26 February 2019 Dearborn County Council Meeting Notes
Present: Liz Morris, President, Dennis Kraus. Sr., Dan Lansing, Kevin Turner, Tim Doll, Alan Goodman, and Bill Ullrich.

FEBRUARY 26 MEETING WILL TAKE THE PLACE OF THE APRIL 2ND MEETING UNLESS NEEDED FOR OTHER BUSINESS.

Morris welcomed new member Tim Doll who replaced Charlie Keyes.

COUNCIL APPOINTMENTS
Ullrich to CVTB board.

CIRCUIT COURT – Judge Humphrey
Additional funds for major trials in 2019- not going to happen until later this year. Some costs will go to 2020 also. Part time employee assists 2 days a week. transferred funds and salary savings helped pay for this. Transcription costs used to come out of part time wages- now cannot do that. Request was reduced to $7500 instead of the $25,000 requested. 
Transcript preparation- will need $20,000. One major trail takes 2.5-3 weeks. This will be expensive. There are 4-5 other trials they expect tis year. Petit jurors and their meals also needed. 5 day trial costs about $10,000. If there is a change of venue- the county is still responsible for the costs. Approved from Riverboat Revenue.  

COMMISSIONERS – Jim Thatcher
Transfer $3,000.00 from acct. 13600 (workers comp) to acct. 36113 (human resources consultant)-  to begin work on the employee handbook and update it. Approved. 

CORONER – Leah Bailey presenting
Transfer from Coroner services to Part-time- to payroll account to cover part timer wages. Approved.

CLERK – Gayle Pennington- Clerk of Courts
Voting Machine- Needs the money set aside for the machines as the bill for $462,000 came in January. She requested less than this- so she is using savings in other accounts  $42,000) to cover the difference. The cities and towns elections this year will use 4 vote stations counting the one at the courthouse for absentees. Only ballots bought were for absentees. She’s going to take the machine to nursing homes. Approved the $420,000 that was advertised and planned for this. 

911 – Jared Teaney
Grant- federal government issues Next Gen 911 grant - Indiana received $2.8 million - want to apply for grant to update 911 CAD and GIS data. They will need a 40% match later. Plans are to take 40% match out of 911 funds. Grant applied for $113,736.58 Match is $45,294.63. Approved to move forward with the grant application. Ullrich complimented Jared Teaney on the state of the art work he’s done. Teaney said he has a good team.

Park Board – Doug Berger presented
Grant – Bright Meadow Park $100,000  from Dearborn Community Foundation to replace the old playground at the park and the equipment cannot be repaired. No county match.
Grant – REMC- asking for $1000 from their rounding up program funds. This is to help remove trees from the storm damages and ash trees. No match. Approved. 

AUDITOR – Connie Fromhold
Minutes from Jan 2 approved.
Salary ordinance needed to be updated for 2 employees as a housekeeping item. Approved. 
Lawrenceburg Economic Development Board Appointment- Council decided to not appoint someone and allow Lawrenceburg to fill that position. 
Couldn’t get answer from the assessors office. Hensley showed up later to tell him that they hire the assessment out. 
Morris explained that 25% of the properties in the county are assessed on a rolling basis every 4 years. She said they don’t single out areas. But it is done across 4 years. She said hers went up too. He said he had gone before the review board. He had a barn that is ready to fall down and can’t be insured so it shouldn’t be worth that much. 
Jim Thatcher- let him know that he was reassessed in HVL also.

19 February 2019 DEARBORN COUNTY COMMISSIONERS MEETING NOTES

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.
OLD BUSINESS- none

NEW BUSINESS
Grant from DCF - Park Board VP and Steward of Bright Meadows Park, Joe Rettig - to seek a Phase 2 grant to remove existing playground set in Bright Meadows park and enlarging the play area surface to 3 times the size. Cost for the new set - $108,000. Labor to remove etc has to be worked out still. Total request is $100,000 grant. The commissioners gave permission to approach Council. 
Doug Berger- President of Park Board for an REMC Round-Up Grant $1000 to cut dead and dangerous trees and storm damage. Approved to approach Council for this grant. 
Park Board is looking for a Democrat to fill an open position. There is a House Bill that may remove this requirement for the Judge’s appointment.
2019 Grant Review and CASA Update- Director- Bevin Wassenhove- passed out information $41,209 in the fund. One Family and Big Brothers and Big Sister, DC Prosecutor’s office, Juvenile detention and Adam’s Art supply, JCAP, DC Court Services were all grants. Approved.

911 Director- Jared Teaney:
NG-911 Grant ( NG=Next-Gen) Updating 9111 standards and modules in their CAD system. trying to still get pricing back from vendors for this. There is a 40% match. Approved to approach Council. 
Smart 911 Renewal - last year was $20,400 and now is $21,028 and a 3 year option with a 4% discount.5 year gets a 7% discount for $20,300/year. All landlines are automatically in the system. Cell phones have to sign up. Approved a renewal for RAVE 911 for 5 years.  
Contract with Centurylink for 911 Circuits and ALI Database - this is necessary since switched 911 providers- $944/month which is a $700 plus reduction. Previously was $1668/month. Approved.   

Ordinance Pertaining to Recording Fees for Dearborn County Projects- Recorder, Joyce Oles - Baudendistel presented as this was for Listerman because county projects were being charged for the partial mortgage releases. This removes that fee for county projects. Tabled until March 5th so Listerman can be present also. 

ADMINISTRATOR – Sue Hayden- bonds for several county officials that have to be signed by Commissioners. In the future they will look at a cost savings for these items after this year. Signed and returned to the Recorder. 
  
AUDITOR – Connie Fromhold  -Claims and Feb 5th Minutes- approved.

ATTORNEY – Andy Baudendistel- went to David Hewitt Chief of Police for Rising Sun’s funeral and had a proclamation for his 27 year commitment to public service. Commissioners accepted and signed.

COMMISSIONER COMMENTS- Art Little - says spring signs are coming up.
Rick Probst- Last week we closed 2 roads for dangerous slips. Take detours- avoid those roads. Working to get those back up. Jim Thatcher said Salt Fork and Union Ridge are really bad slips. Rain will delay the repairs.

IC §5-14-1.5-6.1(b) (2) (D) which pertains to discussing strategy with the respect to the purchase or lease of real property by the governing body up to the time a contract or option to purchase or lease is executed by the parties.  And also, IC 5-14-1.5-6.1(b) (4) to discuss interviews and negotiations with industrial or commercial prospects or agents of industrial or commercial prospects by the Indiana economic development corporation, the office of tourism development, the Indiana finance authority, an economic development commission, a local economic development organization (as defined in IC 5-28-11-2(3)), or a governing body of a political subdivision.  
Title VI statement read as legally required.
ACTION FROM EXECUTIVE SESSION- Memorandum of certification that only the items advertised were discussed at the executive session was read and approved. No action was taken regarding the executive session. 
APPROVAL OF MINUTES- November 19th were approved, December 5th were tabled due to lack of quorum from the attendees who were there, and January 10th minutes approved.
CLAIMS AND FINANCIALS:
Financials passed out by Connie Fromhold to show what was in each account.
Whitewater Mill TIF claims:- $10,000 to Unity Scientific for Nagel Bakery (previously tabled item) and $198 Barnes and Thornburg for work on incentive questions were approved pending proof of payment from Nagel for their portion of the Unity Scientific item.
$20,000 One Dearborn Invoice / 2 quarters split between all TIFs equally at $5,000 each- approved pending the report that will be attached to the claim later today.
UNFINISHED BUSINESS:
Hirlinger Chevrolet Update- nothing new from them per Deddens.
EDA with H Nagel and Sons- Ted Nagel signed the Economic Development Agreement per Terri Randall. Ewan has reviewed it. This will be signed when this gets printed for all of them at the next meeting. Randall said they are needing WorkForce 9 to come out to help get employees from Indiana.
Billboard Contract Update- Received Wingate’s agreement with 2 year payment. Super 8 and Best Western is out. Best Western wants a reduction in payment owed thru last Thursday due to foliage blocking her sign. Shelton has not responded. Approved. This leaves 2 full and 1 half billboard to market. 
School Boards Request Response- Deaton said legislation is going on that could affect this. Randall said the new statute requires that they have an annual report and budget for the TIF proceeds. She has prepared the letters based on what Aurora and Greendale already do. Each will receive that letter. Deaton said that doesn’t include the income sharing idea school boards are wanting. Deddens said Sunman Dearborn wants to look forward and want some sort of promise that if new business comes in - they want some sort of share in the TIF money from the new ones.
Randall is looking at funds for students of manufacturing etc at IVY Tech or vocational schools. The law allows up to 15% of share revenue for this type of eduction or training. You have to be fair to all school in your district. It’s only for capital improvements or career advancements. They only have 2 school districts in the DCRC area. Lawrenceburg apparently is under the city’s purview. Ewan said that this discussion has already been had and read the January 10th minutes to make her point. 
Jamie Graf said there are 3 major areas in Pathways to graduation. Advanced Manufacturing, Culinary, Business, etc. They have like 16 pathways. They do not rely on ISTEP test passing to graduate. The state is recognizing the need for non- college vocations. Two questions: Do you want to give money and how much? Deddens asked if Greendale had any written agreement with Lawrenceburg and South Dearborn. Randall will get that from Al Abdon.
Alan Goodman has a philosophical issue with funneling it through the schools. Graf said that it would reach them earlier if they got them in the schools. 
The board will try to have a philosophical answer by the March meeting regarding whether they agree to fund this or not. Goodman said his decision is made so he can state  it by then.
Randall noted that township and fire protection issues are out there also. Discussion regarding mixing schools with townships at a meeting. 
Decided to meet March 14th at 2 PM to get board attendance. Randall will send out notices. They will meet in April 11 at 8 AM for the funding for schools.
Board approved her sending out the letters for that meeting.

5 FEBRUARY 2019 DEARBORN COUNTY COMMISSIONERS MEETING NOTES

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

OLD BUSINESS

Request to Approach Council /Purchase of Fuel Prover- Bill Shelton, Bldg. Commissioner- personnel change and need someone in weights and measures. They measure the fuel with this equipment that will fit in back of pick up truck. You can pump 16 times at each bay and the job becomes easier. $32,000 for this prover. Using the trailer mount version would save money but be harder to maneuver in gas stations. It’s about 1000 lbs. He has storage for it when not in use. Usually do this testing in moderate weather parts of the year. Stainless steel. Insurance costs not too bad. Savings from just using a part time person would pay for this in about 4 years. This is a model that is cheaper than the original one proposed a while back. Approved to go to Council for this item.

NEW BUSINESS

Interlocal Agreement With Town of West Harrison, IN- Mark McCormack Director Planning and Zoning- This is for the Plan Commission for the County to act as their Plan Commission. The rest of the agreement is the same as what we were already doing. The agreements are perpetual with a clause for termination. Commissioners approved the agreement ands signed. 

Travel Status Advisories from 1/19-20/2019 Jason Sullivan, EMA Director- Retroactively approved the Orange and Yellow travel advisories. Approved.

Highway Engineer- Todd Listerman:
Bid award for paving- Jan 23rd- opened bids for Community Crossing Grant Project- Rohe bid $2,134,309.95  O’Mara bid $2,042,386.00 Commissioners awarded the bid to O ‘Mara  as lowest bidder.
Condemnation for Bridge #5 Laughery Creek Road- Parcel 3- federal aid project and one of the property owners is seeking legal council and her attorney doesn’t agree with their offer. He didn’t want to refute their offer. They are $9,000 apart. It’s 1.4 acres. DNR is requiring tree plantings to offset what they are removing. Offered $3400 in the flood plain. The county is filing condemnation with the commissioner’s approval. 
Baudendistel updated on the status of court work on two other projects on Stateline ( Bentles) and TurkeyPointe ( Donaldsons) Roads. 
Bridge #76 ( Jameson and Losekamp Roads) Construction Inspection Contract- Low bidder FPBH for $32,125- Approved and signed.
UPDATES- Listerman got a letter from INDOT for ll the projects they are doing in the county for the next 18 months. They will send to Register Publications and is also on INDOT site. One of the big ones is Down by the LaRosa’s and Cinema etc for ease of access. 
They will also be going to road school. during the meeting in March.

Resolutions and Quit Claim deed for properties in Aurora Guenevere Emery Aurora- Baudendistel presented the 5 parcels on Conwell Street. Aurora passed their resolution and this is ours to complete the process. They will be assigning the tax sale certificates for the properties. Approved. The other resolution allows the property to be transferred with no payment to Aurora Redevelopment Commission and then they also signed a quit claim deed. Emery said the plan will include 9 parcels in total for housing development. They have taken out blighted properties. She referred to the properties as rectangle pieces in a series like the keys on a piano. They have met with interested developers and the city of Rising Sun on how their development has proceeded. They plan a staged development. Proposed single family cottages. There was over $75,000 in uncollected taxes on these properties. 5th street is also being considered for another development. It’s a hillside there though. Approved the resolution to transfer the property and the quit claim deed. 

Resolution Establishing Reimbursement Policy for EMR/EMT/AEMT or paramedic training - Baudendistel said there was a fund for people to obtain this training, This is a policy hat Commissioner Thatcher put together for this. The training fell by the wayside and so now this will get that set up again. Approved. 

Dearborn County Jail Health Care Services Contract- Quality Correctional Care with 64 out of the 92 Counties in IN. This replaces our old provider. Yearly cost is $259,550 in equal installments. $30,000 savings to the county. Shane McHenry presented. They do not include mental health services. He likes this company as they are an Indiana company. They are 2 hours away. Ownership can be there quickly. They have good recommendations from the other sheriff’s who use them. They will see what the inmates are eligible for in terms of insurances. This agreement starts March 1st. 90 days notice needed to raise fees or change terms. Otherwise it automatically renews. Commissioners approved and signed the agreement.

Juvenile Center Doctor and Nurse Agreement-Sue Hayden presented for them. Doctor- $11,133 per year. Nurse- $12,742/year. Approved. 

ADMINISTRATOR – Sue Hayden- nothing more

AUDITOR – Leah Bailey for Connie Fromhold  -Claims and Minutes from January 15th Commissioners Meeting approved.
Revenue Sharing Agreements- for Fire and EMS units were approved.

ATTORNEY – Andy Baudendistel- employment separation and release agreement January 30th signed by employee and the commissioners had to sign as well. The unnamed employee voluntarily agreed to it as well.  Approved. 
Wilker property hearing- and Bob Hrezo engineering was with him. Hrezo will have till Feb 21st to get his timeline to him. The performance bond will need to be posted for the receiver. Two people who looked at it were not willing to be appointed a receiver. Court resume later. 

COMMISSIONER COMMENTS- Probst- where are we on winter cleanup for salt? Tim Grieve said they were getting the salt in and Probst thanked them for all their work. 
Little- said thanks to highway. 
Thatcher- thanked him for waking him up and making him aware of what was going on with the weather and safety. 

LATE ARRIVAL INFORMATION- Bill Shelton- Ford Ranger that the county can use. Grieve can use it with highway work. They will work thru Sue Hayden to transfer. it.

PUBLIC COMMENT- Chris Mueller- discussed the highlights of the presentation form Hoosier Environmental Council on the fly ash problem on the old AEP property owned by Tanners Creek Development LLC. Had noticed that none of them had attended the meeting and so unfortunately they did not get to hear an understandable assessment of the issues and what it would take to make the water safe. Thatcher said he understood IDEM was waiting for response on their Dec 3 letter and there was a 60 day limit. He also noted that we need to let IDEM and the Governor’s office know if we want to effect a change. Wanted to know if they had gotten notices then. Hayden told him these mails are variable in getting to the officials. Baudendistel said they had an old email address for the mayor of L-bg in the past. He said it appears that IDEM is doing their job as they notified Tanners Creek Development had been notified. So they know they have to abide by the newer standards. I noted that the conclusion of the HEC meeting was that they have to dig it up and move it to a secure and safe site.
I said it may not be our fault that its there BUT it is our fault if we do not clean it up. We cannot depend on someone else to do it for us without being watchful and keep on it to be sure its done right. Flooding is a huge issue with this problem. And there are other pits in our county that need to be looked at too. I’d like the letter showing their response to the IDEM letter to be made public. Suggested they read the local paper article on this too. 

Denise Klump- Question on the Wilker issue- did they look at the drainage issues in their figures- Quotes may not cover what is needed on exterior issues. More in court.
