OLD BUSINESS: none
NEW BUSINESS:
  1. Request: Primary Plat Approval for a Major Subdivision Scenic Ridge Subdivision Applicant: Jeff Talkers / Land Consultants Owner: John T. Maas, Jr. / Scenic Drive, LLC Site Location: Scenic Drive Legal: Sec. 8, T5, R1, Map #07-08, Parcel # 037.001 Township: Lawrenceburg Size: 56.5 Acres
Eric Lang left the room as he works for Land Consultants to avoid a conflict of interest. 
McCormack presented the case. The board CANNOT make a decision tonight because there is no letter from DC Regional Sewer District allowing LMU to provide sewers in DCRC territory. 

McCormack said it’s predominantly Ag zoning around the site and including the site except for NE with is residential. Views of the site and topography maps were presented. There are plans to level out part of Scenic Drive for site distance as required by the Highway Engineer. Primary Plat review is the first state of the development process. Improvement and Construction Plan process is the 2nd stage. This is the phase where they find out how feasible the plans are. If the codes are met the subdivision primary plat must be approved. This is all laid out in section 200 of the code. About 3.14 acres per lot so it meets  code from lot density. 
The proposed road runs straight off Scenic Drive where the almost 90 degree turn is located. The site distance issue is because the property in the one direction is mowed sometimes - but it is not owned by the applicant. They may have to consider a stop sign at the one area. Pictures showed the site distance issues. 
They still need a letter from DCRC to let LMU serve the area. They do have a letter from LMU. Still need a letter from Lawrenceburg EMS. The fire chief letter said he was concerned about FUTURE growth beyond this with the existing 8 in line. He’s OK with it for this particular development. 
County Engineer letter details the site distance needed. The applicants primary plat plans and accompanying information.
Eight adjoining property owners were notified of this hearing. 

Jeff Talkers with Land Consultants presented. Jack Maas owns this and wants to develop it for higher end homes. They are to have sewers and fiberoptic. The project will NOT be built unless there is public sewer. We see that this will probably not happen for about 2 years. There was supposed to be a working meeting with LMU and the county sewer board. He does not have an input from that meeting as of yet. 
Lehmann asked about the relocation of the center line on Scenic Drive- yes they planned to do that. They also conformed that the school is OK and the cul de sac is made to accommodate the school bus turnaround. Site distance was the biggest issue. 

Opened Public Discussion:
Tim Center-Speaking for his parents who live on Scenic Drive. He asked about the rule that it has to be approved if it meets all the codes. McCormack explained that. It is NOT like the discrete that they have with rezoning. This land is not being rezoned. The lot sizes are OK in Ag zone. They need sewer because of the slope that would make getting primary and secondary sites for septic approved. He asked about recourse for the county of the dirt is not moved the way they want for the road issues. McCormack explained the bonding process. He also talked about certificates of occupancy. He also said the bonds are now monitored closely and they don’t lapse. The road is  lane and a half- there are no plans to widen it yet. 

Angela Carter-He driveway is right before this site. She has grandkids getting the bus there and also in getting mail- has almost been hit out there. Cars miss the curve and end up off the road needing to be pushed out. The hayfield is NOT owed routinely out there. 

Shawn J? - lived there most of his life. The grade of the hill is a concern- sun is blinding coming up there. This load nearly triples the number of drivers. This is used as a shortcut to Manchester sometime. Suggest they do a vehicle count. Scenic drive cannot handle any more traffic with it’s current construction. Will Lawrenceburg annex that? That is a concern- He doesn’t think they need another subdivision. This is a country road. It is shady on the hill and ice does not melt on it.  

Patrick Mulvaney- owns the 33 acres from Wilson Creek up there. Concerned about stormwater runoff so that it doesn’t run off not his property. McCormack told them about the rule on stormwater control. They have to have a 75 ft setback from Scenic Road. Deterent will be topography. They will need easements for some of the utilities- McCormack agreed. He also asked if the slides were on line- YES. At Planning website.

Mr Stammer- Lives on adjoining property- 4 inch main form Manchester waterworks- not LMU- and no fire hydrants - just a flush out one.

Victor Whitley- owns property at the curve. Wants to know f they can take his property to enrich themselves. He was told they need to get an easement from him to fix the road. Kraus told him they cannot but the county can use the right of way to maintain the road.

Closed Public discussion

Board TABLED this till he January 28th Planning Commission meeting providing they get the DC Regional Sewer and Lawrenceburg EMS letters. Passed. Kraus will try to get updated information on the traffic count of Scenic. 

ADMINISTRATIVE:

Plan Commission Meeting Schedule was approved for 2019- It’s available online. The November meeting will be Nov18th not the 25th due to conflict for Kraus. Long discussion about tightening up the deadline rules for materials for cases to be in. Board agreed to do this. 

County Zoning Ordinance, with respect to Zone Map Amendments (and applications / forms) - For Jan meeting. 

Staff changes: 3 positions open- Karen Abbott is retiring. Part time adm assistant gave notice also. The part time employees are often leaving for full time positions in the county. The code enforcement spot is open also. Starting with interviews now. Accepting applications deadline is January 5. Hoping to have them shadow Karen until she leaves Jan 25. 20-30 good applicants for Mgr spot. Part time has several good ones also. Thatcher wants to talk to McCormack about HR helping with that.

EXECUTIVE SESSION @ 8:00 a.m. IC §5-14-1.5-6.1(b) (2) (D) which pertains to discussing strategy with the respect to the purchase or lease of real property by the governing body up to the time a contract or option to purchase or lease is executed by the parties.  And also, IC 5-14-1.5-6.1(b) (4) to discuss interviews and negotiations with industrial or commercial prospects or agents of industrial or commercial prospects by the Indiana economic development corporation, the office of tourism development, the Indiana finance authority, an economic development commission, a local economic development organization (as defined in IC 5-28-11-2(3)), or a governing body of a political subdivision.  

Title VI statement read as legally required.
ACTION  FROM EXECUTIVE SESSION- Certified that no other matters other than advertised were discussed.
DCRC Board - Authorize Ewan-  to prepare a contract for project management by One Dearborn for Project Butterfly. Any expenses they incur during the due diligence process is covered by DCRC up to $20,000. 
and also- Sign a letter of support for rezone in west aurora TIF district from Ag to I-2 across from Aurora Casket- for 35 acres.It is attached to the property owned by DCRC. Approved

APPROVAL OF MINUTES- Nov 19 minutes not approved because there is no quorum of members who were present at it.
CLAIMS AND FINANCIALS:
$10,000 Unity Scientific- incentive previously approved for Brighton Mills equipment purchase- Randall said this was approved for flour analyzer quality control equipment. Lowest bid is $41,500. The check is for $10,000 of this. Andrea needs to get Ted to sign the economic development agreement before his is approved.The claim has to be held until they get this for the January meeting. TABLED.
UNFINISHED BUSINESS:
Hirlinger Chevrolet update- hanging still
EDA with H Nagel and Sons-covered above 
Billboard contract update- Ewan said letters are going out today for payments by February or the billboards are up for other ads.

ONE DEARBORN REPORT: Cushman Wakefield sign is on the Stone property. They have an existing client who provide a lead who is asking about the property- very preliminary.
Also working on Project Butterfly which is looking at land.
Got some fun news that Randall is excited about- REDI looking for more sites and emailed her that they are going to produce a marketing video on a trial basis for sites in the area. We have until Friday of next week to have detailed RFI and drone footage. Having that much acreage would be a good shot to be part of this footage. Has $200/hour cost and about 3 hours option from someone who used to work for a TV station. Authorized One Dearborn to use up to $1200 of funds from Duke Site readiness fund for the drone footage.
ATTORNEY’S REPORT- none
OTHER BUSINESS- New law says that the Redevelopment Commission has to invite Commissioners and Council to a meeting. Randall will send those letters out by the Jan 10 meeting for them to attend a DCRC meeting in March. They also have

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

OLD BUSINESS
Wilker Property Update- Building Commissioner - Bill Shelton- gave a letter to them and Mr Stearns, the Wilker’s attorney. The time limit was up on Dec 1 and Wilker was working past the deadline himself even though it was specified that he was not to do the work himself. Thatcher and Shelton inspected the house on Dec 3. He gave  listing of what was done and what was not finished. Drainage issues are not finished. He says they need to move forward into receivership on this property. 
Mark Stearns- attorney for Wilker- said he just received the letter and going thru it one item at a time. JD was working on cleaning up the site- not performing the construction. He does not see any code violations in the list. Gravel driveways are code- pavers nor required. The catch basin worked on the recent rain that we had. There is no lien on the property. Seeding has been placed and some natural plants left in place to control erosion. Lawyer said they have stayed in touch with county attorney all along and the progress has been good. The catch basin was designed by Hrezo engineering-  and he provided the plans to commissioners. The pipes left out in the side yard are not out of code. 
This boils down to the agreement- not the code- per Thatcher. 
Little motioned that Baudendistel entered the court to appoint a receiver for the property as Wilker failed to meet the Dec 1st deadline.  Passed and approved.
Baudendistel - If the court agrees then they will need guidance on appointing a receiver. He will file that today and wait for the hearing date. Shelton will try to find candidates to act as receiver for the court.

Resolution to repeal Resolution 2014-001- Baudendistel read the resolution that repealed the Lead Economic Development Officer from the County Administrator job description and title. Approved.

NEW BUSINESS
SIRPC- Patty Jackson- Owner Occupied Grant Application Signatures and Public Hearing- $350,000 for owner occupied rehab program- for 15 families in the county. This does minor repairs such as roof, windows, furnaces etc. They have an inspector that identifies the health and safety issues in a home. They must be at or below 80% of the federal income level. Competitive bids- awards in March 2019 if we get the grant. They cannot do work in flood plains or with land contracts etc. 
Probst asked how they select the applicants. This used to be done by Life Time Resources. They use people on their waiting list and its an extensive waiting list. Scored on elderly, disabled, and income level. Cap on each property is $25,000. They are using a $70,000 USDA match money for this grant. They also use an aging in place assessment on anyone over 55. They use energy star items also. 
Board approved McHenry’s signature on the document at his earliest convenience. It included a correction on the agreement from Baudendistel which they initialed. 

2019 Materials Bids- Highway Supt- Tim Grieve- fuel, asphalt, stone, and aggregates.
Laughery Valley Ag out of Osgood won the fuel bid. 
Accepted any and all bids on the other materials. This is because it depends on where the work is being done in the county and transportation of the aggregates, etc. Approved the notice of award of the bids as above. 

Highway Dept - Todd Listerman:
Matching grant program - this year we applied for paving on 6 roads in the county and 50% match.(Stateline from Jamison and North Dearborn, Bond from Stateline to the Ohio, Sneakville, North Hogan from Hogan Hill to SR 48, Hogan Hill, and Sawdon Ridge) We got $996,499.08 for this program. He will develop the contract and will bring that to January meeting. Over 2019 summer they will be paving these roads.

Novation Letters with DLZ- Bridges #5, #29, #108, and #215- Land Water group is leaving the project and being taken over by DLZ. Thee are 4 letters being signed so all have copies of this change. The terms will be the same as Land Waters. The Land Water group is ceasing to exist. 
Award for Bridge #76 Jamison Road. They are all prequalified with INDOT. INDOT is on board with this. Approved. 

$994,275.76 is low bid to Rohe Paving for Bridge #76 Jamison Road.Accepted. Closure estimate is after March 1st and open by school start. Accepted.

Award for Bridge #201, West Laughery Road approach-heavy flooding washed out the west approach. Patched with gravel and concrete reinforced approach was bid. The low bid was Rohe for $58,850. Accepted.

Agreements for Small Structures #211 and #213- Lower Dillsboro Road- additional engineering services from Civil Con Inc. There is a concern with the limitations of the wetland area there. They want to work with Corps of Engineers for this. Wetland delineation report. $4700. Accepted. 

SR 1 Closure and Unofficial Detour Agreement- this covers any damages to the county roads during the construction period of the closure for the work time. The agreement with the county and INDOT. Between Dover and Sawdon Ridge. 90 day closure  somewhere in time from April 1 and Aug 30, 2019. Approved.  

Contract Modification #2 for staking Stateline at Georgetown Road- This is for utility staking and some right of way if needed. The modification was approved with GRW Engineering for this project and NTE $8,060. 

Thatcher asked Listerman to start meeting with him in January. 

2019 PAWS Agreement- presented by Sue Hayden. Basically the same contract and they want to have the Humane Center Advisory Committee stricken( Item #11) as they find they are not using them.They are using the board of directors mostly. $10,000/month. Approved. 

Malcon Proposal- Prep of claims for Fuel Tax refund- presented by Sue Hayden. They met with the auditor and Hayden. This deals with highway dept. and diesel fuel - up to maximum of $1500 for  Malcom’s share of the taxes. They can go back 3 years to recoup. The formula for the refunds is hard to track so this is a way to recoup. 

ADMINISTRATOR – Sue Hayden- nothing more.

AUDITOR – Connie Fromhold  -Claims approved and Minutes held till McHenry is available. 

ATTORNEY – Andy Baudendistel- City Mgr for Aurora will be here for the Conwell St property that the county owns and also some tax sale properties so they can get work done there. This will be at next meeting. 

COMMISSIONER COMMENTS- Little - was slick on some roads- be careful. Salt truck was there.
Thatcher- wished people happy holidays this month 

LATE ARRIVAL INFORMATION- none

PUBLIC COMMENT- Phil Darling- came home a tree had blown down and was rotten. The Rumpke safety guy had put cones out. He had called the dispatch to let the know. One county guy was out there on his way home and saw it and with a chain saw cleaned it up. He went above and beyond to do this. Great they way do extra for the county. Complimented Todd and Tim on the employees.

The purpose of the meeting is discussing strategy with the respect to the purchase or lease of real property by the governing body up to the time a contract or option to purchase or lease is executed by the parties. This is classified confidential by state and federal statute:  IC 5-14-1.5-6.1(b) (2) (D)

TITLE VI STATEMENT FOR COMPLIANCE- was read by Liz Morris

SUPERIOR COURT II – Judge Sally McLaughlin presented by Connie Fromhold
Grant Signature- annual $500-1000. No match. Approved. 

SIRPC – Patty Jackson 
Housing Preservation Grant- USDA Rural Development for matching dollars was received. $70,268. This is 2-3 times the usual amount. It needs to benefit all of Dearborn County. The Council approved using it throughout the county.

LIFE TIME RESOURCES – Sally/Dana presented for guardianship dept. $75,000 with Dearborn Ohio and Ripley with us being the main. Guardianship for seniors. Lifetime Resources providing the match. Approve dot sign the grant.

DC REGIONAL SEWER DISTRICT – Steve Renihan
High Ridge West expansion, US 50- Renihan presented with Doug Baer from public Health Dept - wants funding for Texas Gas and Sharon Dr. problem area. Baer presented the severity of the problem. Majority of homes built in the 60s before the health dept. had septic permits. Enforcement cases are ongoing. Sewer arrangements are a cost effective solution for these residents. Renihan said the sewer plant in High Ridge needs more customers to cover its operating expenses. This is the most densely populated area close to the plant with problems. the is the only project we have that we can serve ourselves- about 49 customers. Other areas will be partnered with municipalities and so they will not bring income into the DCRC fund. This will cost just about $500,000. Need at least 30 customers to meet operating expenses there.They have never compelled anyone to hook on. At least 70% usually sign on in their experience. Realtors are all asking home sellers about selling. Average bill is about $35/mo. They will work out payment arrangements. Some get home equity loans. Some do a 6% interest rate and monthly payments to DCRC. $5000 for grinder, pipe to road, and destroying the septic system. Average new septic system costs $15,000 -20,000. So signing on to sewer is cost effective from the construction standpoint. Some of the homes are older than records in health dept and they do not meet the codes currently. Plant operator costs about $14,000/year. This operator also operates the Milan plant. Once they do this project they will be about at capacity. They can double the plant if needed- and if development comes the development can pay for the expansion. Council approved the money out of Fund 4917. Goodman thought this was a good idea and it helps put DCRC in the black.  

PARK BOARD – Jim Red Elk- long list of items $133,000 in the account. Will get $33,000 in 2019. Asking for is about $47,000. Liz Morris asked him to try to use County Farm Fund 4925 from logging etc. first before capital account. 
Bright Meadows Improvements- building repairs ad split rail fence- $13,000
County Farm Improvements (shooting range)-$2,000
Gladys Russell Improvements-Improvements-Poor system, -powder post beetle infestation in barn, and painting and repairs- $16,750
Guilford Covered Bridge Improvements- pedestrian bridge- $2,000
Misc. Park Improvements- picnic tables- tree removal- $5400
Rullman Park Improvements- electrical service-  $8,000
Kraus said they want to get these things covered at budget time, not really emergencies. Council approved the above expenditures out of park funds. Applied for $25,000 grant for a Kubota and got $20,000 from DCFoundation and will get the additional $5,000 from another source. Approved the above requests.   

COMMISSIONERS – Sue Hayden- presented by Connie Fromhold
Transfer of funds for gas-  $5,000 from a dormant Workers Comp fund to transfer to gas fund. Approved. 

AUDITOR – Connie Fromhold
Minutes from September- two sets from Morning Sept 26 and evening of Sept 26. Approved.
Building Department – Transfer of funds for vehicle repairs for $500  and $500 from 2 different funds. Approved transfer.
Soil & Water – Vickie Riggs (Ordinance update – 2nd and 3rd quarters)- salary ordinance changes needs signature- approved. 
Salary ordinance for 2019 to do the last pay so they can get payroll out next year before their next meeting in January. Approved.  
2019 Reorganization meeting for 4th Tuesday in January- January 22, 2019 - approved for next year. Budget will probably be in August. 
Morris asked Council to look over duties and boards for next year when they need to get appointments. Connie Fromhold will try to get some names together also. They want a better email list and phones of their appointees. 

$6,000 maintenance dept needed transfer of funds for building repair- approved.

20 November 2018 DEARBORN COUNTY COMMISSIONERS MEETING NOTES

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.
Commissioner -elect Rick Probst attended the meeting.

OCRA Blight Clearance Program- Zoning Administrator Nicole Daily with Dr Andrew Jackson, Supt. Sunman Dearborn School Corp- Nicole Daily presented- Planning and Zoning is coordinating with SD School Corp and SIRPC to get a grant thru OCRA for demolishing the old North Dearborn Middle School. They need the county to be the lead applicant for this. SIRPC will do the majority of the paperwork. Our PC will assist with documentation and mapping. The ownership stays with the school for 3-5 years or in coordination to ave an end use for this. The school can’t sell it for profit until that period is over. It could also be a park. There is a contract between the county and the school corp to show the responsibilities of each in this proposal. No questions for Dr. Jackson who was present. The Commissioners approved going forward with the grant. 

Midwest Data Network Systems Support Agreement- Sue Hayden presented- $4500/year for 2019. Onsite at $99 and remote etc at $79. There is a $499 per day cap. Midwest Data has been responsive and wonderful to work with per Hayden. Commissioners approved the 2019 agreement. 

ADMINISTRATOR – Sue Hayden: Presenting for Highway Dept and Todd Listerman:

INDOT- LPA Project Coordination Contract- McHenry read through it- $219,520 for 2022-23.

Parking lot out front of Annex will be closed tomorrow for paving. Register and Eagle radio will put it out on their sites. Handicapped access will be preserved. Prepped tomorrow and paved Friday

AUDITOR – Connie Fromhold  -Claims and November 7th Minutes approved. Also approved the claims schedule for 2019.  

ATTORNEY – Andy Baudendistel- had to file against a property owner and they have a report from appraisers and For Bridge #44 on Turkey Point Rd. No judgement yet. Unknown owner piece is also proceeding through the legal system. Hope to wrap it up early next year.

Baudendistel wanted their thoughts on county administrator’s role as lead economic development officer (LEDO) 
Sue was hired on for the 2012 job description and not the 2014 one with the LEDO in it. Tabled for  discussion at Thatcher’s request. They were going to clean up the position in their resolutions to reflect Sue’s actual duties. They are cognizant of the fact that One Dearborn works for DCRC.TABLED.
