Present: Dennis Kraus, Jr., Chairman, Russell Beiersdorfer, Jeff Hermesch, Mark Lehman, Joe Vogel, Jake Hoog, Dan Lansing, Jim Thatcher, and Eric Lang

Also Present:  Nicole Daily, Planning and Zoning Director, and Andy Baudendistel, Attorney.

Approx 20 citizens were present  

Baudendistel read the Title VI statement as legally required.

ADMINISTRATIVE: Dearborn County proposed zoning map and text changes. Nicole Daily presented the information and reminded them of what was in their packets regarding the maps and text on Residential and Ag zones. She noted that Lawrenceburg Township people were present tonight. 

Opened Public Discussion - 

Lawrenceburg Township

Terry Sawyers- Carrie Drive- wants to leave her property in Agriculture Zone, and not the proposed residential one. Sewage stops short of their farm. Several lots on the old 30 acre Gensheimer subdivision plat there are in easement for the towers 1,2 4,6 and 2 others, and the barn and other buildings are using up other lots there (16-19). She gave them the USDA letter verifying their farm and crops. The total farm is 90 acres.  Lehman and Lang quizzed her regarding the subdivision that is on the books but does not meet any current requirements so it will never be developed. There also seemed to be a concerted effort to state that Sawyers can still farm no matter the zone. [NOTE: So why do anything at all??? People can just do whatever they want. Doesn’t sound like much of a plan to me.]

Chris Mueller- Pribble Road- Presented on our 137 acre family farm and the latest Public Proposal that the staff presented. Noted that the zone change criteria had been answered in our presentation and is in their packets. Also remarked on the reason my neighbors needed to be notified (by me , since the Planning Office wasn’t doing it) that the proposal had changed for them as well as for us. Also asked what the future would be for this in terms of what they do after they decide what we will be zoned. Kraus said they had not done anything to decide about this. I stressed that we would like to have an answer so that we can go on and plan our future for the farm. [Note: This is a frustrating process]

Steve Perrine- Lawrenceburg Township - reiterated his request again also. Does not want his property to be split up ever. Wants to stay Agricultural.

Kraus, Jr. - At some point we have to say what we are  going to move forward with. It takes time- government moves slowly. 

Caesar Township- no one 

Clay Township- no one present- but Lang talked about a property that abuts Industrial and is  partly R. Just calling attention to it and noting that they wanted the rest of their property to be zone residential. Kraus said this is a request to up zone without the oversight of a hearing and a zoning request. The PC wants to have negotiating power over the possible development. This site is near Lischkge property. No more comments on Clay township. Lang noted that there was a lot of industrial along the strip and he knows his uncle and another person he knows out there that might be wanting to go to Ag out there. He asked to let him know when she has researched that area so he can see if those people want to come in to voice their opinion.

Washington Township - discussed property that is zoned R now and it was proposed to go to Ag, Sewer maps were provided to show that they should stay R. This is Meinders property and it had a previous proposed subdivision for it several years ago. 

Jeff Meinders wanted it to stay Residential. He noted that it might be wiser in the future to build up and not out to preserve more land. 

Center Township - included Aurora zone map as there are some properties to look at that adjoin  the city. 

Brett Fehrman- did not want to go backwards. He is surrounded by Aurora on 3 sides and residential - so wanted it to be zoned Residential. R-1 would be best as it has some flood plain there. He had sought advice from the Planning office and Dennis. It is currently zoned Ag. When it floods he gets into a boat and goes down Park Ave. It goes under water at about 53 ft.

Sparta Township - There was a subdivision there with lots that someone wanted the 2 larger lots to remain Ag. 

Hogan Township - Had no paper requests on this. Some people questioned the Ag Homestead  and they have not followed up with specifics. There are 3-5 acres off Old 350.There is nothing in the packet but someone spoke a couple times at the meetings. 

Kelso Township- will have more info on this for next meeting from Daily. 

Greg Hyland- 160 acre farm on Hyland Rd. We were here in June and want to see where we are  in the process.Want a timeline for decisions etc. Doesn’t want to be asleep at the switch. Citizens don’t want to have something happen without  them. Kraus explained that in October they can finish the townships. Can make a recommendation to commissioners in November. Hyland- The community has spoken- at some point you will have to make a decision. Lehman- We have to adopt the text first. And then the maps. Commissioners have the final decision.

Manchester Township- no special requests from there. 

York Township- they did have one from there Lyness- requesting Ag Homestead because of the number of allowed lots allowed in Homestead was greater. Lyness was not present tonight but his submitted items were in the packet. Minor subdivisions have been eliminated from Ag now. Kraus noted that this was not a development- but wanting to be able to divide for family. 

Miller Township - some requests along Georgetown Rd due to number of animals allowed. Once the text was changed they were fine with the changes. This was corroborated by emails they sent back per Daily. Lehman asked- Large farm - 160 acres- by Caseys and up against HVL- zoned R2. Is he currently zoned R. His use is different. Do we want to keep that R2 but do we want to keep that R? There is just a panhandle for access. Asked about a PUD- HVL never came in for a PUD- Only PUD we have is Sugar Ridge. If HVL is the only one who can build an R2- shouldn’t they come in to us for a zone change. They have to decide if R-2 or not there.

Jackson Township- nothing new in packet on this either. Primary changes are some are now Ag Homestead.

Harrison Township - nothing new on this township.- had missed a condo development early on bit that was fixed a while back. (By Southpointe.) Kraus asked- about a 50 acre Ag piece that is currently Ag- do we really want that to be R? Thought there was no sewer to them. It’s not flat. Where Jamison drops down. Just pointing that out. Even around the condos is zoned Ag. Something to think about. Lehman asked if it should be Ag Homestead? Kraus said relatives out there - that’s why he knows about it. One driveway is the only access etc. Research a little on that.

Logan Township- Whites Hill Rd had an actual rezone on it. Part of Hidden Acres was not included- and so she fixed it. So they were added to the part of the overall subdivision. Discussed a few other properties and golf course. 

PC Board was told by Kraus that Grand Oaks revised their plat to not require any waivers and are bringing it back in for September? meeting. Without waivers, if it meets the ordinance it will have to be approved. 

Per Kraus- October meeting is  when they will have Kelso Township discussion. With a November vote hopefully. Meeting is the Monday after Thanksgiving. 

Greg Whitaker- asked for clarification on how to get minutes- and if they follow Facebook replies etc. Asked for minutes (and I spoke up and added- agendas)  to be on the county website. There is an obvious need for people to be able to access materials and results in a timely manner.

Dearborn County, Indiana accepting proposals to develop downtown Bright site


(Dearborn County, Indiana) - The Dearborn County Redevelopment Commission (DCRC) is welcoming residential and commercial developers to submit proposals to develop a site on Professional Park Drive in the Bright community in Harrison Township, Indiana.

A Request for Proposals (RFP) was issued on August 16, 2023 by DCRC in regards to four small, contiguous parcels totaling approximately 1.0 acre in size on the west side of Professional Park Drive between Business Center Drive and Megrue Drive. The undeveloped lots zoned for Local Business are located in the heart of the downtown Bright commercial business district.

The property recently appraised at $160,000, however, DCRC may consider selling the property below market value for projects bringing benefit to the Bright area and creating a return on investment for Dearborn County. Proposals must be for the development of the properties as a commercial business or multi-family housing such as apartments, townhomes or condominiums. Developers must be willing to enter into an economic development agreement with DCRC regarding construction timelines, project investment, and design.

Proposals are being accepted through Friday, November 3 at 4:30 p.m. and must include preliminary designs, quantities with detailed estimates, proof of financial security, and a portfolio of their past projects. Bidders must submit their proposals to Dearborn County Administrator Sue Hayden and One Dearborn Economic Development.

ADMINISTRATIVE  DEARBORN COUNTY PROPOSED ZONING MAP and TEXT CHANGES – To review and discuss proposed ordinance amendments and updates to the Dearborn County Zoning Ordinance and Zoning Map, specifically with respect to the text(s) of: Articles 9 and 10, regarding Agricultural and Residential Zoning Districts; Article 25, regarding General Standards and new Use Development Standards; Article 27, regarding Definitions. 


We will be holding another Plan Commission meeting on August 28, 2023 at 6:00 pm at the Dearborn County Government Center (Courthouse) to continue discussions on the proposed draft changes to the Zoning Ordinance text and zoning map.  The last couple meetings have been focused on the zoning map and the Board will continue those discussions.

 

The Board acknowledged last meeting that they would be starting with Lawrenceburg Township, if there is time to discuss other townships we would either do one or another means of deciding;  poll the people that are at the meeting for their township or go in an order from Southwest corner, to the east moving across the County township by township west to east and south north.

 

If I were to give a possible order of the townships for the next meeting it would be the following (there is no guarantee this will be the order in which the Board chooses to discuss but it will be the outline I propose to the Board):

 

Lawrenceburg, Caesar Creek, Clay, Washington, Center, Sparta, Hogan, Manchester, York and Miller.  We will try to get through as many as possible as there are no filed cases on the agenda (this is all administrative items), but we may have a case in October so we would be limited to the number of Townships we could discuss in October.

Minutes: August 3 Minutes approved. Baer abstained as he wasn’t at the meeting.

Treasurers Report: Financials were passed out. Baer is going to talk to Kelly about separating money out for different projects- just has not had time yet to get worthy her. Cline was asking to be sure the money was accounted for easily for each project. Financials approved.

Public Comment: Paul from Moores Hill Sewer- brought Mary McCarty from SEIRPC came to discuss grant opportunities for Moores Hill. They are in the preliminary discussions. They have to have cooperation as they are not planning to annex. There are close to 50 homes needing to be served. Funding with OCRA is what comes to mind. Income-wise she knows Moores Hill qualifies - just needs to see if these properties do as they are outside their town. $500,000 - $700,000 is the money available in the past. The next funding cycle is due Dec 22nd. For 2024 grant cycle it’s June and December. This is a super competitive grant program. Minimum match is 20% and more is needed to be competitive. US Dept of Agriculture Rural Development and Indiana Finance Authority are other options. Logical next step is to get the residents together in Sept-Oct to discuss the targeted area. The project is $1.2million per Cline. McCarty wants to see the preliminary engineering study to see if there are some other paths. Income surveys have to be done. In the past, the DCRSD has not done well with income surveys per the board.Cline said- Christy will get them the map and then existing engineering report. Next step will be to see what the town wants to do and set the scope. Best we can hope for is a $700,000 grant. Doing projects outside the towns or cities is the norm. Fehrman said- that’s why annexation might make sense. 

Dean Duff- resident of Georgetown Rd- daughters are looking at the Coates property by the Guilford project. Wanted to know the timeline. It will be a lateral to the firehouse. It would be 1.5 years before it’s in the ground. 

Mr Bill Neyer- Fehrman introduced Neyer as the current Mayor of Harrison and runs VRUC in HVL now- He is a Class 4 operator. Bill Never is one of our sewer district options and VRUC could handle our billing to help us run more efficiently.The Board of VRUC is on board with that idea. Cline said- we can ask our consultant about this and how to operate our existing system. Neyer said they used USDA Rural development of maybe IFA for a water project. They also have a loan for 20-30 years with a $500,000 a year payment for that loan. They have 2200 homes on sewer and 1800-1900 homes on water. You need a field crew to fix things. He worked for 2019-March 2020- for Envirolink. He was there during the privatizing of SDRSD. They made a proposal to run our railroad per Fehrman. Neyer said- They have SDRSD and LMH, and small operation in SE Ohio- Most support is out of North Carolina. They would have to have someone here with boots on the ground to manage day to day and field operations. SDRSD has 2 employees there now from Envirolink. Fehrman said they haven’t talked to lawyers yet. 

Project Updates: 

Guilford- Cline said Christy has put together a letter that clarifies the sizes of treatment plants. She has spread sheet detail that went to ARPA committee. $8.99 million. $545,000.

ARPA meeting today and Cline said $8.28 million let and we are looking at using $8.2 million of it. Worried about exceeding that once bids come in. $2.5 million is already approved through Council. They want to proceed with 100,000-gal treatment plant. Sewer district and Council to share if it goes over that. We have $500,000. There is a $600,000 contingency. Cline said the opportunity to put in the 100,000 gal plant  is more important than the possible  $200,000 excess cost.   They want to do it now and that’s more important and with the contingency we could watch it closely and get it done. Cline said they were clear that $500,000 is all we have- and Beiersdorfer said- we have to have some working capital too. 

Beiersdorfer said- Dilldear is already approved- so that should move forward. 

Cline said- Note in our minutes should state that the DCRSD will have to supplement any overage.They will be responsible for overages on Lake Dilldear too.

Board approved the possibility of having to pay any overages on these projects once bids come in they will know more.  

Some discussion of pumps and repairs in various places in the county.

Harrison TIF/Stone Project - meeting tomorrow with a company and Perleberg of One Dearborn and they want to know capacity issues out there. They can check with Jim Wesley of Harrison to get the number. It’s a large line.

Serenity Ridge Tranquility Court

Moores Hill- already taken about this above.

Dillsboro- Lake Dildear-already discussed above. Cline got a VM from Watson. They committed at a working meeting that our rate will be based on our percentage of that. They are working out penalties with time to fix a problem before instituting a penalty. Cline wants a timeline for this project similar to Guilford from Hrezo. Approved to get that. 

Cline wants to have invoices with projects allocated on them - for Hrezo and for legals.This way they can allocate the money out of appropriate fund. They agreed to do this. 

Cline asked board to get questions for Barnes and Thornburg together so he can put them all in a letter to the lawyers and see about having a meeting regrading what our options are with selling the DCRSD or not and what their experiences are with these types of issues in Indiana. 

Kramer is going to get with the railroad and ask them to let him know where we stand there on Guilford. 

Fehrman is trying to get a list of the DCRSD assets. They need to get thru files from way back in the office per Bill Shelton. It goes back to when Vera Benning was handling it. 

Sewer rules changes per Baer- holding tanks can be a permanent solution for pump and haul now. There could be an on-site sewer management district. It’s still up in the air. IDEM has to get and NPDES permit re-established on a county by county basis. This will take time. They will hopefully come up with a model ordinance from IDEM. 

Doug Baer said they no longer need a secondary septic site per new state code. Have till Oct 1 to get anything in ordinance reviewed by tech review committee at state. This will affect P/Z and BZA. So ordinances may need to be reviewed and/or changed to reflect these changes.

Present: Jim Thatcher, President, and Rick Probst

ABSENT: Art Little (just back home from hospital) with 4 blocked arteries. They found a small calcium deposit in the upper part of his aorta. Keep him in your prayers,


Also present: Connie Fromhold, Auditor, Andy Baudendistel, Attorney, and Sue Hayden, Administrator


TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.


OLD BUSINESS- none

On 19891 Union Ridge House there is an agreement with Gunter Excavating. The title company was also notified that the court order has been signed by Judge Negangard  to allow the demolition. Commissioners approve the demolition  $14,800 approved for Gunter Excavating to remove the building 


NEW BUSINESS:


Litter Initiative Road Closure- Celeste Calvitto- Georgetown from Fairway to SR1- October 7th from 9am-12pm- HVL people have been helpful with other cleanups and  will help on this too. There is no rain date for this. Approved. 


Permission to be on Cemetery Property- Samy Norris, Director of Programming Archaeological Research Institute- Identity and preserve local archeological sites. The goal of the tour is to look at other sites than the Guard property - they want to take 10 people at a time to the Guard  Cemetery and the Hayes family too.. They will only be walking- no digging. Approved by Commissioners. 


2023 City of Harrison Interlocal Agreement for Fire Protection Services- Sue Hayden $149,448 is the cost for the year. They have fire trucks that go out on all runs per the Fire Chief. Thatcher told him about the LOIT passed this month to give them a heads up on our future. Approved.


ADMINISTRATOR – Sue Hayden- Game Day for Tire Discounters wants to do a commercial on Bonnell Rd by the tunnel and they will do it  Sept 11 or 12 from 4-7 PM. Baudendiatel said they need to work with the sheriff to get an agreement up regarding the road closing etc.This shouldn’t be agreed to just on a handshake. Commissioners  will meet in Sept before the commercial so they have time,


AUDITOR – Connie Fromhold  -Claims/Payroll and  August 1 Minutes were Approved


ATTORNEY – Andy Baudendistel- Signature on Survey for Hospital Property Transfer- Lawrenceburg owned a parcel occupied by Community Mental Health. They have cleaned up the panels into one parcel and it goes back to Lawrenceburg. Approved and signed.


Per Baudendistel.- Anthony Smart, Greendale Attorney - said that Jay McMullen resigned as Building Inspector g=for Greendale. The will send $10,000 to the county and Bill Shelton is OK with taking over Greendales’s Inspections. This is the last of the areas in the county that were doing their own inspections. Approved.


COMMISSIONER COMMENTS :

Thatcher saw the movie - Sound of Freedom- and said it was focused on children and the sex slave trafficking. There are 8,000 people in the Tri state area that are enslaved. He was surprised at the numbers. Recommends seeing it.
