3 MARCH 2020 DEARBORN COUNTY COMMISSIONERS MEETING NOTES

Present: Rick Probst, Acting President, and Art Little.
ABSENT: Jim Thatcher due to illness

Also present: Connie Fromhold, Auditor, Andy Baudendistel, Attorney, and Sue Hayden, Administrator

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

OLD BUSINESS
2nd Amendment Ordinance- TABLED from 2/18/20- Thatcher developed a proclamation in support of the 2nd Amendment per Probst and read by Baudendistel to publicly acknowledge and reiterate the 2nd amendment rights.Public comment.
 Milton Hoffbraugh (sp ?) from Dillsboro. He has no problem with laws as enacted so far. But he is worried about laws that make it a class A felony to have a magazine that holds more than 10 rounds. Some of these laws take out 22 rifles with 15 round chambers. AR15 rifles are not responsible for most of the fatalities. Wants us to have one more legal step to prevent gun ownership. 
Judi Gangloff with Register Publications- Does the county have power over the federal government laws? Baudendistel- The state Attorney Generals band together to prevent the federal law. Home Rule - if there is nothing to say they can’t do it- they can. The state also has the power to regulate firearms. IC 35-7-11.12 prohibits regulation by political subdivisions. Probst said- that’s why they did this as  proclamation. Baudendistel did say that SB 203 was introduced- but died. They then get reintroduced each year. Hoffbtaugh said he doesn’t lie how these keep getting reintroduced without the people helping decide this. In Virginia 92% of counties became gun sanctuary counties. Public comment closed.
Tabled proclamation until it could be voted on by all 3 commissioners. Draft copies available after the meeting. 

NEW BUSINESS
Road Closures for Dearborn County Anti Litter Initiative- Celeste Calvitto:
Stateline Hill from Augusta to Augusta on each end- April 4th -9-noon- Highway Dept will pick up the litter bags after that for them.
County Farm Road April 25th 9-noon- not needed until they are working on it later summer so it will be closed anyway and they will do it then with YES Home help,
Yorkridge Hill May 9th 9-noon- Highway Dept will pick these bags up to after done. 
All approved for closures
March 14 has Whites Hill and North Dearborn will be closed and Highway Dept picking those up too.
There are mattresses and a couch on Wilson Creek that owner put there to deter parking there. Will check with Planning to see if this is allowed as property rights. 

Bid Opening 2nd bid Owner occupied rehab program- Patty Jackson SIRPC- 5 properties  in the county on 715 Sunnyside, 9521 Stoops Road, 4823 Kaiser Rd. 573 Nowlin Ave, 145 Lincoln St. Reynolds, Stehlin Construction, Jackson Construction, and Scott Simms all bid. Bids ranged from $20k ranging to $104K varying by property bid upon.
Commissioners took these under advisement until the next meeting when they will select the bidders. 
Patty said that construction has moved slower due to weather. 

ROW Services Contract Bridge #108 - Highway Engineer Todd Listerman- $107,540 Approved. 


ADMINISTRATOR – Sue Hayden- Jenny Awad is the new Dearborn County Historian. ( Also noted in the local paper this week.

AUDITOR – Connie Fromhold  -Claims/Payroll and Minutes from February 18th approved.

ATTORNEY – Andy Baudendistel- Taylor Siefker Williams Design Group was selected for the project to look at Agricultural and Residential Zoning. NTE $32,490 paid on a monthly basis. Authorized Thatcher to sign this when he gets better. Approved. 
Lawrenceburg and South Dearborn HS raised more funds than planned for 

COMMISSIONER COMMENTS
Little- If you have 100% security you don’t have any rights. We don’t want any ore restrictions on our gun rights. No laws can completely prevent crackpots slipping thru.
Bright and Aurora Lions having Pancake Breakfasts this weekends. 
Probst- Coronavirus- following this and needs to be taken into account. Don’t spread germs. Employees tp take preventative measures. It’s coming eventually to Indiana. [ NOTE: Keep your hands away from eyes, nose, and mouth especially. ]

LATE ARRIVAL INFORMATION- none

PUBLIC COMMENT- Milton Hoffbraugh- based on the last meeting the OKI survey didn’t have many participants when he had gone and done it
Probst said they did increase.
DC Soil and Conservation Board- invited commissioners to their annual meeting. They did respond to the invite already.
