Master Plan Land Use Element- PUBLIC HEARING

Land Use Public Hearing

The Dearborn County Plan Commission will hold a public meeting to review the draft Land Use Element of the Comprehensive Plan on September 24th, 2007 at the Administration Building (in Lawrenceburg). The public hearing will begin at 7:00pm, although the proposed Comprehensive Plan amendments are not scheduled to be reviewed until decisions have been rendered for all other case-sensitive items that are on the agenda.

Following the presentation of these items, the Plan Commission and its staff will review the Land Use Element update and will field and address questions, comments, concerns and recommendations from all interested county property owners, business owners, and residents.

All interested parties may obtain an agenda or staff report for this meeting by visiting the Department of Planning & Zoning office-located on the third floor of the Administration building-or by accessing these items online (via the 'PUBLIC NOTICE' link) at the following website: www.dearborncounty.org/planning

Background

For the past 2 years, the County Plan Commission, its 58-member Advisory Committee, and the local planning staff have been building upon the land use framework set forth in the original, adopted Comprehensive Plan. These groups developed alternative land use scenarios in consideration of the feedback returned from 4 public workshops (which included 533 surveys) as well as the findings and recommendations forwarded by the active membership of the Advisory Committee during its 12 meetings.

The current proposal for the updated Land Use Element features the following amendments: revised existing land use maps; an amended series of future land use designations; new land use criteria maps (that may be referenced to establish a community "base map"); a future land use map guide; two alternative future land use maps; and a preliminary implementation program.

Some of the critical items that the Plan Commission will consider during the public hearing process include:
1) which future land use map, and map palette, to forward to the Board of Commissioners for its final consideration and action; and
2) whether specific geographic areas identified within the Land Use Element should be analyzed or modified further.

Public Review & Comment

Hard copies of the draft Land Use Element and the existing, adopted Comprehensive Plan will be on display for public review at the County Planning & Zoning office as well as the public libraries in Lawrenceburg, Aurora, Dillsboro, and Logan Township. Digital copies of the plan may also be obtained online by referencing the 'Land Use Workshops' link online at:

Public comment forms are also available-both online and at the aforementioned locations-for those who would like to forward their written comments or for individuals who may not be able to attend the September 24th meeting.

To date, since the plans of the the DCRSD have been stymied by clearer thinking and honest people, I have not had to withdrawl money from my children's college fund to pay for the sewers of my local realtor/developer...

I live on a farm located in this County.

Please build a "Kwiki-Mart" and a strip mall on the farm to my East and a Business Park on the farm to my West...I just hate being a contributing factor to all the "NO WHERE" that is happening across this County!

Could I maybe offer up a larger share of my tax dollars and my savings to save us all from all this "NO WHERE" creeping in amongst us all?

Would it help if I testified to the fact that I think my septic tank has led to more birth defects and developers and lawyers than lead paint and disco?

No, they cannot get over the fact that there are those who would force the rest of us to subsidize their developments!

I have seen a number of homes popping up on what was once farm and woodland, while sad, you do not see me protesting such!

Why?

Because they are not using their political connections to try to force me to finance their homes!

Further, we all know development will happen. But we also understood it would happen from the centers of existing infrastructure out.

But now, development interests in government are willing to force existing home and property owners on to sewers for no other reason than to grease the skids for more development into rural areas.

Which only makes sense and profit for a few "connected" realtor/developers! There are already hundreds of homes that are not selling around this county. To add more homes, at subsidized prices, would only exsacerbate that problem.

Forcing existing homes on to sewers at tens of thousands of dollars will further leave these homes unmarketable!

So please, how about offering some real solutions to "YOUR" development problems, minus the need to force others to contribute their savings to your projects and without over-taxing our infrastructure to pad your bottomlines!

With development, they can only use their own money for the initial setup. After the land is bought and the home is built and the road is accepted, then the taxpayers are the maintainers of the infrastructure including emergency services and schools.
To stop all development is foolhardy, as teh population within a community- even if no one immigrates in - will grow. To remain stagnant and only allow insiders to live in a community is unwise also. (You need some new blood to marry into the community!)
However to outpace the finances of a community with growth that is too rapid or FORCED- is what most of the Dearborn County community is "railing" against.
One of the Plan Commission members called it "pace and place"- put development in the appropriate place and at the appropriate pace for the community to fiscally handle it.

And it would certainly be nice if those involved in the planning of this "pace and place" in local government would let everyone know what they are planning, unlike the NW Quadrant debacle where there were realtors canvassing the area trying to buy farm land at farm land prices with their inside information, before the owners of this land had any idea what was transpiring!

It should not be the task of local government to see to it that realtors and developers profit at the expense of those who own the land!

Obviously, informing the County Citizens in the NW Quadrant would have raised the price of their land, if they were willing to sell it, making less profit for the realtor/developer!

But this County does not owe the realtor/developer any more than it owes the County Citizens of the NW Quadrant!

At least that is the way our government should handle such matters!

But with development interests so prominent in local government, all energy was focused on the profits of those involved in development, even if other County Citizens were left with less!

Those of us who live out in the "sticks," near East Jesus, thought we were safe from any type of "dense" development, due in part to the costs to a developer, or developers, of running sewers so far from existing infrastructures.

Never in a million years would we have imagined that our local government had become so corrupt, as to force those of us already on functional septic systems, on to developers sewers, to help these developers with their dreams of making a "killing" buying up farm land to later have it rezoned to residential or commercial, by their accomplices in government!

...are just getting "darned" impatient with the slow pace of development in and around this County!

I live out in the middle of "no where," I keep asking myself:

"Where is my traffic! Where is my congestion? Where is my pollution! Where is my higher property taxes? Where is my bill for excavation and the costs of the number of grinder pumps I would need to hook onto those friendly developers' sewers? Where is my ever-increasing monthly sewer bills?"

St. Leon may not be crooked- more likely they were the victim of their consultant engineers who helped them set up a large web of sewer lines in the area. 40 miles of sewer lines in what was essentially undeveloped area required that they hook on as many as they could.
Now if they'd been gravity lines- they would have covered far less mileage and we wouldn't be seeing this forced hook-up debacle- as it wouldn't be necessary.

Let the the Land Use Map be adopted so it will allow the developers to proceed with development. Therefore, the people that do not welcome development cannot say a thing. Rezonings will be more viable, new sewers can be layed and development will accelerate.

Then the "heady" days of the realtor/developer buying up the first farm that comes up for, then having his pals in government rezone such land and force others to pay for sewering said land, will finally be over!

Now developers can work with other developers to share the costs of sewering their respective projects, within the bounds of what existing infrastructure can allow, and they won't feel compelled (because development flunkies in government in the past made it so easy to do so) to steal from the rest of us!

And those developers who cannot compete within such a fair system...could look into job retraining!

I have been trying to understand how you think developers steal from you, but I can't figure it out. If I developer wants sewer they pay the utility company a fee for the sewer and then they pay the cost of installing the sewer. They also pay for the review of the construction drawings for the sewer.

Just because you think that things are corrupt in this County doesn't make it so. Just like...just because you think you are the only one that lives in this County, doesn't make it true.

If you live on a parcel of land capable of supporting a septic system, because of land mass etc, but a developer decides to build, for example, a subdivision in your area, but cannot afford the costs of running sewers out to his/her subdivision, it is theft when he/she uses his/her political connections to force you on to HIS/HERS sewers to subsidize such sewers!

One day your septic system is "legal," the next day, you are required to hook onto sewer and the only variable in the mix is that a developer now wishes to "densely" develop land in your vicinity!

Thus forcing you to pay all the costs of excavation, grinder pumps, hook-up fees and whatever the sewer rates may end up being.

For a “sewer” connection you did not legally need nor for reasons of public health...require!

And thus…again…you are left with theft!!!

I hope that better aids your understanding of what a hand-full of realtor/developer/banker/lawyers have been attempting to do, to your neighbors!!!

We've all read about the guy that will cost $50K to get to the line, but that's always been claimed just to GET to the line, that doesn't explain how the line gets there. And it is my understanding that tap fees are not for line expansion. Where is the subsidation of the sewer?

Yes, I would call myself pro-development, but do not agree with the practice of "forced hookups". If your septic works fine, by all means continue to use it. I know nothing about the "failing septic system" situation so please don't throw that back.

Well, the DCRSD has every intention of not only "PRACTICING" FORCED HOOK UPS...THEY INTEND TO MAKE INTEGRAL IN THEIR FINANCING OF DEVELOPMENT'S SEWERS!!!

No development in your area planned, no need to force you on SEWERS!

Politically connected developer plans development in your area, all of a sudden your area needs SEWERS!

You are forced to hook on to such sewers, to pay "YOUR SHARE" of the these sewers...which "YOU" did not need or request!

The developers need to force hook ups to these SEWERS to PAY for these very SEWERS!

With out your guaranteed dollars, they cannot SEWER THEIR developments!

If it costs you $15,000.00 or 50,000.00 to hook up, the "politically connected" developer and his flunkies in government, do not care!

Just as long as YOU pay YOUR share of SUBSIDIZING the developer's sewer line, if not an entire new SEWER TREATMENT PLANT, to service this developer's development!

For example, the DCRSD has no means or plans to SEWER development other than by FORCING HOOK ups of existing home and property owners, presently on FUNCTIONAL septic systems!

No choice is offered to those they would FORCE onto THEIR SEWERS, to SUBSIDIZE development of another!

There are no lines or sewer capacity near the proposed development on 50 between Aurora and Dillsboro.

No funds are available to sewer this proposed development.

The only potential capital and collateral the DCRSD has to take to a bond bank, to finance these sewers, is the "forced hook ups" of existing homes on 50 and nearby secondary roads.

So if you are against "forced hook ups," you are against the very "existence" and "business plan" of the DCRSD!

Still no real answer on how the line GETS THERE. Closest thing was someting along the lines of the monthly fees cover it, but the monthly fees are for the service itself.

I saw a lot of quotes referencing that post and no answers, just a lot of CAPITAL LETTERS and !!!!!!!! and ......

System developement fees to cover the sewer lines and processing pro-rated over 25 to 30 years (any legal time frame). That way the development will pay for its own upgrades and not force others not needing the service to pay. The same will work for Highridge, Gabbard, Guilford, Dendridge and Stewart street.

And last but not least, the taxpayers don't need a DCRSD in the middle SCALPING ADDITIONAL FEES to promote the developer/realtor new housing developments while pretending to fix polluting areas!

Dissolve the DCRSD!

Stop the scalping of taxpayer money!

Monthly fees pay back the bonds or loans that built the sewer treatment plant and lines in the first place.

Which is why "politically connected developers need to get "everyone" to hook on to their sewers to service development to lower the developers' overall costs!

Without forced hook ups there would be no lines nor sewage plant!

Sewage plants and infrastructure are built by loans...which are "paid off" through monthly fees!

However, if a developer cannot force others to "share" the cost of a new sewage plant and lines and he does not want to pay any more money out his his pocket, then no sewage plant nor lines!

So what do developers do?

They get on sewer boards to try force others to subsidize their developments!

Right now, on 50 where some of this proposed development is...there are no lines nor sewer capacity to handle these development. Further, there are no developers willing to shoulder the entire burden of building a sewage plant and running lines. So developers devise schemes such those on the DCRSD to force those on existing, functional septic systems on to the developers' sewers to lower costs for the developers' development! As selfish as some of these developers are they do not care that this would force many to remortgage their homes and properties to pay for such sewers!

Development...at any taxpayer cost!

The sewers are initially paid for by tap fees and bonding. Bonds are simply a loan to the sewer board that must be paid back over time by the people connected to the sewers, above and beyond the service (treatment) they use. If there are too few people forced to pay for the sewer the cost for each house goes up accordingly. If only the developers are paying for the sewers the first cost is very high, plus the monthly fees will be so high, no one will buy their houses.

The rest of the costs the homeowner is forced to pay are those incidental costs to put pipe in the ground, a grinder pump, electric and abandonment of the septic tank. They don't cost the sewer board anything. They do cost the homeowner, so they can get to the sewer line to tap in and to push the sewage to the line after they are tapped in.

Without the tap fees and bonding, the developers couldn't make much profit.

And this does not even consider the costs to improve the roads, schools, police, fire departments, EMS county administration and jails to support the development, nor the increase in utility costs, like electric, to build new lines or upgrade existing lines.

Let the developers pay all their related costs and see if the will buy up 'cheap' undeveloped farm land out in the middle of NO WHERE.

Or developers that try to OVERBUILD in areas with sewers and a master plan that prohibits the overtaxing of the existing infrastructure (roads,schools, police, fire and emergency services).
These type of developers are modern day "Getto Builders".

Eight feet between clustered " spit and hit" houses eats up infrastructure that will be a big drain on the county taxpayers IF the commissioners let this type of development take place without the Developers paying their fair share of the cost.
The farther from EXISTING INFRASTRUCTURE that the "clustered developments" are allowed the greater the cost and burden the taxpayer.
