Baudendistel read the Title VI statement as legally required.

NEW BUSINESS:

  1. Vacation Plat in Yorkville, alley within Catherine Perine’s Addition to Yorkville - Applicants: JDJ Surveying and Engineering LLC - Owner: Commissioners of Dearborn County - Site Location: Off of Leatherwood Road, Sec. 10, T 6, R 2 - Parcel: #15-05-10-100-013.000-024 (East adjoining tract) - Township: York - Zoning: Community Business (B-2) - Size: 0.175 acres - this is oil teh west side of Wildoff’s Store. Dennis Kraus, Jr- had a conflict of interest so he left the room for this item. Mark Lehman took over as chair for this. Nicole Daily presented- This is different in that the entire alley will go to the platted area owner and not be split between adjoining owners. This is because the plats were done at different times and by law they cannot give land to someone in a different plat from the one that the alley was created in. There is an easement that will be set up for a septic system that is within the alley area after the vacation is filed. This will have to be forwarded to the Commissioners with a recommendation on the vacation. Jeff Stenger presented for the applicant. He was available to answer questions. No one wanted to speak during Public Discussion.The Plan Commission members basically did no see any problem with recommending the vacation to them Commissioners. They unanimously approved sending this to the commissioners with a favorable recommendation.     

2. Zone Map Amendment of property along York Ridge Road from I-2 to Agriculture - Applicant: Dan Seevers - Owner: Seevers Inc - Site Location: 9000-9100 Range of York Ridge Road, Sec. 33, T 7, R 2 - Parcel: #15-02-33-700-116.000-010 & #15-02-33-700-113.000-010 - Township: Kelso - Zoning: Moderate Industrial (I-2) - Size: 33 acres. Nicole Daily presented. The property is being used Agriculturally in this area. In 1965 is was Ag and then in 1980 it was bing used for an asphalt hauling business and that is how it became I-2. It’s not being used for that any more. There is a part in the I-2 that is someone else’s property and that I-2 will remain that way. Putting a house on this wouldn’t be permitted by code if it were I-2. That is why they are rezoning it back to the Ag of the surrounding area. The inspection pictures show that there is no business being run on the property and there were stakes there for a future house. No neighbors responded of the 13 letters sent out. The existing structures all meet Ag requirements. Dan Seevers - the owner of Seevers Inc. He is carving out 5 acres  for his home. The other parcels involved- one belongs to his sister with her home. The other is with his sister and his brother and they do not plan to do anything with it that os Industrial. No one spoke for Public discussion.  Kraus Jr. noted that there is not enough infrastructure there for Industrial uses. The Plan Commission unanimously approved a Favorable Recommendation to the Commissioners to Rezone this property back to Agriculture from I-2.  

ADMINISTRATIVE

Review and discuss proposed changes to Mylar requirements in Article 2 of the Subdivision Control Ordinance - Daily explained why they were looking at these requirements. Retracement surveys and consolidation surveys were discussed and replats. HVL is an area that has these consolidated lot situation. They will reference the zoning ordinance for public hearing procedures so that it will match up. Primary plat requirements will require best available data from the flood plain ordinance because Daily has to enforce that. Surveyors on the board and audience weighed in on these changes. Types of paper were specified. (27 lb extreme bond paper.) It’s cheaper than Mylar. So both types can be used. There are issues with streaking from the stamp ink on the Mylar. Wildlife Conservation easements, wildlife classified forests, etc. are to be added on with recorder. Variances are to be added also. Covenants are to be on the survey by reference so they should be noted by reference to the record document. The grading plans will be moved to a different article for subdivisions and any other grading plans for an acre or more. Some need to be in the design part of the subdivision ordinance also. Also cross reference them. Maybe put them into the same general section in Article 3. Condominiums and landominiums may need more discussion after the zoning maps get finished.   

Review and discuss proposed ordinance amendments and updates to the Dearborn County Zoning Ordinance, specifically with respect to the draft Zoning Map alternatives and the draft text(s) of: Articles 9 and 10, regarding Agricultural and Residential Zoning Districts; Article 25, regarding General Standards; Article 27, regarding Definitions

NOTE: If there is sufficient time the board will discuss the zoning maps for Manchester, York, and Jackson Townships. There were no people in them audience to object or affirm any of these 3. 

York Township Map was discussed- it is mostly Ag and Ag Homestead. There is some residential. The board had no suggested changes from the proposed zone map. 

Jackson Township Map was discussed- All Ag and a  couple areas of existing B-2. They did change some in Ag Homestead with smaller lot areas. The board had no suggested changes to it as proposed.

Manchester Township was discussed. There is some business in the town area itself. The area of Residential out by 48 and 148 has no sewer yet. There is a very small line up near that. The board had no suggested changes to it as proposed.

STARTING IN JANUARY THE PLAN COMMISSION MEETINGS WILL START AT 6 PM

Circuit Probation-

County Council- 

Resolution 2022-002 -Transferring $4,030,613 from County General (1001) to Rainy Day (1186) Baudendistel - this is not more than 15% and not from debt service. Approved resolution. Question from Glenn Wright about having it be with a 2/3 majority to spend Rainy Day. Baudendistel said that simple majority is set by statute.

Resolution 2022-003- Baudendistel Interlocal with Greendale, Aurora and Lawrenceburg for MS4 services. - wanting to bring in a consultant to work with all parties here on the MS4. $25,000  for the company (OHM) and each pays percentage per capita. County share is $17,600+ and the rest is carried by the other 3 cities. Money already allocated under Commissioner budget. Appreciate what the surveyor has been doing to get this together. $15,000 for the county to use their services after this and the cities can contract separately or with us. Leah said that the money has already been budgeted for this and will pass thru to next year for the county. Hidden Valley does their own MS4. MS4 has been around a long time and it started with the big cities. Approved the resolution. 

Resolution 2022-004- Interlocal Between the Dearborn County Sheriff and Towns of Dearborn County for collection, storage and handling of evidence: and for testimony regarding evidentiary matters in criminal proceedings. Baudendistel updated the agreements to get the statutes the same. This puts Aurora, Dillsboro, West Harrison, and Moores Hill. Kevin Turner abstained as he is involved. Approved the resolution. This does not have to be approved by the AG’s office. 

Ordinance 2022-010 Combine Park Board Funds - Baudendistel presented. 1179 Park & Recreation non-reverting operating. 1178 Park Board Land Acquisition non-reverting capital- terminates this fund and transfer to 1179. This will give them flexibility in using these funds. Approved the Ordinance. Kraus was NAY. 

ADDITIONAL APPROPRIATIONS:

Dearborn County Coroner- Part-time wages $12,918 & Autopsies $30,000 (1001/4914)- Cameron McCreary - ran out in October- had 12 cases come in that first week.Discussion regarding autopsies and how many are being done.  Both approved out of County General fund. 

Maintenance- $63,000 (1001/1136/4914)- Eric Hartman- $37,000 of this is for boilers that are failing. These are only 8 years old. Approved out of County General. Hartman has money left over from Parking lot drain - wants to put money into flooring for jail showers that have are slick. Has to take up and recoat it. Going to make it sandy grittier than the old one. Morris- So they can exfoliate? <Laughter> Approved to use that money

911- Overtime $11,885 (1222)- Leah Bailey presented. Approved out of the 911 Fund. 

Commissioner Sue Hayden presented for Jim Thatcher who is out ill. 

$2,538,289 Lake Dilldear Sewer Project (ARPA 8950)- TABLED as it was TABLED from last night Commissioners meeting too. Preliminary engineering report was not ready yet. 

$148,624 Basement Restroom & Kitchen Project (ARPA 8950)- the shot clinic last year didn’t have restrooms only a portolet outside. They wanted to make this ready if another use needed it. Only bidder was Maxwell Construction per Baudendistel. If Funds are allocated the commissioners will make an agreement with Maxwell. Noel No answer and Bruns Gutzwiller said they couldn’t bid on it.Hayden had slides and pictures of the areas under consideration. Inmates are never in teh basement anymore as they have lifts installed in the tunnel area. Since this is an internal request for the county- the ARPA money can go thru  regular process. Approved.

$36,090 Screening for Basement Files and Election Equipment (ARPA 8950)- Files from the hospital and the election equipment require humidity control so instead of a room- they are screening it instead - with a tarp like screen. They have to keep election equipment on camera. There are 2 that keep it visible at all times. It is also under lock and key. Hospital records from DCH have to be kept 75 years. Approved. 

Auditor: 

Salary Ordinance-  Leah Bailey said they should know by tomorrow if their budget was approved for 2023. Approved the salary Ordinance. 

Dennis Kraus Sr has agreed to serve on SIRPC for 2023- They like to get their board set up ahead of the new year.

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.


OLD BUSINESS

Request to Close Guilford Bridge 9/9/23- Tamara Taylor, Editor, Bright Beacon- Insurance is taken care of and engineer’s report is in. Waiting on a recommendation from the Park Board.


ARPA Committee Recommendation to Board of Commissioners- tabled as the agreement is still being formulated regarding the sewer agreement with Dillsboro.



NEW BUSINESS

Proclamation- PG Gentry Inducted into Indiana Military Veterans Hall of Fame- Probst said it was a privilege and a pleasure to work with him and an honor to make the presentation. Baudendistel read the Proclamation. PG was a Vietnam War Veteran with several awards and medals. He also works wit teh Veterans Treatment Court and many other Veteran’s Affairs.

PG also made a few comments. Treatment service officer here in Dearborn County also and he’s great to work with - Dave Currence. Two of his classmates did not have the opportunity to come home. Veterans are well taken care of in SE Indiana. Have 6 WW II Veterans left here. 

200 Vietnam Vets in their group. They also do the Honor Guard for the funerals. 


Student Art Work - Kristina Martin, Project Manager, Prosecutor’s Office and Lynn Deddens, Prosecutor- Deddens said they add pictures annually that the students do to the hallways. Lawrenceburg and EC participating. 25 kids with submissions. All DC employees will vote on the art work. They want to introduce 2 pieces to put historical piece in it, They will relocate the 911 banner.Trying to get South Dearborn synced up in the picture. Judge Humphrey had a lot of history to share. Commissioners agreed to use of the hallway.


Election Voting Updates- Gayle Pennington, Clerk of Courts - reported 34%  participation rate-  3432 mail in.  47.42% in the 2020 election. Sheriff Shane McHenry was top vote getter in the county. Busiest precinct 2174 people at Dearborn United Methodist Church on Stateline. Willies 1610 voters. Agner Hall 1520 voters. No complaints from people. By 9 PM the last vote center was in and by 10 all had been reported to the state. Probst thanked Gayle and her staff for all their work. She said they thanked all the poll workers. They always need people and they train them for the task. 


Ordinance to Establish the Broadband Ready procedures- Baudendistel said this was an initiative from the Lt. Gov Office. This puts procedures in place to set this up. One Dearborn is the point of contact for this. Permits cannot be applied for until all zoning matters with cell towers have become resolved. Once that happens it’s a 10 day turnaround for the permit. Commissioners approved the ordinance.


Resolution Approving the Interlocal Agreements with Towns and Sheriff Dept regarding Evidence currently stores evidence for Dillsboro and West Harrison and Moores Hill wants to join in. They redid the 2 we already do to get them updated to current laws.Approved.


Interlocal Agreements with West Harrison, Dillsboro, and Moores Hill regarding Evidence Storage - The actual agreements with the 3 towns were also tabled until Dec until Council does theirs Wed night. . Council will also have this so that they don’t have to be approved by the AG office.


Baudendistel also had a resolution to have an interlocal agreement to hire OHM Advisers Consultant for MS4 regulations and 3 cities. $25,000 divided by population between  DC has over $17,000 as their share.This also will go to Council tomorrow night. The Consultant will help us meet the deadlines on these rules.  Working with cities will help split the cost.  Approved. 

Tabled the actual Interlocal until the Council approves this just like the evidence one above. . 


ADMINISTRATOR – Sue Hayden- 2023 Board of Commissioners Schedule- May 3 changed to Wed July 5 to wed Oct 17 to morning meeting Nov 8 to Wed - all others on 1st Tues mornings at 9AM and 3rd at 5 PM- Approved.


Gerald Bruns 12th annual Prayer on the Square for Knights of Columbus for Friday Jan 21,2023 - Approved


AUDITOR – Connie Fromhold  -Claims/Payroll and Nov 1 Minutes approved.

COMMISSIONER COMMENTS:

Art Little - Happy Thanksgiving and try to dig deeper to see what all we have here.

Rick Probst- Thanks Vets and noted how great a job Dave Currence is doing for Veterans even beyond Dearborn County. Little chimed in that PG Gentry helps move beds into and out of houses when they deliver hospital beds. 


LATE ARRIVAL INFORMATION- Derick Puntney- lives on the other side of the speed bump in Bright on Einsel Rd. Speed bump is 50 ft from stop sign. Commissioners will look into it and check with Listerman and Sheriff. 


Jason Kinker - Regarding Jenny Lynn Drive and his mother’s (Rose Kinker) property.He went back to May meeting notes. Traffic is increased and there have been 3 incidents since June that he has seen where cars have about run him or others off the road nearly being an accident. Drainage issue is draining onto her property. So much water it killed oaks etc. and only paw paws and sassafras grows there. McCormack told him nothing had been approved there. He was later told it had been approved before this. He went on at length about those 2 issues and he was referred to Soil and Water District about the drainage. He needs to contact Listerman about the road issue. He had issues with the election and too long a wait. He had issues with contacting the commissioners directly. Commissioners adjourned the meeting before he was finished as he was getting off the subject a bit and couldn’t be refocused.

 Principles: Why We Vote

There is an old joke whose origins are unknown but which you have probably heard in more than one movie or TV show. P.J. O’Rourke borrowed it for the title of one of his cynical books about politics:

Don’t vote – it just encourages them.

But that really is our function as members of the electorate in a representative democracy, isn’t it? We don’t have a pure democracy in which the majority always gets its wishes. We elect people to act on our behalf.

But what does it actually mean for them to act on our behalf? If we can’t expect them to give us just what we want, we can but hope that they will act on their consciences. We might end up liking it or not. As The Boss says, we lay down our money and we play our part.

But we have encouraged them.

Indiana has long been a deep-red state, and in this election cycle it went even redder, with even stronger supermajorities in both legislative chambers. We have encouraged our lawmakers to do whatever they want to with no meaningful input from anyone, friend or foe. Democratic stalwarts in Indiana have good reason to be discouraged.

But overwhelming numbers aren’t necessary. Democrats have had a tie in the U.S. Senate for the last two years and a razor-thin majority in the House, but that was enough for them to pass an “anti-inflation” act that included far-reaching climate legislation with costly and potentially devastating implications. Republican stalwarts in America have good reason to be discouraged.

Statehouse Republicans have no reason to re-evaluate their actions; we have not encouraged them to. Neither do Democrats in Congress; by refusing to turn them out in that imaginary “red wave,” we have encouraged them to keep doing what they have been doing.

Perhaps it is time for us to re-evaluate what we have been doing as voters. Whether we are discouraged or not, we are getting what we chose. It is all on us.

Despite what we might have gleaned from our civics lessons, we don’t really vote as members of a republic, trusting our representatives to act in good faith. We vote as small-d democrats, wanting politicians to do our bidding. We might not be single-issue voters, but we vote on the things important to us, and the politicians encourage us to do so. They ask us – directly or through pollsters – to tell them what we want, so they can then tell us what we want to hear, on inflation, crime, abortion, the border.

But then they vote, not just on those issues but on all others as well, based on their world view, just like it says in the civics books. We have empowered them to do what they wish, whether they are voting their consciences or not.

Do not vote for the party, the trite warning goes, but for the person. But it’s the party that rules, and the party has a philosophy.

If there is a great disconnect in this country, it is not the red-blue divide. It is that we pretend to live in a republic but behave as if we live in a democracy. What causes the disconnect is that the politicians pander to our day-to-day concerns but govern based on their long-term views. They have a philosophy, and we don’t.

But we don’t know what those philosophies are, do we? Do we really know what Statehouse Republicans think, except for platitudes about “a state that works” and “respect for ordinary Hoosiers?” Do we really know what Democrats in Congress think except for platitudes about “fairness for all” and “respect for ordinary Americans?” Forget about limited government; none of them believe that anymore. It is just a question of what they would use government for.

We don’t know because we haven’t made them tell us. We are encouraging the wrong things in them.

There is another joke, inaccurately attributed to Mark Twain but sounding more like something Will Rogers might have said: If voting mattered, they wouldn’t let us do it.

If we want our votes to matter more, perhaps we can start by grounding them in a core set of principles about what we want in a state and in a country. So, the next time we vote, the question should not be, “What will they do?” but “What do we believe?”

Then we can ask them the same question.
