VOTER REGISTRATION ENDS OCTOBER 4

Contributed by Senator Nugent's email:

7 Things We Need To Remember
Going Into the Nov. 2 Election

For starters, new voter registrations end Oct. 4;
You may be registered, but are family and friends?
Between now and Tuesday, Nov. 2, Indiana voters will make decisions on a wide variety of offices and issues - from electing a new U.S. senator to represent Hoosiers in Washington, D.C., to deciding the balance of power in the Indiana Statehouse and in local courthouses. Voters will also decide if an amendment guaranteeing property tax caps will be added to Indiana's Constitution.

But the upcoming General Election will be a spectator-only event for Hoosiers who aren't registered to vote. You may be registered, but family and neighbors may not be. Feel free to print or forward this e-mail for their use. The deadline for new voter registrations - midnight Monday, Oct. 4 - is fast approaching.

Here are seven items for voters to consider as we look toward the General Election:

1. Plan ahead. Voters may register with their county clerk, county election board or online at www.IndianaVoters.com
. To check if you are properly registered, visit the same website or call 1-866-461-8638. Those registering for the first time need a valid Indiana driver's license or state-issued identification number. Voters may find their polling places and driving directions online at www.IndianaVoters.com
by entering a name and date of birth. Voters can also get an advance look at their respective local ballots at the same website, so they will know exactly which candidates and issues they'll be considering. Remember, polls in Indiana are open from 6 a.m. to 6 p.m. on Election Day and sometimes involve waits in line, so please schedule accordingly.

2. Bring photo identification. When going to the polls, be sure to bring your Indiana or federal government-issued identification card, like a driver's license, U.S. passport or military ID. Voters who don't have photo identification cards can easily obtain one free-of-charge at any Indiana license branch. Branch hours are available online at www.in.gov/bmv
, are posted at each location, and are generally publicized prior to each election. When seeking a photo ID, voters should bring a birth certificate, pay stub, utility bill or bank statement, and Social Security card or document that includes their Social Security number.

3. Consider voting early. Those who qualify may vote absentee by mail or by traveling board. All that's needed is completion of a simple form. You may vote by absentee ballot if you have a reasonable expectation that you will be absent from the county during the entire 12-hour period polls are open; have a disability; are at least 65 years old; have official election duties outside your voting precinct; are scheduled to work during the entire 12 hours the polls are open; are confined due to illness or are caring for someone confined due to illness; are prevented from voting because of a religious discipline or holiday that takes place during the time the polls are open; or are a participant in the state's address confidentiality program. Voters may ask about early voting and absentee procedures by calling their county clerk's or election board office. Numbers can be found at www.IndianaVoters.com or in local phone books.

4. Pay Attention. Consult area newspapers, radio and television stations for coverage on candidate views concerning topics important to you. This will help in preparing for your Election Day choices. After arriving at your polling site, look for signs posted with directions on how to use the voting machines, a list of voting rights, information on provisional ballots and instructions for filing a complaint if you believe your rights are violated.

5. Know the law. All polling places must have facilities and machines accessible to elderly voters and those with disabilities. A complete overview of election law is available at www.in.gov/sos/elections
. Voters with questions may find contact information for their respective county election boards as well as information about campaign finance and other election issues on the website.

6. Offer to help. Contact your county clerk or election board to see if volunteer and paid workers are needed at your neighborhood polling site. Phone numbers are available at www.IndianaVoters.com.

7. Vote!

27 September 2010 Dearborn County Plan Commission Meeting Notes

27 September 2010 Dearborn County Plan Commission Meeting Notes

Present: Mike Hall, Chairman, Dennis Kraus Jr., Russell Beiersdorfer, Mark Lehman, Mike Hornbach, Ralph Thompson, Dan Lansing, and Jake Hoog.
ABSENT: Ken Nelson
Also Present: Mark McCormack, Plan Director, and Arnie McGill, Attorney.

NEW BUSINESS:

Request for a zone change from Agricultural (A) to Restricted Business (B-1) to allow for storage units. Applicant: Shane Coffman and Owner: Ray & Ruth Schlemmer. Property is on Stateline Road near Megrue in Harrison Township on 1.263 Acres.

Part of this property is already B. Existing is Ag and land use plan has this as commercial potentially. Front part is level and back is sloping. Far back end of the property is the only part needing rezoning. Bufferyard has been discussed on the one side. Fencing is proposed to decrease the amount of screening needed. These will be discussed further when they come for approval for the storage units if the zone change is approved. Traffic would be low- about 9 trips a day. If they would have a more traffic intensive use in the future, they would have to have a traffic study completed. (McCormack wants that addressed in the motion) Density as proposed is not an issue. Slopes are not an issue. Sewer can be provided for LMH if another use requires it.

Seven letters sent to adjoiners. Other businesses in the immediate area include Bright Business Park, an engine shop and an insurance agency. It also adjoins Southpointe Development. Storage use will also require BZA approval.

Jeff Stenger, surveyor, speaking for the applicant. Has a user on lot 2. Decided not to go to B-2 use, so that the Schlemmers will have all contiguous zoning for their property, It also fits better in the area to be B-1. They will go for conditional use hearing with BZA. There is a detention pond that will serve all the lots, but will be on Lot 2. They won’t be using the slopes on the back as there is a water line cutting it off and slopes are not as easy to develop. They are withdrawing the waiver on the side yard and will address it at BZA. Very heavy vegetation in the back for screening- so don’t need the bushes usually required. An existing building will be removed.

PUBLIC COMMENT:
Mike Henegar- adjoiner. He asked about the current zoning and the plans for the front of the lot.

Thompson said this seems to be a natural extension of the lot there and was inclined to approve recommending the B-1 zone and that it fits the comp plan, shouldn’t affect land values, etc. Kraus, Jr. 2nded. Lehman noted that they should add the traffic study if the density should require that if a use change occurred. Thompson noted that the buffering would be a concern then too. Motion stayed as Thompson proposed and all ayes.

ADMINISTRATIVE:

1. Financial report included Tucker’s developments. Laurel Valley proceeded to Commissioners and they denied it. Commissioners sent Laurel Valley back and Seldom Seen was still being reviewed. Tucker was trying to package Seldom Seen with some ROW acquisitions. No decision yet. Old Orchard I financial guarantee renewed with a different bank. Drainage issues and sidewalk.

Indian Ridge with Kern is still out from 10-15 years. He plans to get it done by next year.

Maxwell looking to reduce his bond with improvements also.

McCormack planning to get the list pared down. He also sends this report to auditor and county engineer.

2. In October PC will redo the articles on bonding and financial guarantees.

3. Rutenschroer will reopen at October meeting. Water service and sewage issues. Packets will be sent out to those who don’t still have them from last December when it was tabled. Rutenschroer feels that Greendale and McCormack are in “cahoots” to deny him water. Greendale recommended that he look at other water servers. He is caught in the issue between VRUC and their contracts with Greendale.

4. Series of draft zoning maps will be presented at October meeting. PC can look at them and see if they can make this happen. Some of the arrows and hatching in the old maps are not suitable and hard to read.

5. Grant for salt bins for county, that Ashley Webb helped write, yielded a $100,000 from Lawrenceburg Foundation.

6. St. Leon Economic Development working with Jim Kinnett as consultant. He formerly worked with DCEDI. They will position themselves to try to get some help with Lawrenceburg.
They also will look at Greendale’s Redevelopment Commission.

7. Working with Ag and R revisions in October again. McCormack noted that there are several areas that need to be fixed on the maps. Get map converted to color and digital. Then take care of things that are not right. Staff is staying busy. He said to send anyone up who isn’t busy and he’ll find something for them to do.

Meeting adjourned at 8:00 PM

21 September 2010 Dearborn County Commissioners Meeting Notes

21 September 2010 Dearborn County Commissioners Meeting Notes

Present: Ralph Thompson, President, Tom Orschell, and Jeff Hughes
Also present: Gayle Pennington, Auditor, Bill Ewbank, County Coordinator, and Jack Gay, Attorney.
Commissioner candidate, Shane McHenry, was present.

OLD BUSINESS:
Tucker Development – Seldom Seen 1,2, and 3/Old Orchard- remains tabled.

DCRSD Appointments- continued tabled since 7/20

Animal Control Fees- tabled since 7/20- Jack Gay researched possible conflicts with state law. He’s comfortable that it does not conflict as written. Commissioners APPROVED the new ordinance and resolution for license fees and signed it.

Brett Dodd- RQAW- Pre-design contract- tabled from 9/7. Gay received language from Brett Dodd. Owner shall be owner of all drawings by architect and a complete set of as built drawings will be transferred to owner and not to be sold or transferred to anyone else. Hughes said this was for the jail and for $20 million. He thinks that they should get more firms involved before accepting. Orschell said he was comfortable with RQAW and outlined several reasons including charette results. $90,000 approved by commissioners Orschell and Thompson with Hughes voting Nay for Pre-Design contract with RQAW.

NEW BUSINESS:

Mark McCormack- Planning Director- proposed changes to Article 4 and 7 of the County Subdivision Ordinance- this is regarding removal of letters of letters of credit and the items of infrastructure that these bonds will now cover. They also included the certificates and performance guarantee standards to get them relieved when the work is completed to county standards. The county auditor, engineer, and plan commission will all get monthly reports on these performance guarantees, so that all involved are notified. Hughes wanted to be sure that this would eliminate what happened in Sugar Ridge. Jack Gay assured commissioners that this put sound financial backing to these projects. Gay wanted to remove BANK bonds- not sure what that would be. He also suggested some language changes to the certificates. He wanted to remove the words indicating discretion of the inspector- there are standards to meet, so discretion should be removed. He suggests sending it back to P&Z for one more crack. Inspection should also mean they approve or disapprove it. Commissioners cannot modify these documents- so if changes needed it goes back to PC. Commissioners sent this back to PC. McCormack thinks the PC will approve their requested changes and have it back next month.

DCRSD- West Harrison TIF District- Steve Renihan- asked commissioners to grant permission to go to Council with Alternative 4 and 4a to sewer West Harrison. The alternative to go to Harrison picks up more potential customers to help pay it off. Cost is $1,364,799.71. Folks do not HAVE to hook on due to county ordinance, but many will choose to hook on.
Commissioners approved DCRSD to seek this money from Council for this purpose. The DCRSD has the ability to sign contract with West Harrison for this as they are a separate entity from the county. The only reason they have to ask the county today is that they are seeking funding from the county.

HIGHWAY DEPARTMENT- Todd Listerman- gave a 10- minute report.

Met with AAA Striping for areas around East Central and will be completed today.

Line striping contract will be finished next week for the rest of the county with 3,000 vpd traffic count. This eliminated some of the roads previously done. Hopes funding next year will go back to 1,000 vpd. Now the rules changed and feds only require striping for 6,000 vpd this year.

Old SR 1 from Dover to Gaynor has started with millings and chip seal. Rohe Paving got this and other roads on this chip seal list.

Randall Avenue upgrades for the Highway Dept had two quotes for 3 of the four contracts and one for the fourth:
Floor drains- Cook Mechanical- $81,600, Maxwell $61,400.
Electrical upgrades- Glenwood $47,000, Maxwell- $26.945
Mechanical work- Cook Mechanical- $32,100, Maxwell- $22,695
General remodeling- Maxwell- $82,900.
Maxwell was lowest on all and has all the work. They were approved by commissioners to hire. Work to be completed in 60 days.

Ford has trucks for Woody Sander- with a step up truck with rebates on Chrome package and Haag. The numbers are $27,000+ range. He was approved to decide.

ANIMAL CONTROL- Marlene Underwood- was out of town yesterday. Not present today. Thompson said they were proceeding with ACOS as stated in last meeting.

AUDITOR- Gayle Pennington- Minutes approved. Claims approved.

ATTORNEY- Jack Gay- Problems between Fehrman and Scudder have been resolved.

COUNTY COORDINATOR- Bill Ewbank -270-300 West High Street properties need appraisals. Ewbank has been approved to seek those.

Surplus property sale has removed almost all those items for about $40-50,000. Ewbank would like to see these properties moved faster, especially vehicles. He wants to seek out a public surplus auction site and start using this once all county depts have had an opportunity to use it. Commissioners agreed to allow Ewbank to do this. Once this valuable floor space has been recovered and the 20 skid pallets of records were destroyed. He says more records need to be stored. He thinks they can use the water rescue area to store this until time for destruction again. He thinks he can secure this area for this. Approved.

COMMISSIONERS:

Jeff Hughes- any more research on road blocks? Jack Gay authorized to do this for public hearing on November 3rd.

Tom Orschell- Jim Olsen form Jefferson County and asked if they could have Bridge 55- Collier Ridge bridge. They would disassemble it for $1 and would need proper waivers. Gay was approved to work on that.
Asked Brett Dodd to get the pre-design teams to work with sheriff etc. That is in the works, per Dodd, and he intends to recheck with the sheriff etc on needs.

Ralph Thompson- Burn Ban issue was raised by Bill Black. Fire Chiefs can do that. He asked Jack Gay to further review that.
Gay is also to have a list of unresolved issues by next meeting.

PUBLIC COMMENT:

Howard Luke- on the issue of the fire hydrant, he is representing his son in law due to his depression. There was no permit for the fire hydrant within 3 ft of the pavement which was a safety hazard. Average cost of fire hydrant was $600. The cost was much higher- he questioned this cost. Listerman will give him a copy of the bill the water company submitted for repair. There is a permit utilities get to be sure they don’t damage roads. There is no other reason for this permit. Luke didn’t know why his son in law was responsible for unpermitted hydrant repair.
The state police were called and no report exists. There was a car in the right of way- actually on the road, illegally parked, with no lights. How can he be held responsible? His son in law was backing up as the hill was too slick as he was sanding it during a snow storm and hit that car. This was an incident prior to Listerman being hired here. Listerman will get him a copy of that accident report.
Other incident- his brakes failed and he was not even in the vehicle at the time. He was out helping another vehicle. He was supposed to be in control of his truck. Listerman was not in charge at this time either. He was unaware of brake failure. There are other incidents with Mr Ken Griffin and Listerman does not want to go into personnel issues at a public meeting. There was another incident where he would have to back up over half a mile. He hit a barn on a private driveway when he chose to do that as there was no turn around. Mr Griffin’s dismissal was for a host of reasons per Thompson.
Gay said they had abandoned the process as they did not use appeals process in a timely manner. Luke questioned if he could hire an attorney and sue the county. The commissioners said he can have an attorney at any time. The COUNTY process is over, however. Luke asked if Ewbank told him appeals were over and to get on with his life. Ewbank said he did give him that personal advice.
Listerman said the county had decided to terminate Griffin and the document was signed in the presence of Listerman, Grieve, and Pickens. Luke asked who gave them the authority to dismiss Griffin. They can hire and fire anyone at will? asked Luke. Yes, within the proper procedures.
Luke said he didn’t want to cost the county money, but that they will probably seek an attorney.
Cathy Albert- a company has been contacting people out in their area on Collier and on Kaiser getting timber. They are using the small concrete bridge on Kaiser loaded with timber. She was advised to get with the sheriff to enforce this. Listerman also spoke with 2 residents about this concern. He will also talk to the sheriff again. Cathy provided the name of the company to Listerman.
Cathy Albert- still was asking about the Collier Ridge bridge. She was also asking about the small concrete one above the Collier ridge Bridge. Orschell was concerned about the narrowness and curve on that. It is also a weight limited bridge and is structurally inadequate for width as well. Orschell was saying that they should perhaps fix both bridges and realign the road to fix both. If they leave it as a service bridge just for 5 homes it will last longer. It doesn’t meet today’s standards for a main road though.

Meeting adjourned at 10:30 AM

7 September 2010 Dearborn County Commissioners Meeting Notes

7 September 2010 Dearborn County Commissioners Meeting Notes

Present: Ralph Thompson, President, Tom Orschell, and Jeff Hughes
Also present: Gayle Pennington, Auditor, Bill Ewbank, County Coordinator, and Jack Gay, Attorney.

Commissioner candidates, Jim Schuler and Shane McHenry, were present in the audience

An executive session preceded this meeting for a discussion on real estate property. Commissioners voted to have the county attorney make an offer made to the owners of Hoosier Square $575,000contingency that all legal issues will be resolved.

OLD BUSINESS:
Tucker Development- Seldom Seen and Old Orchard- tabled.

Langley Heights needs signatures on Ordinance to vacate which was passed last meeting. Commissioners signed ordinance- with Hughes not signing as he voted nay.

DCRSD Appointments tabled from July 20th- tabled.

Signatures not done yet for Animal Control Fee ordinance yet. Commissioners decided to have the attorney check on some possible conflicts with state law.

Lisa Taylor- Sugar Ridge Discussion- no one present. They will have to make a new request to be on agenda.

Brett Dodd, RQAW Pre-design contract. Thompson and the attorney were concerned about who has ownership of the record drawings post construction. RQAW will meet with attorney to get the legal language worked out to be sure this is what happens. Tabled until the attorney and Dodd have meeting to work out appropriate legal documents.

NEW BUSINESS:

Knights of Columbus Council 1231 request to use the Courthouse Square for a prayer session Fri Jan 14th starting at 11 AM. Approved.

Bill Black-EMA- received signatures from commissioners for the National Preparedness Month (Sept) Proclamation after reading it into the record. They are working on severe weather alert radios and WSCH is giving away some. Sirens – all 33 – in our county go off at one time. Sometimes the alert is for the northern part of the county – but all go off, that’s why they recommend checking local media when you hear a siren to see who is affected.

Burn ban suggested for the county due to extreme dryness per Bill Black. Discussion included not having enforcement options. Gay is authorized to see what can be done if a ban becomes necessary. Commissioners decided to issue a BURN ADVISORY to warn all citizens that open burning at the present time is exceedingly dangerous.

Ginny Daum- Dearborn County Medical Reserve Corps. Mark McCormack said they are applying for a $4784.57 grant from DC Foundation to establish a mobile disaster response unit. In a large emergency situation they are another level of response. This is essentially a 7x14 utility trailer of medical supplies. This will take about 3 months to see if it is approved. Commissioners approved the grant application. McCormack is pursuing other avenues for funds for this unit. This works as an auxiliary to Red Cross, EMA, Health Dept and Fire depts. DC MRC is a volunteer organization of retired medical professionals and others.

Ginny Daum- reapplied for the DC Medical reserve Corps in Feb and was approved this summer. Commissioners are the responsible fiscal officers. We are the 28th county in Indiana to have a Medical reserve Corps. She has nurses, pharmacists, EMT’s etc. She has $10,000 plus the almost $5,000 in this grant to get started. There will be a town hall Wed Oct 27th at 7 PM at the Tate St Adult center. This will explain how shelters get set up in an emergency. All volunteers will have police checks and predator/sexual offender checked before being on their team.

HIGHWAY DEP’T - Todd Listerman, Director, gave a 50- minute report.

Signatures obtained on design cover sheet for Bridge 159 - George St Bridge to be bid in Feb 2011 to be completed by Farmer’s Fair that year.

Bridge 34- still needs to get 4th parcel secured on Short Ridge Road. Signatures obtained for the design cover sheet.

Highway dept received City of Lawrenceburg Phase 2 grant for $100,000 for the salt building at Randall Avenue. This will cover over 50% of that building. This keeps salt and salt sand mix under cover. Thompson signed the grant acceptance form. Orschell asked Ewbank to write a letter of thank you to the foundation for this.

Acceptance of Laurel Valley Drive off North Dearborn Rd. depth tested at 4inches and a waiver recommendation from Plan Commission was requested to be accepted by commissioners to be 18 ft. wide instead 20 ft. for a length of 0.07 miles. This road serves about 4 homes. Hughes was concerned about giving this to one developer and others wanting it. Listerman noted this was an 8 year old road. Tucker did not offer anything that they knew of at the Planning meeting. TABLED to see what rules were at that time etc. Commissioners wanted to see why he didn’t perform his stated design.

Application for highway safety improvement funds for county roads with a 90/10 matching program through OKI. Listerman suggested it be for advanced warning speed limit at North Dearborn and Bright Elementary and Sunman Dearborn Middle School. These flashers will be up at times when kids are present. Principals can also set them for other times as needed. These will be solar powered with LED lights. Commissioners signed the support letters. Listerman is also working with INDOT to get some for South Dearborn schools along state highways.

Funding for reconstruction of the ford crossing on Holt Road that has been closed for 2.5 years. $10,000 for Barth Construction to design this “bridge” structure. Approved to sign documents and begin the process.

Two weeks ago he went to IN TIME – for first responders to look at traffic management in emergencies. They found over 20% of accidents are secondary accidents due to the primary one. Many fatalities occur in these also. If interstate is closed for an hour- it takes 4 hours to get the road traffic back to normal. Lusby now has someone trained to do photometry equipment that will do that traffic data faster. This can be for crime scenes.

Change order for $1501.56 for additional fog seal on North Hogan on a stimulus project was signed.

Bridge 34 over North Hogan Creek had environmental management work and needed a signature for Rule 5. Signed.

ROW agreements for property purchases along Stateline with a unit cost contract and a not to exceed amount were reviewed by Jack Gay. Commissioners signed the agreement for ROW Acquisition engineering with Beam Longest and Neff. Listerman had another quote to check these prices.

Final inspection and acceptance for North Dearborn, North Hogan, Yorkridge Rd, and installation of ITS cameras on I-275 were received from INDOT. Signed acceptance letters.

Spoke with Cathy Deaton of Seymour INDOT office regarding Old 350 (Wilmington Pike)- it has some slips etc. The county will sit down with INDOT to see about negotiating how to fix it so county will accept it. They will not accept anything that is a financial burden to the county.

SR 1 and Schuman Road and Trojan drive and Old SR1 have pavement markings that have served their life as turn lanes for the schools. Requested a quote from AAA striping for $5,333 to stripe them- double coated. State won’t do the approaches. County has to do this out of line striping fund.

Due to getting acceptable low bids there is $30,000 left. He is driving a 1990 Chevy Tahoe and over 190,000 miles. Wants to purchase a Ford F150 4x4 so that he can haul supplies and signs etc. this would give him more flexibility. $27,000 is the low price he rec’d for this and is $7-8,000 less than invoice price on a fleet quote. Commissioners thought he should get more quotes and get back to them.

AUDITOR- Gayle Pennington- claims and minutes approved. August 3rd minutes approved as a non-verbatim transcript. August 17th minutes tabled till Thompson could review as he didn’t receive his copy.

ATTORNEY- Jack Gay- nothing

COUNTY COORDINATOR- Bill Ewbank- nothing

LATE ARRIVAL INFORMATION-

Margaret Minzner GIS coordinator- wants to apply for citizens of Hardintown for a grant from the DC Foundation to get on the city of Greendale’s water lines for the cost provided by Steve Lampert of $82,400. She has prepared some preliminary applications and the county needs to be the applicant and administer the funds. They currently have Greendale electric and sewer but have well water. They need to do this before the upgrade the levee in Lawrenceburg. Greendale takes over and maintains the water line once constructed.

Bob Fehrman- having some problems with DC health dept- while they are redoing an apt on St Clair Street and a house on Center Street. He is aware of lead based paint problem. He took out siding, walls, ceilings, and windows. John Grace is refusing to grant occupancy permit, even though he used the Greentree Co he suggested Fehrman use and they cleared him. He has talked to Dr Scudder and the county attorney. Doug Baer told him they were complaint based. John Grace said City of Lawrenceburg requested it. Lawrenceburg said they didn’t. Health has no complaint in there. He likes John Grace and he liked his father too. Fehrman noted his wife is in the hospital with cracked vertebrae and this is his 51st anniversary too. He is supposed to get another $450 inspection. Jack Gay is to investigate this to see what the facts are and where the issues lie.

PUBLIC COMMENT- Howard Luke- is getting a letter from Jack Gay per the attorney. He asked who did hiring and firing from a county dept. He was told that the dept heads do their hiring and firing with HR dept doing checks on employee resumes etc. Luke said the ads stated that the resumes get submitted to commissioners. It was explained to him that the resumes come in to the Commissioner’s Office. Luke felt like something was being covered up. Commissioners explained to him that they do NOT hire the highway maintenance workers. Suellen Cauble is the HR person and she gets that mail at the Commissioner’s Office.

Meeting adjourned at 9:00 PM
