DCRSD's Lawyer Answers SDRSD's Lawyer

The following letter was in answer to the letter posted at the bottom of the most recent DCRSD meeting notes:

Dear Matt:

Thank you for your letter of July 18,2007.

Except by agreement, the South Dearborn Regional Sewer District (SDRSD) cannot legally serve outside the corporate boundaries of Aurora, Greendale and Lawrenceburg. Enclosed is a copy of Court Order entered January 26, 1972, which fixes the boundaries of SDRSD. The area outside those corporate boundaries are served by the Dearborn County Regional Sewer District (DCRSD), other than the private utilities.

13-26-5-7 allows a governmental or private body owning and operating facilities for water supply, sewage or solid waste disposal, recovery or treatment may contract to supply water or treat all or part of the sewage or solid waste of a District. Greendale has offered to enter into a contract with the DCRSD to serve some of the subdivisions in close proximity to Greendale. However, Greendale does not own a treatment plant and, therefore, is not authorized to enter into such a contract. That is why the DCRSD wrote to your client in March seeking this service.

Please reconsider your position. The DCRSD meets on August 2, 2007, and I would appreciate a response before that date.

DCRSD has no lines (they are giving what they just had installed on Cole Ln. and Stewart Rd. to Aurora) and no capacity to treat, yet they are trying to bar SDRSD from serving customers!! Talk about a power play.

If they can't contract with Greendale how can they contract with Aurora?

The DCRSD despises the SDRSD because of the SDRSD’s reluctance to permit subdivisions to be built far from existing infrastructure and forcing all homeowners onto sewers (regardless of the costs to the homeowners), between the existing treatment plants and the “far-off” subdivisions.

The SDRSD knows a crook when they see or smell one!

No discussion should take place as to "costs" of so many gallons per minute, without factoring in first the "real costs" of sewer service to those being forced to hook-up, at their own expense.

We also need to factor in the cost of these pumps and their need of replacement in a number of years. Further, the yearly electrical costs to run these pumps must be factored into the "costs" of sewers to the citizen/taxpayers of this County!

These are the "real costs" of sewers for existing homeowners currently on working septic systems!

Do not let these hacks try to suggest otherwise!

It might be of interest, that Brett Fehrman is running for a seat on Aurora City Council.

If he wins, will he get himself appointed to the Board of SDRSD as Aurora's representative? Will that be a way for the DCRSD crooks to weasel their way into a working sewer district? They sure can't seem to do it any other way! He still needs sewers for his subdivision on US 50.

It is uneconomical for persons such as Fehrman and Maxwell to pay for sewers to service their developments, alone, but it is somehow economical for the neighbors of their respective developments to go into tens of thousands of dollars in debt in order for the Fehrmans and the Maxwells to walk away from their developments at a profit.

Think about the type of discordant and ruthless thinking that needs to come in to play to find such conduct tolerable?

Sometimes the community has to all pitch in to bring about needed services. Roads are an example. If the county constructs the roads (sewers too) with an eye to the future maintenance and costs of such things it would be preferable.

Funny thing about this. When a developer constructs a new subdivision, he must pay for all the roads and any that will become dedicated county roads must be constructed to county standards and tested to prove that, before they are accepted. The citizens are not forced to pay for those roads.

And upgrades to the main roads are paid by taxes. Citizens are not required to upgrade their driveways to some new standard nor to individually pay for the developer's project.

The developers should bear their own cost and thereby determine the real profit, or loss, on their project. Without the citizens subsidizing the cost can they even make a profit? Or will they not make an exorbitant profit like they are used to now.

It does not take an economist to figure out the only way someone like Fehrman could afford to service his subdivision on 50 is to spread the cost amongst all those already existing homeowners surrounding his project.

The "forced hookup" issue has nothing to do with developers, but the utility entity itself. Developers deal with the same tie-in fees that the residents do, and pay for downstream upgrades as well.

As an example....If St. Leon had plans to run a new sewer line down a road because of bad septic systems (not because of any other development going on), the utility company would make everyone that lives along that new line tap into that line.
The forced hook ups have nothing to do with development.

And even if a developer pays to have a line put in for a development they still have to pay tap fees just like everyone else. So the developer is paying for a new line and tap fees.

Try looking at the state and/or the individual utility companies about the forced hook ups and stop blaming the developers or realtors or lawyers or who ever you don't like at the time.

The DCRSD was formed specifically to fix this problem and you can see how their focus immediately changed from High Ridge's problem to the personal projects of the Board members!

Well it would be nice to see development up on the farms near St Leon. I have always said that I don't care if development took place in my back yard as long as it was smart growth. It wouldn't matter if it was done publicly and ethically and by guidelines, you all would still find something to bitch about. From reading the blog it seems to be your nature.

I personally know one person where it will cost approximately $30,000.00!

But that is ok with tgif, because she is sure that his septic tank, located in the middle of his 60 acres, is poluting the entire country side!

She would be appalled to learn what my horses and the cattle that graze on my 150 acres are doing to the environment!

I would also guess she would be sick if she found out what my ducks and geese are doing to my ponds! And has anyone ever seen all the deer droppings in the woods?

After reading this blog and meeting notes is it reasonable to say that people go on these boards to satisfy their own agenda? I've said that from day one...Federal, State, County, and city government is a nice idea; however, when it's driven by corrupt and unethical leaders it's wrong. It's just morally wrong what goes on. Top to bottom Dearborn County is corrupt. Let's clean house and get everyone to take a mandatory ethics class before entering office.
