Renihan read the Public Access Statement as legally required.

Guilford Project:

Mike Hrezo presented materials for the board. Current cost estimate versus one from a year ago. Actual cost thru July from contingency plus Earth Tek equipment plus, Meinders CH&M bid. The land acquisition cost is off this list as it is NOT in the construction bid. It is a construction hard cost. That comes up with the $5,576,000 and includes the $627,000 contingency. Eng and design, legal advertising and permitting is thru July- $291,967.92.

He also added in costs prior to 2021 as they spent that money chasing grants etc. Board remembers looking at start of ARPA application work. Some of the other money was looking toward the Greendale option. That cannot be included as it is a different project. 

Projected costs sheet changes after July adding just the soft costs. Construction and administration of the contract as job progresses. Sometimes there are a lot of questions and that is why it is done hourly. This will depend on how much you want us out there and in the office. His goal is 4 hrs/day. RFI ( Request for info) can be lengthy at times. $200,000 is budgeted for that for a year. That is 8% of the budget.

They are a little under budget- which is good so far. 

Contingencies needed- underground work and satellite from project and railroad. Thinks INDOT will be done before the project work on SR 1. ( by mid December) Work with less traffic can be easier. 

$191,996- reconcile that after more info in on rate consultant etc. 

Christy can change numbers as needed on her screen. 

Board discussed options.

Original ARPA was 4 million- before expansion of the plant was decided. 

$5,590,000 is now $5,576.000- so $14,000 less. 

Mike Hrezo said both great contractors - low bidder was CH&M and we have used them several times on these type of projects.

More discussion of the separate Earth Tek contract. They are a material supplier per Frank Kramer. We are their customer. Proposal only good for 60 days. Updated contract as of August 21 reflecting this. This is good to Oct 15th. Then $330,000 is due. The deposit of 30% is because of this being an equipment heavy project and they have to pay these people. Copies of this went to Andy Baudendistel as well as Frank Kramer. This is a unique system- not as many people doing it with the underground tanks. We needed someone who could do this kind of work.

Is the price of the equipment including the material and design for Earth Tek. Kevin Chaffee is known in the area for these kinds of situations. They are out of Batesville. They have done other systems in the county.

Commissioner Thatcher left

There is no bond for Earth Tek.

The other bidder was similar to CH&M except for the pump costs. 

61 customers on this project for pumps.

Probst said they HAVE to go to ARPA next week so they can go to Commissioners meeting first Tuesday in Sept. Council then will schedule an emergency meeting. Thatcher is the contact for ARPA. Get with Sue Hayden to schedule. Need to forward a positive recommendation on the contract. 

Cline still wants to meet with Earth Tek to be sure of the down payment time. 

Stenger said- no we meet with Connie Fromhold and see how we can get the payment done.


Present for Hrezo and DCRSD the contracts to ARPA $5,576,000.47 with the low bidder’s numbers presented also. (This will allow the low bidder to be prepared.) Approved.

Cline and Renihan will come down and get with Jim Thatcher and Connie Fromhold. 


Cline- On Dillsboro ( Lake Dildear) the discussion was regarding the numbers. He redid numbers and got to about $11 on HighRidge for examples. Trying to see what the bulk costs could be. $15,000 margin on operation out there at High Ridge. 

Renihan- Bottom line is Dillsboro is the only game out there.

Cline- We need to get a rate that applies to all. Talk to Brock about this. Renihan- Rate is same since 2009. Others have taken a couple since then. Look at Cost of Living. Brock is recommending a 50% rate increase. 

Cline- If board spends $50,000 to add a supt. This would be $39 each to their fee. And if we want to engage SRF for a grant for Moores Hill, We’d have to work on that by Dec 1 to hit March 1 deadline. Board agrees this would be good to do that. 

Mike Hrezo- Dillsboro Lake Dildear - Advertise for bids tomorrow  at paper for 2 weeks from Thursday Aug 29th they can open bids Sept 17th in a public place at Commissioners administrators office. They will email the bids out to DCRSD board and spreadsheet will be before the meeting also. BOARD will essentially decide bidder Aug 19.  Hrezo will have to have the spreadsheets ready that night too.  

Cline and Board working on one or other with bulk rate and remove penalties perhaps. Talking to Brett and Bill about that to get special meeting on Dillsboro.

Renihan - RFP sent out and Barnes and Thornburg should be at Sept 5th meeting. Cline wants to get that RFP from Chris at B&T. Doug Baer will be gone and Stenger maybe too. Worried about quorum. Accountant will be there maybe too.  

Cline still wants to understand cash flow. 

Renihan noted that 2 signatures on all checks and all claims have to be approved at meeting before checks go out. SBOA rules. Health related emergencies could have a check authorized later at a meeting.

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.


OLD BUSINESS

Proposed Zone Map Amendment- Business - B-1 to High Density Residential R3 (Bright)- Nicole Daily- gave an overview with pictures of the lots and the plans for 12 townhomes. Professional Park Drive is a private drive. They have 2 written commitments. Includes that there has to be an agreement with DCRC. Anthony Smart (DCRC Atty)said that Redevelopment had proposed terms and Joseph Henry Construction (Joe Perleberg) had a counter proposal. Now they are close to an agreement. Ordinance 2024-013 to rezone 3 parcels from B-1 to R3 and the maxis 12 townhouses and there is a sixty day window to finalize the agreement with DCRC- If that agreement does not happen in sixty day- then there is no rezone.Approved. 


NEW BUSINESS

Proposed Zone Map Amendment- Heavy Industrial I-3 to Planned Unit Development Mixed Used- PUD- Nicole Daily- There are special conditions for this PUD. It’s density, open space, plus commercial. This is the existing Lighthouse Marina area between 56 Laughery Creek and the Ohio River. It is wholly within the floodway. There are state permitting processes that have to be done before the local permitting processes. 64 townhomes, marina, RV park close to Laughery Creek, and  open space of 45.35 acres. The two streets are to be privately maintained as they are in the floodway.these plans have to go before INDOT that may require turn lanes. Utilities are supplied by Aurora and Rising Sun for electric and sewer. Only 16 units at first as that is total capacity until the sewer service lines have been improved. On July 6th Favorable recommendation. Daily noted that Jurgenson- Rohe’s area next to them is I-3. There will be some notations on the plat to show I-3 adjoining. Plans have to be submitted in 2 years or is goes back to original zoning. It has to be the exact same plans for the PUD. There is landscape buffering. They want to sold also from cars on SR 56. May have a ditch system if INDOT allows. There are alternatives to this is INDOT does not allow. There is a letter from Jurgenson- strongly objecting to this rezone. 

Thatcher said that this letter is probably a CYA  letter in case someone begins to reuse that Jurgenson piece as I-3 and neighbors complain. Jurgenson was there first. .

Russell Beiersdorfer did vote NAY at Plan Commission - against a favorable recommendation. 

Probst asked about the homes and floodway. There is garage under each townhome to raise it out of floodway in addition to the parking areas outside. 

Nicole Daily- The Ohio River has different reg than IDNR that have to do with tourism. If the Creeks off it were involved - this would not have tourism regs. 

There are 6 conditions in the rezone that are included in the rezone ordinance- Approved.    


Jack’s Forever 3 Foundation Run/Walk- Linda Fox This is for Sept 7th in Bright - doing it for 13 years. Sheriff’s dept OK with road closures for this. Approved


Bridge #64 Sneakville Rd REMC Utility Reimbursable Agreement- Sue Hayden presented for Todd Listerman. 80/20 match We pay $103,826.50 and get back  $83000 plus, (80 % reimbursed) Approved

Hayden presented Bridge #215 Brush Fork Rd- Signature Block sheet for this was approved and signed for Listerman. 


ADMINISTRATOR – Sue Hayden- Title VI 2025 Implementation Plan Update- resolution- Approved. 

 And send INDOT the 2025 Title VI assurances that every one of our federally funded programs will include this. 


AUDITOR – Connie Fromhold  -Claims/Payroll and August 6th Minutes- Approved.


ATTORNEY – Andy Baudendistel- nothing. 


COMMISSIONER COMMENTS- Thatcher- acknowledged 5 star rating for St Elizabeth Dearborn. Only 3 got it in the tristate.

Also present: Bob and Mike Hrezo and Christy of Hrezo Engineering, Commissioners Thatcher and Probst, Doug Price maintenance.

Renihan read the Public Access Statement as legally required.

Bids Opening-Mike Hrezo opened the 2 bids. 

Lykins Contracting- $3,855,591 

C& H/M from Milan- $3,155,693

The third one did not bid. 

The equipment purchase is $1,158,150 which leaves budget of $3,520,671.32 for this project at Guilford. 

Minutes: August 11, 2024 Approved

No Treasurers report

Public Comment: 

Josh Davis- Letter received from IDEM permit on the Guilford Project.. Asked where the grinder pump would be located etc. Mike Hrezo said the contractor has bid 150 ft excavation but if it is over that- the homeowner makes up difference. How about abandoning the septic tank? Most part they pump crush and fill in with inert material. This is the homeowners cost. You could use the excavator that installs grinder- but the cost is on the homeowner. What is the rate for the homeowner? Cline said that the rate study should include these new customers and that will affect the rate. Rate is just under $17 per 1000 gals right now. That has been same since 2011- so new rate will be higher than that. Currently my septic is working and it was new the I bought the house 20 years ago. It’s well maintained. Kramer and Baer answered- Can apply for a waiver. No connection fee, no excavation fee for 150 ft, and no grinder pump fee. No electric panel fee. Only now they get this and if you get waiver and hook on later- you pay all this fees. 

There is a minimum usage charge. Unknown as to what that is yet. Have to have that by October at the latest. They will communicate that by letter to the 60 plus customers. Completion of the project will be about the end of Sept 2025. 

Chuck Griffis - have a need for sewer out there on 350. The plans have been approved by IDEM. Waiting to hear from Dillsboro on the treatment and costs. This can then go to bid and in budget. Baer- there were 5 areas we looked at for ARPA money. Your area is not in that funding. Baer said Moores Hill is willing to work with this board. They want a main under 350 and not a bunch of single laterals. There were about 65 homes in that target area. Discussion about trying too get the 14 families plus more to work the out later.

Rick White ( ???) from last meeting- asking when the pump would be available- November 2024 per Doug (who maintains the lines.) Discussion on what alternatives they have as this is too long… There is an option for another pump brand. They have 2 people advising they clean the line. Board decided to Purchase the Liberty Pump for $4,000 and they will accommodate the pump and do a 90 day trial. They will also flush the lines  close to the owner. Approved. 

Nancy Curry - glad we are having this done- but we are having things bubble up with suds - showed pictures. 

Steve Ashcraft- High Ridge- hates his pump- redid it a year ago and it did not last a year. Had nothing good to say about the pump. Doug said he might be a candidate for the Liberty pump- he’s in a high head situation. He has had 4-5 pumps out there. He is concerned with the quality of pumps and it is a terrible design. His situation appears to be an outlier for some reason.  

Project Updates: Christy and Bob Hrezo presented

Guilford- Contract passed out by Bob. Mike and she will review all numbers on bids. Cline thought rates need to be set first. Stenger said they won’t have the rates in time. Cline wants to get ARPA committee to see this. Looks like they have a $350,000 contingency per Cline. DCRSD will meet next Thursday August 22 at 5 PM for compiling the documentation and finalizing the amount to go to ARPA for the bid award.  Approved.

Stateline Rd- Baer asked to get IURC to get description of boundaries for Beeker to draw up.

Moores Hill

Dillsboro- Lake Dildear is ready to bid it out. Kelly totaled all the costs $58,504. 3.6million gals. About 90 customers who do not have it treated by Aurora. Cost was $14.50- $23/1000 gals. We could use this to get a bulk rate? Stenger said they need to go out to bid to see what the costs are? Kramer said to use bulk rate from Serenity Ridge as a measure ? Board decided to move forward with the bids. Approved. 

Cline said he has talked to Mr Brock regarding rates. And would it affect the rate if we hired a supt.? He will bring numbers to next meeting.

 

New Business: none

Office Update: Board had written updates and talked thru some. Decided to return a check to Townsends as they did not buy the lot.

Claims: Boggs and Race to attend Oct 3 meeting. Claims approved. Moved to adjust billing cycle to Mr Lloyd. Approved. 

Discretion of the Board: Barnes and Thornburg to be at first meeting in Sept per Cline. They are to look at the RFP. Stenger said the only discussion in the RFP is moving toward selling them district. He does think we do need help running this “railroad”. We need a superintendent. He wants to see an RFP for someone to help run it. This needs to be part of the RFP. Stenger said he has worked with one of the sewer districts to fix things. If there is a polluting problem then the connection needs to be forced. He appreciates the commissioners coming to all our meetings to see what we deal with. Kramer said - they need to not say force connection - should say that they should show that they have a working system. 

Cline said - some of us want to focus on operating and some are looking for a larger focus. We are all on the same page to look out for the customer. 

Stenger said the timeline needs to be longer for people to think about purchasing the system. It should take more thought. Cline- Clarify advertising process- and make it longer than 30 days but less than 90 days. We want a reasonable sample size. Stenger- maybe we will get some collaboration with other units in the county even. 

Christy said she can get Lake Dildear in the paper by next Friday and open bids by Sept 19th. 

Cline if we agree to RFP in Sept. and if we get 3 legitimate inquiries. We can answer questions. That won’t be together in 60 days. They should be able to get an initial response.  

Fehrman- only one pump left- having difficulties meeting pump requests. These should be in the installers sheds. Starting to see a problem. Several out front repair. Hard to get new pumps. Cline - We could rent a storage unit. Explore an annual contract to do emergency pump replacement.
