

Huesman Rd and Cole Lane- Jeff Meinders coming up with his specs soon. 

Harrison TIF/Stone Project- none

Scenic Ridge/148 Sewers /Outer Drive- none

Stateline Rd- Nick from Crossroads- Meinders is getting a quote together for the entire project-there are no other bidders - he had sought out 6. Expect some more customers on the Madden line.

Serenity Ridge Tranquility Court- house being built there so new customer coming in. 

Moores Hill

Dillsboro- Lake Dildear-Cline said that Watson had been working a trial so they were waiting on some things. Christy- Bidding on Lake Dildear might be a month behind Guilford. It doesn’t take as long as Guilford- just 3 weeks for her to do the low pressure lines. Christy this the street ROWs were big enough for the lines. They are looking at buying treatment from Dillsboro. John Lewis - said he did not think his neighbors knew about it. Christy- But they will after the engineering phase is completed. Stew said they always want to be pushing Christy- not Christy pushing us. 


New Business: Jacob from Barnes and Thornburg- sent some documentation. He wants to come on March 7th. Cline said it does have provisions for management versus acquire it. Board was trying to figure out how to zoom meet with Jacob prior to March 7 to expedite the meeting. Fehrman wants to see how they will address the public’s concerns. Cline said they need to know how bidders will fix existing problems. RFP is first and then contracts. Once they see proposals, they may need more info etc. They have to think about a timeline for RFPs and so forth. Board will try to get 3 to attend the zoom next week.   

Office Update: Board agreed that Kelly could buy whatever office supplies she needs within the budgeted amount. 

Doug Baer ( treasurer) - gave them budget numbers. There is a line item for project manager. He thinks it should be in the operating budget. Taking that out means they are in the black. 

Renihan thinks we should take this to the accountant. Construction budget should be separated from operating budget. 

Fehrman found $3.5 million on pipes in the ground. 

Renihan- That needs to be an asset- and also a liability as they need maintenance and/or replacement. Katrina- the accountant needs to be consulted about this.

Baer- not all of Kramer’s fees are on projects. He separates them for us.

$120,000 spent per year

Wastewater revenue was $69,164.20 Plus these separate funds like- tap income $76,500, $14,170, $ 714.58 $12,086, $738.79, $4,170 

$519,106 from county that is project money. 

There is no maintenance on here per Cline. Like replacing aging systems. 

Adjust litigation and project manager audit will be close to budget.

Renihan wants to be sure all the money the county put in and we put into the ground counts as our assets.

Baer - no need to vote tonight. He is keeping spreadsheet for this running totals.  

Renihan- said thanks to Baer for the efforts. In a better place now.

REMINDER FOR COUNTY ZONE MAPS CONSIDERATION AT 2/20/2024 COMMISSIONERS MEETING AT 5PM  

This is just a friendly reminder for anyone interested in attending for the next step in the proposed zoning ordinance and zoning map changes.

 

Dearborn County Board of Commissioners will be considering changes the Zoning Ordinance and Zoning Map proposed from the Dearborn County Plan Commission. These proposals will be considered at the Dearborn County Board of Commissioners meeting to be held on Tuesday, February 20th, 2024 at 5:00pm. See attached notice.

Executive Session at 8 am preceded the meeting

IC §5-14-1.5-6.1(b) (2) (D) which pertains to discussing strategy with the respect to the purchase or lease of real property by the governing body up to the time a contract or option to purchase or lease is executed by the parties;

IC 5-14-1.5-6.1(b) (4) (A) to discuss interviews and negotiations with industrial or commercial prospects or agents of industrial or commercial prospects by the Indiana economic development corporation, the office of tourism development, the Indiana finance authority, an economic development commission, a local economic development organization (as defined in IC 5-28-11-2(3)), or a governing body of a political subdivision

MEMORANDUM AND ACTION OF EXECUTIVE SESSION- Board certified they only discussed what was advertised.

Action on Executive Session- Mark Dole moved to  Sell the Bright Property to Joe Perleberg for $60K . Approved by Board. 

APPROVAL OF MINUTES- JANUARY 9 MINUTES- Approved. 

CLAIMS AND FINANCIALS

Claims:  $407.00 to CherryRoad Media Ad for Offering Sheet Randall Ave. Property 2nd run; 

$18,485.00 to Bayer Becker for Task #3 - 100% complete, Task #4 - 30% complete and Task #5 - 85% complete.

Total claims : $18.892.00 Approved. 

OLD BUSINESS:

STONE PROPERTY RIGHT OF FIRST REFUSAL- Ewan has it more or less drafted- but the 2.3+ acres does not have it’s own legal description. Releasing the 2.3+ acres. She said someone is going to have to do a survey. She can do the agreement to take it out of the right of first refusal. without a survey. Tom Stone will be responsible for the survey.Andrea will contact him. 

NEW BUSINESS:

2024 MOWING- Will contract with Drake again for 2024. Perleberg asked if they would continue with Bright. Yes.

ONE DEARBORN REPORT:Mike said he talked to Rosenberger and he gave out the bullet points from him  to the board. 

Ball State puts on Econ Dev. Course there is anyone wants to attend. 

ATTORNEY’S REPORT- Andrea Ewan is terminating her relationship with DCRC, because there are more and more clients of hers that are coming up with DCRC and she sees conflicts coming up. She will stay till the transition goes through

She suggested Anthony Smart and then DCRC approved talking to Smart about the position.
