 5 JULY 2023 DEARBORN COUNTY COMMISSIONERS MEETING NOTES


Present: Jim Thatcher, President, Art Little, and Rick Probst


Also present: Connie Fromhold, Auditor, Andy Baudendistel, Attorney, and Sue Hayden, Administrator


TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

HEARING on Unsafe Building Order - Bill Shelton, Building Commissioner Unsafe Building Order re: 23342 Stateline Road, Lawrenceburg, IN 47025 pursuant to I.C. 36-7-9 and County Ordinances 154.01 to 154.17- Bill Shelton and Nicole Daily presented. Baudendistel state that this is is owned by Whiskey City Development with Harrison OH. They were notified to their PO Box and returned. Anthony Shroud sp? for them  is listed with an address at Ormand Beach FL address. It was purchased on tax sale by M and M - Mr Ellis- at Seymour IN address. Both were notified and it was received. Baudendistel has had other contacts wit this group. Shelton said 2-3 years ago it was vacated by  inhabitants. He said it is ready too fall down and is not sure what’s even holding it up. This one is worse than Union Ridge because of foundation being accessible as well. There is no sewer there. The property is 0.53 acres.There is probably a septic tank on the property.  That needs to be pumped and filled too.The owners have been ordered to demolish the structure. 

They had a 45 day order to demolish the structure from June 27. It puts it to August and it may be that we should be cautious as the tax sale owner will own it in Sept per Probst.

Commissioners affirmed the order to demolish and that the building is abandoned.


Baudendistel said the Union Ridge property is posted for sale on auctions.com starting at $1. The buyer can go back to seller under civil law as it is under the unsafe building order. The owners are trying to pass the problem to someone else…. 


OLD BUSINESS- none


NEW BUSINESS

Matt Jarvis, Chris Powell, and Kyla Dick- Soil and Water District --  passed out the 2022 finances of the district.They appreciate the budget the county provides. For every $ from county they provide $20 in services. There will be a new Farm Bill in Sept. 

Kyla Dick- Rain Barrel Workshop and Cost Share workshop in August and Regional Conservation Council Sept 22  for OKI and a Field Day in Sept.


Barnes and Thornburg Engagement Letter- Baudendistel This is to pay for services for DCRSD and it’s been signed by them. They will be representing DCRSD and the County has no involvement other than paying for the attorneys per Thatcher. Renihan has been sent the letter. It was not sent to anyone else or the DCRSD attorney. Barnes and Thornburg will be here Thursday and DCRSD meets Thursday night at 5PM. Rick Probst will attend the meeting. He will give the signed one to Renihan tomorrow night. Thatcher noted that there had been issues with other board members not getting everything that Renihan had received. He wanted to be sure this was communicated to hem all.  


2024 OKI Funding Contract- Sue Hayden- $16,875. This is based on cost per capita and the rate has not change in 20 years. Census results varies the total. Approved.  


ADMINISTRATOR – Sue Hayden- Title VI 2023 and ADA Implementation Plan and Resolution. With the new law passed they have hired people at INDOT to monitor this. We did this in 2012, 2016, and 2018. Now we are being told that it has to be updated annually and adopted to Commissioners and sent to INDOT. The meeting notice for this read at each meeting is part of this. For example updating included voting online for the blind or otherwise disabled. She got it done tis year and there are assurances added to the document that they will not discriminate. Assurances approved. Resolution 2023-007 that puts that 2023 plan in effect was approved. 


AUDITOR – Connie Fromhold  -Claims/Payroll and June 20th Minutes.  Approved.


ATTORNEY – Andy Baudendistel- nothing more


COMMISSIONER COMMENTS

Little- Hopes that everyone out shooting fireworks was really celebrating Independence. 

Thatcher- tries to teach the kids about July 4 and they liked teh smoke bombs as they could run thru the smoke. He ran thru it twice.
