Present: Dennis Kraus, Jr., Chairman, Russell Beiersdorfer, Jeff Hermesch, Mark Lehman, Joe Vogel, Jake Hoog, Dan Lansing, Jim Thatcher, and Eric Lang

Also Present:  Nicole Daily, Zoning Administrator, and Andy Baudendistel, Attorney.

Baudendistel read the Title VI statement as legally required.

ACTION ON MINUTES- July 23, August 29, and Sept 13, 2022 minutes approved with abstention from a member who was absent on August 29 and corrections on attendance for Sept 13.

ADMINISTRATIVE

Review and discuss proposed ordinance amendment to Article 3 Advisory Board of Zoning Appeals- Nicole Daily said the majority of the changes were the same as the ones for the Plan Commission. There is a section from state statute that has rules on not contacting board members. It also has something on condos and home owners associations as interested parties. Daily plans to send the Plan Commission and BZA amendments at the same time  to the Commissioners as they are so similar. Baudendistel reviewed them legally. BZA also reviewed it. 

The Board voted to send a favorable recommendation for Article 2 on Plan Commission also to avoid an issue with the 90 day rule. 

Plan Commission gave this amendment a favorable recommendation to go to the Commissioners with Thatcher abstaining as it is coming before his board for approval. He has no problem with it at this time. All others ayes. 

Review and Discuss proposed Ordinance Amendments with respect to Ag and Residential Zoning Districts texts and maps 


The Board discussed the following text changes.


Dearborn County, IN Use Development Standards Use Development Standards (Article 25, Section 2585 **New Section) Keeping of Animals. 

  1. Development Standards i. Minimum setback for accessory buildings housing non-household animals or kennels: (a) Less than 4 animals - 10 feet (b) More than 4 animals – 50 feet ii. Animals may be kept on contiguous property provided that: (a) Such animals are not a public nuisance and are not vicious, as defined by the Dearborn County Animal Control Ordinance (Chapter 90, Sections 90.02 and 90.16 of the Dearborn County Code of Ordinances); 
  2. (b) The animals do not present unsanitary conditions or a health risk as determined by the Dearborn County Department of Health; 
  3. (c) The animals and their keeping, including restraint, are compliant with the Dearborn County Animal Ordinance; 
  4. (d) If there are 5 or more dogs/cats on the premises, a kennel license must be obtained from the Dearborn County Animal Control (Chapter 90, Sections 90.02 and 90.38 of the Dearborn County Code of Ordinances); iii. Up to four (4) animals customarily considered domesticated, household pets may be kept on any property in any agricultural or residential districts (A, AH, R1, R2, and R3). iv. To keep undomesticated, non-household animals on contiguous property^ that is zoned Agricultural or Agricultural Homestead (AH), except as noted otherwise below, or in the next subsection**. 


For properties located in any agricultural or agricultural homestead zoned districts that are greater than 1 acre but less than 5 acres, may have a combination of 2 animal unit per acre (1 animal unit being from the large animals and 1 animal unit being from the small animals per acre) of the following animals: 

For properties in Agricultural Homestead (AH) and Low-Density Residential (R-1) zoning districts with less than one (1) acre, 10 laying hens, no roosters, may be permitted but no other livestock. 

(b) Wild / Exotic Animals – Must be in compliance with IC 14-22-26 and all other applicable Federal and State laws, including 312 IAC 9-11, as well as local County laws (including animal control, health, zoning codes, etc.) and are only permitted on property located in an Agricultural District on more than 10 acres. ^Said contiguous area shall not contain any structures that are not intended for the sole purpose of housing said animals or lateral/leach field(s). 

Any contiguous areas within a single parcel that is more than ten (10) acres shall be considered livestock production. v. Other Standards (a) The keeping of Undomesticated or Non-household Animals is prohibited in the residential districts (R2, and R3), except backyard poultry, where up to 5 laying hens, no roosters, may be permitted. (b) Nothing in this section shall prohibit the temporary keeping of newborn offspring of permitted animals (less than 4 months old). 

(c) Fish in aquariums are exempt, provided they are not associated with a commercial animal establishment as defined in the Dearborn County Animal Control Ordinance. 

Small Animals

 50 Rabbits = 1 animal unit 

 32 Chickens = 1 animal unit 

 16 ducks = 1 animal unit 

 8 turkeys = 1 animal unit 

 8 geese = 1 animal unit 

 50 Pigeons/Raising Game Birds = 1 animal unit 

Large Animals 

 2 head of cattle = 1 animal unit 

 3 horses = 1 animal unit 

 5 sheep = 1 animal unit 

 5 swine = 1 animal unit

  5 goats = 1 animal unit 

 5 llamas = 1 animal unit 

 5 alpacas = 1 animal unit 

Dearborn County, IN Use Development Standards 2. Kennel, Commercial. a. Development Standards i. Minimum lot size: 5 acres ii. Minimum setback: 250 feet from any lot line 3. Equestrian Facility/Riding Stables. a. Development Standards: minimum lot size: 5 acres


Opened Public Discussion- 

Ken Keilholz- Wedgewood Lane - West Harrison- They have Ag Homestead. Street is one acre lots. There is a neighbor boarding 10 dogs in her home. They have a kennel license for $50. It does not depend on the zone currently. He has farm animals behind him and they do not harass him The dogs do. 

Nicole Daily said our ordinance does not cover this currently. Animal Control needs to control this. Baudendistel will get with Animal Control regarding this. He will also check to see that our regulations for Animal Control match the ones with Zoning. Daily and Baudendistel have his phone number and email. There is a code of federal regulations on kennels also for operation and inspection of animals. They will work with Animal Control. 


Closed Public Discussion


Looking at the 3 township maps. Daily will have the maps out in the entryway at each meeting for people top see. 

Caesar Creek is almost all Agricultural. Daily said the small lot sizes are limited due to septic issues. Board consensus his that the Caesar Creek proposed zipping is acceptable.


Clay Township has a lot of Ag but the area around Dillsboro has Residential  and further out Ag Homestead. There is some R around Lake Dilldear. Hoping to get Sanitary Sewer out there in 3-5 years. There is the Markland road connection to consider too. Board consensus is that the proposed map is acceptable for Clay Township. 


Washington Township has more Residential. The US 50 section has a 200 ft. strip of Ag as buffer from R to Industrial. There is a Mfg Park. Beyond the US 50 corridor the township is primarily Ag, They plan to look at that buffer yard with the new rules at our next meeting.


Board is considering meeting start times of 6:30 PM for 2023.

 This email is a friendly reminder to those who have taken time out of their lives to be involved in the Planning and Zoning process for the Proposed Agriculture and Residential Zoning Districts, that we will be having a meeting on Monday, September 26, 2022 at 7:00pm at the Dearborn County Government Center.  This will be a public meeting and we will be discussing potential changes to the “Keeping of Animals” section of the proposed ordinances and will have some maps of each Township of the proposed Zone Map changes.  During the meeting on Monday, if the Board has the opportunity, we will begin discussing the map changes of Caesar Creek, Clay, and Washington Townships.  We may or may not get through all three of those Townships that night but I wanted the Board to be prepared if we don’t spend too much time on the Keeping of Animals section.  So please make note, that the Board may not get the chance to discuss any of the maps Monday, but we wanted to leave it as an option.

Present: Diane Bender, Chairman, Jim Helms, Jim Deaton, Alan Goodman, and Dave Deddens arrived about 10 minutes in via telephone but couldn’t vote.

ABSENT: Andrea Ewan Attorney and Jamie Graf (non- voting school board member)


Also present:Sue Hayden, county administrator and attorney,Connie Fromhold, Auditor and DCRC treasurer.

EXECUTIVE SESSION @ 8:00 a.m. 

IC 5-14-1.5-6.1(b) (4)(A) to discuss interviews and negotiations with industrial or commercial prospects or agents of industrial or commercial prospects by the Indiana economic development corporation, the office of tourism development, the Indiana finance authority, an economic development commission, a local economic development organization (as defined in IC 5-28-11-2(3)), or a governing body of a political subdivision; 

IC §5-14-1.5-6.1(b) (2) (D) which pertains to discussing strategy with the respect to the purchase or lease of real property by the governing body up to the time a contract or option to purchase or lease is executed by the parties.

Memorandum of Executive Session- Board certified they only discussed what was advertised. 

ACTION ON EXECUTIVE SESSION- One Dearborn be authorized to obtain appraisals on the properties discussed during the executive session. Approved.

APPROVAL OF MINUTES- July 14th Minutes Approved

CLAIMS AND FINANCIALS- Drake Lawn Care $1,150 mowing in the districts. 

OLD BUSINESS:

Guilford Property Update-per Bender- still waiting for Andrea schedule a closing but documents are signed. Messaged twice to see when and she hasn’t responded yet. 

I-74 Brush and Tree Removal Update- Perleberg said he and Deddens had talked about this recently and still trying to work thru INDOT. There are employers located there and want INDOT to clear out there so it will show off the mowing. If we can get approval from State the the DCRC can pay to mow that area. Deddens has gotten no response and they are going to check with Randy Lyness to get that permit.

Engineering Civil Engineering Services RFQ- 6 responded and narrowed to 3 and they will move forward to interview them at executive session on Nov 10.

2023 Budget Update- Council gave the county employees a 5% raise. DCRC approved the 5% for Hayden to have that also for her tasks for them.

ONE DEARBORN REPORT: Perleberg- Gage and he took a tour of the West Harrison facility and Maxwell did a great job constructing it. Dyke Industry is open to them touring it also and they are happy with it. Ribbon cutting at a later date. Some talk about having a meeting out there- no decision.

Site plans for other project going to submit to Planning and Zoning next week.

Perleberg said Andrea has been very responsive throughout the whole thing- but the out of state title company has been slow. Got to get the closing- work out the title issue. Goal is to get it done by mid September. The company they contracted with said they can have cement walls ready to go.

Gage and he went to talk to Todd Listerman about estimates to get Randall and the other 2 streets there paved in West Aurora TIF. Some mention of Probst bringing it up to get DCRC to pave there. If you want to move forward with this- then the DCRC can go to Board of Commissioners to get that permission to pave. Maybe can cost share. Or reduce the scope of the project and do it in phases. Board thinks they need to see if the Commissioners would even want to discuss that.

Deddens wanted to know if they really want to get into the blacktop business? The County would be doing the supervising of that. Deddens said (warned) if we do it there- we will be doing it everywhere. He said he’d go with Bender to meet them. He’s not in favor of DCRC being responsible for that. 

Deddens asked about using TIF money to help with a road to get traffic consolidated to help with school traffic by Civista and the BP station. Will discuss later. [NOTE: The TIF money appears to be able to be used for road creation in the St Leon TIF district, but maintenance paving in the West Aurora TIF is questionable?]

Schneider GIS Contract- Nicole Daily, Zoning Administrator-Tabled at the request of Nicole Daily until 9/19/22 meeting


BI Inc Agreement for Electronic Monitoring- Steve Kelly, Director of Court Services- $220,000 /year historically spent on equipment. Saving $56,000/year. This comes from grants and users fees. Baudendistel reviewed and amended the contract already. BI has about 80% of the GPS services in counties in Indiana. They have had competition and dropped prices. Approved. 


Soil and Water District  Updates- Matt Jarvis, NRCS District Conservationist- passed out state officials visit  info pictures. Completed the Johnson Fork and Bonnell Rd pictures that they worked on with the county. Had public meeting a couple weeks ago for resources for programming. There is a priority list there for them to see what they plan to work on in the county. Tim Gunkel also presented - Beth Terrill -Joined as district coordinator and they  got a storm water coordinator too. Kyla Dick was hired and is getting trained in to take over Jennifer Hughes position and handle MS4. Thatcher asked about the progress they can expect on her duties. Lives in HVL and from Dearborn County and she worked for Duke Energy also. Matt Johnson joined Board as an associate- non- voting member. Their annual meeting is in March.  


County Engineer- Todd Listerman:

Bridge Inspection Contract from 2023 thru 2026 - 80/20 contract for $274,706.27 between American Structurepointe and Dearborn County. Approved


Contract Agreement for Small Structure  #111 and #112- on Station Hollow Rd-  Paul Rohe Company- this puts the bonds in force for that project. Approved.


Triple Whipple Bridge #95 Inspection Contract- has to be inspected every 4 years as our pedestrian bridge. There is no requirement for this but the county does this every 4 years as this is a fracture critical bridge. The other pedestrian bridge in the county is the one on the Lawrenceburg Aurora Trail. Lawrenceburg is responsible for that. This is $4500 and all county funds for Triple Whipple pedestrian bridge in the budget.


Listerman is working with contractor for thin overlay on bridges. Looking at trying to surface seal for a 5-6 year life as compared to the 20 year life. Looking at the bridges that are in the interim gap process that might need this. He will get prices on the soon for them. 


Also Listerman gives a shout out to part time employees- they had an unfunded mandate to put emergency and load limit signs on bridges and had to be done by Sept 1. Larry Stroll and Gary Ryan did this part time to get it done this summer. 


Resolution Authorizing the Investment of Public Funds- came from Barb working with Baker Tilley on getting quotes on CDs outside the division. Thatcher had issue with paying Baker Tilly to go and look for these rates. Since we use CDs it seemed like a high prices. They have other options they can look at even if we don’t use them. Approved. 


Ordinance to Repeal the Ordinance to Create a Sheriff Sale Fund- $300 on adm fee on these sales. This simplifies the sales. Approved to repeal the fund.


ADMINISTRATOR – Sue Hayden- Ordinance Amending Section 5.5 of the Personnel Handbook- Use of Cell Devices- Hayden said State Board of Accounts wanted this. This covers employee ones as well as those dispersed by the county. This updates the current ordinance on that. It also strikes out pagers per Baudendistel. Approved.


AUDITOR – Connie Fromhold  -Sheriff’s jail grant $55,000 with no match. Integrated reentry support program. Approved.

Claims/Payroll and August 16 Minutes- Approved.
