25 July 2022 Dearborn County Plan Commission Meeting Notes

Present: Dennis Kraus, Jr., Chairman, Russell Beiersdorfer, Jeff Hermesch, Mark Lehman, Joe Vogel, Jake Hoog, Dan Lansing, Jim Thatcher, and Eric Lang

Also Present: Mark McCormack, Plan Director,  Nicole Daily, Zoning Administrator, and Andy Baudendistel, Attorney.

There were 13 citizens in the room

Baudendistel read the Title VI statement as legally required.

ADMINISTRATIVE: 

Review public comments from the 7/14/22 workshop at Agner Hall in Lawrenceburg.

Review and discuss proposed ordinance amendments and updates to the Zoning Ordinance, specifically with respect to the draft zoning map alternatives and the draft text of Articles 9 and 10 regarding Agricultural and Residential zoning districts , Article 25 regarding General Standards, and Article 27 regarding Definitions.

Mark McCormack reviewed the comments previously from the meeting on May 31st. He reviewed the comments from the workshop on 7/14. Comment on property to keep Ag on panhandle on StationHollow and Chesterville Rd. Comment about walking so far to the building, The police had the parking set to be behind the fence. 

Keller Rd properties were bigger as you go further down. Wanting Ag and had R. 

Georgetown Rd resident wanted to pass on their rights in a grandfathered situation. They also commented on being able to have barn in R1. Also commented on the Rs with more than 5-10 acres and keeping of animals. 

McCormack said he thought that they need to have the animal issues be set for any of these zones with acreage that can support certain animals. Chapter 90 in the state codes talks about keeping off animals. This would be where these animal things come in to play. Ours is mostly about dogs and cats with animal control. Chickens, roosters, horses, exotic animal etc are not covered. We could take the animals out of the zoning codes and have the Animal control handles it. Or they could be covered in the Health Dept. for neglect or nuisance issues. The Sheriff Dept might become involved. 

Ag has been on the left side of Georgetown and  Residential on the right side. Historically it had been the dividing line in that area. 

The man on Wilson Creek and Scenic wants it to be R and it is- but he also noted that others in the area are large lots also. There were comments about building a wall around new sub’s and other ways to separate farms from Suburbia. She also wrote about food scarcity and water issues in 2025.

Most of the people there were specific to their own property issues and others were there for animal issues. Others wanted to be on the mailing list for notifications. 

Nicole Daily said the people she talked to were more about their own property and seeing what it was planned to be. 

OPENED FOR PUBLIC DISCUSSION:

Steven Perrine- 1658 Scenic Drive.- Currently it was Ag and now it s proposed to be Ag Homestead. Currently the bale and sell hay. Doesn’t see any more development on Scenic at that end. The gentleman that owns is now has made it a family compound. He has no intention of selling any of it. There is no magic ball that predicts the future. He sees himself there for 20 years or so. He’s been there since his grandfather had it. If it’s not forested, it’s in hay. Far, is almost 37 acres. He has a large area in hay as seen on the map. 

Mrs. Arnold - 28 acres on Keller across from the Kellers. People couldn’t get off work. They want it kept as Ag. Very steep in the back and sides. It goes down to Mud Lick Creek. We’ve had it 31 years. 

Charles Keller- SR 48 and Keller- House is R zoned. Going down Keller Rd they want to keep the farm in Ag. His son will be building a house on the other end of the property. There is sewer there. They want to keep it Ag there. His son is taking it over. 

Jason Morgan- property touches Kellers. 3 tracts- 7 acres and 10 acres etc, Keeps bees  for 12 years on far back  of it away from homes and maple trees. He has chickens and a rooster. His tracts are all currently zoned R. He wanted to be sure he could still legally keep doing what he has been doing. The answer was yes he was still legal. 

CLOSED PUBLIC DISCUSSION

Board members comment. Kraus Jr. said that he thinks they need to decide what they want to do with the text before deciding on the maps. Lehman- finalize the text first and then tackle the zone map. McCormack said there are things in the text that need to be addressed. Keeping of animals can be thrown out and addressed elsewhere in the county code. Many people had not read the texts and they needed it explained. Some people don’t want government involved in their lives. There is a line they are reaching here. If gov’t does not get involved at all, then there may be problems with issues. 

Discussion of 5 or 10 acres as minimums for Ag uses for animals. Dexter cattle (small cows) would change the numbers also. 

10 acres or more kicks in the right to farm law. Thought might be to have keeping of animals be on any type of zone be set for certain amounts of acreage. Might use animal units rather than specific animals. Many examples of situations that work or don’t with the various parameters on animal amounts. There is concern that R areas aren’t going to want a lot of animals kept on even larger lots. 

Also wanted to talk to a vet with the animal board of health regarding how to avoid neglect issues or to have proper numbers of land acres to feed them etc. 

Baudendistel said people took away from previous meeting - Why have rules if you are not going to enforce them? Really he wants them to know that people need to know that we don’t drive around looking for infractions. 

McCormick said that they do inspect when someone complains. If they see another problem around the area - they will address it too. We have rules in place to address situations when we need it. 

McCormack will update animal provisions for sure. Also look at outbuildings in R zones. Will go with animal units as the board thinks that will work best as more jurisdictions do it. Roosters see dawn an hour before dawn per Beiersdorfer. Dog barking in subdivision is the similar. They will look at that. 

Steve Perrine again- thinking about animal units which makes sense. You need to make it easier to administer. You have grazing animals which need to be fenced. Then chicken and rabbits etc that don’t. Grazing animals factored by weight and so many points per acre. Just a suggestion. 

Chris Mueller- 5 acres with the assessor might need to be checked as it was used to determine ag use.

OLD BUSINESS: 

Libby discussion of Grant Submitted- walkabout the 2 tasks they have been working on since May. 

She talked about Railroad Transload Progress. It was roughly 86 acres but only 40 acres were usable for their access. Carey Transit was looking for a sit. The West Harrison site is off the table for them. There are other Rail sites with Developmental Potential. 

Walker asked about working with sites here and see if current property owners might be interested. Libby thought that having a say in this would be good as we are the locals and know what is available and have connections. This is a dormant task for now per Libby.

American Marine Highway Grant- aimed at taking trucks off the I-70 interstate. There are 5 partners- Ports of Paducah, Louisville, Henderson, Owensboro, and Ingram Barge and Vanderbilt University. Potential Partners are Port of Granite City IL (St. Louis) and Pittsburgh. We did not make the deadline and there was a glitch with them recognizing us as a unique address for getting our SAMS #. There may be interest in more areas along I-70. Looking at Ocean containers and moving them on the inland waterways. Economics associated with short haul. 

They were looking at One Dearborn to help to get this but decided against that due to where the money would land. We can put our application into the next submission opportunity. This grant was to identify sites within SIRPA jurisdiction. And then the costs of it. Then the next grant could be used to get the site prepared, The other task was to understand the free flows and service schedule that Ingram would set up along the river. They want modeling to understand the flow of equipment. There is a box plant going in at Henderson. How to get resources to Henderson and then getting the boxes back to Amazon. One of the original OKI applications was to look at steel from Nucor. She’s looking for other examples of things like this. She talked to CORBA about having a more active role in what we are trying to do this. The Ohio part of this doesn’t have much available to handle something like this.

Meet with OKI to insure freight study includes SIRPA interests

Host MARAD ( Maritime Administration) round table for this. Meeting space and catering and labor to do agenda- grant funds can pay for this - otherwise SIRPA pays for this. Ingram was excited about this. 

MARAD is the Marine administration at the Dept of Transportation. They have funding that will help. In 2018 the application process changed. She asked if Ports of IN would want to be part of this process to show they were active. They were only under the  old application process and the new one required them to show they were active. Joining us would help them do that. Many of the old projects were not networks. This process under CORBAs goal of taking trucks off I-70 corridors would be a network. Not just a single line such as pointA to pointB. We need to be sure that our projects are in their priority list. 

The money won’t come in to 2025 for the grant if we get it in the 2023 round. 

Balancing federal gov’t and shippers. She wants to have us host a round table with MARAD. She thinks with all the partners there would be 35-40 people. IVY Tech would be the location and there is no charge to non-profits. She wants to look at others like Monroe that hosted one and mirror that to see what the agendas are and also the people to invite. The box factory has been silent.She wants to work with CORBA for Sept -Oct. And then do this in early 2023. Weiss noted that OKI and CORBA had to be with us. In first qtr of 2023 we will hopefully have more people involved to bolster our application. 

Thatcher asked Krantz if he’d followed up with OKI and the EV stations. Libby said she will follow up on that to see what OKI is thinking on this and this would give SIRPA a venue stream. She noted we have to find an IN source for that funding. OKI came in on July 7 and talked about the VW settlement money used for this. They did not have anything at the state level. A handful of power companies are involved to try some of this too. IN has not done this like OH has. OKI has an intern for IN to look at our EV situation. OKI has money for OH and KY for this but IN seems to go unnoticed. Rodoshi Sinta is the intern assigned to IN for EV. Libby will get with him and Robin at OKI regarding the 3 different finding programs. 

Libby wants a contract  or task order for her tasks that SIRPA to continue with her tasks. She cannot invoice without a contract.

NEW BUSINESS

Bid Award SS#111 and SS#112 County Engineer Todd Listerman- small structures on Station Hollow Rd. Bids open July 13th. 

Rohe Paving - $509,530- low bid within estimate.

McAlister Excavating- $519,651

Sunesis Construction - $555,779.65

Commissioners approved the award of the contract to Paul Rohe Paving as lowest bidder. 

Probst asked about the difference in these structures versus Weisberg’s. Listerman explained that the design depends on where it is, the hydraulics, and other maintenance costs and life-cycle costs. Small structures are 20 ft or less. There has to be more cover for some other designs. Every structure is independent. Commissioners also asked Listerman to check road issue on Stateline Rd hill. 

Bonnell surface will be finished tomorrow. Had paver breakdown today. Striping bid will come in on Aug 2 meeting. The fog seal settled the issue that residents came in to a recent meeting complaining of the chip seal. They are now happy with the end result per Thatcher. 

Highway budget submitted. Also working on Community Crossing matching grant also.


ADMINISTRATOR – Sue Hayden

Resolution 2022-004 Transferring Personal Property to Aurora Emergency Rescue- These are Toughbook laptops and docking stations. Sheriff dept gave some of these last month to others. These are for Aurora. Approved by commissioners. 


Not on agenda- another item- Jim Bischoff in Dec 2021 had American Discovery Trail support letter for Rep Pence for house bill. Now needs one for Braun and Young for the Senate version of this. Commissioners approved the letter.

Present: Diane Bender, Chairman, Jim Deaton, Jim Helms, Dave Deddens, and Alan Goodman.

ABSENT: Jamie Graf (non- voting school board member)

APPROVAL OF MINUTES- May 12th minutes approved 

CLAIMS AND FINANCIALS

Claims – Drake Lawn & Landscape $1330.00 for: mowing Aurora (8 times), mowing Guilford (4 times) and mowing W. Harrison (4 times) also spraying Guilford twice and Harrison once.  One Dearborn 2022 2nd Quarter payment $10,000.  Hylant $100 for INDOT Blanket Bond for tree removal and reimburse Dave Deddens for flowers $100.00. All approved. 

Connie Fronholder, Auditor- Hire Baker Tilly to prepare tax calculation neutralizations - approved. 

OLD BUSINESS:

Economic Development Agreement with Mohr Capital- this was approved by Council and Commissioners. Approved to sign the agreement with Mohr Capital.They will attach the Council abatement resolution to record. 

West Harrison Billboards- INDOT cannot find a permit ever issued. Stone said it was a verbal agreement. Bruner passed away at INDOT and no one knows where it was. Deddens hoped they were grandfathered in. Dyke was told by Diane Bender to not pay any more on the billboard till they get it settled. Board agreed. Deddens to take pics of them. 

NEW BUSINESS:

Annual presentation to taxing units- Mike Perleberg- One Dearborn- by statute this is required.

Indiana Gateway posts this info for this wishing to see the report. Basic diagram of how TIF mechanics works. Impacted entities are listed for the TIFs. Bonds can be issued, projects in the TIFs with positive impacts. West Harrison and Whitewater Mills, St. Leon TIF, West Aurora.

Showed the bonds, debts, and money coming in and out. 

St. Leon- $2.2 million.

West Aurora includes Kaiser Pickles has $2.1million tax attributed

West Harrison expanded in 2021 to take in West Skally area- $3.8 million

Whitewater Mill - includes Brighton Mill- $22.4 million 

  

Civil Engineering Services RFQ- Perleberg had sent responses from June. This is for any projects the DCRC wants to do. They all came in yesterday at deadline. 6 firms responded. Cover letter an dfee schedules were included in packet. There will be a review committee set up to respond. They can decline all or accept all or a portion of them per the RFQ. Deddens declared son co-opping with Bayer Becker now so he has a conflict of interest. Tabled for now to review. Perleberg said One Dearborn could use a scoring rubric on this also - board agreed to use that also. Some of these are One Dearborn investors so Perleberg will stay out of the decisions and discussions. 

SEI READI Match letter- $15million reward for the region. They want us to focus on areas where growth is happening or reasonable expect to grow.They have selected the West Harrison/Whitewater Mills District. The project is the I-74 West Harrison project with $2million needed to do that. We have enough to match the 1-1 public match and 3-1 match for the private sector ones. Included fill dirt and access driveway, sewer, utility lines etc. for projects. READI will have $700,000 -$1million is the potential award.DCRC has to commit to up to $500,000 to match for this. DCRC board approved the up to $500,000 match.

Goodman asked if there would be help for a firehouse in West Harrison because of the ongoing growth. They are looking at this in the future. 

In response to Deddens about St Leon meeting- There was a meeting in St Leon that Franklin County atttended and Perleberg was there.     

Determination to Capture Tax Increment Revenues- Resolution DCRC 2022-001- this goes along with the letter from June. This goes on Indiana Gateway also. Approved.

Ratify Signatures on Letter on Intent to Capture Tax Increment Revenues- approved to ratify Diane Bender’s signature.

2023 Budget- is the same as 2022. Approved

ONE DEARBORN REPORT: There is a One Dearborn report out. Some highlights. Helped 8 small businesses in the county for website help and digital inclusion. Agribusiness conference at 4H fair- 30 attended. 50 RFIs came in and responded to 27 this year so far. 

ATTORNEY’S REPORT- none

OTHER BUSINESS- Deddens said someone wants a business by BP and Civista and to know if they can get help from St Leon TIF to build a connection road back there. It will be another year before the intersection is approved now- has been pushed back. He will get a map for them to consider next meeting.

Perleberg said Bender and he and Commissioner Probst had a conversation regarding Randall Avenue. It’s in the TIF District. County may be asking for help.
