Judge Humphrey's Memo to the Bar on Continuances

TO: All Members Of The Bar

FROM: Judge Humphrey

RE: Continuances

The Court has recently received a significant number of continuances filed the day before, or shortly before, the scheduled hearing date. First of all remember that the filing of a continuance does not mean that it is going to be granted. Approval must be given by the Court. Counsel should also be aware of Local Rule TR9.

“Any motion for continuance filed within two (2) weeks of the trial, hearing or other Court matter will be denied unless personal appearance is made by both counsel, in Court, explaining the necessity for the continuance. In extreme emergencies the Court may grant exceptions to this Rule.”

Last minute continuances create significant inconvenience for the parties and opposing counsel. These last minute continuances also create a significant issue with the Court’s calendar. Therefore, counsel should expect that the filing of last minute continuances, in the future, will not be looked upon favorably by the Court.

Honest question: What is the point of this? Really. I am not looking to be snarky. Just curious as to why the judge would want an internal memo meant for a select group of people to be posted here.
Is there a message I'm not getting?

public record info doesn't require anyone to want it posted or not.
judge humphrey seems to be trying to unclog his calendar from continuances.
the previous posting from miller for judge addresses this continuance issue as did some of his earlier posts.
how long do alleged criminals sit in jail at taxpayer expense while continuances go on?

I, too, wondered why Humphrey posted a response. Was he concurring with Miller? Was he slamming Miller? Was he sending a message to voters or to Miller personally or to all local council? And since when do judges bother with blogs? Oh, wait - I forgot. Never mind.

Just maybe could it be that he is unhappy with the way both the prosecutor as well as defense are acting? Or is it that the prosecutor is causing most of this by being unprepared but Humpfrey won;t call him out alone? Hmmmmm
