Present: Dennis Kraus, Jr., Chairman, Russell Beiersdorfer, Mark Lehman, Jake Hoog, Dan Lansing, Jim Thatcher,Joe Vogel, and Eric Lang

ABSENT: Jeff Hermesch 

Also Present:  Nicole Daily, Zoning Administrator, and Andy Baudendistel, Attorney.

Baudendistel read the Title VI statement as legally required.

ADMINISTRATIVE

DEARBORN COUNTY ZONING MAPS – To review and discuss proposed ordinance amendments and updates to the Dearborn County Zoning Ordinance and Zoning Map, specifically with respect to the text(s) of: Articles 9 and 10, regarding Agricultural and Residential Zoning Districts; Article 25, regarding General Standards and new Use Development Standards; Article 27, regarding Definitions.

This will be an overview of all changes to date for only the proposed zoning map changes, which will determine the final proposed zoning map that will be voted on a date yet to be determined.

Nicole Daily- Said she gave them in their packet the changes requested from surveys and emails per township.. She said the maps have some discrepancies with creeks for example. The 2 Ag districts are about  123,490 acres- which is what was Ag before. 21,780 acres are Residential which is approximately what it is now. The one PUD is not include in this. R3 uses at 95 acres. R 1 and R2 make up the rest. 

We can talk about the specific townships that have people present tonight. Board agreed.

Lawrenceburg York and Hogan. 

Lawrenceburg Township- Public discussion- 

Steve Perrine- Scenic Drive- requesting about 38 acres to be Ag and not Ag homestead. His land is touching Ag. Mark Lehman said that they were using Ag Homestead if they were close to sewers. Discussion about being close to sewers but the land around him is steeper and he sees little chance of Residential there. Dennis- Kraus said the property across from him is going to be 3 total instead of 7 lots. Lehman- said Ag Homestead is to be a transition between Ag intensity and Residential. Your points are solid here. 

Chris Mueller- Ag intensity uses on our farm- wish to have it changed to Ag to reflect what we are actually doing. Grandfathered uses need to be changed as this farm has not been anything but Ag use. Beiersdorfer asked if we had been harmed monetarily by being Residential. I told him that money is not the only way we can be harmed. There are other ways to be harmed besides monetarily. Having peace of mind concerning our operations requires that we are properly labeled as Ag. Our packet of materials  is in the Plan Commission members packets, so I did not reiterate it for the 4th time now. Frank and Mary Ann Brauer also spoke to the board explaining how they were informed that they were buying Ag property back in 1980. 

Terry Sawyer- from Carrie Lane off Pribble Road- They have recently inherited the property from her parents-  problems with Carrie Rd having a platted subdivision that they are trying to get removed as they want it to be Agricultural like it has been for over 65 years. ( The proposed zoning map has it as Residential. 

Jeff Lyness- supported  what he was hearing from the previous speakers. 

Mr Probst- Hogan Township- Ag Homestead-sees property in that area now that doesn’t meet the criteria for access to sewer. Also would like to see them make decision-  Because if they don’t decide to change map- these people will not win on appeal by asking for zone change after it.

[NOTE: This is a significant point - and discussion followed up on this with the attorney also weighing in with how there was no judicial appeal available for  people asking to have properties changed due to their current use etc.]

Jeff Lyness- has a piece of property on Burzelbach Rd-  about 75 acres owned for 4- 5 years— wants it to be Ag Homestead so he can split it up into smaller parcels. It adjoins Ag Homestead.He wants to maintain his right to be able to do that- as it would have been legal as stated in the current Ag text - just not in the new version.

Center Township- Brett Fehrman- 4792 Park Avenue area of concern.12 acres in the city and 18 acres in the county.Wants to have the same density potential that he had when he bought it 13 years ago. There is some flood plain.

Washington Township- Jeff Meinders- wanted to keep his property Residential and not Ag (Homestead) as it had been changed to on the proposed map. He had provided the PZ office with the sewer availability to his land from the DC Sewer Board maps. He was surprised to see it was now listed as Ag Homestead and not Ag. 

Caesar Creek-  discussed with no citizens present . I left the room at this point briefly and they discussed Clay Township.

Nicole said she has to have a vote to let her know what properties are changing as she has to have a map for them to vote on. Text and map go together because they don’t want to have issues with text approved and no maps to refer to. Other 7 townships will be discussed at next meeting. Anticipates the June meeting to have it ready. This will go to first meeting in August for commissioners to have final approval,

Cum Capital Development Increase Has Affect on Property Taxes

 Dearborn County Cum Cap Development

Dearborn County, like any other county, needs to balance its expenses with revenue. The proposed re-establishment of Cum Cap Development (CDD) fund to 0.0333, the original rate which was reduces yearly by State Statute can now be frozen at that the proposed rate, and will support that necessary financial balance.  The rate increase for a $150,000 assessed value home with a Homestead exemption amounts to $5.50 per year less than a dollar per month or $12.45 per year on a home without a Homestead exemption. 

  • CCD can be used equipping the Jail, the Juvenile Detention center, Purchasing vehicles for the Sheriff’s Department 
  • Maintain all our existing buildings 
  • Repair of bridges, approaches, and grades separations
  • Purchase of voting machines; 
  • Purchase, lease, upgrade, maintain, or repair computer hardware, software, wiring and computer networks, and communication access systems used to connect with computer networks or electronic gateways; just to mention a few. 

Some examples of the County’s increasing expenses:

The cleaning and paper supplies budget has gone up from $65,000 to $90,000.

Cell locks in the jail will need to be up graded soon. That will be a major expense.

Per the Maintenance Director, plumbing supplies have skyrocketed and the inmates are constantly causing issues with the showers and toilets.

The maintenance department needed an additional amount last year from CCD of $30,000 for mechanicals and will need a projected amount of an additional $50,000 this year. 

The real problem is inflation and that is out of our control. 

Cost Savings efforts – Commissioners budget has been reduced over 500K in the last 6 years.  This year alone it was reduced 350K.


Potential effects of 0.033 Re-Establishment of CCD  

on the tax bill for $150,000 properties

I have attached the Township maps for the proposed zoning maps being presented to the Plan Commission on Monday.  I am unsure how many Townships we will cover in the meeting that night, just depends on how much conversation is spent on each township.  I will also have the Townships print at a larger scale on boards in the lobby for the public to review.  Please attend the meeting if you would like to discuss with the Plan Commission specific areas of the County regarding the proposed zoning map.  This will not be the last public meeting on the zoning maps but don’t miss one or two/three remaining chances to voice any last minute concerns, suggestions, or comments.

 

The meeting begins at 6:00pm on Monday, March 27th and will be located in the County Government Center (address is below).

Questionnaire

Ohio-Kentucky-Indiana Regional Council of Governments (OKI) is a council of local

governments, business organizations and community groups committed to developing

collaborative strategies to improve the quality of life and the economic vitality of the region.

OKI has a questionnaire on their website regarding transportation uses, needs and wants. 

Commissioner Rick Probst sits on their board of and would like to have a good representation of

responses from Dearborn County.  It is an opportunity for DC residents to tell the federal

government thru OKI what is important in Dearborn County.   The more who participate, the

louder our voice, the greater our potential to receive support.   It is for OKI residents and is 25

mostly multiple-choice questions about YOUR transportation uses, needs and wants and takes

less than 10 minutes to complete.

Participation is very important to Dearborn County as it sets the stage for potential FEDERAL

funds to support transportation projects in our towns, cities, and county.

Please take a moment to go to oki.org and once on their website the questionnaire can be

located to the right by clicking on “Take our Regional Planning Survey”.  The survey closes at

the end of this month so please share this information.

Present: Jim Thatcher, President, Art Little, and Rick Probst


Also present: Connie Fromhold, Auditor, Andy Baudendistel, Attorney, and Sue Hayden, Administrator


TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.


PUBLIC HEARING on Reestablishment of Cum Capital Development Fund. Introduction of Ordinance to Reestablish Cum Capital Development Fund under IC 36-9-14.5 pursuant to IC 6-1.1-41  

Public Discussion Opened and Closed as no public wanted to speak about it. (There were 2 people in the audience besides the newspaper and myself)

For a $300,000 home is $11 or $12.45 if not a Homestead property. Per Thatcher


Mason Parris was honored by the Commissioners with a proclamation for all his achievements in state wrestling 330-19  win loss record. As NCAA champion and athletic success at University of Michigan. Pictures were taken by the paper and County. 


OLD BUSINESS


Sewer Disposal Ordinance - Tabled


Animal Control Director Position- Steve Hostetter is now the official Director of Animal Control. Approved. Commissioners also directed him to share news- both good and bad with them - to keep them in teh loop.


NEW BUSINESS

ARPA Grant Agreement with Hogan Water Company- Baudendistel presented this and the money will be transferred to Hogan Water and the County will then monitor it. They will agree to appear to Commissioners and Council to give reports. Hogan Water already signed it and the Commissioners signed it tonight. This is a 15 month project so it will be completed by the ARPA deadline in 2026. 


ADMINISTRATOR – Sue Hayden- update on teh windows. They are in house and cleaning the existing stained glass. They will start on Circuit Court installation and they ate working with Judge Negangard on scheduling that. 


AUDITOR – Connie Fromhold  -Claims/Payroll and March 7th Minutes approved.


ATTORNEY – Andy Baudendistel- Summons and Notice of Appropriation of Real Estate - complaint for appropriation of real estate - Condemnation- This is along SR46. We just have to indicate that we have no objection to the project. Baudendistel will handle this.

City of Lawrenceburg will transfer their square of property to the county. Seig Surveying will handle the transfers to us and back to the utilities with etc new description from Seig along with the panhandle access. There is still an agreement with Mental Health on that property too to be settled. 


COMMISSIONER COMMENTS

Probst- Health Depot Gott $50,000 Grant to each of 3 schools for Covid . April 4- Mary voting at courthouse for the 3 cities elections.

Little- A fellow from Dearborn County having a National Championship (Mason Parris)- thankful for that.
