17 SEPTEMBER 2019 DEARBORN COUNTY COMMISSIONERS MEETING NOTES

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

OLD BUSINESS- none

NEW BUSINESS Guilford Wastewater Treatment Project Grant Hearing
Shannon, the grant writer, presented for the hearing
Herzo Engineering updated the original engineering plan for the grant proposal. 23 homes along SR 1 and 35 homes in Guilford will be served by a low pressure system that flows into lift station and into the plant. 20,000 gal per day plant is proposed for this. The site for the plant is still being negotiated. Lift station is at Main and Tanner in the ground past the bridge. Land acquisition and a section 106 environmental are being pursued now.
 Cost is $1.304 million for the project. OCRA $604,000 is coming from sewer district as match. $60/ month is the monthly sewer bill. Homeowners will pay for grinder pump and lateral also. All 58 homes have to tap in for this to work. The state law will be enforced here. Thatcher asked how that will ensure they hook up. Had a meeting inviting all the residents and there is a USDA grant for financial needy residents to pay for the grinders and laterals individually. 
Thatcher asked about how that draws down the reserves of the DCRSD. Steve Renihan answered- $150-200,000 will be what is left in the reserves. They are looking at a rates and see what they need to do to get cash flow positive. They need to do this to get ahead of possible maintenance and repairs. 
Mike Hrezo pointed out that the infrastructure is new and they do build maintenance into the costs for the rates.
In October they submit a rough draft of the proposal. then they come out to meet including a county commissioner. Full application goes in on Nov 22. Grants are awarded in the first quarter of 2020. Shannon feels that we have a very competitive project.
There were no questions from the audience.Sign in sheet showed the small number of public who were present.

Commissioners had to approve several forms documenting the income levels and act on the commissioners behalf etc. Approved.
Shannon and her staff will have to conduct an income survey as the census records go over two area and the data is grouped. One of those areas has to be broken down to the people in the project area only,

ATTORNEY – Andy Baudendistel- sent out OCRA requested drug free work place and fair housing ordinance changes for them and our employee handbook company. They will have these on the agenda for October’s 2nd meeting of the month. 

COMMISSIONER COMMENTS- Probst- was at OKI today on conservancy. North American problem with honeybees came up. Need to encourage people to buy local and not imported honey so our bees survive. 
Little- agreed to saving honeybees. Hoping the heat is over at the end of the week. 
Thatcher- Sunday went to Aurora and toured the LST docked there and went on the dinner cruise that evening with a spectacular view of fireworks. A great event by Aurora.

PUBLIC HEARING GUILFORD WASTEWATER COLLECTION SYSTEM PROJECT TONIGHT SEPT 17 at 5PM Comissioners Meeting

Guilford Wastewater Treatment & Collection System Project 
Public Hearing Notice 
On or about October 4, 2019, Dearborn County Commissioners on behalf of the Dearborn County Regional Sewer District, intends to apply to the Indiana Office of Community and Rural Affairs for a grant from the State Community Development Block Grant (CDBG) Wastewater Program. This program is funded by Title I of the federal Housing and Community Development Act of 1974, as amended. These funds are to be used for a community development project that will include the following activities: construction of a new wastewater treatment plant and collection system to serve the unincorporated community of Guilford Indiana. The total amount of CDBG funds to be requested is $700,000. The amount of CDBG funds proposed to be used for activities that will benefit low- and moderate-income persons is $362,000. The Applicant also proposes to expend an estimated $604,000 in non-CDBG funds on the project. These non-CDBG funds will be derived from the following sources: Cash on Hand. 
Dearborn County Commissioners will hold a public hearing on Tuesday, September 17, 2019, at 5:00 p.m., in the Dearborn County Government Center at 165 Mary Street, Lawrenceburg, Indiana to provide interested parties an opportunity to express their views on the proposed federally funded CDBG project. Persons with disabilities or non-English speaking persons who wish to attend the public hearing and need assistance should contact Sue Hayden, County Administrator at (812) 537-8894 no later than Friday, September 13, 2019. Every effort will be made to make reasonable accommodations for these persons. 
Information related to this project will be available for review prior to the public hearing as of September 3, 2019 at the office the Dearborn County Commissioners at 165 Mary Street, Lawrenceburg, Indiana between the hours of 8:00 a.m. to 4:00p.m., Monday through Friday. Interested citizens are invited to provide comments regarding these issues either at the public hearing or by prior written statement. Written comments should be submitted to Sue Hayden, County Administrator, 165 Mary Street, Lawrenceburg, IN 47025 no later than Friday, September 13, 2019 in order to ensure placement of such comments in the official record of the public hearing proceedings. A plan to minimize displacement and provide assistance to those displaced has been prepared by Dearborn County Commissioners and is also available to the public. Present: Liz Morris, President, Dennis Kraus, Sr., Kevin Turner, Tim Doll, Alan Goodman, and Bill Ullrich. 
ABSENT: Dan Lansing

TITLE VI COMPLIANCE: Read as legally required by Liz Morris

OLD BUSINESS:

DISCUSSION ON POLICE PENSION- Goodman said there is an IRS clause that says anyone over age 41 hired from outside doesn’t have to work 20 years here to be fully vested in the pension plan. Shane McHenry was present- but did not need to speak. Council approved the changes to comply with the IRS laws. 
Stan Brown sent him all the state agencies that have fees that feed into this. One was bond forfeiture money the could be recouped on a percentage basis. 

NEW BUSINESS:

APPOINTMENT TO SEWER BOARD- Steve Renihan- Art Wentzel has stepped down from sewer board. Need someone to fill this term until 2021. They have  a few interested candidates. Three interested. They want to wait a little longer to see who wants to come to the table. They would like to have someone with Construction and or County background. He just wants to have the Council be aware of this and to send any candidates they know about. Morris wants a short bio of acc candidate for their November meeting for appointment. 

PLANNING & ZONING: Raise Baudendistel retainer from $8,295 to $10,000 also up the hourly fee to $175.00 per hour. This was the same for all board attorneys. No vote required.

BLIGHT CLEARANCE PROGRAM GRANT- Grant to demolish old North Dearborn Elementary 
School. Morris said this was something the school board decided and they just need the county to sign off. Approved with Kraus Sr voting NAY. 

911 COMMUNICATIONS: Transfer $45,494.63 of Statewide 911 other Services/Charges for grant  match- Jared Teaney- This was a match that they had the money for so Council approved. 


HIGHWAY: Tim Grieve- Additional appropriations, sign grant paperwork for Natural Resources Conservation 
Services.Union Ridge and West Laughery. Total is $2,528,778- 75/25 match. $1,896,578 is 75% and $632,192 is what we get back. Have to front the whole amount first. The money to front it is going to come from the following 3 accounts. There is a 5 year performance warranty. Approved this as a short term “loan.” In kind services from the county dept. work for this match amount also.

NEW BUSINESS:

Grant Application for Blight Clearance Program- Planning and Zoning Adm, Nicole Daily- This is for North Dearborn Elementary School - they want to be sure county is on board and have done the environmental remediation. No expense to county except for her help with it as employee of county. Public meeting as one of the steps and documentation that she helps with.
Abatement requirements are being met. Approved the grant application for $500,000 for demolition of the school.  

Proposal to lease Gradall- Highway Supt- Tim Grieve- Propose to have 5 year lease to own on the Gradall. Our 2 were both bought at the same time- and both wearing out at same time. Acquisition cost of the machine is $353,163.83 Trade in is $11,500 for both machines and one has worn out transmission. Trade in is first years payment. Five more payments after that. Closing doesn’t occur till it is in hand. $75,139.04 annual payments for 5 years. Getting all the attachments and tools needed. Can do higher mowing on the road ways with attachment too. These are proposed rates - contract later. Replacing 1999 and 2000 Gradall - about 20 years old. Approved.

HIGHWAY ENGINEER- Todd Listerman:
Fuchs Road Reacceptance- Got an email from state that had an error on their maps for Fuchs Rd from Kuebel Rd to the turnaround, having mixed it up with a road that doesn’t exist. This will assure that we get paid correctly for our roads from state. It is 0.46 miles. It’s 16 ft wide and is paved. It is in our system. The mileage is the same as the non-existent road. 

Bridge Inspection Cover Sheet-  required every 2 years by federal law. Some have to be done every 12 months because of their condition.( about 16 bridges) With new bridges, some can be done every 4 years if they are less than 10 years old and have 8,9, or 10 ratings. If a bridge gets flooded, then it does not qualify for this 4 year inspection. 
2019 inspection this past spring. This coversheet needs to be signed to turn in to the federal highway database. American Structurepoint completed this. There is a 4 year contract with American Structurepoint. Last year it was United Consultant. There are only 3-5 companies certified to do this work in Indiana. Commissioners signed the report. Listerman will schedule them to give the report at a future meeting.

ADMINISTRATOR – Sue Hayden:
Annual Certification of Local Approval for Heart House- Emergency Solutions grant thru HUD. Commissioners have to certify that it serves the purpose of serving the homeless and trying to get them jobs etc. Approved.

AUDITOR – Connie Fromhold  - Claims and the Minutes from August 20th were approved and signed. 

ATTORNEY – Andy Baudendistel: Nicole Daily contacted him regarding this and the Drug Free Workplace Ordinance due to OCRA ( Office of Community and Rural Affairs) requirements. Our ordinances were 9 years older than theirs and need to have them updated for current regulations and OCRA’s requirements. Approved to rewrite ordinances.

COMMISSIONER COMMENTS
Probst-  He attended state AIC Interaction and coordination between fed and locals.
Wanted to congratulate Ray and Janice Pope and they opened Rt 52 Cafe in July. It’s good to see a small business evolve.
Little went out to Park County and drove home off the interstate routes. Noted that the county is doing better than many places. Said also to remember the people in the storm path now.
Thatcher- recognize local law enforcement. Last week response was to Brown residence Kirby Road. Ran into an armed man who challenged the deputies to shoot him. The deputies were able to tase him later in the wooded area where he ran and had  gun pointed at them. They were able to apprehend him without killing him.
