24 February 2020 Dearborn County Plan Commission Meeting Notes
Present: Dennis Kraus, Jr., Chairman, Russell Beiersdorfer, John Hawley, Mark Lehman, Michael Lynch, Jake Hoog, Bill Ullrich, and Jim Thatcher
 ABSENT: Eric Lang
Also Present: Mark McCormack, Plan Director, and Andy Baudendistel, Attorney.

ADMINISTRATIVE:
Ordinances: 
Proposed changes regarding Site Plan Review process; Article 23, Sections 2305, 2310, and 2315- Minor changes in 2305 to match up with state codes, 2310 has a couple procedural clarifications in site plan reviews, 2315 had changes in the timing of the application and approval process. 
Thatcher had some questions that were brought up as he was hearing complaints about all the time it takes to get through the processes. Board noted that the county moves faster than most areas around us- especially across the state line. There are longer times required if there is a flood plane issue or a zone change. Incomplete information or missing information can sow the process also. Thatcher noted that he was just asking as he had been approached about this.
Tabling that extends beyond 90 days has been an issue in the past. Sometimes the ones with conditions can create a host of issue also when they are not met. Fees will be assessed for additional reviews in some cases.
Lehman said they have issues getting all the utility letters for subdivision reviews. McCormack said they will get to that in the subdivision review process later. 
Ullrich and Lehmann took turns made motions to pass favorable recommendations to approve the changes in each of the 3 sections including the highlighted texts. Unanimous approval of each of the 3 motions. 

Proposed changes regarding roof and subsurface drainage; Article 3, Section 325.5 C. of the Subdivision Control Ordinance regarding residential lot grading, erosion control, and drainage. County Engineer, Stormwater Coordinator, and others have been wanting these changes for quite a while, because of issues from where people are putting their perimeter drains too close to streets and rights of way. Kraus, Jr. noted that they don’t have a good way to enforce this. Planning and Zoning doesn’t do onsite inspections of these items. It seems that building or highway dept are most affected by this. Wood Ridge Subdivision was discussed with examples of some of these issues. McCormack wants to have a discussion with tech review on how to inspect and enforce this. Historically, Planning asks building inspectors to flag drainage items so that the county engineer or Planning goes out to inspect it. This code then enables enforcement. 
Hoog asked about clarifying whether they needed both sets of directions on the discharge of the water. McCormack said the highway dept wanted it to be sure it stressed keeping it away from the street. Beiersdorfer asked about the 3 different setbacks. Kraus, Jr. said there are issues with stormwater and how far and fast it can go. Motions made by Beiersdorfer and Lehmann to give a favorable recommendation to commissioners on the proposed changes. Passed. 

Discussion and recommendations regarding a potential Zoning Ordinance & Map Project—focused on updating the County’s Agricultural and Residential Zoning Districts - McCormack went to 3 different groups to get 3 estimates from American Structurepointe, Taylor Seeker Williams joined with GRW lowest bid , and Calfy Zoning a law based firm from Cincinnati, lowest on option a and highest bid on option b. 4 public workshops - 6 public workshops in each proposal. Text changes and map changes. $3000 is the dollar difference among the 3. Kraus, Jr. wants to have someone form Indiana. McCormack knows the project leaders for the 2 IN firms. There has been a lot of turnover in Structurepointe in last couple years. He also knows the one form GRW and they did a good on Moores Hill. He also knows more people in that firm. They are both good groups. Discussion about what the master plan recommendations were regarding using the current land use plan to drive some of the rezones. Also to not just order a zone map or overlays to rile up people. Commissioners are funding these studies. Trying to get the public involved and advised of the meetings and workshops will go by newspaper, radio, etc. Possibly put signs out as in zone changes or developments.
Board sent a favorable recommendation to Commissioners for Taylor Seeker Williams and GRW for the Zoning Map Project for Ag and Residential Zone additions to the County map.

Updates, related to Planning & Zoning staff activities 
McCormack trying to get a new assistant planners Derrick went to become Aurora’s City Manager
Have an intern and she’s been helpful and updating the community profile. This can be slid into the Comp plan also and is on the web page. 
New code enforcement person has been hired. References spoke well of her also She used to collect child support payments. 

All the planning bills that they were worried about that took out Home Rule were killed. This is a good thing. 
OKI transportation plan needs input so trying to get more people to take the survey on their site. 
Hoping to have an annual report on PZ soon. 
Baudendistel will not be here for March meeting.

18 FEBRUARY 2020 DEARBORN COUNTY COMMISSIONERS MEETING NOTES

Present: Jim Thatcher, President, Art Little, and Rick Probst

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

OLD BUSINESS

Zoning Amendments and Ordinances-Mark McCormack Planning and Zoning Director:
Article 25 Table 25.1 and Section 2564- presented by Baudendistel for McCormack. The initial changes that were rejected and sent back to PC- and the PC then set 950 square feet as the minimum square footage for homes and 1550 sq ft for duplexes. The tables and ordinance was revised to put this number in place. Minimum standards MAY also be able to be varied if they want to seek a variance from BZA. Public comment - none. The commissioners approved the changes. 

911 Communications Board Appointment -This item occurred AFTER the Ordinance was amended below: Sue Hayden presented- The board is a 7 board member- fire dept recommendation is Jeff Lane and David Schneider the police chief for Lawrenceburg are the recommendations for the 911 board. Commissioners approved them for 911. 

NEW BUSINESS

Ordinance to Amend 32.006- DC Communications Board- the board is having a hard time getting people who fit the rules for the 911 board. The rules are being changed. Director will be on the board and the members do not have to reside in the county. This is more like other boards in the county. Commissioners approved the ordinance to amend the code of ordinances for that board.

COMMISSIONER COMMENTS:
Probst- asked who was familiar with OKI. All federal transportation money comes thru OKI for the area There is a 30 year plan- the 2050 plan for $17 billion dollars. There is a survey going on now until Feb 29th that is online at OKI- about 10 questions long. Go to OKI.org and click on the rainbow colored are to complete the survey. We need numbers to participate to get the Dearborn County ideas heard.
Thatcher- asked Hayden to relay info about 2020 LHS HS Sandy Ledesma- is Miss USA Indiana Teen and the Commissioners recognized her. 

LATE ARRIVAL INFORMATION- none

PUBLIC COMMENT- Josh Heis- passed out info to board. IN had a lot of unconstitutional gun laws. The sanctuary movement is now in place. Signatures of over 300 IN residents. He is a peaceful gun owner. He has sold 10-30,000 firearms over the years. Asking that the county not take over the enforcement of any new gun laws. All of NKY is on board with this. They are pro- gun- and that is why they vote pro Republican. 
NFA Penalties- National Firearms Act. Banned machine guns, short barrel rifles and shotguns. Some currently owned items are now being reclassified into those categories. Some guns that are very expensive are now classed as something that could get a $250,000 fine if you don’t destroy the gun.
Thatcher wanted to table the ordinance so they can review it. TABLED. 

Doug Odum- plan to retrofit a trailer and want to go to Council. Has tried 25 agencies for grants and couldn’t get it. $7,000 is needed to retrofit the trailer to move items from the truck to this. He needs permission to go to Council to get permission to submit grants. Approved.

Mark Henrits- sp ?- wanted to elaborate on the NFA issue above. He said the 2nd amendment rights do not specify the length of the barrel of the gun etc. It says the people have the right to bear arms. Taking away the right to own a firearm of a law abiding citizen is against the constitution. People want to be heard and to have our rights. Owning firearms do not make you and enemy- Taking away our rights makes law abiding citizens into criminals. We are not prosecuting people who shoot up with heroin- we are giving them Narcan. Instead we are going after gun owners. Spanking children now gets child protective services called. Have to look at all the wrong that is going on around you. If you take it away from us- you have to take it away from the secret Service and the police too. Can’t do that - it leads to chaos.

Present: Diane Bender, Chairman, Dave Deddens, Jim Helms, Jim Deaton, and Jamie Graf (non- voting school board member)
Alan Goodman was present via phone due to having the flu.
Also present:Sue Hayden, county administrator and minute taker, Andrea Ewan, Attorney Connie Fromhold, Auditor and DCRC treasurer.
Title VI statement read as legally required.
MEMORANDUM OF EXECUTIVE SESSION- EXECUTIVE SESSION @ 8:00 a.m. IC 5-14-1.5-6.1(b) (9) pertains to discussing a job performance evaluation of individual employees. Verified that this was all that was discussed.
ACTION OF EXECUTIVE SESSION- board plans to have another executive session to discuss the employee matters 
APPROVAL OF MINUTES- January 16 minutes approved

It’s so hard to say goodbye

It’s so hard to say goodbye

When I was in high school, my teachers often complimented my writing abilities.
Voted the quietest person in my class, writing helped me find my voice.

But how could I use that voice?
I signed up to write for the school newspaper. I was chosen to serve as sports editor.

But how could my voice go further?
At the time in Cincinnati there was a regional high school newspaper called Brainstorm.
It scared me to death to go outside my little world, but I pushed myself, and a whole new world opened.

At Miami University I wrote for The Miami Student, covering various feature stories and a few City of Oxford council meetings. I spent a semester internship writing for The Oxford Press.

There I learned that I love community journalism.
Being part of a community in that way is something really special. It is not always easy, especially when someone is not happy with you, but it is without a doubt worth it.
Because I would not have found my voice, if the people of Dearborn County had not given me the chance to share their voices.

And I just want to say thanks.
I have been blessed over the span of almost 23 years to be part of this community.

But at the end of this week, I will leave my job at Register Publications.

Looking back I have helped share some amazing stories. I appreciate every single one. It is never easy to open up your heart and life to someone else, but so many of you gave me that privilege. What an incredible gift.

Forever extra special in my heart was the chance to write stories about the men from Southeastern Indiana who gave up their lives for all of us during the Vietnam War. To their families and friends, I am forever indebted for entrusting me with sharing a glimpse into their inspiring lives.

Saying goodbye is not easy. I think of all the stories I am going to miss having the chance to tell.

My kids have needed to bear hug me more than once the last couple weeks to stop me from crying.
And I hate crying.

But I hope to see some of you again on my new path somewhere down the line.
In that way, I can at least hope, you sharing your stories with me will never come to an end.

4 FEBRUARY 2020 DEARBORN COUNTY COMMISSIONERS MEETING NOTES

OLD BUSINESS
911 Communications Board Appointment - Tabled until 911 board meets- TABLED again

NEW BUSINESS
Road Closures for DC Anti Litter Initiative-Celeste Calvitto- Portion of Whites Hill and Portion of North Dearborn on March 14- Calvitto asked for more support to avoid some near misses on those roads from 8:30 -10:30 and 10:30-noon blocked on two separate sections. There are ways around to detour these closures. Sheriff’s office is on board with this. Approved these closures. 

Ordinance to Amend Chapter 32 of the DC Code of Ordinances adding SE Indiana Regional Port Authority- SIRPA- Baudendistel - discovered this doing housecleaning on his files. This was changed to 12 seats by interlocal agreement. Now they are amending the ordinance to have this in our codes of ordinances. Tom Palmer and Terri Randall are the at large county  appointments we have until the end of 2020. Each of the 3 cities has 2 at large appointments for 4 years also. The Mayors of the cities serve as does a Commissioner. Jim Thatcher is the Commissioner and Chairman of this board. Next meeting is March 20 at 1 PM in Lawrenceburg City Chambers. Approved. 

Approval to move forward with RFP for Guaranteed Energy Savings Contract- Sue Hayden- wants to move forward with the proposal. She read the advertisement requesting RFPs until 3/20/20. Thatcher is the contact for this project. Thatcher said they had done an energy audit and they are pursuing some avenues to see if they can improve the energy usage in the county. Approved to place the ad. 

Signature for 2020 Initial Boundary Validation Program for Census- Hayden said the census has sent a boundary CD and Planning Dept has looked at the CD and verified that the boundaries are OK for the county and Probst is heading this up. Approved the validation of boundaries 

ADMINISTRATOR – Sue Hayden- PAWS 2020 Contract- the same contract that we’ve had for past years. Just missed signing  it in January Approved. 

AUDITOR – Connie Fromhold  -Claims/Payroll and January 21st Minutes approved. 

ATTORNEY – Andy Baudendistel- nothing more.

COMMISSIONER COMMENTS- Little- no comments
Probst-  Census workers needed $21.50 /hr for part time flex working employees Job fair at IVY Tech at today and tomorrow
Ohio has signs all over. 45-60 days before election OK in Indiana for signs.
Thatcher- the energy costs can be lowered by half to get LEDs and motion detectors for lights to go on and off at night. Solar is a possibility. But actual return on investment needs to be determined. Expenses for utilities are going up- so put measures in place now. Little said they did cut electric in half at LIONS building and the Food Pantry. 

LATE ARRIVAL INFORMATION

PUBLIC COMMENTAndy Baudendistel wanted to get the word out about a South Dearborn/Lawrenceburg game at LHS  to do a coaches vs cancer event. For 20 years after Steve Blackwell’s death. John Blackwell, his son is in charge.  
Team in Orange and Red uniforms etc. February 21st is the event date.
