5 September 2024 DCRSD Board Meeting Notes

5 September 2024 DCRSD Board Meeting Notes

Steve Renihan - President, Brett Fehrman - Vice President, Russell Beiersdorfer, Bill Shelton, and Steward Cline

ABSENT: Jeff Stenger and Doug Baer

Board Attorney - Frank Kramer

Also present: Bob Hrezo, Mike Hrezo, and Christy of Hrezo Engineering, Commissioners Probst and Thatcher, Council President., Liz Morris, Tamara Taylor (Beacon), and two attorneys from Barnes and Thornburg

Renihan read the Public Access Statement as legally required.

Minutes: August 15th Minutes Approved.( Renihan abstained) Special Meeting on August 22nd Minutes with included bid tabulation from Hrezo and engineering recommendation letter from Hrezo were added to this set of minutes - Approved.

Treasurers July report from Boggs and Race, CPA- Approved. Boggs and Race CPA will be at the October meeting.

Barnes and Thornburg RFP- Chris and Jake presenting. Fruitful comments about RFP and the timeline. Multiple options not just for acquisition but also for operation.  The final document is here. This backs not November. No matter what we do here we will still have an IURC process to back it up. This RFP does not commit you to anything. I know you have asked about this several times.

How are we going to send this out and communicate with you all. They have access to some utility groups regionally and are trying to garner some interest for you there.

Cline - there is in the timeline a pre-proposal meeting so they can seek info prior to the RFP deadline.  The significance of IURC approval- is that they will have to approve any costs that go back to the consumers. There is an advocate at IURC for consumers in these cases. IURC approval takes 4-6 months not 4-6 weeks.

We also decided the deadline is 60 days as 30 days is too short.

Jake - If and when the time comes we have started the conversation in the water industry.

Chris- We can also issue amendments during the process.

Cline- So this is ready to be issued now. YES.

Fehrman - asked about the mission of the Board continuing. This is in a couple different spots in the FFP per Chris.

Cline - hopes to see numerous responses.

Renihan- thought this was well done and documents how we got to this point.

Renihan called for. Vote to release the RFP to the public. Approved.

Cline said if board members know of anyone interested to send their names to Chris and Jake.

Public Comment: Richard Lloyd ???- sewage still leaking in his backyard.PSI is up to 50 and should be 35.5 Renihan said they are waiting on a pump. Will ask engineer later in meeting. Would like to get it to 40 PSI at least. This is why they flush once a year. Mike Hrezo says it has NOT been flushed. Cline motioned - Purchase the LIBERTY pump at $4000 etc. Mike Hrezo said he would flush every 6 months if they authorize him to do this. Renihan- thinks it has been about 2 years since they flushed the lines. It’s on us to get this done. That should lower pressure and get pumps to not burn up. Cline wants Hrezo to bring in a maintenance agreement by November meeting. If this doesn’t work we will need an independent investigation of the issues. Renihan- wants some readings to see what it is happening.

Board motioned to have Hrezo flush lines-  Approved.

Project Updates:Mike Hrezo

Guilford- Mike Hrezo-attended ARPA meeting and will go to Council Sept 27th at 9 AM and Lake Dildear is at that same meeting.

Wanted to know when they want to meet with Earth Tek- before the final contract. Board suggested at next meeting on Sept 19th.

Prebid meeting 10 AM Sept 10th for Lake Dildear upstairs in conference room at county bldg. 2 good contractors interested. Bids due by 10AM and opened 11 AM on Sept 19th.

They will present both Lake Dildear and Guilford to Council on Sept 27th at 9 AM.

Cline agreed with Watson from Dillsboro to have a meeting to hammer out the contract at 1 PM September 12th and be signed before Sept 27th meeting. We will need a probationary period of 6-7 months to understand the efficiency of our system. There are times when they will do some flushing in the beginning. Fehrman has trouble with the rates he is seeing on this now. Cline going to share the numbers from Christy that had the I and I in it too as compared to High Ridge numbers. A pure for meter cost won’t be in this as we are getting a bulk rate. Renihan- This is then best opportunity to get the sewer out to Lake Dildear. Renihan would like to see the penalties reduced. We could have a holding tank got hold it back to not hit their limit at Dillsboro. Fehrman- It’s a 4 inch line at Lake Dildear.

High Ridge WWTP -

High Ridge west Expansion -

Wilson Creek Project

Huesman Rd and Cole Lane

West Harrison TIF/Stone Project- Christy said Pair Tree is working now.  There are 7 commercial  lots out there.

Scenic Ridge/148 Sewers /Outer Drive

Stateline Rd- Fehrman- People out on Stateline rd want to be connected. Communication issues with the Crossroads Group. Homeowners want to pay for it. Mike Myers is involved now from Crossroads parent company. We are not financially involved - LMH/Crossroads thinks it IS our territory. Doug Baer had thought not. Either way it has to go to them for treatment. We are not standing in their way to get treated per Renihan. They can just hook on- as long as Crossroads agrees to treat it. Board agreed they need to hook on at their expense and Crossroads will treat because we cannot treat.

Serenity Ridge Tranquility Court-

Moores Hill

Dillsboro- Lake Dildear- see above under Hrezo and Guilford.

New Business: none

Office Update: CDs need to renew by Sept 18th. Kelly and Renihan can go to bank to take care of this. Only using 3 month CDs.Cline thinks to stagger them out on 3,6,9, and 12 month CDs. Renihan will look into that at bank. Townsend made deposit and it was deposited but he did not buy the lot. Board voted to write a refund check back to Townsends. Approved.

Ashcraft- bought last pump with no warranty. This is his 3rd pump.Had a low, then a high, then high head used. Renihan wants to suspend the bill on both Ashcraft and Lloyd and to flush it and see if that works. There is also air in lines where the amps run continuously. People need to maintain their pumps - especially with the floats. Want MikÄ™ and Christy go out and see if these need to be reset if they are pumping air into the lines. The probe (not the float) is the item that has to be cleaned off per Mr Lloyd as he learned that from Doug Price. Perhaps we send a letter to the users regarding maintenance procedures with a user agreement. Pumps last 8-10 years so they should know what to expect. Maybe send these with bills annually. Maybe a list of certain plumbers to call too. Lloyd and Ashcraft will only charged $15 per month when pumps not working.

Claims: Approved.

Discretion of the Board: List of those who owe over $200 - 13 people- so Frank Kramer can file liens.

Renihan- SBOA State Board of Accounts- has 25 minute video that every board member has to watch to finish off their action plan. Then sign the form stating they have done that. Then they submit it to compliance officer at IDEM.

COMMISSIONER COMMENTS

LATE ARRIVAL INFORMATION-  Amy Philllips- Update on the YES Home renovation. They have had donations from T-shirt sales and a bike ride raised $15,000. The Impact 100 grant came out and visited. She read a letter from a former resident from 15 years ago.

They needed a bus stop for kids out there and an eagle scout (Ryan Benz from Batesville HS) will raise funding- but they need concrete pad. Needed permission for this. She will talk with Tim Willoughby who is managing the downstairs project to help manage the bus stop project. Approved bus stop at County Farm.

They have also been gifted 2 concrete picnic tables from McDonalds for use by the basketball court. Would like a concrete pad for that. If price is right. Might want them to expand to coverage for tables and sealant. Approved.

PUBLIC COMMENT- Mike Perleberg One Dearborn- Update on Stellar Pathways. Did do 3 public meetings. Thatcher attended one in Bright. There will be another public workshop later. Feedback from public surveys etc. The survey had more than 720 responses. Goal was 500. Stretch goal was 800-1000. They have cone a long way to whittle down the list of projects in the area. Some projects could be added to this list also. INDOT funds $1.5 million would make them ineligible for other projects for 5 years.- They decided NOT to use them as a funding pot for these stellar projects. That would lose much more federal money and get “pennes” instead. Looking at Park Board Plans for DNR funding. Plans ere for downtown Greendale. Probst wanted to know where downtown Greendale was. He said around the Brown Street area. They have plan options for several things in Greendale.

22 AUGUST 2024 DCRSD Special Board Meeting Notes

22 AUGUST 2024 DCRSD Special Board Meeting Notes

Steve Renihan - President, Brett Fehrman - Vice President, Russell Beiersdorfer, Doug Baer, Jeff Stenger, and Steward Cline

ABSENT: Bill Shelton

Board Attorney - Frank Kramer

Also present: Hrezo Engineering- Bob, Mike and Christy, Commissioners Thatcher and Probst, Marc Emral, Register and Tamara Taylor, Beacon.

Renihan read the Public Access Statement as legally required.

Guilford Project:

Mike Hrezo presented materials for the board. Current cost estimate versus one from a year ago. Actual cost thru July from contingency plus Earth Tek equipment plus, Meinders CH&M bid. The land acquisition cost is off this list as it is NOT in the construction bid. It is a construction hard cost. That comes up with the $5,576,000 and includes the $627,000 contingency. Eng and design, legal advertising and permitting is thru July- $291,967.92.

He also added in costs prior to 2021 as they spent that money chasing grants etc. Board remembers looking at start of ARPA application work. Some of the other money was looking toward the Greendale option. That cannot be included as it is a different project.

Projected costs sheet changes after July adding just the soft costs. Construction and administration of the contract as job progresses. Sometimes there are a lot of questions and that is why it is done hourly. This will depend on how much you want us out there and in the office. His goal is 4 hrs/day. RFI ( Request for info) can be lengthy at times. $200,000 is budgeted for that for a year. That is 8% of the budget.

They are a little under budget- which is good so far.

Contingencies needed- underground work and satellite from project and railroad. Thinks INDOT will be done before the project work on SR 1. ( by mid December) Work with less traffic can be easier.

$191,996- reconcile that after more info in on rate consultant etc.

Christy can change numbers as needed on her screen.

Board discussed options.

Original ARPA was 4 million- before expansion of the plant was decided.

$5,590,000 is now $5,576.000- so $14,000 less.

Mike Hrezo said both great contractors - low bidder was CH&M and we have used them several times on these type of projects.

More discussion of the separate Earth Tek contract. They are a material supplier per Frank Kramer. We are their customer. Proposal only good for 60 days. Updated contract as of August 21 reflecting this. This is good to Oct 15th. Then $330,000 is due. The deposit of 30% is because of this being an equipment heavy project and they have to pay these people. Copies of this went to Andy Baudendistel as well as Frank Kramer. This is a unique system- not as many people doing it with the underground tanks. We needed someone who could do this kind of work.

Is the price of the equipment including the material and design for Earth Tek. Kevin Chaffee is known in the area for these kinds of situations. They are out of Batesville. They have done other systems in the county.

Commissioner Thatcher left

There is no bond for Earth Tek.

Brett Fehrman left at 6:25 PM

The other bidder was similar to CH&M except for the pump costs.

61 customers on this project for pumps.

Probst said they HAVE to go to ARPA next week so they can go to Commissioners meeting first Tuesday in Sept. Council then will schedule an emergency meeting. Thatcher is the contact for ARPA. Get with Sue Hayden to schedule. Need to forward a positive recommendation on the contract.

Cline still wants to meet with Earth Tek to be sure of the down payment time.

Stenger said- no we meet with Connie Fromhold and see how we can get the payment done.

Present for Hrezo and DCRSD the contracts to ARPA $5,576,000.47 with the low bidder’s numbers presented also. (This will allow the low bidder to be prepared.) Approved.

Cline and Renihan will come down and get with Jim Thatcher and Connie Fromhold.

Cline- On Dillsboro ( Lake Dildear) the discussion was regarding the numbers. He redid numbers and got to about $11 on HighRidge for examples. Trying to see what the bulk costs could be. $15,000 margin on operation out there at High Ridge.

Renihan- Bottom line is Dillsboro is the only game out there.

Cline- We need to get a rate that applies to all. Talk to Brock about this. Renihan- Rate is same since 2009. Others have taken a couple since then. Look at Cost of Living. Brock is recommending a 50% rate increase.

Cline- If board spends $50,000 to add a supt. This would be $39 each to their fee. And if we want to engage SRF for a grant for Moores Hill, We’d have to work on that by Dec 1 to hit March 1 deadline. Board agrees this would be good to do that.

Mike Hrezo- Dillsboro Lake Dildear - Advertise for bids tomorrow  at paper for 2 weeks from Thursday Aug 29th they can open bids Sept 17th in a public place at Commissioners administrators office. They will email the bids out to DCRSD board and spreadsheet will be before the meeting also. BOARD will essentially decide bidder Aug 19.  Hrezo will have to have the spreadsheets ready that night too.

Cline and Board working on one or other with bulk rate and remove penalties perhaps. Talking to Brett and Bill about that to get special meeting on Dillsboro.

Renihan - RFP sent out and Barnes and Thornburg should be at Sept 5th meeting. Cline wants to get that RFP from Chris at B&T. Doug Baer will be gone and Stenger maybe too. Worried about quorum. Accountant will be there maybe too.

Cline still wants to understand cash flow.

Renihan noted that 2 signatures on all checks and all claims have to be approved at meeting before checks go out. SBOA rules. Health related emergencies could have a check authorized later at a meeting.

Also present: Connie Fromhold, Auditor, Andy Baudendistel, Attorney, and Sue Hayden, Administrator

Also present- Marc Emral, Register and Tamara Taylor, Beacon

TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.

OLD BUSINESS

Proposed Zone Map Amendment- Business - B-1 to High Density Residential R3 (Bright)- Nicole Daily- gave an overview with pictures of the lots and the plans for 12 townhomes. Professional Park Drive is a private drive. They have 2 written commitments. Includes that there has to be an agreement with DCRC. Anthony Smart (DCRC Atty)said that Redevelopment had proposed terms and Joseph Henry Construction (Joe Perleberg) had a counter proposal. Now they are close to an agreement. Ordinance 2024-013 to rezone 3 parcels from B-1 to R3 and the maxis 12 townhouses and there is a sixty day window to finalize the agreement with DCRC- If that agreement does not happen in sixty day- then there is no rezone.Approved.

NEW BUSINESS

Proposed Zone Map Amendment- Heavy Industrial I-3 to Planned Unit Development Mixed Used- PUD- Nicole Daily- There are special conditions for this PUD. It’s density, open space, plus commercial. This is the existing Lighthouse Marina area between 56 Laughery Creek and the Ohio River. It is wholly within the floodway. There are state permitting processes that have to be done before the local permitting processes. 64 townhomes, marina, RV park close to Laughery Creek, and  open space of 45.35 acres. The two streets are to be privately maintained as they are in the floodway.these plans have to go before INDOT that may require turn lanes. Utilities are supplied by Aurora and Rising Sun for electric and sewer. Only 16 units at first as that is total capacity until the sewer service lines have been improved. On July 6th Favorable recommendation. Daily noted that Jurgenson- Rohe’s area next to them is I-3. There will be some notations on the plat to show I-3 adjoining. Plans have to be submitted in 2 years or is goes back to original zoning. It has to be the exact same plans for the PUD. There is landscape buffering. They want to sold also from cars on SR 56. May have a ditch system if INDOT allows. There are alternatives to this is INDOT does not allow. There is a letter from Jurgenson- strongly objecting to this rezone.

Thatcher said that this letter is probably a CYA  letter in case someone begins to reuse that Jurgenson piece as I-3 and neighbors complain. Jurgenson was there first. .

Russell Beiersdorfer did vote NAY at Plan Commission - against a favorable recommendation.

Probst asked about the homes and floodway. There is garage under each townhome to raise it out of floodway in addition to the parking areas outside.

Nicole Daily- The Ohio River has different reg than IDNR that have to do with tourism. If the Creeks off it were involved - this would not have tourism regs.

There are 6 conditions in the rezone that are included in the rezone ordinance- Approved.
