28 April 2017 Dearborn County Commissioners EMERGENCY Meeting Notes

Baudendistel read the Title VI statement as legally required.
NEW BUSINESS: Baudendistel: Meeting asked for by Baudendistel after hearing about this from Mark McCormack, from Planning and Zoning.
Wireless support structures SB 213 is overly broad and it allows local municipalities counties towns etc to establish
Miller, Smart, and Weldon, attorneys for the 3 cities were involved.
Designating all the incorporated areas to have underground utilities not just the the current subdivisions preserves the ability to control cell tower placements. This can be amended later as needed. The governor has’t even signed this law. Even if he doesn’t the deadline still stands. The law does not change anything as far as co location or on maintenance and repair.
McCormack: explained further saying that there are areas of the county that could be impacted like Bright where they have a lot of underground utilities. Development standards favor getting the utilities underground. They need to have consistency so as to not discriminate on standards. The cities are more impacted as they are placing more small cell structures on buildings or towers etc.
Discussion around the ability to control some of these issues. Carmel IN, Decatur, Shelby and Johnson County are all watching this bill over time. Baudendistel read off the names of the authors of the bill. McCormack says its a bad bill- they should have worked longer on it. AIC (Association for Indiana Counties) and other entities for municipalities were all against the bill as is. It effectively eliminates our home rule over our own right of ways. It was being pushed by industry. McHenry said the deadline said it shows it intends to deceive people. Tech needs to be advanced but not this way. They were thankful to Mark for keeping them in the loop and getting this out in time. McCormack found out April 25th that they had changed it. That gave us 5 days to react. Listerman said Mark kept them up to date on how the affects our right of ways.
Asked for my thoughts on public impact. I told them I was surprised that they could take more liberties than even a public utility generally gets. It would be a taking if this were private property. Instead they are taking the public right of way for themselves.
All our reps voted for it. In their defense, Baudendistel said they probably didn’t see the last minute change with a short deadline. I said- that even with that- they should have had an issue with the immense latitude they had with the entire public ROW.
Resolution is to cover us using the blanket approach for protecting the whole county. Baudendistel read the entire resolution.
RESOLUTION NO. 2017-_2____
SHORT TITLE: RESOLUTION OF THE DEARBORN COUNTY BOARD OF COMMISSIONERS WHICH IDENTIFIES CERTAIN AREAS OF THE COUNTY AS AREAS DESIGNATED STRICTLY FOR UNDERGROUND OR BURIED UTILITIES
WHEREAS, the Dearborn County Board of Commissioners (“Commissioners”) have jurisdiction over street right-of-ways within the unincorporated areas of the County of Dearborn, Indiana (“County”) and is the permit authority of such municipality regarding the use of County street right-of-ways; and
WHEREAS, Senate Enrolled Act 213 has been enacted into law and amends Indiana Code § 8-1-32.3 as of April 30, 2017 to allow the use of the County’s street right-of-ways for the construction, installation, and use of small cell facilities and wireless support structures; and
WHEREAS, such legislation allows the permit authority of a municipality to designate areas as strictly for underground or buried utilities, provided that such areas are so designated before May 1, 2017; and
WHEREAS, the County, through its Commissioners, desires to designate areas within the unincorporated areas of the County as strictly for underground or buried utilities in order to restrict or prohibit the construction, placement, or use of a small cell facility and the associated supporting structure within the County’s street right-of-ways in such areas where investments have been made to ensure utility lines are located or buried underground.
NOW, THEREFORE, BE IT RESOLVED BY THE DEARBORN COUNTY BOARD OF COMMISSIONERS AS FOLLOWS:
1. Purpose. The purpose of this Resolution is to adopt a local policy regarding
the designation of locations within the unincorporated areas of the
County as underground or buried utility areas pursuant to Indiana
Code § 8-1-32.3-15(c)(1).
2. Designation. The County, through its Commissioners, hereby determines that
various developers and homeowners located within the
unincorporated areas of the County have previously made
investments to ensure utility lines are located or buried
underground and, therefore, in an effort to continue this policy, all
subdivisions located in the unincorporated areas of the County
where utility lines are currently located or buried underground are
hereby designated as areas strictly for underground or buried
utilities pursuant to Indiana Code § 8-1-32.3-15(c)(1).
3. Restrictions. With respect to the construction, placement, or use of a small cell
facility and the associated support structure, the Commissioners
hereby restrict and prohibit the placement of new utility poles or
new wireless support structures in the designated areas of the
County right-of-ways as outlined in Section 3, except as otherwise
permitted in Section 4 of this Resolution.
4. Exceptions. Notwithstanding the restrictions and prohibitions contained in
Section 3, above, the following provisions shall be met and the following exceptions are hereby permitted:
(A) Collocation of small cell facilities on existing utility poles and wireless support structures within the unincorporated areas of the County are allowed;
(B) Repair and/or replacement of existing utility poles and wireless support structures within the unincorporated areas of the County are allowed;
(C) A petition for a request to install new utility poles or new wireless support structures within the unincorporated areas of the County may be filed with the Commissioners which shall hold a public hearing on such petition within thirty (30) days of filing, and upon which a decision shall be made by the Commissioners within sixty (60) days of such filing;
(D) Upon receipt of a petition for the construction, placement, or use of a small cell facility on one (1) or more new utility poles or one (1) or more new wireless support structures in the unincorporated areas of the County, the County shall post notice of the petition on the County’s Internet website with a statement that the petition is available to public upon request; and
(E) The prohibition or other restrictions with respect to the placement of new utility poles or new wireless support structures within the unincorporated areas of the County shall be applied in a nondiscriminatory manner.
5. Emergency. Due to the statutory deadline by which the Commissioners must
take action, an emergency is hereby declared and this Resolution
shall be binding and effective immediately upon its adoption and
execution. Should Senate Enrolled Act 213 not become law for
any reason, this Resolution shall not take effect.

VERIFICATION OF INFO DISCUSSED IN EXECUTIVE SESSION- The board verified that they only discussed the potential employees as stated in their advertised purpose for the session as deemed confidential.
ACTION OF EXECUTIVE SESSION- No action from the session per Deaton.
APPROVAL OF MINUTES- April 13th minutes approved
CLAIMS AND FINANCIALS- no claims
Review of Financials were passed around. No questions on those.
UNFINISHED BUSINESS:
One Dearborn Contract tabled from April 13th- Board decided that based on the personnel discussions from executive session this remains tabled.
NEW BUSINESS:
USDA Contracts for farm property- Ag Risk coverage- County Option and Price Loss Coverage-because the Stone property is farmed again this year. This allows the government credits to go to the farmer. No payment on this. There are two parcels and two forms. These are common.
ECONOMIC DEVELOPMENT OFFICER’S REPORT: closing is tomorrow on the Aurora property from Paula Kramer. Then they can move forward on signal etc.
ATTORNEY’S REPORT- Andrea was not present.
OTHER BUSINESS- none
Want to reschedule the meeting on One Dearborn. Need to have attorney there. Set for April 27th at 8:30 AM.

HIGHWAY DEPT. Todd, Listerman, County Engineer: All the following were approved by Commissioners:
Bridge #24 - Cold Springs Road - Contract Supplemental 1- INDOT shifted the funds to fiscal year 2018. It will start in spring 2018.
Bridge Inspection Contract Supplemental 1- INDOT bridge inspection requires scour inspections now. This updates the contract to cover the additional funds at an 80/20 split. There is an additional charge for the additional inspection.
Bridge #108 - Harrison Brookville at Johnson Fork Road- Contract Supplemental 1- Last fall the county was awarded federal money for this. This is for additional work required for the federal dollars. $135,000 is contract total with Land Water Group and Dearborn County.
Report of Contract B-33278 (Collier Ridge) Final Inspection - work was completed and final inspection done in July, 2015- and this is a catch up on INDOT’s paperwork apparently.
Bridge #5- East Laughery Creek near Gregory Road- Federal aid money to replace this to realign this to take part of the curve out in 2019. To get the necessary permits we need to sign this report to IDEM to limit environmental impacts.
ADMINISTRATOR- Terri Randall- was contacted by Tim Grieve and working on quotes for dump trucks. $92,242 plus from Lischkge Motors was the lowest of 2 bids. Commissioners approved this as a Not To Exceed that amount.
AUDITOR- Connie Fromhold covered for Gayle Pennington- April 4th minutes approved. Claims approved.
ATTORNEY- Andy Baudendistel- nothing
COMMISSIONER COMMENTS- Lynch- thanked Lawrenceburg for handling the state legislators town hall for the public- was well attended even from other counties.
Little concurred.
McHenry - thanked every one for the flowers etc and support during that time. (His grandmother passed away) Annex is staying on time and on track.
PUBLIC COMMENT- Tom Niedenhauer lived in HVL- he sent emails to Chip Perfect, Randy Lyness, and the Council and Commissioners. Only got an automatic computer generated answer from Lyness. His concern is the bottles and garbage on the sides of the roads. He travelled for 29 years for Agriculture in Michigan and they had a 5 cent deposit on bottles and cans. Nevada does this also. Now they are a dime per cans and bottle in Michigan. They have CLEAN roadsides. Ten other states have this deposit. People who clean this up say 3/5 of the containers are alcohol ones. He wants to know where to start with the cleanup. McHenry said to contact the state legislators. He asked if Shane would do that. Shane agreed to pass this on to them. He will contact Tom with that info.
Chris Mueller- asked about Skally’s Old World Bakery status with the West Harrison TIF. Commissioners asked Terri Randall to answer the question. Randall said they didn’t want to say too much as this was Skally’s story to tell really. Skally’s is stalled. Skally’s parted ways with their developer early on in the project. Randall had spoken with them as the DCRC was holding the property for them and needed to know if it was going or not. She told them they could come back to us when they are ready to make the commitments. The problem was all on Skally’s end. They are not going to move forward. What will happen to that property? Randall said they are proud of what we did on this. A lot of work went into getting that Skally’s TIF district set up. The property is open now? Yes. She plans to start marketing it now. There’s a lot of interest now so that is good news. What about the bonds tied to this? Randall said - The bonds were queued up. But nothing has happened with them. No actual bond documents created as that is an expensive step. Didn’t close on the land, so the bonds didn’t happen. It’s all still in the county hands, with the bonds queued up for another business perhaps. She said that any other information could be gotten from Skally's.

[NOTE: ONE DEARBORN is a local group of private business leaders hoping to partner with the local government using private funds and PUBLIC TAX DOLLARS to promote business and development. They were present at last Thursday's special meeting on April 13 with DCRC which was supposed to be for the West Aurora TIF area. Please note the notices posted below for that previous meeting. Why was the 2nd purpose not listed on the meeting purpose? Why were several members of Dearborn One present at a meeting called for the West Aurora TIF?]
DCRC will hold a special meeting to consider One Dearborn’s proposal for services as a new LEDO (local economic development organization). Other administrative items may be discussed.

The proposed amendments, which have been preliminarily approved by resolution of the Commission, would amend the Plan to add certain additional projects and to include the purchase of two (2) parcels that are located within the existing Allocation Area with the intention of making certain improvements on those parcels that would benefit the Allocation Area by encouraging business growth.
Written remonstrances against the proposed amendment may be filed by no later than 6:00 p.m. local time on April 13, 2017 in the office of the Dearborn County Redevelopment Commission, Administration Building, Commissioner’s Room, 215B West High Street, Lawrenceburg, IN 47025.
At the public hearing, the Commission will hear any person interested in the proceedings and will consider all written remonstrances and objections that have been filed and will determine the public utility and benefit of the proposed amendments to the Plan. Maps and plats for the Economic Development Area have been prepared and can be inspected at the office of the Dearborn County Redevelopment Commission at the address listed above.

NEW BUSINESS:
HIGHWAY DEPT. Todd, Listerman, County Engineer
2016 Annual Operating Report for Local Roads and Streets- copies already given to commissioners. Receipts taken in were $5,830,514.56 Expenses were $7,069,048.47 It lists all the major projects for the year. Commissioners signed off on the report to be sent to INDOT.
Utility Reimbursement Agreement with North Dearborn Water for Bridge #77 on Woliung Road. This is the Community Crossings Grant project. The water line needs to be relocated. Commissioners signed the agreement.
Let Bridge 43 Platt Road- Centurylink needs to relocate for that project. Started later this month and reopened by August 1st.
Bridge 138 - cleared ROW for RR crossing- pre-bid meetings next week and letting this on the 20th of April- to start in May and done and reopened by Christmas.
Woliung Bridge 77 is ready to start when the utilities relocate.
Let Cold Springs Road late this year.
Jamison by Losecamp is working on the funding with this- perhaps Community Crossings Grant.
50/50 Cmmunity Crossings match program - looking into that also with Council.
Need permission to go to Council to set aside Rainy Day funding for the Community Crossings 50/50 grant program. We don’t have a wheel tax so have to use rainy day. Old to go to Council
ADMINISTRATOR- Terri Randall- nothing today
AUDITOR- Gayle Pennington- Veteran’s Officers transportation fund grant form Lawrenceburg- approved and signed by Commissioner McHenry.
Minutes for March 21st meeting approved. Special Meeting Minutes from March 28th approved.

ATTORNEY- Andy Baudendistel- nothing today.
COMMISSIONER COMMENTS-
Lynch- Spring Forward- check smoke detectors- be more alert to kids outside and laying on bikes more.
Little- Annex coming along and roof is on and drywall starting.
McHenry- wishing his daughter Lauren a happy 12th- doesn’t know where the time has gone!
