Present: Jim Deaton, Chairman, Dennis Kraus,Jr.,Tom Tepe, Trevor Bischoff, Jordan Hoffman, Jim Mansfield.

ABSENT: Doug Baker, and Daryl Cutter (non- voting school board member)


Also present: Sue Hayden, county administrator and minute taker, Anthony Smart, attorney, Connie Fromhold, Auditor and DCRC treasurer.

EXECUTIVE SESSION @ 4:30 p.m.

IC §5-14-1.5-6.1(b) (2) (D) which pertains to discussing strategy with the respect to the purchase or lease of real property by the governing body up to the time a contract or option to purchase or lease is executed by the parties.

Memorandum of executive session- board certified that they only discussed what was advertised.

Smart Law $6240 for legal services  9/5 thru11/5 2025- Kraus,Jr asked about when the board approves the attorney meeting with other entities. Anthony Smart answered that he does attend meetings and executive sessions, if they want that to change that just notify him. There was no answer about him meeting with other entities ( Like One Dearborn???) Kraus said he is new to board and wanted to understand how this relationship operates.

5:10 P.M. PUBLIC HEARING -no public spoke 

  1. 2025 Whitewater Processing Allocation Area- This is about the reTIF of that area. 

Board Discussion- Jordan Hoffman- were the landowners notified that they might be TIFed. Perleberg- Yes- The Kopps own the 2 parcels that are going to be TIFed. APPROVED


OLD BUSINESS:

Confirmatory Resolution for Whitewater Processing TIF Allocation Area- Approved and Signed

Declaratory Resolution for Clay Township Economic Development Area and Allocation Area- this is corrected one with the list of parcels. This extends out to Stoops Road. 

Perleberg presented tonight. He went over the way a TIF operates on getting only the excess tax money over the base tax amounts at the opening of them TIF. At the end of the 25 years it will then go back to the county. The allocation areas are where the revenue is actually collected. 

To promote a resilient Dillsboro area and take blighted properties like along Lake Dildear. The DCRSD is investing a few million dollars getting sewer out there. Larger strategy- they have seen 3 schools down Moores Hill, Manchester, and St Mary’s in Aurora. He hopes that Dillsboro Elementary will remain open. Dillsboro IGa- they need customers to support them. Is it on Dillsboro alone to handle all of this? One Dearborn thinks there should be partnership and collaboration. [NOTE: And yet One Dearborn is dangling out the idea that these schools closing would have been helped by more development amassing more TIF money  to pay for even MORE development and on and on it goes,]

Green line is the sewer line. Dillsboro wastewater treatment plant with capacity.The town of Dillsboro owns a site near the treatment plant. Along US 50 is a 20 inch gas main. You can get to other highways and interstates west and north of this. How can the county help with DCRSD taking initiative out there? [NOTE:Maybe pay DCRSD back the $1.4 million they used from DCRSD for Whitewater Mill Allocation area in West Harrison TIF.] 

Clay Township TIF has 1400 acres of area. 

Two colored areas- collecting different TIF dollars. This TIF will last till 2050.

Perleberg went over the declaratory resolution , the Plan Commission, then Commissioners. Then back to DCRC for Confirmatory resolution for December. And there will be plenty of time for people to have public comment on this. 

Kraus, Jr. We don’t have any properties out there yet. Why do we want to TIF this area if we don’t know of anything that wants to go out there. Does not see the need for TIF at this at this time. 

Mansfield- Thinks they should do  something instead of nothing. The schools are in danger out there. We can’t be of help to anybody if we don’t capture money out there. What happens of we do not TIF?

Andy from Baker Tilley- We have not done this area. He gave a circuitous explanation of how this doesn’t hurt the taxpayers or schools….

Tom Tepe- also asked about what this helps? 

Perleberg said the project spurring this is SEI Data Center expansion.

Discussion about Dillsboro sewer plant covering all of this. No one had talked  DCRSD except it sounded like Hoffman and Kraus had talked to someone at DCRSD. 

Chris Mueller- said she has attended the DCRSD meetings and there has been discussion about expanding the High Ridge Sewer Plant also. Not speaking for DCRSD- just reporting what I heard at the meetings.    

Declaratory Resolution for Clay Township TIF.- Approved with 2 NAYS- Kraus and Hoffman 

[NOTE: Some members of this board are not sharing information nor are they getting the whole picture before voting on things. There are things tonight that could have been researched better before even setting up the plan for the TIF. And it was obvious that they have no intention of notifying the landowners in the area of the TIF they are enacting upon their properties. Using the same old tired excuse of how expensive postage is. Also saying the law does not require that they notify landowners. If that's true then something is seriously wrong with our laws. Perhaps the TIF money should be used for notifications. Should the rights of property owners be required to take a a back seat to private development interests? If this is such a great plan, why are those proposing it afraid to let people in on the plans that will affect their lives and property? It takes a certain amount of arrogance to think that you have to take control the future of people’s property as if you know best what  is good for their community. ]    

3.2 Acre Site, Campus Drive, Lawrenceburg - TWG Development Purchase Agreement- Letter of Intent from TWG.

They have a resolution for this if they accept the Letter of Intent from TWG. Marissa Knitter sp ?. TWG stands for Together We Grow- based out of Indy. Affordable and Workforce Housing. Founded in 2007. Have also done some Market Rate Developments. Have had 54 of these developments in Indiana. The tax credit process- is a non-competitive, thru IHCDA that they are proposing. As long as they score high enough in tax credits they can do the as a non-competitive round. If they get the purchase agreement signed tonight they can proceed with the process. Then they close in 2026 and hear on tax credits in 90 days ( around March) build- taking 16-18 months. 

110 units of 1-3 bedrooms. Affordable rents until 2068. They will pay no more than30% of their income for the rent. Playground, fitness center etc with on-site maintenance. Calling it the Lofts of Ludlow Hill. The rents will be for people just under $70,000 so rent is 30% of that. Committing to 10% for special needs thru IHCDA. 

Deaton said this was the only applicant for the property. The city of Lawrenceburg is on Board with this. 

Board Approved the Resolution for TWG sale  Unanimously.

NEW BUSINESS:

  1. Request for Assistance - Dearborn County P& Z - IN State Depart. Bike & Pedestrian Planning Grant for $5,000 to match. Kayla from P and Z presented. It is $20,000 match for a $20,000 grant. This is for $5,000 of that. This $5,000 would max out the grant. They already have $15,000 of this already. Approved the $5,000
  2. Request for Assistance - Indiana Small Business Development Center Southeast- Mike  last name ??- presented- Thanked them for their support in the past and submitted an application for a request. Ginny did the last presentation. All services are free. Anytime a business owner hits a road block we can assist them. Approved $5,000 grant for them from DCRC. Have to get Council approval or maybe use TIF money per Anthony Smart.

BAYER BECKER REPORT- Mark Rosenberger presented

  1. West Harrison I-74 EB Ramp- nothing new to report on that
  2. West Harrison Moore Drive and Railroad Crossing- submitted to the county for tech review, Still struggling to get RR going with Mr Tepe helping. This will be bid out Jan- Feb for Spring Construction.
  3. Downtown Bright Infrastructure- St E’s letter said that they at St E’s  are leery about doing detention pond for that site. Maybe a board member or leadership should speak on this. Dennis Kraus will work on finding someone to help with this for next month. 

ONE DEARBORN REPORT: Mike Perleberg presented

  1. READI 2.0 Grant Update- IEDC is supporting the Moore Drive Project- Hope to have this for your December meeting, 
  2. For Sale Signage at US 50 and Randall Avenue Site- Sue Hayden got these from Amazon and they are situated on the site to see what interest we get in buying that property.
