15 OCTOBER 2019 DEARBORN COUNTY COMMISSIONERS MEETING NOTES

Present: Jim Thatcher, President, Art Little, and Rick Probst

Also present: Connie Fromhold, Auditor, Andy Baudendistel, Attorney, and Sue Hayden, Administrator

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

OLD BUSINESS

Ordinance Amending Personnel Policies Handbook- Baudendistel presented this which affects vacation and sick leave and goes into effect on or after Dec 31, 2019. Approved by Commissioners after review at a previous meeting.

Burn Ban Update- Jason Sullivan asked if they wanted to lift it. Commissioners decided to leave it in effect until more rain is received. The board decided that Thatcher can lift it in consultation with the EMA director if more rain arrives before the next meeting.

Bid Openings - SIRPC Housing/Special Projects Manager, Patty Jackson
Jackson Construction - $40,650, $31,960, $38,250, $38,300, $25,300 for 5 homes
Bob Crosthwaite- $27,480, $34,545, $24,760, $27,008, $24,980, $21,500 for 6 homes
Mike Stehlin - $39,850, $46,525, $32,550, $35,700, $29,300, $30,250, $25,820, $38,100 for 8 homes
First Choice - $ 25,690, $44,600, $32,735, $36,275, $44,680, $37,350, $40,200, $41,075, $43,100 for 9 homes
 Board took them under advisement and will approve or disapprove at next meeting after Patty reviews.Grants received for this are  $350,000 from IND Housing and $75,000 from USDA
SIPRC will come in with a rural broadband presentation at December meeting. 

Grant Application Approval- EMA Director, JasonSullivan- salary reimbursement grant for $39,132.40 , Radio grant $89,297.35 , Outdoor warning sirens grant in Moores Hill and Greendale $ 28,849.67, mobile in car radios grant $58,054, Jason’s replacement vehicle $40,000. Approved

Grant Application Approval- Prosecutor’s Office- hard drives etc for Ohio County $2,508 and $9,253.90 for Dearborn CountySpecial Crimes Unit  from Rising Sun Regional Foundation. Approved. 

Planning and Zoning Director, Mark McCormack- Hearings and Ordinances to amend the following Ordinances:
Subdivision Control Ordinance 
Article 3 Section 305 D Access to Arterial and Collector Streets
Zoning Ordinance
Article 23 Section 2310 Procedure for Site Plan Review
Article 23 Section 2320 Site Plan Requirements
Article 24 Section 2444 Approval of Access Points
McCormack explained the text changes and simplification of the process in 305 D and 2444 for many of these requests to allow majority of tech review to approve in many cases. No public comment on either. Commissioners approved. 
McCormack presented 2310 and 2320 on site plan requirements and review. Adding pre-application meetings 2 weeks before. Also eliminating parking space and 4,000 square footage threshold. They also amended process for storage sheds in industrial zone. Wetlands area must require DC Soil and Water review for erosion control requirements. No Public comment. Commissioners approved. 

McCormack spoke about the 2050 Plan for transportation with OKI. They want an updated state roads maintained by INDOT and any trails. Tech review does this. They try to get feedback from Commissioners and Council  and Lawrenceburg and Greendale officials. Some of the other towns are outside OKI’s jurisdiction. There is money associated with this plan for our projects. Prioritization of the roads is important for this. 

ORDINANCE to Amend 96.01 Burning Ban in Code of Ordinances- to prohibit fireworks during a burn ban in the unincorporated areas. Except during July 4 and New Years Eve. Effective 30 days after publication. Commissioners approved. 

ORDINANCE to Amend 34.23 Code of Ordinances and GIS perpetuation Fund and Fee Schedule- house cleaning on this for the membership of the administration committee and allowing a third party to act as the GIS coordinator. Also fee changes. This has to go to Council for approval for the fee schedule changes. Effective Jan 1, 2020.  Approved. 

ORDINANCE to Amend 96 Code of Ordinances - Fair Housing- also at the suggestion of OCRA to update these for federal regulations. OCRA sample was used for the basis of this with some modification by Baudendistel for interior and exterior of the residence. Approved.  

ORDINANCE to Amend 37.10 Code of Ordinances - Drug Free Workplace- this came from OCRA ( Office of Community and Rural Affairs) for to update this to comply with IND and Federal statutes. This outlines the minimum standards. Approved.

ADMINISTRATOR – Sue Hayden
BZA Board replacement- Ruth Ann Stenger- Joseph Schmeltzer resigned and the board recommended Ruth Ann Stenger for the BZA. Approved.

Barnes and Thornburg Engagement for State Legislature Relations 2020- $46,000 for 5 months in session-$5,000 per month and $3,000 per month for the 7 months they are out of session. Approved. They also have a federal government lobbying letter form them later for less money the this. 

AUDITOR – Connie Fromhold  - Claims/Minutes from September 27 meeting approved.

ATTORNEY – Andy Baudendistel- Have an offer on the Wilkes property. Shelton will be meeting with them. Once the property transfers the case will be dismissed without prejudice. 

COMMISSIONER COMMENTS-
Probst- Hazardous material coming through our highways and there is a dilemma for SR 1 to keep it safe.
Little- This Friday there will be Trunk or Treat  out in Bright- Fun event. 6-8 PM North Dearborn Elementary.
Thatcher- Letter sent out regarding spousal exclusion that was approved. Hard decision to make. This was to keep budget to keep the premiums level and not eliminate jobs.

LATE ARRIVAL INFORMATION- none

PUBLIC COMMENT- Sandy Fairfield working with Adult Protective services. Why did vacation change to only taking so much vacation in a 6 month period? They went to a PTO accrual system to avoid people taking it all at once with their retirement and using all accrued and saved days which will prevent them from hiring replacements with the budget being used up on PTO. The new policy takes place in 2021 so that people who had saved this year will be able to use theirs still. Vacation is based on their anniversary date of hire. They will look int the FMLA on provision for major surgery etc.
