NEW BUSINESS

Poll Workers Salaries - Gayle Pennington, Clerk of Courts- and Secretary of the Election Board. Coming to them to get their recommendation for salary increase. No raises since 2016-17. Totally electronic since then. They are trained. A lot are read to pass the baton to the next generation. Need to attract new worker. $150-200 per election in other counties. Inspectors get $150. We do $100 now. Wants it to be $150/election for the workers. $20 for training and $15 for meals is also in the budget currently. They work from 5 am to 6:30- 6:45 pm usually. We used to have 225 poll workers when there were more polling places. We have about 100 workers now per Rick Probst. The judges also get $150 and $200 for inspectors in this new 2024 budget request. The absentee ballot workers and traveling ones will be $100. Approved to go to Council for these amounts at budget request time.

Bid Award for 2023 Line Striping- County Engineer, Todd Listerman- had 2 bids - Ogelsby Construction from Norwalk OH was lowest bid. They also do state highways in WV. $172,876.50 is the bid amount-which is 9 1/2 cents per linear foot. We do 86 miles of our roads get striped. 1.8 million linear feet of line striping. Some of the roads last year were paved and the striping was included in the paving bid. It’s a little over $20,000 increase from last year. Approved.

Bridge 33 at bottom of Union Hill Rd. - Todd Listerman  presented -Have to relocate REMC utilities for $38,861.07 is max amount. This is an 80/20 project. Our cost is just under $8,000. The purchase price is a separate agreement. Approved.

Zone Map Amendment- Director of Planning and Zoning, Nicole Daily

Ag to B-1 Local Business- Property on the Corner of SR1 and address is 7140 Hyland Rd- On May 22, 2023 PC met and passed a favorable recommendation with conditions- 1. Property owner puts landscaping on western and northern property lines within our buffer yard standards. 2.the property lights that exist or are added meet the current standards so it is not trespassing on other properties. Sewer is available. The local fire dept requested they remove the barriers in the  parking lot to prevent semi turn arounds. Property owner is here this evening. He met with owners regarding the lighting. Mixed use with commercial and industrial is the future land use options there. They have a 20 ft wide buffer line. She read the height and width of shrub and tree examples he can use. Photometric light measurements will be done for lighting if needed. .8 is the measurement along any property line. They may have to a adjust the LED lighting. Steve Naltner purchased the property. He said he called his neighbor who has knowledge of lighting to help with the lighting adjustment. He said they have done some changes to have the lighting facing the parking lot more and will do more if the neighbors think it is needed. Commissioners approved the Zone change to B-1.

Ordinance to Change the Zoning Classification of the above property if approved. Commissioners signed the zone change ordinance also.

Review of Interlocal Agreements for Dispatch Services- Baudendistel presented. They have not been adjusted since 2016-7 and the costs have increased. They met with Jared Teaney to get real number costs for the towns and cities. They are sending a letter to the towns and cities to not automatically renew. County has 37% of phone calls and 86% of budget costs now. There is a letter to be sent to get them to meet with us to discuss the new interlocal agreements and costs. $800,000 in new equipment is NOT included in these new costs for the cities and towns. This include 2 new people to be hired. They still take off the 911 costs. The money the county gets is taken off first before they figured the shared costs. Commissioners approved the letter to be sent so the automatic renewal will not happen. These fees are discussed. Letters will go out certified.

ADMINISTRATOR – Sue Hayden

AUDITOR – Connie Fromhold  -Claims/Payroll and June 6th Minutes- Approved

Legal Rep for Tax Sales- $15/parcel and now $25 / parcel. Buchanan and Brugganschmidt retained for legal services. Approved.

Opening the bids July 18th at the Commissioners meeting. All 5 respondents were served. The company that owns the property has been served thru their agent. This bid package has about 60 pages. When all is done then is goes to sheriff sale. We are more than likely not going to get the money back.

COMMISSIONER COMMENTS- Probst- Tuesday is July 4 - meeting is Wednesday. Have a safe celebration.

Little Have a great July 4 celebration. There is a house on Stateline House that is falling down too. It’s on the list for Bill Shelton coming in on July 5th meeting per Baudendistel.

1 June 2023- Dearborn County Regional Sewer District Board Meeting Notes

1 June 2023- DCRSD Board Meeting Notes

Steve Renihan - President, Brett Fehrman - Vice President, Russell Beiersdorfer (who left at 6:00 to give out scholarship at South Dearborn), Bill Shelton, Doug Baer, Jeff Stenger, and Steward Cline

ABSENT: Attorney - Frank Kramer

Renihan read the Public Access Statement as legally required.

ALSO PRESENT: Rick Probst, Commissioner and Christy from Hrezo Engineering.

MINUTES- May 18th minutes approved minutes with Stenger making corrections that include ayes and nays and also correction for saying none opposed when 2 were nay, The motion on one item was 4-2 and the quorum question will be submitted to Frank Kramer when he returns so they get it straight for the future. Stenger sent an email to the board regarding this as he was not sure about majority of quorum or majority of the whole board.

TREASURER’S REPORT prepared by CPA - March and April Financial report approved after they read through it with some comments. $72K collected year to date. Most of the tap fees collected for Texas Gas Rd in Jan and Feb. More grinder pumps coming and that will be a bigger capital expense later.

PUBLIC COMMENT: Steve Brock from Indy working on rate study  and is here now. He passed out copies. A rate study tries to see if the revenues will match what you are bringing in. Hard to calculate  as DCRSD is all over the place. Last rate increase was in 2010. Per Cline -$60k used to come in annually for about 6-7 years 2003-2010 and it was stopped. $4million originally was for capital expenditures. In about 2015 they stopped funding DCRSD so they could stand one their own. All projects had been taken with approval of Commissioners and Council. Callahan did previous rate study originally. Brock- State law says you can force people to hook on- and it changes every year. Used to be 300 ft from the property line to the main. Should check with attorney Kramer about that. Maintenance for Serenity Ridge, Guilford, and High Ridge, and maybe West Harrison TIF. There is no debt outstanding at this time for DCRSD. Meter fees, availability fees, and service fees are revenues. Looking at budget to see how accurate that is. Operating capital. Future capital improvements. $125 million grant each year and you missed the one this year. Deadline next year is April 1, 2024. (unclear if this was income based)- USDA funds? SRF or RD ( rural development)? 3 different income parameters for these.

Provide, replace, and repair funds are needed. Operating expenses - connection charges, availability  fees - a one time charge for new customers. Need to look at what an availability fee is charged for. Currently DCRSD charges $15 for customers who don’t hook on- but may want to later. There is some discrepancy about whether or not there is enough capacity to cover all to all the  people who pay availability fees. Again Frank Kramer will have to look at this. Because you are a regional district you would score high with USDA grants.

Wastewater revenue- 2021 and 2022-  65K ( this was higher due to filing liens on customers owing)  and 22K. He encouraged them to be timely in filing liens- every 60 days.

Tap fee income- we have a robust tap fee of $7500. - should go into an account to fund future capital improvement.

Wilson Creek was different as they turned it over to the local provider- though they get money back to pay off the expense of putting lines in. $18/month to get this back. We get half the fee- $1500. Only 8 customers. 18 x 12x 8  is what they get per year.

City of Harrison treats the TIF and they pay twice a month.

Brock- Revenues are now $80,000/year using these figures.

(Beiersdorfer left at this point- see note above)

$140k- new budget- and Baer will send that to Steve Brock. (this will be a $50k deficiency on an annual basis.)

How to space out rate increases so they are explainable. Not wait 13 years.

Statute limits you to 5% per year without a public hearing,

Brock- you have no consistency on your revenues or expense over the year.

Project manager $64k in 2022 and it’s not in that budget.

Steve Renihan contract is $600/month. $7200/year.

Legals are $17k/year.

Balance as of April - $433,000 cash assets. With a bunch of grinder pumps at $4k to pay for also.

Cline- fast forward 2 years will have Guilford - yes- more income.

We also have 117 customers now Renihan.

Will need another rate study for Dillsboro and Lake Dildear in a couple years.

Need to budget higher especially for the 2nd plant.

Steve Brock- Rates can go ups to $105/month without any further county subsidizing.

Dillsboro wants a bulk rate and not what we did with others previous to this.

107 paying customers at High Ridge. Average $65/month. Also about 20% of the 107 are paying the  $15 availability fee.

Brock will go back to the table and set up the rate study with the new numbers. Warned them that they won’t like the numbers. He will have the report in 10 days. I will send to a two page sheet on why it’s expensive to sell your utility to investors for your utility customers.

PROJECT UPDATES: Christy and Doug gave updates. Treasurer is bonded now- and they need 2 signatures on all the checks written.

Cline wants a timeline at every meeting to go over.

Guilford- need Christy to keep them reminded of where they are on the timeline, and purchase of land. She wants to know if she was to consider going up Yorkridge on that- no was the answer. Because using federal funds all have to be hooked on- 100% participation.

High Ridge WWTP- had a blown pressure gauge they fixed over holiday weekend.

High Ridge west Expansion - Texas Gas Rd

Wilson Creek Project

Huesman Rd and Cole Lane

Harrison TIF/Stone Project

Scenic Ridge/148 Sewers /Outer Drive

Stateline Rd

Serenity Ridge Tranquility Court- DCRSD does maintenance on this as the Serenity Ridge people paid for the lines.

Moores Hill

Dillsboro- Lake Dildear- also need to purchase the land for this - lease to buy comes due at beginning of August

North Hogan Issues

NEW BUSINESS- Brett Fehrman- noticed in the last year the SDRSD is smelling much worse. Noted that Envirolink runs that plant now. Stenger has noticed it too. [NOTE: This has been going on this year and part of last year- I pass that plant several times a week.]

Also looking into the costs for getting Moores Hill funding thru SRF. Christy will get that info for them. Also need an asset management plan. And it should be done with financial people.

Renihan- Steward Cline is working with Christy and Watson and Frank on Lake Dildear and only 3 board members can be there to avoid quorum. Meeting set later this month.

OFFICE UPDATE- As planned Sarah resigned - last day today- Kelly taking over and will let board know If they need more help. Board voted to have $250 gift card to 3rd and Main for her years of service. Probst warned they needed to check with Frank Kramer- it has to be done so as not to violate rules on their fundings. Board members  willing to do it personally and not from the budget.

CLAIMS- approved and approved billing adjustment for SBOA.

COMMENTS: June 15 Renihan was unavailable. Renihan said that they have nothing on Barnes and Thornburg and no engagement letter. Staying at the 15th for the next meeting.

6 JUNE 2023 DEARBORN COUNTY COMMISSIONERS MEETING NOTES

Present: Jim Thatcher, President, Art Little, and Rick Probst

Also present: Connie Fromhold, Auditor, Andy Baudendistel, Attorney, and Sue Hayden, Administrator

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

OLD BUSINESS

Sewer Disposal Ordinance-  Baudendistel- recommended sending this back to Board of Health in light of legislative changes that went thru.  They need to truncate Chapter 51 and incorporate that by reference. If they want to be more strict that state law that is what would be in our ordinance. This keeps the number of changes needed down as the state revises laws. Approved to send back to Board of Health for review.

NEW BUSINESS

Business Continuity Plan for Cyber Security- Ramzi Nusibeh- Midwest Data- This documents all the places servers are etc. The highway garage data is migrated to the main server now for back ups. This will reduce the insurance having ti be paid by the county. It was $100,000 now $90,000 and hopefully this will reduce that further. If we were hacked the sequence of backups is critical. Approved.

Improvements to YES Home - Amy Phillips, Executive Director and Natalie Workman- asking for building improvements there- just drainage issues to reduce winter ice that they have to walk over in winter- $23,898.79 is the cost of excavation  and repair for part of the cisterns will be filled. This is Maxwell and Klump. One well will be capped and cisterns filled. This will keep water from sitting against the building.Less than $25k and no public funds being spent. Still has to be approved by Commissioners as they own the property. Approved.

OKI Representative and Alternate on Intermodal Coordinating Committee - Sue Hayden- this is a tech advisory committee- This is for the Transportation Improvement- and they needed Planning Dept. person in addition to Todd Listerman. Approved Nicole Daily and alternate is Deena Collins.

ADMINISTRATOR – Sue Hayden- nothing more

AUDITOR – Connie Fromhold  -Claims/Payroll and May 16th Minutes Approved and $1,850 for certified Guilford Covered Bridge approved and signed.

ATTORNEY – Andy Baudendistel- nothing more

COMMISSIONER COMMENTS-

Little- This is D-day in 1942- his brother was in Algeria- and Art told him that neats being on Omaha Beach

Probst - nothing

Thatcher - reiterated remembering the services.

LATE ARRIVAL INFORMATION- Moores Hill Sewer project - also Tim Hunt with HWC Engineering needed out there where the pond out in front- the frogs are all black. Lost the school and need more flow also. Area is 25-35 homes and 19 tests so far failed. The area is outside Moores Hill service area and they need an interlocal agreement so that Moores Hill can serve it. One is very bad and needs a bore under SR350. Commissioners said they need to go to Council only because they need some money to help with this. The agreement has to be with DCRSD for the relinquishing of the land or to send to Moores Hill DCRSD has no money for this right now. They will work with DCRSD on how the funds are distributed. INDOT is needed for under the road boring on SR350. They want the town and DCRSD to get an agreement and some support from Commissioners for Council to approve some money. Commissioners support fixing as it beats evicting those people. Moores Hill will continue to work on this.
