 25 September 2023 Dearborn County Plan Commission Meeting Notes

Present: Dennis Kraus, Jr., Chairman, Russell Beiersdorfer, Mark Lehman, Joe Vogel, Jake Hoog, Dan Lansing, and Eric Lang( who arrived late at 6:25 PM)

ABSENT: Jim Thatcher, Jeff Hermesch 

Also Present:  Nicole Daily, Planning and Zoning Director, and Andy Baudendistel, Attorney.

Approximately 20 citizens were in attendance. 

Baudendistel read the Title VI statement as legally required.

ACTION ON MINUTES- July 24 and August 28th Minutes (with correction of spelling error of discussed instead of disgust) - Approved 

OLD BUSINESS: none

NEW BUSINESS:

Request: Grand Oak Estates Phase II Primary Plat—13 lot subdivision Applicant/Owner: Seig Surveying / Norb Schmid Site Location: 370 Grand Oak Drive Parcel: #15-01-01-200-001-000.006 Township: Harrison Size: 195 acres Zoning: Agriculture- Nicole Daily presented saying it had been reviewed by Tech Review and there are now NO waivers requested. This is being requested instead of the previous request. There will be a private street as part of this request. The private street can be used for frontage requirements. This has to be 50 ft easement for the private street.The private street will not need to have asphalt. It is set up to be easier to upgrade to the public road standards as the base will be there.  The 13 lots will only encompass 132.9 acres of the 188.927 acre remainder. 34 letters were sent out and and very few were not acknowledged. Rob Seig presented for the owner. This should be easier and our goal was o make it compliant with the code. Next step would be be the improvement location plan after this. Asking for. A favorable vote tonight. 

Lehman asked Seig about the number of ponds- They are the same. Lehman - The stormwater calculations are part of the next step. Any idea of concerns? Not really. Lehman asked about lot 13 pond and lot 9 pond below it and how that would be maintained. If the dam broke? Seig- Try to get a maintenance plan and easement for that perhaps. Seig- They could offer easement and restrictive covenants to cover this perhaps.

Baudendistel told the citizens that if the subdivision meets the subdivision control ordinance fully, then it has to be approved by the Plan Commission. 

Jean Huber- Lives on one of the sides of the street/driveway. There were 4 houses on it and last time- now there are 5 houses.Not a regular subdivision street.  It sounds like we still have waivers. Daily answered her that the developer will be putting it in and it will be gravel. 

Annette Fohl- What happens to the lots at the end at the bottom. Kraus Jr said that because they are panhandles is would be difficulty for them to be developed further. They are =not part of teh subdivision request. 

John Fohl- Confused where the new road will be put in. Nicole- It was shown where it came it at the bend. The original road is 35 years old. It should be on a list to be upgraded or resurfaced. The construction traffic will affect that old road. He wanted to present the need for this to be done. It does have a great base- can they work together to get the one mile paved cooperatively with the developer perhaps. Board explained that they cannot require that of a developer. He did ask that they could convey this idea to the commissioners. 

Joe Alexander- voiced concerns again about the lakes and flooding and run-off. Has been in contact with DNR and they can request for people who live downstream from certain areas to look at that. They cannot require the engineering study now per board as there are no waivers.  

Steve Difiglio- Lives at lot 17 and its close to one of the ponds. Also concerned with the stormwater.Asked about rules that have changed since 1996. He’s trying to understand how the 2 panhandle lots fit in now- were they approved? Discussion of setback requirements on the Martin property at end of Grand Oaks Dr. His biggest concern is the ponds and they are not being maintained now. That needs to be determined. Doesn’t want it to get left out. Daily said it was 25 ft back in the 90s for setback.     

Closed PUBLIC DISCUSSION

Lang asked Seig- Still concerned about the stormwater - have you done any preliminary looks at this. Seig said he hasn’t as that is later in the process. 

Kraus Jr.- The developer is building the street? Yes and they will have water main extension and bonding etc. 

Lehman- what did you want to respond to from the public. Seig said the rules were complied with in the division. In regard to land next to Difiglio- that is not even part of this subdivision request. Everything we did is fully compliant with the code. 

Beiersdorfer- motioned to approved the subdivision. There is no choice as it meets the requirements.Lehman seconded. All ayes Approved.

ADMINISTRATIVE: DEARBORN COUNTY PROPOSED ZONING MAP and TEXT CHANGES – To review and discuss proposed ordinance amendments and updates to the Dearborn County Zoning Ordinance and Zoning Map, specifically with respect to the text(s) of: Articles 9 and 10, regarding Agricultural and Residential Zoning Districts; Article 25, regarding General Standards and new Use Development Standards; Article 27, regarding Definitions.

Daily said she was not doing Kelso tonight as they were to do it in October when nothing big was on the agenda. There is a case where someone was coming in to change a written commitment on access points on Sneakville. 

NO discussion on any of the townships.

Dear Citizens:

 

The next Plan Commission meeting is scheduled for September 25th at 6:00pm.  We do have a case that night on a proposed subdivision along Grand Oak Drive that will probably take up most of the meeting.  At this time we do not plan on discussing any draft Zoning Ordinance text or map changes at this meeting.  With that being said if there is time, the Board will allow people the opportunity to speak, there just won’t be any scheduled discussions at this meeting.

 

I do want to let you know the estimated plan for the next several months for the review of the draft map and ordinance changes.  In September the Board does not plan on reviewing any of the proposed changes.

 

In October (if there are no cases), the Board plans on reviewing all draft Zoning Ordinance text and map changes (the maps would include all the townships at this meeting).  The October meeting is set for October 23rd at 6:00pm.  The Board has not yet made any decisions on request that have been made by the public and I am hoping that they come to a consensus at this meeting to the final look of the text and maps.  But please remember if the meeting last long with public decisions, it could continue into the month of November.

 

In November (if there are no cases), the Board plans on one or two things.  Either continuing with the review of all the draft Zoning Ordinance text and map changes (this would be a continuance of discussions if necessary from the October meeting) OR the Plan Commission could be ready to take an official vote on the proposed changes.  If they take a vote it would be in a form of a recommendation to the County Commissioners.  The November meeting is set for November 27th at 6:00pm.

 

If the Board continues the discussion in the November meeting.  Then the vote on the changes would be scheduled for the December meeting.  The December meeting is set for December 18th at 6:00pm.

 

At this time, this is the best estimate of how the upcoming meetings will go with the discussions of the proposed text and map zoning changes.   I highly suggest citizens who would like to express their support or concerns please be present at the October November and possibly December meetings.  I can not guarantee if the vote will take place at one of the meetings I have listed above, but we are trying to give an estimated time to give enough notice to people.

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.


EXECUTIVE SESSION @ 4:30 p.m.

IC § 5-14-1.5-6.1(b)(2)(B) For discussion of strategy with respect to…Initiation of litigation or litigation that is either pending or has been threatened specifically in writing.  As used in this clause, “litigation” includes any judicial action or administrative law proceeding under federal or state law.


Baudendistel asked for the certification that that was all that was discussed in executive session - Verified by Commissioners.


Action - The Commissioners approved initiating litigation that they had discussed in executive session. 



PUBLIC HEARING FOR REVIEWING AND ADOPTING FISCAL YEAR ADA TRANSITION PLAN -  Sue Hayden presented. Shelton McHenry Hayden and Walton did a walk around the buildings to see if it was compliant. 

There are 4 pay phones that are not ADA compliant  and they removed them as no one is using them - even in the jail. 

Resolution 2023-001 for adopting the ADA Transition Plan  was approved.

NEW BUSINESS


EAGLEVIEW- Sketch inspect (tool addition)- Director of Planning and Zoning, Nicole Daily

Upcoming aerials for Dec/Jan- the new flights are coming then. There is a change in the program.There is software to track changes. This finds errors that might not have not have been caught by permits. The new program works hand in hand with what the assessor uses. 

Accuracy Efficiency and cost savings are the benefits. There was a demo video of how it works. 

$116,113.06 original cost. The Sketch inspect costs about $16,000 more. 

Non compliant properties get increased permit fees. This increased fee is justified by getting properties into the assessor for tax collection. $24,104 in the Commissioners budget. They need $6,000. In next years budget they may have to go to Council. Moving forward for 2025 she will budget the $25,000. Approved.  


Interlocal with Greendale Regarding 911 Dispatching Services- Baudendistel has the first agreement back as Greendale will pay $10,000 for this year to start coverage Oct 1st. $84,000 is next year and more the year after that by built in 5% increase. This year county is paying about 84% of the shortfall as the sheriff office has the highest number of calls. Approved the dispatch for Greendale starting Oct 1. Baudendistel is to be sure the $10,000 gets paid in time.

AUDITOR – Connie Fromhold  -Claims/Payroll and September 5th Minutes- Approved.


ATTORNEY – Andy Baudendistel- checked with Weldon regarding the panhandle lot. Hoping to have quit claim on the hospital property soon. 

Thatcher said he needs an update on Health Dept and the sewer rules for the Building people as he had promised to get info to them before. 


COMMISSIONER COMMENTS: Thatcher-said he visited Little and he’s recovering well. He has a way to go still but is looking better. 


LATE ARRIVAL INFORMATION- none


PUBLIC COMMENT- Tamara Taylor- thanked them for allowing the Community Bridge soiree in Milford Park last week, Raised a lot of money for JCAP. Thatcher agreed and said that speakers were excellent and Garret Bascom was great.

Present: Jim Deaton, Chairman, Dave Deddens, Jim Helms, Alan Goodman, Jim Mansfield, and Daryl Cutter (non- voting school board member)

EXECUTIVE SESSION @ 8:30 a.m. 

IC §5-14-1.5-6.1(b) (2) (D) which pertains to discussing strategy with the respect to the purchase or lease of real property by the governing body up to the time a contract or option to purchase or lease is executed by the parties;

IC §5-14-1.5-6.1(b) (4)(A) to discuss interviews and negotiations with industrial or commercial prospects or agents of industrial or commercial prospects by the Indiana economic development corporation, the office of tourism development, the Indiana finance authority, an economic development commission, a local economic development organization (as defined in IC 5-28-11-2(3)), or a governing body of a political subdivision.

MEMORANDUM OF EXECUTIVE SESSION- stated that nothing else was discussed other than what was advertised.

NEW BUSINESS:

Bayer Becker West Harrison TIF driveway report- Mark Rosenberger- stated they had a plan engineer’s plan. $450,000.Deaton said that is a lot of money and they have other uses for this money. If someone else does it it will be a lot cheaper. Board decided to keep the info for future use. Rosenberger also brought up- Current survey shows some of this property in the flood plane. It may be beneficial to get this out of the flood plane on a section of this. We could move this out of the flood plane with an excavator to get this done. 50-60% of the property is needing to be elevated. The map does not show it but the actual physical elevation does show it. This is how they did it with Whitewater Mill. Board said they need an estimate of the cost to do that. Another comment was just because we have the money does not mean we want to spend that on this parcel.Board voted to get an estimate via Rosenberger. 

Rosenberger said there is definitely an improvement coming to the interchange at 52 and that will help get that to be safer. The east bound on ramp is deficient also ant INDOT would like to see the locals come to them with a design and then they would participate to get this fixed. They want the county highway dept. and DCRC  and they need money brought to the table. Break it into smaller projects and Todd Listerman already knows about this. Helms said this interchange has been a problem since inception. He described in detail the issues and safety concerns. Helms and Deaton will meet with Perleberg ( One Dearborn) and as committee will meet with Hwy dept. Report will be at teh meeting in November.     

Cleanup of 1 acre property in Bright- Deaton said there has been a problem getting it cleaned up.The cheaper guy has not done it. There is an estimate from Chris Drake $3250. This company has been working for DCRC already. Board approved Drake to do the cleanup.The first bidder will be notified by Perleberg that they are moving to another bidder.

Sale of 1 acre property in Aurora TIF- Perleberg said they could approve the ad now or at Nov meeting. Board agreed to wait till Nov. TABLED

Modification of Cushman Wakefield listing agreement- Ewan said they could work on some language with them and send it via email to the board so they can get this moving before Nov. Approved. 

Payoff of Flour Mill bond- This bond is low interest in respect to what you would pay now. Decision TABLED till next meeting.

Report of HOTIF committee-  (Jim Deaton Jim Mansfield Mike Perleberg) - Perleberg - Developing a potential parcel list requested from the county auditor - nothing to review with the board yet. May need expert legal Council. Ewan can get help from Barnes and Thornburg if needed. Approved for Ewan if needed. 

ONE DEARBORN REPORT:Perleberg- READI 2 is funded again with $500 million. We will be prepare for READI 2 and we compete with 14 other regions. Proposals will be due around February and awards announce in April.Three buckets- Quality of Place, Life and Opportunity are considered for the awards.
