24 November 2025 Dearborn County Plan Commission Meeting Notes
Present: Dennis Kraus, Jr., Chairman, Russell Beiersdorfer, Mark Lehman, Joe Vogel, Jake Hoog, Dan Lansing, Jim Thatcher, and Eric Lang
ABSENT: No County Extension Member still
Also Present: Nicole Daily, Planning and Zoning Director, and Andy Baudendistel, Attorney.
Baudendistel read the Title VI statement as legally required.
ACTION ON MINUTES- December 17, 2018 (found without approval in files) -Approved after checking with Baudendistel if they had to abstain if they weren’t here. He said they could still vote relying on the previous members who were here.
September 22, 2025- Approved.
OLD BUSINESS – Britton Zone Map Amendment (Carr Road) is being tabled until further notice - Remains TABLED.
NEW BUSINESS –
- Request: Declaratory Resolution for establishing an Economic Development Area and allocation area—Clay Township US 50 Applicant: Dearborn County Redevelopment Commission Site Location: The area known as Lake Dildear Township: Clay Size: +/-1,477 acres.
Jim Deaton president of DCRC presented. Information has been forwarded earlier with about 3 pages of information. He was there to answer questions.
Lang asked if they had just used the ones from the master plan.Stopped the allocation area at Stoops Rd. Trying to get to Lake Dildear. Lang asked about Spangler Rd subdivisions in that area. Asked with the green lines- Is it trying to push commercial and industrial?
Deaton- we are not there to drive it- it’s up to the property owner. We are there to help industries like SEI Data, etc.
Lang- driving along US 50 - commercial makes sense.
Deaton- If it’s housing that also is great as it puts kids in the schools. We cannot take property away from people.
Lansing- What about sewage out there.
Deaton- I understand there is sewage out there. With this TIF we can help change the cesspool that is out there at Lake Dildear.
Beiersdorfer said the 4 Inch forced main is all on the south side of US 50. Not doing North of US 50.
Lang- So it will take TIF money to do the north side?
Deaton agreed.
Andy Baudendistel County and PC Attorney- County have DCRSD $2.5 million of ARPA money to do this project. Dillsboro is playing ball or we would not have done that. Stress that the PC is only looking how this impacts the comprehensive plan. The question about BIG picture TIF is not what we are considering tonight. That comes at the other Commissioner and DCRC meetings after this.
PUBLIC DISCUSSION:
Tim Benning- President of Dillsboro Town Board- we sent a letter of support from the Town Board - we do have capacity at our sewer plant for this. We have about 30% sewer capacity available for out there.
CLOSED PUBLIC DISCUSSION
Kraus Jr. explaied_ The green area is where the TIF money is being generated (where the TIF revenue will come from) . The allocation area is where the money can be spent.
Lansing- Is SEIData the only business?
Lang- Cutter Cut and Stitch - some other smaller stuff- not a bunch. Looks like SEI Data is tech tail that is wagging this dog,

Baudendistel- this will be the 3rd resolution for DCRC this year.
Lang motioned and Lehman seconded. Approved validating the resolution for DCRC on the Clay Township TIF.
2. Request: Primary Plat for Hidden Acres Subdivision Phases 3, 4 and 5 Applicant/Owner: Maxwell Development, Inc. Site Location: Grubbs and One Mile Roads Parcel: 15-01-34-300-009.000-018, 15-01-34-300-010.006-018, 15-06-03-201- 001.000-020 and 15-01-34-300-010.000-018 Township: Miller and Logan Size: 84.65 acre
Baudendistel- said that in Indiana of the subdivision control ordinance is being followed then it gets approved by code. So asked that the audience would address that in their comments.
Nicole Daily presented-
In 2006 the original plat on phase 1 and 2 was done. The properties are zoned R2. What is planned for this meets that R2 density code. Some lots are owned by just one owner. There are only 3-4 like this. There is a connection to One Mile Rd. There are 70 lots in the 3 phases of this plan. The only 2 items in detail. 293 lots approved on this originally. Grubbs Rd extension was part of the 1st phase. They are still keeping that connection from the first phase- that was not met then. Sidewalk waiver- to be on both sides- it would be 1/2 acre per household or 3 per acre. The smaller your lots are the more people- so you need more residents. 1/acre or 2 per acre requires sidewalks on one side of the road. If each lot is 1.25 or 2 acres per lot - no sidewalk is required. They got a waiver for the first 2 phases.
To get the average you must remove the large lots. I removed 7 lots totally 40 acres.The average is 1.4 units per acre. So your are in the range of 1 sidewalk on one side of the road. This went thru tech review. All the items were met except for the sidewalk waiver.
Lang asked if this was an open ditch subdivision. YES.
Kraus Jr. noted there was a sidewalk waiver on the first 2 phases.
PUBLIC DISCUSSION
Debbie Eidy.sp ? - asked about a lot in there that was non-buildable. Daily said it sold off tho an adjoining owner on 2817 Sneakville Rd. as it had not frontage.It is no longer part of the original subdivision. It is no longer owned by Maxwell. She also wanted to know who owned the wooded area near her. Daily- That is weed by Maxwell still. She also wants to know if it will be one builder or various ones. And what is min sq stage of the houses.
Another woman noted she was happy without the sidewalks.
CLOSED PUBLIC DISCUSSION
Randy Maxwell- no minimum sq footage. Smallest is 1800 sq ft. currently. No specific builder.
Kraus asked for the connection to One Mile. Todd Listerman County Engineer wanted to know. Maxwell said it will be 15 lots north. Then Phase 4 will be the connection to One Mile. There is also a Phase 5. Daily said Listerman wanted to know of they would do a ROW dedicated in Phase 3 at least, so if something happened- they would have a solution.
The streets are not created until secondary plat approval.
Discussion about control here to make this street work. Waiver makes it a way to require the connection or a ROW dedication.
Beiersdorfer moved to grant the sidewalk waiver in phases 3,4, and 5. Lang second. Approved.
Lang motioned and 2nd by Beiersdorfer to approve the Primary Plat. Approved.
ADMINISTRATIVE
NO PC MEETING IN DECEMBER.
Daily- Have been asked by commissioners to look at Data centers- as they are associated with solar farms. Adding Data Codes to the Zoning Ordinance as Conditional Use within Residential, Agriculture and Commercial and allow the use within Industrial districts. We could make these conditional uses. Discussion by board seems to agree that conditional use would be a good option.
Daily- Add an exemption into non-buildable lots for utility usage- like for this 10x10 lots as North Dearborn Water requires for their water.
Daily - wants to take these out of our ordinance to enforce these. Discuss driveway permits, ordinance, and bonds being returned to the County Engineer and Highway Department. Giving examples of how this works in other Counties and Communities. Thatcher says she needs to discuss this with Todd Listerman first and come back to the PC.
Daily- Discuss next steps of the Comprehensive Plan process through the winter months. Are any Board members interested in being on the focus groups? Zoom or team meetings- virtual. Transportation, Residential, Health and Environmental Economic development. She plans on 2-3 meetings on each topic. Wants to look at these so when they come back in summer- they have ideas.
Daily is looking into a grant on connectivity.
Meeting Schedule for 2026- Similar to this year. APPROVED
Liz Beiersdorfer - told Thatcher- there are no plans to replace the County Extension Agent. So Daily said they are looking in for some citizens for them to appoint from there. They might be able to sit on this board.
