27 April 2009 Dearborn County Plan Commission Notes

Present: Hall, Chairman, Thompson, Lehman, Nelson, Hoog, Kraus, Jr., Beiersdorfer, and Lansing

Absent: Hornbach

Also present: McCormack, Plan Director, and McGill, Attorney

Primary Approval for a 5-lot subdivision for the creation of a medical office facility on SR 48 and Wilson Creek Road in Lawrenceburg Township on 71.66 acres of recently rezoned B-1 land was submitted by Owner Health Care Services of SE Indiana and applicant Land Consultants represented by Jeff Talkers, PE.

All information was similar to what was presented at last month’s zone change hearing. 25 mailings sent out with no comments pro or con received. The plan is to begin earth moving this summer all internal to the site- not trucking it in. Geotech reports will be gone into in detail after primary plat approval. The preliminaries indicate no red flags.

Lawrenceburg will annex this effective 2010. The site will have 30 Alzheimers beds and 140 assisted living units. It will be all single story and so will cover more land space. Talkers will advise Lawrenceburg of the issues involving neighbor comments on the 90-degree curve in Wilson Creek. All accesses line up with others ( SR 48 lines up with Clinic Dr. and Wilson Creek lines up with garage driveway.)

The 47 acres of slopes will be a good backdrop for the complex with space and views. Private cemetery will not be moved and all development will be 75-100 ft from it- per DNR requirements. Parking is as required in other municipalities. There is extra parking around the medical building to accommodate hospital employees that currently use those spaces across the street now.

No public was present to speak on this.

Nelson motioned and Kraus Jr. 2nd to approve the primary plat. All ayes. Passed.

ADMINISTATIVE:

1. Bond reports passed out. Miller and Tucker coming up soon.

2. Ron Barnhart was approved and hired as assistant planner. He previously worked in GIS dept and has a background in Urban Geography. He also is a graduate of ECHS and lived in Sunman.

3. 3. All three grants the Plan Dept and Mike Hall helped write were granted: Manchester Recreational facilities for $42,000, West Harrison for $85,000 and Lawrenceburg Aurora and County for US 50 for $1.85 million.

4. Complaint filed in Jan 2008 regarding a local surveyor is finally moving through the attorney general’s office as they are asking for more information. This complaint was also filed with the Land Surveyors Board and their certification and registry board. The surveyor was not named during the meeting.

OLD BUSINESS:

1. Thompson reported on the status of the work order for the sound system, which is partially “fixed.” Cliff Eibeck thanked him for all those who have been complaining about it.

2. Brett Dodd of RQAW presented a revised proposal for the Justice Center complex with phasing. The first phase would find the best site, even though they believe the Shumway Votaw site is too small. They still want to look at both sites. They can defer fees until the project comes to fruition and absorb them into their fees for completion of the project. They will evaluate the project two ways- with all courts moving or with partial. Pickens said he didn’t think they’d pry the circuit court out of the courthouse. Dodd wanted to evaluate it without preconceived notions. [NOTE: Dodd has been working on this for over 4 years without a contract or pay. He already has notions of what he thinks would work. The circuit courtroom is UNIQUE. It may be that that room should become a courtroom for all jury trials, thus used by all the judges on a scheduled basis.]

RQAW Phase 1 would be $6000 plus about $800 for reimbursable costs. Dodd answered questions from the commissioners. He wants to make space flexible so larger work forces could be accommodated in years to come.

Thompson passed out a proposal from PMSI Inc (Bill Schepler)- PMSI is a management company that would then hire RQAW to design build. PMSI would provide a free spot estimate (pro bono). This is not an apples to apples comparison of services. Pickens suggested they do both- since one is free and they could use PMSI to check RQAW.

Orschell motioned and Thompson 2nd (when Hughes wouldn’t) to accept both RQAW’s Phase 1 proposal and PMSI’s. Thompson and Orschell voted Aye- Hughes is opposed.

3. Administrator position job descriptions was retabled at Hughes’s request as he still hadn’t reviewed the revised job description from Waggoner Scheele in the current personnel policy. [NOTE: The commissioners seem to need an administrator in order to GET an administrator hired! What’s so hard about getting materials to each other and being prepared? Or is Hughes stalling? Or both?]

4. FSA form removing Fox and adding Orschell as commissioner was signed.

NEW BUSINESS:

Lifetime Housing rehab letters signed. Projects are 14335 E Main St Moores Hill and 103 Eleanor Lane, Aurora.

Dennis Kraus Sr. ( County Councilman) and Kelly Mollaun (Lawrenceburg School Board) were appointed to SE Regional Community Corrections Board at SERCC’s request.

The Zone Map change from Ag to B-1 for a retirement Living and Health Services Complex at SR 48 and Wilson Creek in Lawrenceburg Township on 71.66 acres of county land adjoining 11 plus acres of city lands included was approved with no opposition. It had come with a unanimous favorable recommendation from the Plan Commission. Pete Resnick, Hospital Adm was present as was Jeff Talkers of Land Consultants. Trilogy is also involved in the complex with the hospital owning the land. The commissioners’ approval reflected the Plan Commission’s fact-findings as justification for the zone change even though it did not follow the master plan map of future land uses for that area. (See Plan Commission notes from March for further info.)

Todd Listerman, Transportation Dept, gave a 1 hour and 25-minute update and report. [NOTE: Several items are ongoing and their presentations could be shortened, as they are repetitious.]
1.Commissioners signed the Interlocal agreement with Aurora that was amended to reflect the widened sidewalk on the George St Bridge. Aurora already paid the $7500 owed to the county.

2. Listerman presented a draft of the needs assessment from LTAP with a discussion of the shortfalls in the budget. When this money comes in, the state police get their $86 million, the BMV gets its $50 million, and the rest goes to the roads etc. The report showed 86% of the state roads were in substandard condition. Over 88% are not edged and over 72% are not striped. Listerman has a complete report at the office.

3. Trash on roadsides is being picked up by County Corrections. Highway is involved when the item is too big to lift. Highway will take items off roads if they are IN the roadway. Call Community Corrections if roadside trash needs attention.

4. Dave O’Mara is repairing Bridges 10, 59, and 87 per last meeting. Inspections will be done by Barth and Associates for $13,500. Commissioners approved them as lowest bidder.

5. Rediscussion of the salt purchasing process and some snags in the computer sign-up. We are getting it for $68-70 per ton. Buying 4000 tons. We are committed to at least 3200 tons and can have 120% of what we requested, if needed. It will be delivered to our 3 sites.

6. Budget prep workshop is May 12 and Listerman will be there. He wants a workshop with commissioners after that to set the 2010 budget.

7. Council meets in May and Listerman wants to approach them regarding the 172 Riverboat Revenue funds. He spends 2008 money in 2009. So far the list below is about $40,000 over the 2008 funds and he may have to use some 2009 funds to complete it. Federal law requires striping on roads with 3000 or more vpd and edging with 6,000 or more vpd. County does 1000 or more- but commissioners decided now to only do the federal guidelines of 3000 or more due to low funds. Striping will be Cole, Georgetown, Jamison, North Dearborn (partial), Old US 52, Stateline, and Wilson Creek for $60,000 instead of $120,000.
Paving for 3 roads that have been let go and will soon be beyond repair for $500,000 approved to go to Council for Carolina Trace from Franklin County to Ohio stateline, Stout Road, and Pribble from Sr 1 to the top of the hill only. Will use dolomite mix to increase traction on that hill probably. Hoping asphalt costs $65 per ton vs. the $80 last year.
1997 dump truck replacement with over 200,000 miles and a crack seal machine for $60,000 that will save manpower and repay in 2 years. Also a $3,000 oil filter crusher. Total for these items is $184,000- approved to go to Council. Total for all the above is about $744,000. Council will have final say.

8. Discussion recycling and working more with solid waste district ensued.

9. Collier Ridge bid approved for Rohe Paving at $401,647.20 and includes the 9ft lagging to prevent leakage. Still have to get Rail America approval. Work will be June to mid August. The inspection work was approved for Geotech by HC Nutting at $12,373.50 and all the rest of the inspection by Barth at $11,220. Listerman said he wanted the design engineers to inspect on this project. Together they are at 5.9% of the contract price- well under industry standard fees.

10. IDEM considers Hwy to be a small waste generator due to their recycling and using rags instead of Floor Dry etc. They will be doing spot checks starting soon.

11. Thompson said they might want to reopen the idea of the Randall Ave site to get into more compliance with IDEM and Env rules. Commissioners will go on a site visit and will give 48 hours notice to the paper when they do. Pickens said Hensley could do one of the 2 appraisals required for free.

12. Listerman wants to auction off highway equipment- 1965 Farmall tractor, trucks etc. They could advertise it on their website. May do a county auction and include it.

13. Land acquisitions for ROW on North Dearborn TABLED until commissioners could find out how the landowners feel- they do NOT want to eminent domain. Orschell was adamant about that. United Consultants had a not to exceed price of $30,590 to do the ROW acquisitions.

14. Jenny Lynn will have the access to Old Orchard closed off with guardrail until they can get grass to grow. Too many people illegally using the emergency access.

15 No good news for IT and Artemis on 275. Listerman said they can’t get INDOT to do design work on this.

16.Listerman said he’ll do whatever the commissioners want on the workweek hours. Commissioners voted to try 4 – 10 hour days for 3 months this summer in highway dept. They will have M-Th workdays and people on call for Fri and the weekend. Survey showed about 50/50 on the workers wanting this. Orschell said it will gain 336 hours of lunchtime savings for Fridays removed.

17. Beam Longest and Neff will be at May or June meeting to discuss Stateline Road project.

Pickens- Auditor - Cum Cap Dev Fund is to be revised by the county attorney to comply with the state code, so the county isn’t “dinged” by their annual audit on what we spend it on. Claims signed- Hughes abstained- he hadn’t reviewed them. Minutes signed with March 17 tabled again with Hughes revisions. Orschell hadn't reviewed the new changes.

Bond Commission needs reappointment with Bill Jackson’s death. Pickens said Ewan created the board- for some compliance issue. He thinks they never meet. Tabled to research.

County tax rates will be here by May 29th at the latest. [NOTE: We haven’t received tax bill again this year.]

Jack Gay- Attorney- for Witte- Stone Property Zone Map Change signed. Also Witte’ s research on the ATV’s on county roads was approved to present to the citizen from last month’s meeting with issues.

Thompson reviewed a stimulus money powerpoint and didn’t see much opportunity for us here.

PUBLIC:

Phil Darling- York Township- asked about the rules for ATVs on County roads. Listerman has the law on that. Must be 16 and have to have DNR permit. Darling noted that kids use them without lights at night on his road. Huge safety issues.

VRUC SEWAGE FROM HIDDEN VALLEY OVERFLOWS AGAIN

To all of any concern,

After just 1/2 inch of rain last night the lagoon for VRUC is overflowing this morning into double Lick Creek. VRUC has done nothing to stop the sewage overflows even though they have been under a continual IDEM Agreed order for over 13 years.

When will our evironmental regulators do more than pass paper from one official to another?

From the US Conference of Catholic Bishops (USCCB) and the National Committee for Human Life Amendment (NCHLA):

The U.S. Department of Health and Human Services (HHS) is inviting public comment on a proposal to rescind an important federal regulation issued in December. The regulation implements and enforces three federal laws protecting the conscience rights of health care providers, especially those at risk of being discriminated against because of their moral or religious objection to abortion.
The Catholic community must speak out to protect Catholic doctors, nurses and hospitals.
Deadline is MIDNIGHT – Thursday April 9.

Med Ben appeal heard at executive session was denied at the regular meeting.

Bright Fire Dept Fire District has been withdrawn. [NOTE: It was reported on the local radio station that Gary Theurer, Fire Chief has resigned.]

Contract for Jack Gay, who is subbing for Witte was signed.

Thompson assured the audience that the sound system was being checked and they are proceeding with the manufacturer now.

Aaron McFelea for Cedar Pointe Assisted Living Center received verbal support ( Non- financial) to seek a grant from Lawrenceburg for economic development. Cedar Pointe will hire 35 employees and will be located on SR 48 across from Sunrise Estates. Grant will help with infrastructure.

Bill Black Jr, EMA- received grant signatures covering the grant for his, the sec’y , and part of a deputy’s salaries plus fringe benefits. Grant is from Homeland Security. Employees signed conflict of interest at state request because they were also part of LEPC (Local Emerg Planning group)

Ann Averill was appointed the new director of Animal Control Center. Doug Taylor, board member, and Thompson both noted that there were over 30 applicants and many were well qualified.

Commissioners signed the Notice of Intent for Pendleton Sears Architects for the Animal Control Center Building. As owners of the project, the County has to sign and pay $100 fee to IDEM per state regulations.

Mark McCormack presented the Zone map amendment for the Stone property on 82 acres in Harrison Township. Jim Kinnett of DCEDI noted that the agreement with Harrison or DCRSD sufficed to get the state to label it showvel ready. All other utilities are in place. No opposition. Commissioners approved the zone change from Ag to M-2 noting the new jobs it will produce, that it fits the other things in the area , traffic is handled well, RR access, and it’s location in the TIF district.

McCormack also received approval for changes to subdivision ordinance for Article 2 sections 244 and 260, Article 7, and Article 3 section 305N. The ordinances will be signed and a text change that is more typographical and not affecting content will be fixed by attorney Gay for section 260. Only opposition was from Hughes on 305N for cul de sacs. He said he lived on a dead end street and people are smart enough to figure out how to get around an accident. Orschell asked how many houses were on the street- Hughes said 3-4. Section 305N allows for about 10 times that amount and 1200 ft. It also allows for a waiver request.

Land Use Element Resolution was signed from the last meeting.

McCormack also asked for and received support for a grant request to Lawrenceburg with Aurora, the county, and Lawrenceburg being the applicants for infrastructure improvements on Phase 1 of US 50 project from the collaborative efforts. The amount requested is $1,850,124. The support was granted with the stipulation that it not harm existing businesses. Aurora Lumber ( Phase 1) and (in Phase 3) McCabes were mentioned as 2 long time businesses that need to be looked out for. Mike Hall- surveyor and PC Chairman- noted they were doing everything to enhance and not harm the existing businesses. The service road will help with truck loading and traffic. Cary Pickens called attention to the fact they were taking dirt from N of US 50 and dumping it into the flood plain S of US 50. Filling in the flood plain is not a good idea- it harms people along the streams and river and increases flood areas. [NOTE: Unfortunately, Commissioners did not seem overly concerned about that.] Phase 1 of this project includes moving the light at Walmart and the driveway at Aurora Lumber about 100 ft. they will run a service road behind there to Frisch’s area. Phase 2 continues on to soccer fields and Shurlite Drive. Phase 3 includes McCabes to the Post Office. Hope someday to go through to Lawrenceburg town.
The grant uses very conservative numbers for job growth, and tax base increases, etc. along this project.

Todd Listerman- Highway Dept- gave a 25-minute report and also a written report of the analysis of 4 vs 5 work day weeks for the highway dept. Summary Report is posted at the end of these meeting notes.
1. Commissioners approved $7500 which will be reimbursed by Aurora for increased walkway on George St from 5’ to 6/8”.
2. Collier Ridge slip bids to be opened next Thursday and presented for next meeting.
3. Three bids submitted for Johnson For, Salt Fork, and Sagamaw bridges. Commissioners accepted Dave O’Mara, lowest bid at $217,716.10. The other 2 bids were American Contracting at $349,398 and Force Construction at $340,143,17. The original estimated cost was $368,900.
4. Force Construction started Bells Branch and it will be closed till the fall.
5. Paul Rohe is working on SR 46 from SR1 to SR 52 and has 6,000 tons of millings to sell . Commissioners allowed Listerman to approach Council to buy this and since it is summer he thinks it will seal better on the low traffic roads, That will allow possible delay of the chip seal topping for a year or two.
6. Deck on Collier Ridge Bridge will be done with a 4 “steel grating form E&H Bridges for $45,107.28. Listerman can approach Council later if he needs more steel for his account for other bridges.
7. LPA training for Listerman is May 6.
8. Animal Control Durango is repaired and ready for pick up.
9. Report for 10 hour 4 day work week option given to commissioners. See end of these meeting notes for summary report. Commissioners to review report before making a decision.


Pickens- Auditor- Commissioners approved claims, tabled minutes and approved getting a resolution to require employees to take reimbursements as direct deposits.

Thompson- Commissioners approved signing a title for Special Crimes Unit vehicle to be traded in to local dealership.

RQAW- Brett Dodd- late arrival- had a proposal for $24,000 – 320 hours estimated work – to get financing costs, options, land comparisons on sites, etc. They have been working on a strategic plan for jail-justice complex since 2004. Consensus building for 2 options lately he said. They will look at Votaw/Shumway site and the old Fortune Mgmt lot next to Vance Tousey House. Pickens said Council will need this broken out in phases and also may require a bid.

PUBLIC COMMENT:

Work Day Report

When looking at what schedule works best for an organization, one must first look at the type of work is being performed, working conditions, and personnel.
The Dearborn County Highway Department work consists of outside manual labor operations which include but not limited to: guardrail installation, pipe & culvert installation, mowing & weed eating, herbicide spraying, tree & brush cutting, pothole & road patching, wedge & level, crack sealing, road grading, ditching, etc.

Workers are exposed to all weather elements, including cold, extreme heat, wind, rain, snow, etc
The Dearborn County work force ages are between 40 and 63 years old. The average age is 51 years old. (See page 6)

The Medical history of the work force is as follows:

1 employee off Workman’s Comp due to hurt shoulder,
1 employee 2008 Workman’s Comp physical therapy for hurt shoulder,
1 employee off 2007 on FML due to stress,
2 employees off 2007 due to knee surgery,
2 employees off in 2008 on FML due to knee surgeries,
1 employee off 2007/2008 on FML irritable bowel syndrome,
1 employee under medical treatment for lung condition: taking chemotherapy treatments,
1 employee under medical treatment for prostate & bladder cancer,
10 employees with high blood pressure,
3 employees with diabetes/ high sugar,
13 employees with weight issues,
2 employees with cholesterol issues,
1 employee with circulation problems in legs, clots,
1 employee has arthritis issues,
6 employees restricted CDL due to medical reasons.

The Dearborn County Employee manual presently states “each workday, the employees are provided with two paid rest periods of 15 minutes in length and a paid lunch period of thirty (30) minutes in length.” (See page 7)

Neither Federal law and Indiana law requires employers to provide breaks of any kind including for meals. However, rest periods if allowed must be counted as hours worked. Meal periods need not be compensated as work time. (See pages 8-10)

The Dearborn County Employee manual also states “No established schedule should be construed as a guarantee of work hours…” (See page 7)

Federal Fair Labor Standards has no provisions regarding the scheduling of employees. Therefore, an employer may change an employee’s work hours without notice or obtaining the employee’s consent. (See page 11)

EMPLOYEE SURVEY

26 of 28 field employees surveyed (two off, 1 sick and 1 workman’s comp.)

13 prefer traditional 5 day/8-hour workdays
1 did not vote
12 prefer 4 day/10-hour workdays

Of 12 who prefer 4 day/10-hour workdays,
10 would prefer staying 5-day schedule than work a split 4-day schedule, off on Wednesday. 1 made no choice. 1 wanted 4-day schedule even with split schedule.

For this report, we will look at the months of June thru August. This will be while school is in summer break so to limit disruption of school buses and limit disruption of evening rush hour traffic. When looking at work periods, one needs to look at sunrise/sunset hours. Earliest start time based on sunrise sunset would be 6:30 a.m. between June 1st to July 17th and 7:00 a.m. for July 20th to August 28th. (See pages 12-17)

2 less paid 15-minute breaks and 1 less 30-minute paid lunch.

Cons: Substituting working hours during heat of day in lieu of cool period of day, i.e. less production, (See pages 23-24)
Substituting addition work hours at end of day, i.e. tired worker, less production,
Recommended additional 15-minute break per 2 hours worked in heat of day to reduce risk of Heat Stress. (See page 24)

4-10: It is my experience that if you have a split shift, you don’t get as much work done as four days in a row.
4-10: Will we have to use vacation or personal time to cover a sick or vacation day. Earn 8 hours and 10 hr workday. July 4, 10 hours?
5-8: We need to be here 5 days a week to serve the public.
5-8: If we do 4-10’s would prefer straight 4 days.
