candidate must further file campaign finance reports (CFA-1, CFA-4 &
attachments) with the county election office, (812) 537-8867.
Township Advisory Board candidates are exempt from filing campaign finance reports IF campaign receipts and/or expenditures are less than $500.00.

The
lifecycle of a candidacy for Elected Office Candidates has 3 mandatory phases:
1. Declaration of Candidacy. Completion
and submission of official forms to the Elections Office. The forms
necessary for this action are:
a.
Declaration of Candidacy
(CAN-2). You must legibly complete SF 46439, DECLARATION OF CANDIDACY FOR
PRIMARY NOMINATION IN 2014 (CAN-2). Complete front and back, sign in
presence of a notary, have notarized. This form MUST be completed and
submitted together with the Economic Interests, (CAN-12); it will not be
accepted separately and it must be received prior to NOON, Friday, February 7,
2014. NOTE: Certification of County Chairman may be
required. See paragraph (3) of the CAN-2 form.
b.
Economic Interests (CAN-12), this is
a new requirement. You must legibly complete SF 55128, STATEMENT OF
ECONOMIC INTERESTS FOR LOCAL AND SCHOOL BOARD OFFICES (CAN-12). Complete
front, sign in presence of a notary, have notarized. This form MUST be
completed and submitted together with the Declaration of Candidacy, CAN-2; it

d.

(CFA-1). Each other County, City, Town, and Township elected

$50 per day civil penalty. Defective reports shall be subject to $10 per
day civil penalty. Knowingly filing a fraudulent report is a felony and
subject to $10,000 fine, 3 years imprisonment or both.
3.
Campaign End. You won, or lost, but your campaign and campaign
reporting requirements do not stop. Indiana Law requires that you continue
to submit required Campaign Finance Reports. You may disband your
committee (officially end your campaign) at any time by giving written notice
and filing a final report (CFA-4). When completing your final CFA-4,
lines 18a, 19a, 20a should be ZERO. Indiana Code 3-9-1-12 addresses

23 January 2013 Dearborn County Commissioners Meeting Notes
23 January 2013
Dearborn County Commissioners Meeting Notes
Present: Shane McHenry, President, Art Little, and Kevin
Lynch
Also present: Gayle Pennington, Auditor, Teresa Randall, County
Administrator, and Andy Baudendistel, Attorney.
OLD BUSINESS:
Appointments:
Highway Engineer- Tabled at the request of Kevin Lynch this
time.
911 Director- tabled again
Plan Commission- Jim Thatcher of HVL was appointed to
replace Ken Nelson on PC and BZA
PTABOA- Mark Neff and Mark Hardebeck reappointed
Bill Black Jr- District 9 Planning Council- tabled as Black
hasn’t found a replacement yet.
NEW BUSINESS:
Port Authority –
Shane McHenry can be removed from the agenda now as the new law has been
withdrawn for now, so it is not as urgent as previously thought for the county
to join the port authority. [NOTE: For
more explanation of this see the Tuesday Journal Press article.]
Bill Black Jr-
Signatures for EMPG Competitive Grant for $5179.77 Emergency Mgmt
performance grant program. Couple
surveillance cameras, weather station, computers, etc. were requested. Baudendistel had no concerns about this. Commissioners
signed the performance grant.
Yellow travel advisory for Jan 21st was signed by
commissioners. They will keep it in effect for the next few days also as the
roads are still snow covered with the temperature issues. Highway has been
keeping on top of it per Lynch.
Sheriff is getting rid of the food wagon and EMA would like
to take it over. Black has a 6 wheel drive they bought a few years ago and
haven’t used- so he wants to sell it. He will get with Baudendistel to be sure
he follows the correct procedures. Commissioners are OK with that.
McHenry asked for warm shelter procedures- Black said that
RED CROSS handles that for the county if it becomes needed. Black will let
McHenry know the procedure by email tomorrow.
Donna Thacker- 2013
Summary of Dearborn County CASA was presented to commissioners so that
commissioners will approve their grants again this year. There were numerous
partnerships she said. Partnered with prosecutor to pass out drug kits to
encourage parents to drug test their kids. $1500 scholarship will be awarded to
someone actively pursuing recovery and going to IVY Tech. McHenry asked about the drug test kits and she
said it was prevention and intervention and when people hear about it in detail
it has been positive. They have $8,000 for drug testing kits in their line
item. Recovery event was held. Recovery café at Hamline church was well
received. Lawrenceburg gave them $185,000 this year. They have $10,000 for
Lawrenceburg residents to use the intensive GMHC treatment and same for the county
residents. They have the same surveys administered for several counties to
correlate information - $10,000. McHenry expressed the county’s appreciation
for their efforts. Commissioners approved the summary and grants. $86,084
divided up 4 ways was approved.
Wade Kimmon- MOU –
Memorandum of Understanding- for data sharing with Boone County – this is
an update of one we had that expired in 2012. This is for our police officers
when they go to help over there and vice versa. They share pretty much their
whole data base with us also. Commissioners approved this. No money is involved
in this per Baudendistel.
Charlie Ashley-
Signatures for NCIC and IDACS Mgmt Control Agreement- this has to be signed
whenever a person on that board changes. This is being done to replace the
former police chief from Aurora on that board. Approved.
Brad Rullman- Change
orders for Jail project- 6 change orders: All approved:
Change order # 1 for Banta electric- $30,000 deduct for changes in interior lighting
package.
Change order #2 for Security Automation System $5788-
which is a net deduct for RFI
#12 deducting some access controls , camera and intercom added to new elevator,
remove door access controls and removed the head in system for security package
which was redundant.
#1 for Quality Fire Protection- deduct 30568.76 for
combining zones, add PR #3 for
345.07 - leading to net deduct of $30,223.69.
#1 for Valley
Interior Systems- add PR3 polygraph add wall modification for total add of 3510
#1 for Queen City Mechanical- 2265 added and plumbing
modifications for add of water heaters and contingency for future unseen
conditions for $10,000 etc for total
$18,974.
#1 for Triton Services-
modifying existing air intakes to bring up to code. $55,934 additional.
SUMMARY - $2,277 is the total add for all change orders. So
they are still in the construction budget.
They are falling slightly behind due to weather conditions.
Can’t keep it warm enough without a complete roof. They still are on target to open it in July
for new addition and November for renovations.
ADMINISTRATOR:
Teresa Randall- wanted to also thank Brad and Maxwell Construction for all the
discussions that kept us on budget. She said she has been well informed of
every issue. This is a testament to the fact that we have a good crew of
contractors.
Interlocal agreement crafted by Aurora’s attorney Jeff
Stratman for the county to take over their dispatch completely. This is a
smaller fee for them and there is better communication now. It starts March 1 for $37,726.02 for this
year but will be for $45,000/year after that. But it has to be redone for next
year as it does not automatically renew. Aurora’s equipment will be used for
spares. Commissioners approved the agreement.
County Website project has their kick off meeting this week.
Epop??-- CORRECTION- EGov Strategies LLC impressed her with their whole plan and experience. Department heads
need to be engaged as this is their website too.
EMS next week with Charlie Ashley and Wade Kimmon to discuss
information they need from GIS. They can decide how to spend the $100,000
incentive money they were given. They are thankful for Kimmon’s input.
Courthouse Annex review- they interviewed architects with
Bryan Messmore and Liz Morris and Eric Hartman and Maxwell. Narrowed it to the
top 2. She is doing more research and they will visit them as well as do some reference
checking.
Randall stated that Jan 31st (with a tent and maybe portable
heaters) is the groundbreaking for Whitewater Mills. Both Governor and lt governor
have sent regrets. Ted McKinney is the new director of the Ag dept at the state
and he will attend. He is very excited about this project and will bring
another member of the dept. to discuss this further and want to see how it
affects the farming community.
AUDITOR: Gayle
Pennington - Claims and Jan 7th
and Dec 17th minutes were approved.
Signatures for
Commissioners Tax Sale- SRI Contracts- that they reviewed. Baudendistel had
no issues. Commissioners signed the contract for the live tax certificate sale
for severely delinquent property taxes and NOT the internet sale.
ATTORNEY: Andy
Baudendistel:
Animal Control
Ordinance – big picture is to look at the entire ordinance. He thinks he
needs to have meetings with Marlene, PAWS, and someone from planning and zoning
and law enforcement to draft another one. He does have one tonight to address
nuisance animals and what to do with one. This attaches a penalty to it.
Amending the current ordinance. 90.01 and 90.99 sections are amended. The penalty is $50 first offence, 2nd
$100, and third offense they will seize the animal and it becomes property of
the county. Commissioners approved the amendment. The sheriff’s dept will be
made aware of this also. Effective 30 days from advertisement.
Unsafe Building Ordinance – tabled until
he can get it finished in February at 2nd meeting probably.
County Administrator-
Lead Economic Development Officer is the new title for Terri Randall. Baudendistel
prepared this as a housekeeping item. Under IC you can assign duties to
employees- to clean the job description up he has a resolution that will assign
economic development duties to the county administrator position. Baudendistel read this into the record and
stated it is authorized per IC 36-2-2-13. She has been doing this since
March.
Baudendistel will proceed on a small claim for the sheriff
dept for about $2000.
COMMISSIONER COMMENTS-
Lynch encouraged people to check in on neighbors in this cold weather.
McHenry said- we should be checking on Art. Laughter. Art
said for people to drive safe.
He said highway is getting hit hard with wave after wave of
snow. Lots of praise for highway dept.
LATE ARRIVAL
INFORMATION- Randall said that the jail project has been drawing down. They
will be going back for another $3.5 million draw soon. Also it cost $48,751.68 for fuel diesel tank that leaked.

Divorce Corp - a Documentary Worth Seeing
Divorce Corp -
a Documentary Worth Seeing
I saw Divorce Corp on opening night Jan 10th and it is NOT
boring. The documentary is by the same people who gave us the award winning documentary
and book in 2006 called MAXED OUT- about the predatory lending system and credit
card industry. I expect Divorce Corp (movie and soon to be released book) will
garner similar critical acclaim.
Spoiler alert: Our
Dearborn County Court system plays a part in this documentary that is not
flattering. It will probably make you question the wisdom of some of our local
officials who made a series of serious mistakes that cost one extended family a
lot of time away from their children and grandchildren who seem to be pawns in
the family court business. It also cost a lot of money on all sides, including county
taxpayers’ money.
The movie shows the national disgrace of our family courts.
This abuse goes well beyond Dan Brewington’s case. It illustrates several cases
of people courageous enough to allow their stories to be told in the hopes of
reforming our divorce and child custody rulings.
If you know anyone who is or has been through a divorce, you
must see this. But any citizen, wishing to be informed, will find this to be a short
1.5 hour lesson in family court and how it operates differently from criminal
court.
See the movie- it will make you think- it will make you
upset- and perhaps it will make you take action.
Divorce Corp has limited release and is only available
locally at the AMC Newport on the Levee until Jan 16. They have showings from
11AM thru 11 PM daily.

County Redevelopment Commission Reorganizes and Changes Leadership
9 January 2014
Dearborn County Redevelopment Commission Meeting Notes
Present: John Rahe, Chairman (arrived 15 minutes late after
Maxwell report), Kevin Lynch,Vice Chairman, Jim Helms, Dave Deddins, Jim Deaton
Also present: Terri Randall, and Sue Hayden
ABSENT: Andrea Ewan- who arrived at 5:15 PM and left after
her report and Maynard Barrett
Audience: Randy Maxwell, Chris Mueller, and Denise
Freitag-Burdette
Maxwell Consulting
Updates- Randy Maxwell- slow month in December- started the flood plain
study- preliminary draft- Terri and he met with flood plain study person in
Blue Ash today. He’s taking a few different approaches in analyzing this. He
will finalize this in the next 30 days. We want to know how much ground is
affected by this. Land acquisition from
last exec session- the adjoiner to the mill property has decided now that he
has no interest in selling his property after 3-4 months of negotiations.
Deaton asked if we could get the little piece across the road. That is still in
motion. Those discussions are ongoing. Bill Rudisell owns the one to the east
that does not want to sell. He wants to just let it go to auction at his death.
Deaton says it may be more advantageous to his heirs after his death. Maxwell
said everything happens for a reason and this will be OK. Randall said that the
mill doesn’t need any of this any time soon as they haven’t gotten the plant
built yet. Maxwell then departed for Batesville for his son’s game.
Election of 2014
Officers: Helms suggested Rahe might want to be relieved of the post as he
has been in that position for a long time. Rahe listened but did not concur. Helms
nominated Dave Deddins and he was elected Chairman. Vice Chairman was Jim
Deaton. Secretary is Jim Helms again. [NOTE:
Rahe did not turn over the meeting to Deddins at this point- as is the custom.
He continued to run the meeting.]
Land acquisition
funds, EDI, and keeping grants separate require a treasurer per Randall.
Angie Walters does treasurer for Greendale Redevelopment and Randall will meet
with her and see what is needed. They want to get a non-member of the commission
as treasurer. Lynch thinks Sue Hayden could learn how to do it from Angie. She
also would be available when people need to see her. They will address this
officially at the next meeting. Tabled for now.
Minutes of December
12 meeting approved.
Unfinished Business:
none
New Business:
Maxwell –covered
above as he had to leave
Financials- Cash
balance was stated, TIF balances are unchanged. This starts a new budget year.
There is $25,000 funded by Council which does not show on this report thru Dec
31, 2013. Report taken as information.
Claims- approved
4 claims. Randall did not state the names or amounts of these for the public to
hear. Randall said that Maxwell gave them a major discount on their fee for
December because this was fair. They do have a maximum monthly fee even if he
works extra on some other months. Randall stated that she warned him that if he
worked beyond the maximum some months he wouldn’t get any extra money for that even
though he had charged less in December. [NOTE:
Whose money is this? If Maxwell is charging fairly, then why encourage him to
take the full amount now IN CASE he works more hours some other month?]
County Administrator
Report-Terri Randall- Returned Funds
from Land purchase- when the Stone property was purchased in 2012- half was a
Law’bg grant and half from County Council. When EDI was reconciling they split
the total and $10,855.54 is returned to us. The other half went back into the
Lawrenceburg grant account. Approved.
Deaton asked what would happen if we didn’t return it to Lawrenceburg.
Randall said it is part of interlocal agreement. She said we want to keep good
relations with Lawrenceburg. [NOTE:
Interesting how we view this grant money vs. taxpayer funds above under claims.]
Andrea Ewan arrived
at this point at 5:15 PM.
EDI had a meeting and
disbanded and they are closing down the books also. EDI wanted to know if
the county wanted to take over any of their activities. They have a $1000 lease
for a billboard promoting the Stone property. Discussion on whether or not
people buy property based on that sign. EDI was the marketing arm for
redevelopment. Kelli Boiman did the website and the radio spots to keep up with
marketing. Randall talked with her visioning cohorts in the 3 cities. EDI
brought in all the contacts for economic development. She sees the county as a
neutral place for those contacts to go to now. The Committee of county and
mayors reps would be monthly meeting to get together with that employee that is
hired with the grant to be the contact for all Economic leads. Andrea Ewan said
she could help with work force development. She is with a group that gets data
from College Success Coalition to get county data on the county work force.
Lynch, Maxwell, Deddins, and Randall, and Scott Fortner and Tom Walker from
Dillsboro are going to Muncie for the week long educational course of economic
development. Deddins will review the billboard agreement with Stone to see what
he can negotiate. Either party can terminate with 30 days notice. Redevelopment
voted to pay the fee for one more month to keep it up for negotiation. They
will notify of cancellation if they need it. They could see if Hirlinger wants
to use it possibly too per Lynch.
Ground breaking for
Whitewater Milles is Jan 31st. Governor can’t come. They might
get another official from the state agriculture director and maybe bring the Lt
Governor per Lynch. He will also be down for the Farm Bureau in April as their
keynote speaker. Jud McMillin and Randy Freye have committed to be there. Randall will put together a budget for the
ceremony. They want this to look professional as it is a big deal.
File for a LOMAR or a LOMA form (she couldn’t remember the
form name) for Mills to get them
considered as being out of the flood plain as they have raised the site above
it now. For banks to loan they need to get it recognized as being different
from what shows on FEMA flood maps.
Minor things to sign
off on London- Witte’s work on the bonds etc.
Annual report that has to be filed with commissioners each year by
March. She will bring that to them at Feb meeting to get that to
Commissioners. Maybe have a redevelopment person present that to commissioners
then.
We don’t have the
$50,000 that comes annually from CVTB. She and maybe commissioners need to
go to their next meeting to seek that support still. They meet at 8:30 AM on
the 21st.
Attorney’s report-
Ewan said that Thursday is now a good day for her to be at their meetings. She
apologized earlier for her tardiness. She is attorney for her mother’s friend
out of town and had several closings to attend to.
Rahe said that this
new person we are going to hire will be for marketing.
Randall added- and
website management, center for all IEDC leads, networking to get leads, and
branding. This person is not just hired by the county- but hired by the 3
mayors also. The caveat is that this is not for a county employee who works
just for the county.
Rahe said- WHO oversees this person? Who hires and fires?
That will be as problem. Rahe also wanted to know if we should be advertizing
on radios in Cincinnati again?
Randall said that a lot of leads come from existing
business. The Mills – is one we got one from one of their partners. Maybe
pulling in information from our businesses too. Use local redevelopment groups
to help.
Rahe said the chamber
of commerce promotes local business. Deddins will now go to that. The Chamber
does not have a new director yet.
Deaton said we should also partner with adjoining county
redevelopments too.
Lynch said we need to visit the statehouse more too. We want
them to refer to us too.
2014 Meeting Dates
and Times- 2nd Thursday at 8 AM meeting times being considered.
Feb 13th at 8 AM is the next meeting. They will poll other members
to see what date and time works best for them. I brought up that the newspaper
might not be open by then. It was discussed that the newspaper might not be
able to cover them that early. Comment was that that was not their problem. (unless
you want transparency I stated to them.)Randall
does not anticipate many executive sessions. [NOTE: Why not- does she see no new business to negotiate with all year?]
They can set executive sessions any time- not just before meetings. [NOTE: So
we will bend over backwards to accommodate business prospects- just not the
public?] Randall went on to tell the board that they could set meeting
times that suited their schedules. [NOTE:
This is starting to get ridiculous with the county. Have they forgotten that
they serve the PUBLIC and setting all meetings when the public has little chance
to attend is not a good idea. Even WORKING board members will have trouble
being there at 8 AM and coming to work late. Anyone getting kids to school
might also. Commissioners are also doing
this- morning meetings after people are at work in the morning and evening
meetings that start right about the time work ends so that people aren’t home
yet. Isn’t is the employed county residents that pay the bulk of the taxes? Isn’t
it the employed business owners they are trying to bring to the county for
economic development? The pervasive attitude here is not transparency and wide
open doors. If you discount coverage of your meetings you are shutting down a
source that gets the word out of your existence and your plans so that business
gets to know your procedures and how to approach your board. Not everything
needs to be behind closed doors. Just out of curiosity- when do other City and
Town Redevelopment Boards meet? How will the minute taker- Sue Hayden - operate within the law when she is employed form 8:30 - 4:30 by the county and paid separately by the Redevelopment board? If she works as their treasurer also they need her for the meeting. Does she come to work late on those days? Who covers her county duties then?]
By statute have a
school board member- Dusty Burress will come to redevelopment as non-voting
member. Maynard Barrett is now a voting member. Andrea Ewan and the county
attorney were part of checking this statute per Randall.
5 members- appointed 2
by council and 3 by commissioners and 6th member is non-voting
school board member. We now have one too many. We can have a 5 or 7 person
board. If 7 then commissioners are 4
appointments and council gets 3 appointments.
Nothing more on Project C- per Randall and Lynch.

Commissioners - Terri
Randall- Architect and geotech analysis- they are at the interviewing stage
and 4 architect firms are being interviewed Friday. Liz Morris will be there
for interviews Friday. They are trying to see if it is feasible. The best place
to put it is between these two buildings and it would then be adjoined. Maxwell
is assisting with this process. Only one public access so security savings.
They have no price yet. They need a conceptual drawing to get an estimate.
Maxwell determined we were short 20,000 sq ft. to conduct business. They would
have the architect go thru and validate that number. They want to put the funds
up for the entire architect project with an out clause at each stage of eth
process. There are fees associated with Maxwell managing this. There are also
geotech fees. Asking for $250,000 up front and is hoping not to use all of
this. This is a several month process. This is data you would have for all
time. Randall thinks this would be a good investment to know what the costs are
further out.
Morris said she noted that the RQAW numbers pretty much match Maxwell’s. She wants to
know if we can take the funds out of capital improvement section of the
Riverboat fund. Ullrich is impressed with how every one involved with the
building has had input. Lansing said that if he had to vote to fund that now he
would have to vote no. He wanted to know why we would have bought Hoosier
Square if we were going to have an annex. Barrett said we could unload Hoosier
Square anytime we wanted to and make a profit. Lansing said- there are 10 less
people working in the courthouse than before. Morris agreed with Barrett that
when landlocked it is a good idea to buy property when available. Ullrich said
the state has a lot of security things that need to be incorporated in
courthouses. Lansing likes some of the alternatives now that we have all that
invested in the jail. If we get the study- then we are going to do it. Bond or
how to pay for it- Lansing asked. Kraus Sr. said pay for it or it costs twice
as much. If we lose our $5million riverboat revenue we lose 1/3 of our work
force. Lansing worried about all the other gambling competition. Lynch agreed
that we will be seeing decreases. We need to utilize the funds we have now to
build for the future. Because we may not have that money in the future. Lansing
says he doesn’t like being hit up for it all in two years. Kraus, Sr. said why borrow when we had to
move our savings out of Dearborn County and still only get 1-2%. A loan would
be 4% or more. Morris said that we are not looking to build an empire we are
addressing a problem. We have made progress and appropriate capital
improvements for the county. Morris
moved and Ullrich 2nd to approve a NTE $250,000 for architect and
geotech. Randy Lyness agrees with Denny that he doesn’t want to borrow. He
wanted to know what is in capital improvement. About 50% of money is disbursed
for the jail per Randall. Economic development from TIFs will not be available
for 20 year per Denny. Glen Wright told them about an option the private sector
had when they borrow from themselves and pay 1% to the bank that is holding
their cash but paying no interest on it as savings. Pennington didn’t think
gov’t could do that. Randall said she would let the council know exactly what
it would cost when they know. They want to get a couple of good firms competing
for this. Randall said she does not want to be doing this many projects either.
They don’t want to get the reputation for spending money. They are being
prudent in their processes. The feedback is to address this. I have been very
close to the issues over there and it is an embarrassment how we operate over
there with overcrowding etc. Commissioners are all worried also about what will
happen with revenue projections. Lansing still says costs are going to go up. Motion passed 5-2 with Lansing and Keyes as
Nays.
Legal services-
$20,000 approved out of riverboat.
Surveyor- Dennis
Kraus. Jr. – Plotter- withdrawing
his request- he has decided to lease the plotter as it will save money.
Auditor- Gayle
Pennington:
December 10th minutes were approved.
Salary Ordinance Amendment-
Pennington said there were minor changes in jail as not enough in corporals but
too much in sergeants and so they flipped some there. A few more items like
that. And a 10 cent error in one highway worker salary.
Budget Amendment- Rolling
part time money into a full time salary for auditor deputy. $17,000 in part
time money for Sharon Probst. She was working a full 40 hours being shared with
two other departments. This changes her budget by $10,000 more to include
benefits and PERF. Probst also works in HR and Treasurers office. Auditor lost
3 full times and replaced 1. These cuts were from 2010 and 2011. They will
still share her work. Council approved all ordinance and budget amendments.
County Redevelopment request will be moved to another meeting,
Prosecutor and Listerman for highway also want to be on February agenda.
Charlie Keyes questioned the sheriff’s contract employee
salary being higher than Pennington had said it was. Discussion. And he was not
entitled to the 2%. They can table the budget amendment until Pennington gets
it explained with Mike Kreinhop.
Meeting schedule for the year for Council are:
February 18
. May 20th. Budget is set for
week after Labor Day Sept 8-12. Nov 18.All
at 6:30 PM
Listerman wants to
come back for Stateline project $2.2million and advertize out of growth and
development funds and infrastructure funds just in case they want to split it
up. Want to get it constructed this year.
IDEM is making hwy do stream mitigation from North Dearborn in
Guilford Park. He also told them Collier Ridge will be built this year.
Meeting adjourned at 8: 15 PM
