has called an Executive Session for

The purposes for the Executive Session are to:

Area 1 Closure Description – Closure By Removal
Tanners Creek Development LLC
• Coal combustion waste in Area 1 will be excavated from Area 1 and the removed material incorporated into
Area 2
• Collection and analysis of soil samples for analysis of background concentrations – samples to be collected
from an area that was not impacted by the operation of the Tanners Creek Generating Station
• Confirmation samples will be collected from the floor and walls of the excavation and analyzed for various
chemicals of concern.
• Confirmation sample results will be compared to the background soil concentrations obtained from an
area that has not been impacted by historic site operations
• Install 6-inches of cover soil over the excavation area following the completion of verification sampling
• Establish vegetation on the cover system
Area 2 Closure Description – Closure In Place
• Delineate the horizontal extent of ash up to the Area 2 property line
• Revise the closure plan based on the results of the horizontal extent of ash investigations – extend the
limits of the cap to cover all areas on the property where ash is present
• The Area 2 Closure Plan assumes that approximately 16,000CY of material will be excavated from Area 1
and placed in Area 2
• Regrade the near surface and Area 1 material for positive drainage (no ponding of water onsite)
• Install a compacted clay cover with a permeability of 1x10-6 cm/sec or less to the limits of the ash on the
property (minimum 2-feet thick)
• Install 6-inches of top soil above the compacted clay layer
• Establish vegetation on the cover system

• Construction Quality Assurance/Quality Control Plan has been developed and will be
implemented for all phases of construction – independent engineering certification of the
construction requirements for the closure of Area 2.
• Stormwater/Rule 5 Erosion and Sediment Control Plans will be in place and implemented.
Final work will include vegetative stabilization of entire area (Area 1 and Area 2).
• Cover soil materials to be derived predominantly from borrow areas located off-site – work
will be designed to minimize truck traffic on local highways.
• Dust Suppression Plans will be implemented to control construction dust.

NEW BUSINESS: Aurora sign is landscaped and looks good. 
ONE DEARBORN REPORT: Spoke to Nicole Daily on the Guilford properties and bids on properties opened. Bids did not go past the amount for Blight elimination program. They should be down by October.
Dearborn County Regional Strategic Plan with Dearborn and Franklin Counties August 25th Tuesday - Virtual.
West Harrison Business Park with drone video etc. done soon. They can do somethings with the Drone Video- they have money in the Duke Readiness for future for marketing.It can be used for appraisals or road base etc.

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

OLD BUSINESS
Bids for Cyclical Reassessment - Assessor, Megan Acra - rejecting all bids and rebidding. Commissioners approved. 

NEW BUSINESS
Agreement with Pictometry International for County Flyover - Nicole Daily, Planning and Zoning - ortho and oblique at 3 inches with 360 view of all properties.  Hasn’t been done since 2008. This will help many departments in the county including police, planning, assessment, etc. Commissioners approved the contract. This fall and in 3 years another one. Includes a change finder to compare changes from 2020 from 2012. Gets a building footprint layer for GIS. This can be used for Emergency Management services. Cost is  $128,184.14 this year and $116,113.06 paid over five years. This can be paid for the first round by COVID money. Tries to get it after leaves down and before snow on the ground. Approved the agreement.

With its notice, the Indiana Department of Environmental Management initiates a period during which the public may submit comments regarding the closure/post-closure plans. This public comment period ends September 19, 2020 (30 days after the public meeting date).

The notice of the virtual public meeting and public comment period is attached.  Below is information on the two open dump areas and the proposed closure plan.  


Areas 1 and 2 (Slag pond 4 and Bottom ash processing area) 

Both areas determined by IDEM to be open dumping sites. Subject to enforcement action and Agreed Order approved May 8, 2019  

Area 2 to be closed in place, Area 1 ash to be excavated and moved to Area 2.

  • 2 acres 
  • 16,000 cubic yards of ash; up to 5 feet deep 


Area 2 

  • 17 acres  
  • 175,000 cubic yards of ash; up to 20 feet deep – 5 to 11 feet below groundwater level  
  • Area 2 is on opposite side of a flood control levee from a residential neighborhood in the City of Lawrenceburg.
