TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.
OLD BUSINESS
Request to Approach Council /Purchase of Fuel Prover- Bill Shelton, Bldg. Commissioner- personnel change and need someone in weights and measures. They measure the fuel with this equipment that will fit in back of pick up truck. You can pump 16 times at each bay and the job becomes easier. $32,000 for this prover. Using the trailer mount version would save money but be harder to maneuver in gas stations. It’s about 1000 lbs. He has storage for it when not in use. Usually do this testing in moderate weather parts of the year. Stainless steel. Insurance costs not too bad. Savings from just using a part time person would pay for this in about 4 years. This is a model that is cheaper than the original one proposed a while back. Approved to go to Council for this item.
NEW BUSINESS
Interlocal Agreement With Town of West Harrison, IN- Mark McCormack Director Planning and Zoning- This is for the Plan Commission for the County to act as their Plan Commission. The rest of the agreement is the same as what we were already doing. The agreements are perpetual with a clause for termination. Commissioners approved the agreement ands signed.
Travel Status Advisories from 1/19-20/2019 Jason Sullivan, EMA Director- Retroactively approved the Orange and Yellow travel advisories. Approved.
Highway Engineer- Todd Listerman:
Bid award for paving- Jan 23rd- opened bids for Community Crossing Grant Project- Rohe bid $2,134,309.95 O’Mara bid $2,042,386.00 Commissioners awarded the bid to O ‘Mara as lowest bidder.
Condemnation for Bridge #5 Laughery Creek Road- Parcel 3- federal aid project and one of the property owners is seeking legal council and her attorney doesn’t agree with their offer. He didn’t want to refute their offer. They are $9,000 apart. It’s 1.4 acres. DNR is requiring tree plantings to offset what they are removing. Offered $3400 in the flood plain. The county is filing condemnation with the commissioner’s approval.
Baudendistel updated on the status of court work on two other projects on Stateline ( Bentles) and TurkeyPointe ( Donaldsons) Roads.
Bridge #76 ( Jameson and Losekamp Roads) Construction Inspection Contract- Low bidder FPBH for $32,125- Approved and signed.
UPDATES- Listerman got a letter from INDOT for ll the projects they are doing in the county for the next 18 months. They will send to Register Publications and is also on INDOT site. One of the big ones is Down by the LaRosa’s and Cinema etc for ease of access.
They will also be going to road school. during the meeting in March.
Resolutions and Quit Claim deed for properties in Aurora Guenevere Emery Aurora- Baudendistel presented the 5 parcels on Conwell Street. Aurora passed their resolution and this is ours to complete the process. They will be assigning the tax sale certificates for the properties. Approved. The other resolution allows the property to be transferred with no payment to Aurora Redevelopment Commission and then they also signed a quit claim deed. Emery said the plan will include 9 parcels in total for housing development. They have taken out blighted properties. She referred to the properties as rectangle pieces in a series like the keys on a piano. They have met with interested developers and the city of Rising Sun on how their development has proceeded. They plan a staged development. Proposed single family cottages. There was over $75,000 in uncollected taxes on these properties. 5th street is also being considered for another development. It’s a hillside there though. Approved the resolution to transfer the property and the quit claim deed.
Resolution Establishing Reimbursement Policy for EMR/EMT/AEMT or paramedic training - Baudendistel said there was a fund for people to obtain this training, This is a policy hat Commissioner Thatcher put together for this. The training fell by the wayside and so now this will get that set up again. Approved.
Dearborn County Jail Health Care Services Contract- Quality Correctional Care with 64 out of the 92 Counties in IN. This replaces our old provider. Yearly cost is $259,550 in equal installments. $30,000 savings to the county. Shane McHenry presented. They do not include mental health services. He likes this company as they are an Indiana company. They are 2 hours away. Ownership can be there quickly. They have good recommendations from the other sheriff’s who use them. They will see what the inmates are eligible for in terms of insurances. This agreement starts March 1st. 90 days notice needed to raise fees or change terms. Otherwise it automatically renews. Commissioners approved and signed the agreement.
Juvenile Center Doctor and Nurse Agreement-Sue Hayden presented for them. Doctor- $11,133 per year. Nurse- $12,742/year. Approved.

AUDITOR – Leah Bailey for Connie Fromhold -Claims and Minutes from January 15th Commissioners Meeting approved.
Revenue Sharing Agreements- for Fire and EMS units were approved.
ATTORNEY – Andy Baudendistel- employment separation and release agreement January 30th signed by employee and the commissioners had to sign as well. The unnamed employee voluntarily agreed to it as well. Approved.
Wilker property hearing- and Bob Hrezo engineering was with him. Hrezo will have till Feb 21st to get his timeline to him. The performance bond will need to be posted for the receiver. Two people who looked at it were not willing to be appointed a receiver. Court resume later.
COMMISSIONER COMMENTS- Probst- where are we on winter cleanup for salt? Tim Grieve said they were getting the salt in and Probst thanked them for all their work.
Little- said thanks to highway.
Thatcher- thanked him for waking him up and making him aware of what was going on with the weather and safety.
LATE ARRIVAL INFORMATION- Bill Shelton- Ford Ranger that the county can use. Grieve can use it with highway work. They will work thru Sue Hayden to transfer. it.
PUBLIC COMMENT- Chris Mueller- discussed the highlights of the presentation form Hoosier Environmental Council on the fly ash problem on the old AEP property owned by Tanners Creek Development LLC. Had noticed that none of them had attended the meeting and so unfortunately they did not get to hear an understandable assessment of the issues and what it would take to make the water safe. Thatcher said he understood IDEM was waiting for response on their Dec 3 letter and there was a 60 day limit. He also noted that we need to let IDEM and the Governor’s office know if we want to effect a change. Wanted to know if they had gotten notices then. Hayden told him these mails are variable in getting to the officials. Baudendistel said they had an old email address for the mayor of L-bg in the past. He said it appears that IDEM is doing their job as they notified Tanners Creek Development had been notified. So they know they have to abide by the newer standards. I noted that the conclusion of the HEC meeting was that they have to dig it up and move it to a secure and safe site.
I said it may not be our fault that its there BUT it is our fault if we do not clean it up. We cannot depend on someone else to do it for us without being watchful and keep on it to be sure its done right. Flooding is a huge issue with this problem. And there are other pits in our county that need to be looked at too. I’d like the letter showing their response to the IDEM letter to be made public. Suggested they read the local paper article on this too.
Denise Klump- Question on the Wilker issue- did they look at the drainage issues in their figures- Quotes may not cover what is needed on exterior issues. More in court.
