 28 February 2022 Dearborn County Plan Commission Meeting Notes

Present: Dennis Kraus, Jr., Chairman, Russell Beiersdorfer,  Mark Lehman, Joe Vogel, Jake Hoog, Dan Lansing, Jim Thatcher, and Eric Lang

ABSENT: John Hawley, former County Extension Agent left for a new job. The new Extension Agent started here Friday. Will probably be at the next meeting.

Also Present: Mark McCormack, Plan Director, and Andy Baudendistel, Attorney.

Baudendistel read the Title VI statement as legally required.

ELECTION OF OFFICERS- due to no January meeting is tonight. Keeping the current slate of officers. Kraus, Jr is Chairman Lehman is Vice chairman, McCormack is secretary. Baudendistel is still attorney also.

OLD BUSINESS: none

NEW BUSINESS:

 1. Request: To re-plat the utility easements associated with part of lot 5 of the Reiner Acres Subdivision and lot 4 and part of lot 17 of the Paul Wiwi Subdivision Applicant: Seig Surveying Site Location: 668 Harrison-Brookville Road between the East Dr. and Reinier Dr. intersections Legal: Section 12, Township 7, Range 1 Township: Harrison Zoning: Agriculture (A) Size: 1.2 acres (Approx. Affected Acreage)

Mark McCormack said that he had left a message for Mr Reinier who may not have been notified. His neighbor was in the audience and he said that he had seen the notice and materials and he was OK with this. The applicant is making significant changes with platting easements. This is a moderate density subdivision. Section 288 requires this to be heard by Plan Commission. This subdivision is from the 1960s. The Noppert lands were combined in 2021. Permits were issued in 2014 for an attached garage and what was built did not match the permit. These then ended up in utility easement. There was another one like this later as well. They then contacted the Nopperts as an enforcement issue. They propose to move the utility easements around the area and still accommodate the 3 properties without encroaching on further improvements on the Noppert properties. There are two buildings encroaching on the utility easements shown in the pictures of the site that McCormack presented.

Rob Seig, Surveyor was there for the applicant, Mr Noppert, who works out of town. He pretty much reiterated what McCormack showed and the proposal to provide a new route for the easements. They did call 811 to be sure no utilities were in the easements currently. There is a route now that they could use if they did need an easement for utilities. This is an older subdivision that is built out so the likelihood of any easement or utility issues is unlikely. There is a neighbor present who has properties out there. 

Public:

James French-( neighbor)  There is a gas line to the one house on the right about 9 ft off the property line. This is a personal service line and so it does not require an easement per Seig. He just wanted them to be aware of this as 811 did not locate that when they came out. 

Closed Public Discussion. 

Plan Commission had no discussion. Lang motioned to approve the modification pf the plat and the easements as shown. Beiersdorfer 2nded. All ayes. Approved.

2. Request: To address the Plan Commission to discuss a modification to one of the Written Commitments associated with the 2005 Plan Commission public hearing for the Harvest Ridge Zone Map Amendment—specifically with respect to a (proposed) significant reduction to the proposed density associated with the development and the corresponding traffic impacts and recommendations. Applicant / Owner: Maxwell Properties V, Inc. Site Location: SR 46 and Trojan Road intersection, with respect to the applicable written commitment Legal: Section 15, Township 7, Range 2 of Kelso Township Township: Kelso Zoning: Residential (DP) Size: 101.21 acres (Original Affected Acreage of ZMA area) 

Mark McCormack worked here in 2005, but was not Director then. 340 units drawn but 198 were proposed. So there were 142 less units. The traffic study is at issue. They complied with the sewer service from St. Leon. One of the improvements was at Schuman and SR1. This year they are putting in a full signal there, whereas before there was not enough traffic for it. They always have to have INDOT’s blessing to do these improvements as it is a State Road. They needed update traffic information to see if the turn lane could be removed from the plan. 

The code changed and now there are new regulations on this for changing a commitment. 

The intersection pictures show that a left turn lane will be competing with R turners for site distance across the bridge there on SR46. Widening this road at the intersection may be problematic with the slope at the end of Trojan Rd. They are droppomgh the total units to 138. This is a nearly 60% reduction from the 340, and 30.5% from the 198. The school has rerouted traffic and times since this was done also. The letter from the county engineer acknowledges that improvement there at SR 1 will reduce the need for the SR46 side. Board is to decide whether or not the L turn lane is still needed. 

71 letters sent on this to the subdivision owners affected. 

Randy Maxwell-17 years ago I was still in my 20s. They made the $125,000 improvement at Schuman and SR1. And now there will be a light there soon. They were going to do more homes then and they are going to scale back this development. They are addressing this first before they go to the next agenda item that is also for this subdivision. 

Public Comment:

Sarah Jordan- bought the old farmhouse across the way from this subdivision. The county owns a strip of land there in front of her house.It will remain ROW or if they will vacate it they usually offer it to adjoining landowners, per Eric Lang. 

Closed public discussion. 

Plan Commission- Jake Hoog said the sheriff’s dept has deputies directing traffic after school for the left turn issues. Eric Lang said the engineer 

Jake Hoog motioned to release them from the commitment on the L turn lane from Trojan Rd onto SR 46. Lehman 2nded. All ayes. Approved.

3. Request: Primary approval of the Harvest Estates Subdivision, a development proposal which involves the creation of 15 new single-family residential units as well as a waiver request to not construct sidewalks within the proposed development area, as required by Article 3 of the Dearborn County Subdivision Control Ordinance. The affected property involves changing the approved concept development plan for the Harvest Ridge Zone Map Amendment (from 2005). Applicant / Owner: Maxwell Properties V, Inc. Site Location: Approximately 4,000’ south of the SR 46 and Trojan Road intersection Legal: Section 15, Township 7, Range 2 of Kelso Township Township: Kelso Zoning: Residential (DP) Size: 45.662 acres (Affected Acreage of Primary Plat / ZMA area) 

Mark McCormack- briefly went over the site. This is about a sidewalk waiver- to NOT have to put them in this section. Now they are discussing a new portion across DogRidge. There are 6 half acre lots and 9 larger ones. They were proposing twice that amount before. Cutting this amount in half. It will have sewer. This is no longer connecting into the Harvest Ridge West subdivision road. Originally they would be looking at curbs and gutters and sidewalks. This density is less and the sidewalks will not be connected to the rest of the development.  This is not a collector or arterial road. Common areas are being removed. 15 acres is tied to these 15 lots.This is part of the total of 138 discussed in the previous Request by Maxwell tonight.It is proposed to be called Harvest Estates. McCormack noted that they don’t necessarily need to change the name as it is part of the original Harvest Ridge property. Sidewalks were required if there is 1 unit per acre. This is right at that threshold. This subdivision is less than 250 trips per day. If this is a stand alone area it is less than that. Maxwell is requesting a waiver from this sidewalk requirement. There is a sidewalk on the west side of DogRidge. On the east side there are none. There were pictures of the adjoining developments with none.

Randy Maxwell- this is fifteen 120 ft lots. To be transparent , he plans to sell 5 acres or so to Sarah Jordan who owns the farmhouse there. This would skew the density numbers here. He said sidewalks need to be tied to curb and gutter. He notes that some times like in Park Place when a lot ions’t sold there is a disconnect with a sidewalks piece missing. There is likely only 32 lots on the entire 45 acres across from Harvest Ridge West. 

Public:

Ellen Bulach- Where will the entrance be to go into this new part. He showed her the section and where it is in relation to her home. She likes farmland, but knows it won’t be that. She also wants a fence between the subdivision and Sarah Jordan’s property. 

Sarah Jordan- Thanks for opportunity. I work in real estate as my livelihood. It’s a very emotional thing for me and I bought Ellen Bulach’s house. I want to see it done correctly. I want my view off my balcony. Maxwells are willing to work with me to help preserve my view by selling me some of this land. Thanks Ellen- I would like to have a fence between my property and this. 

Closed Public Discussion.

Plan Commission- There are 2 things to discuss- the waiver on sidewalks and also the Primary Plat. There are things that were part of the original rezone and plat plans that are not going to happen now. Eric Lang said we often do not have someone who wants to reduce density. This may fit better with the rural area. Lehman- Mark McCormack has told us before to we look at intermodal connectivity and correct the sins of the past. There is a school there and connecting to this with all this space to do it would be a good idea. He sees the north section later and getting closer to the school. Lang said this is a single dead end street that has no chance of connecting anywhere else. The road is a dead end- so you can walk on the road. Lehman is trying to connect this side of the 45 acres with the side north of it. 

Neighbors commented on this and noted that the sidewalks are not used even in the current development. People walk in the streets. Maxwell noted that the cost of the sidewalks is borne by the owners. There are areas where it would be nice to have them but not in this 15 lot area. 

Beiersdorfer moved to grant approval for the 15 lot subdivision on a cut de sac. Lang seconded. All ayes. 

Beiersdorfer motioned to grant a waiver for no sidewalks as there is low volume cut de sac street. Lansing 2nded, All ayes. Approved.

ADMINISTRATIVE  To review and discuss proposed ordinance amendments the Dearborn County Zoning Ordinance and the Subdivision Control Ordinance, and to discuss other administrative items—including updates related to Planning & Zoning staff activities and projects- McCormack went over all the changes to Article 2 Advisory Plan Commission that he revised after the previous discussion of this Article. These are the rules of procedure that we are doing and clarified many as well.

Lehman motioned and Beiersdorfer 2nded to forward these changes to Article 2 with favorable recommendation too the Commissioners. All ayes. Approved. 

March 28th is next meeting. 2 items on the agenda. They plan to have another separate meeting for the Zone Map changes. They may be able to get it in one meeting.

Have a lot of people who want the administrative position here. They have 30 plus applicants. Interviewing.

 'The 'Quilhot Bid'

I have a new phrase to add to your vocabulary and self-help guide: the Quilhot bid.

It comes from Russ Quilhot, who hosted the weekly afternoon card games a group of us old codgers participated in. I played bridge with him Wednesday before last. On Thursday he died. It was one of those abrupt and unwelcome events that encourage us to put everything else in perspective.

I am tempted to say he was my friend, but that would be presumptuous. He lived for 89 interesting and productive years, and I knew him only for the last three. But we enjoyed each other’s company, and his knowledge of history and zest for discussing it made our Wednesday afternoons informative as well as entertaining.

He was also a very good card player, and being his partner taught me something important about bridge. It’s not always about the strength of the hand.

We would be having what players would call a bad run. All the good cards would be going to the other side, hand after hand, and we’d be getting our brains beat out.

Russ would sigh and say something like, “You know, it’s no fun losing,” look at his hand, then jump into the bidding with a reckless abandon totally unjustified by the cards he was holding.

He might have eight points and a couple of four-card suits, which an experienced bridge player will tell you is barely enough to support a partner’s bid, let alone make an opening one. But he’d do it anyway.

That was the Quilhot bid, a damn-the-odds maneuver meant to at least shake things up if not turn them around.

And the thing is that he sometimes parlayed that unorthodox move into a winning hand. One of the secrets bridge players learn is that if the 40 high-card points (which we must obsessively count), are distributed more or less evenly, no one has a hand worth opening with. But any two hands in combination could win a modest bid if one of the players has nerve enough to take a wild shot.

People who knew Russ longer and better than I say the way he played bridge was the way he approached life – not always intimidated by the weakness of his hand.

I don’t doubt it. He played football for Purdue, then became a member of the elite Marine Corps. He was a successful businessman, then he and his wife Jeanette started a nationally respected horse breeding and training farm at an age when most people would be thinking ahead to retirement. He was the respected rather than feared patriarch of a large and loving multi-generational family.

You do not have a life like that by always adding up the points and just playing the strong hands. Sometimes you have to take a chance on a weak hand.

I hasten to add that this is not gambling, at least as that word has come to be used. Since the Supreme Court opened the door to sports gambling, millions of Americans have bet and lost billions in physical spaces like casinos and digitally by merely pushing a few buttons on their smart phones. On the recent Super Bowl alone, $7 billion was wagered, a 10-fold increase over last year.

That is just stupid – desperate chances taken by foolish people against overwhelming odds, encouraged by unscrupulous governments preying on human weakness.

What Russ did, in cards and in life, was to trust that his experience, wisdom and skill would occasionally see him through when his position wasn’t the strongest. It might seem like taking a chance, but it was in fact a calculated risk.

Think about that the next time something really important seems about to slip away from you, when you think you’ve already used up your best efforts. Sigh, take a breath, and make a Quilhot bid.

Jim Thatcher - participating via telephone as permitted by IND code as we remain under Covid emergency that is still in effect.

OLD BUSINESS:

2021 Annual Review - Dave Currence- Veterans Service Officer- TABLED until 3/1 meeting.


Request to extend Carrie Drive Right of Way into the Old Mack Family Farm Property- Rob Seig, Surveyor. Carrie Drive is off Pribble Road at the top of the hill. One of the owners, George Morgan, was present. Copies of exhibit were given got Commissioners previously.138 acres. Carrie Drive was the old Gensheimer Subdivision that was not developed. Put a cul-de- sac on his property for the 3 family residential lots they will have on the 138 acres. Might not put in a couple pan handles if needed. They also talked to Todd Listerman. Needs to be gravel to match existing Carrie Drive. Commissioners approved the cul-de-sac.


NEW BUSINESS:

Weather Advisory Declarations- Jason Sullivan, EMA Director- Sullivan was not present, so Sue Hayden presented. Jan 28th and Jan 29th Feb 2nd, 3rd, 4th, and 6th advisories were approved. 


ADMINISTRATOR – Sue Hayden- 2022 EMS Squad Contract- Dillsboro. this is the last one needing to be signed. Two squads for $40,000 approved. 


AUDITOR – Connie Fromhold  -Claims/Payroll and Feb 1st Minutes were approved. 


ATTORNEY – Andy Baudendistel- nothing


COMMISSIONER COMMENTS:

Little- guess everyone was disappointed in the Super Bowl. Weather looks like it will be nicer now.

Probst- also commended highway dept.

Thatcher-  thanked HWY dept for a terrific job with weather. Thx for covering to Probst so he could spend Valentines Day with wife in Hueston Woods.

NEW BUSINESS

Dave Currence, Veteran Service Officer - 2021 Annual Review- TABLED due to Dave Currence being under the weather.


Soil and Water Conservation District:

Updates Jessica Rayburn, District Coordinator,- Meeting annual the year in person on March 8 at 6:30 at Carnegie . Annual Plant sale- helps with backyard program at the libraries. Doing a tree giveaway - planning now. Also Matt is doing the EWP things with the Highway Dept. Trying to replace invasive with native species. Working with the local FFAs to help sort plants at Bright Park and have a drive thru for the trees ( 2 / landowner)  Donations suggested- Canned goods or monetary for the parks-but not required. 

SWCD- Jennifer Hughes, Storm Water Coordination- MS4 Overview-New MS4s waiting on signatures from IDEM. Once signed they will come to the new MS4s. Chapter 154 of Elkhart has an example of this from 2006. State likes their plan. 

Will have to determine our new MS4 operator from  the Board of Commissioners. There will be an office designated.  


[NOTE: MS4 is short for, “Municipal Separate Storm Sewer System", where the word “Municipal" refers to a unit of local government like a borough or a township, but may also refer to an organization responsible for the administration of a developed area. And the number 4 refers to the four words that start with the letter “S"; “Separate," “Storm," “Sewer," “System."]

They will need an MS4 Coordinator. Thatcher asked if she will do that. Hughes replied that is not her. Not allowed to be her per statute,NOI- Notice of intent and Part A to IDEM -within 60-90 days.

Part B to IDEM - baseline info about MS4Water quality, TMDL’s current ordinances etc. 

Form a committee for input to stormwater quality management plan. They have a lot more details on items to prevent and stop pollution. Part C to IDEM- SWQMP and Minimum Control Measures MS+CM with measurable goals. 

Write and implement all required ordinances.

Write and implement Stormwater Prevention Plan ( SWP3)- all MS$ owned facilities. Write all standard operating procedures (SOP) for all activities MS4 does that have the chance to cause pollution.

Provide annual reports to IDEM.

Provide annual training each year. 12 hours years for the coordinator. 8 for staff and 1 for other employees. 

Hughes encouraged them to talk to other MS4s.

Some of the things we already do here- so we have started our base activities in some areas. 

If a pond exists that disturbs an acre you fall under this. It was Rule 5 across the country. The they decreased it from 5 acres to 1. 

Probst said he couldn’t take it on and Thatcher was already full. Little said he’d do it- but would need lots of help. Thatcher still is the signatory. 

Bartholomew county (Columbus) were 2 other examples where MS4s exist. Hidden Valley Lake is our only MS4 locally. That coordinator is ready to retire. EPA told IN that they can’t do this under administrative code. 

Mark McCormack said they could get with some of our drainage consultants regarding this to get ahead. Probst said with an RFP to get at this. Greendale, Lawrenceburg, and Aurora will be affected- maybe West Harrison. If the county is named MS4 you cannot do boundaries except for the municipalities who are incorporated. If Bright is in one- that is the county- as it is not incorporated. 

Ken Gunkel, Supervisor - noted that the commissioners communicate wellll with  them. Feb 9 meeting upstairs on MS4 next week. Thinks it will be a win- win. Why are we doing it- For cleaner water and healthier soil.

County Engineer, Todd Listerman:

Bid Award for Small Structure #616 Run-around on Thomas Road- McAllister low bid at #115,075- approved.

Bid Award for 2022 Paving Project- This is a Community Crossings Grant. Paul Rohe was lowest bid at $2,399,969 which was approved. It’s higher by $150,000 than estimate we had- but oil prices are affecting this. 

Bond Acceptance on Bridge #135 Weisburg Road- $243,781 was approved.

Hallgarth Property@Small Structure #112 Station Hollow RoadRain washed out the structure- have been working on ROW for 2 years. Have 2 out of 3 signed. The 3rd is Hallgarth and they signed acceptance of $182 for .028 acres. They have not signed the deed- several attempts to contact go unanswered lately. County Commissioner Probst will go out with Sue Hayden Adm (and notary) to get deed and W-9 signed if the next attempt is not answered.


Ordinance Amending ARP Funds Application- American Rescue Plan Funds- Baudendistel amended the ordinance to reflect due dates by Dec 2024 and funds finally used by 2026. He also put in the nondiscrimination statement. Approved and signed. They will also advertise so people know what funds are available. Aurora put their notices in their utility bills. 


Resolution Opposing Legislation Regarding Lowering the Business Property Tax- The House was eager for this- but the Senate is not so eager. - Baudendistel- this was requested by former association of cities and towns now called AIM- urging opposition until a replacement stream of money for local gov’ts is there. This revenue is over $1billion for the state and approx. $2.1million  for the county ( not including municipalities) per Connie Fromhold, Auditor.  Approved. 


ADMINISTRATOR – Sue Hayden- 2022 EMS Squad Contract- Moores Hill  ( $40,000) and Manchester ( $20,000) approved. Dillsboro will be next meeting hopefully. 

Lynn Deddens, Prosecutor asked her to have Malcon approved for the IV-D recovery expenses on child support. It costs $600/month and they recover about 60%. Funding comes out of IV-D. approved. 


AUDITOR – Connie Fromhold  -Claims/Payroll and January 18th Minutes approved


ATTORNEY – Andy Baudendistel- Who-dey! Finally the Bengals are heading to the SuperBowl. 


COMMISSIONER COMMENTS:

Probst- want to thank the citizen and media who attend these meetings. Disappointed there are not more people. BE PREPARED- Major bad weather even coming Thursday- Friday. Be prepared for 24 hours of it. He’s going to test his generator today. 

Little-  REMC is looking for a staging area for their trucks for the ice storm. He also thanked everyone for their condolences after the passing of his granddaughter. 

Thatcher- I remember the Freezer Bowl- Thought it was over at the beginning of the age Sunday but they went on to win miraculously. Saw a guy out on the highway selling T-shirts and banners. He will be able to retire after he sells all that Bengal stuff now. Also echoed Probst’s thoughts on being prepared.
