The Dearborn County Redevelopment Commission 

has called an Executive Session for 

Wednesday, October 21, 2020 at 8:00 a.m.

A public meeting will take place at 9:30 a.m.

The purposes for the Executive Session are to: 

(1)   Discuss interviews and negotiations with industrial or commercial prospects or agents of industrial or commercial prospects by the Indiana economic development corporation, the office of tourism development, the Indiana finance authority, an economic development commission, a local economic development organization (as defined in IC 5-28-11-2(3)), or a governing body of a political subdivision, classified confidential by state and federal statute IC 5-14-1.5-6.1(b) (4).

The HOTIF ( Housing Opportunity Tax Incremental Financing) approval is found under OLD BUSINESS below:

Present: Kevin Mollaun, Chairman, Bryan Johnson, Brian Jansen, Mark Knigga, Bob Miller, Fayla Nane, and Regina Rybolt

Supt. Karl Galey and Attorney Del Weldon and several administrators and student rep were participating via telephone

Also present: Casey Knigga, Jim Thatcher, DC Commissioner, Al Abdon, GRC,Mike McLaughlin, Jeff Lyness

1. Ms Tammy Gregory (via telephone) presented LPS ( Lawrenceburg Primer School) goals for 2020-21 along with a powerpoint presentation for the board.They are in Year 2 of their dual language immersion program. Reading is goal 2. Increasing phonics instruction with a multi sensory program. Dyslexia law compliance is considered as they implement the law SEA 217. There is a program for universal dyslexia screening with a worksheet. The 3rd goal is social/emotional learning. They use Minds in Motion. They have  aPeace Corner with wiggle seats to help the student get ready to learn. They have zones of regulation to help them identify what they are feeling to get them back to learning. Last thing is other events where they had officer Bryant there and monthly awards. They also focus on staff with a Woot Woot Wagon with a special treat of pick- me up for staff at times to show staff appreciation. 
2. Galey recognized Ashton Rasnick made the Cinti Symphony Youth Orchestra.  JAG Class featured in Work Force with pictures of Seniors.
3. Galey reported the school lunch fund was in the negative because there was a split month with the government reimbursement issues wit the free breakfast and lunch funds. Mark Knigga questioned some of the funds and Galey explained. They still don’t know what they are paying for these services. USDA did extend the free meals thru the end of June. Pam Taylor is still on vacation so they will get more on this when she is back. There are some new formats that need to reworked in. The Board adopted the 2021 budget including the capital projects and bus replacement plan. The busses will be replaces in 2022.Board approved the Appropriation reduction resolution. This helps to capture the maximum amounts with their budgets.
4. Minutes for Sept 14 and Sept 28 (special executive session ) 2020 minutes were approved.Regina Rybolt had to abstain as she was absent.  
5. Personnel Items were presented by Galey with a list of staff hired for extracurriculars and other positions. Resignations, transfers and retirement staff were presented also approved. Knigga had an issue with not receiving 5-6 names that were added later. The other board members received the info. All approved by board. Administrative and support staff raises from 2019-20 year were approved. The teachers were done last month.

7. Field trips on Dec 18 to Greendale Cinemas with appropriate spacing- approved
8. Fund raisers- were approved for various sales to fund extracurriculars. 

9. OLD BUSINESS-

Approval to support the Crossings atTanners Creek HOTIF- Galey said there has been dialogue for the past 2 months. Give parameters of only the property that is being developed. They want the TIF to not exceed 15 years. Knigga said they should agree to no Re TIFing. The TIF is for 85 houses. Abdon said they do not know what they are asking for yet. They haven’t actually asked GRC for anything. TIF statutes change annually. He thinks it is more for the developer to answer. Abdon had no problem with not re-TIFing. Abdon did tell them GRC can TIF outside their boundaries.Wanted not to exceed 20 year TIF. 

Casey Knigga said it’s at 85 units - it could go down to 83. If you buy a lot you have a year to build on it They don’t want empty lots. Additional property across the creek will be decided after and would require another hearing. 

85 houses is phase 1. There is more property than that. If phase 2 comes later it will be part of that same TIF. 

Board approved unanimously.

10. Draft - no reTIFing and a 20 year TIF was requested to add into it to share with Attorney Smart and Abdon.  They approved this and Abdon also gave GRCAnnual report to the school board. Galey asked how they assess the number of jobs each project brought to Greendale. Abdon said they hammer out details and expectations. they weigh heavily the jobs added and the revenue that they will bring in and the benefit overall to the entire community. Abdon said they have clawbacks. They get a list of employees or certified payroll documents. The clawback makes the business give back the difference if they don’t meet their contractual goals. 

Approved contracts with Lancer+Beebe and Maxwell Construction- 3 documents included for board. Attorney Weldon said one contract for architect, one for construction manager, and a third. The AIA construction documents and also show changes in the documents for the board. Guaranteed max price and start and completion date. They have be able to identify improvements to make ahead of the projects. This is because the construction manager was selected ahead of the project itself. We are still in reconstruction phase. Maxwell is the construction manager. They have a dispute resolution clause that has binding arbitration and then to DC Superior Court with a $250,000 threshold. Not federal court. Arbitrator selection was also delineated to be someone who is board certified. One provision still up in the air is damages for going beyond completion time. $1,000 per day damages. - Here we do this and had substantial talks with Maxwell. They (Maxwell) thought $1,000 per day could cost us money because some bidders would increase their bids and it would add to their cost. So they suggested $500 per day. Having Maxwell involved in reconstruction phase should help get us the best numbers we can. Doubt we want to scare away bidders. Jeff Lyness with Maxwell said that there is not necessarily an average number for this. Have a process to precertify Tier 1 contractors. They have to send in their qualifications in advance to see if they can do the work. Attorney Weldon supported Lyness’s approach. Figuring having Maxwell in ahead of this is helping instead of just dealing with the architect. Mark Knigga noted that there will be surprises in the projects. In the last situation they had there was no effort put in by the contractor. You want to be on time - no one wins when you have to invoke this penalty. Board decided to approve the $500 per day.

OF NOTE:Mike Schwebler from High Point Health and Board Members from the hospital attended the executive session and were seen leaving prior to the meeting.

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

TITLE VI STATEMENT FOR COMPLIANCE was read by Probst as legally required.

NEW BUSINESS Public Hearing – Infrastructure Development Zone Motion to Open Public Hearing on the proposed IDZX.- Probst was asking about the expiration date. Thatcher said they can revoke it laster if needed. Commissioners passed the ordinance and signed it.  This is to designate the entire county for facilities and development of broadband services.

Public Hearing – Revolving Loan Fund through COVID-19 Grant Program Eric Kranz, President/CEO of Dearborn County Chamber of Commerce- Commissioners passed this also- Krantz said they will be processing these loans soon. He can hold the meetings at the Commissioners room instead of virtual per Thatcher. They have partnered with Civista to hold funds. $250,000 grant from OCRA and $35,000 in matching local funds. This is to assist businesses housed in Dearborn County that have been affected by pandemic. $10k- $50k for max loans per recipient. They (Chamber of Commerce) as sub-recipient will handle this on behalf of Dearborn County. 

OLD BUSINESS- (tabled item) 911 Director Jared Teaney – Subscription Agreement for IAmResponding- This was leftover from last meeting. The Fire Depts. are giving good feedback on this. All but 2 of the fire dept chiefs were there. Commissioners passed the agreement and signed it. 

ADMINISTRATOR – Sue Hayden- Susan Hejlik, Adm Assistant, covered for Hayden during her absence. Nothing to present.

AUDITOR – Connie Fromhold  -Claims/Payroll and Sept 15 Minutes approved.

Cost Allocation Plan with Malcon for 3 years- approved for county wide cost allocation plan for $5400 each year.

Resolution Establishing Intent to Conduct a Commissioners Sale- this is for anything that didn’t sell on regular sale and then Commissioners sell it. You commissioners can meet with SRI and decide what you want to do about setting a minimum bid. Resolution approved and signed. 

Health Dept Grants- $200,000 COVID Test Clinic Site and another for $ 74,914.05 for local health services for Health Dept. to provide. Approved. No county match required. 

 

ATTORNEY – Andy Baudendistel- not present

LATE ARRIVAL INFORMATION- Perleberg with One Dearborn introduced Jack Sutton with a Dearborn County Trails report. The Economic Dev Startegic Plan  includes Trail Connectivity which is  30 years with parks in Hamilton County OH including 17 years as CEO of that. Sutton lies in Aurora. They had a trails committee and this is a result of that. Thatcher interjected that he’s known Jack since he was a kid on a swim team.

Jack Sutton is sharing this information around the county. He’s presenting the assets of the county today to commissioners.  This report is available on the One Dearborn website. 

Running jogging fishing cycling top 4 activities. This year a big surge in trail uses due to COVID also. 8 miles of paved multiuser trails. Most is in L-bg to Greendale trail. There are other loop trails throughout the county. Identified key gaps in the county. Every 5 years the state has trail plan revised. Ohio River Recreation Trail runs all along the Ohio River from Portsmouth OH to Louisville KY. Lawrenceburg has 2.5 miles of paved trail and they have another on to b the riverfront trail connector to connect to Greendale along the levee and Oxbow. It should be constructed in 2021. Hopes to keep the link from that and dock site to Krogers area. 

Context Design worked for Greendale and Lawrenceburg, Ridge Avenue near Proximo tia the to Conservancy are and greendale soccer field and all a play thru to L-bg schools. They have 8 proposed trails to connect to all their neighboring communities.

Arora has Dearborn Trail , Lesko Park and they want to connect these 2 via the George St Bridge and or the streets in Aurora. They also have a Downtown Connector Trail option across to SR 56. 

The County has a trail plan also in their plan.

Dillsboro, Moores Hill and Hidden Valley have plans, some more than others.

Franklin Count has the Metamora trails. Also the Whitewater River trails. 

Hamilton County has Whitewater River to Shawnee River connections  that we can do.

Ohio County does not have any on file.

Sutton outlined several potential funding sources He has talked to DNR and 60% of Ind state funds will be to locals.There are other sources.

He suggests a Regional Group to keep the Dearborn Trail and more connections to have 4 local governments to share in costs of that trail for sustaining a unique asset to the county.

Thatcher asked about overnight accommodations for the hikers of eta longer trails.

Sutton said that Inns and B&Bs can be set up along these.

Mark McCormack said they have had 30 or so applications for funding and got all but 2 over the years he worked here in Panning Dept.

Thatcher said- we may need a grant writer for this.

Little- noted and chuckled that if you believe the news the President is going to give us all COVID. He also has masks and sanitizer in his truck to pass out.

Thatcher- liked the presentation on Parks and moving forward on the county issues with broadband etc.
