27 February 2023 Dearborn County Plan Commission Meeting Notes

Present: Dennis Kraus, Jr., Chairman, Russell Beiersdorfer,  Mark Lehman, Joe Vogel, Jake Hoog, Dan Lansing, Jim Thatcher. Eric Lang arrived at 6:20 PM

ABSENT:Jeff Hermesch

Also Present:  Nicole Daily, Zoning Administrator, and Andy Baudendistel, Attorney.

Baudendistel read the Title VI statement as legally required.

ACTION ON MINUTES: January 23, 2023, September 24, 2020, November 16, 2020, and October 28, 2019 . All approved. These were minutes being cleaned up from the files. When they couldn’t find the official approvals. 

OLD BUSINESS: none

NEW BUSINESS: none

ADMINISTRATIVE:

Review and discuss proposed ordinance amendments and updates to the Dearborn County Zoning Ordinance and Zoning Map, specifically with respect to the texts of Articles 9 and 10, regarding Agricultural and Residential Zoning Districts, Article 25, regarding general standards (Keeping of Animals), and new use development standards;, Article 27, regarding Definitions. 

This will be an overview of all changes to date for only the proposed text changes, which will determine the final proposed text of the ordinance that will be voted on in a date to be determined. The maps will be discussed at the March Plan Commission meeting, as long as no cases are submitted. 

Opened PUBLIC DISCUSSION

Charles Keller ( Keller Rd) - said he’d wait till March when the maps were being discussed. As did Mr Perrine ( Scenic Dr), Chris Mueller (Pribble Rd) and Mr. Merz. 

Jeff Meinders- Owns land on Carr Rd and 8873 US 50. 175 acres. The zone is currently Residential and the property has been platted out also. The land is not suitable for farming at present. They have it moved to Ag on the new maps and have he wants it to remain Residential. 

No one else spoke as the maps are being discussed in March and April.

Nicole Daily- said she hopes to bring it back in May for a vote. There may be a 3rd meeting and the final vote in June depending on how the map meetings go. There will have to be public hearings for the map changes as well as the text changes per Baudendistel.  

Discussion about how they plan to run the next meetings. 

Also how to put the criteria for selecting zones was done. Mark Lehman wanted those out so the public knows that sewers were a main decider on the Zoning. 

Nicole will have the maps mailed to the board so they can have a paper copy to see what they will be deciding.They will also have maps up in the lobby at the next meetings.
