GREENDALE RESPONDS TO VRUC BOARD PRESIDENT

Greendale Responds to VRUC Board President

The following letter was sent by Al Abdon for Greendale to Jack Arduin, new President of the VRUC Board. The Stan mentioned in the letter is Stan Beeler- also on VRUC's Board. (Beeler has a posting on the PUBLIC FORUM just prior to VRUC elections) VRUC recently turned down Greendale's contract for service.

Jack:

This correspondence is in reply to our discussion on Friday, July 20th wherein you informed me that, at your Thursday, July 19th VRUC Board Meeting, the VRUC Board again voted down the contract for water & sewer service, and failed to propose a counter offer. It has become increasingly obvious that no matter how many concessions Greendale makes VRUC is not interested in getting an agreement. Every time we come to agreement on each new VRUC issue, the Board rejects the agreement. It has gone so far as VRUC Board Member Armbrectd calling me on my personal cell phone before a meeting stating that he and Board Member Bittner were ready to vote for the agreement, and then both voted against it.

Greendale has offered VRUC a thirty-year agreement which guarantees long-term rate stability for both water and sewer service to VRUC customers, relieves VRUC of its contractual obligation to spend millions of dollars on a new water treatment plant, and offers VRUC the ability to serve hundreds of new customers inside your CTA, including the Red Pines developer, who is currently before the IURC to opt out of your CTA because of your inability to provide service. Finally, in an effort to help save VRUC money by avoiding future action by IDEM against VRUC, Greendale has offered technical assistance, and to accompany and support VRUC efforts to acquire low interest funding to fix your current collection system problems.

Greendale feels that to continue to spend valuable time on fruitless negotiations with VRUC is time that we could spend doing more productive work for the City. We plan to move forward with alternate plans, including service to Red Pine, and wish you luck in the future.

Jack, it has been my pleasure to work with both you and Stan and we applaud your common sense, intellect and especially your noble efforts on behalf of the good people of Hidden Valley, as well as the other VRUC customers…but you and I both know that you can only bang against the wall so long and eventually you have to walk around it…it’s time to walk around. That said, if at some point VRUC wishes to submit a contract proposal to Greendale, we will give it just consideration, but we will not continue down the long road already traveled.

Oh, I see the person who keeps posting articles pretaining to HVL, a private community, on a public forum is back from vacation. So how was Italy, was the pizza as good as your daddy-in-law makes? From what I've seen and read it is Jack, Stan and yourself who are selling out HVL. Afterall, you are the one who is spearheading the move for HVL to incorporate. Everyone knows it's much easier to incorporate if your sewer and water issues are solved before hand. If anyone is interested in finding out about this person and her ridiculas ramblings and just exactly what HVL thinks of her just go to hvlprivatecommunity.com and click Comments. As far as the letter from Al Abdon goes, he was the one who helped write the proposal, did you really expect him to point out the long term ill effects it would have on VRUC/HVL. And dealing with DCRSD is good for the citizens? The costs from DCRSD would be significantly higher as indicated by DCRSD itself.

How much money is there for the realtor/developer inside HVL. You don't make much on individual lots!

How many developments are they trying to serve outside HVL, where there is a whole group of houses to make money on?

And why does a VRUC employee provide incorrect information to the plan commission, that VRUC has capacity to serve an outside development, when Greendale indicates there is no such capacity and VRUCs capacity is from Greendale.

Hello everybody, I'm so happy that everyone is glad that I am home. As you can read, again the HVL residents and other county residents are being better informed.

I want to state a correction to all the people that wonder why I want to become a town. I moved to HVL to raise my family exclusively in a private community. Due to the VRUC wanting to build a sewage treatment plant that would bring down the value of our homes, spending hundreds of thousands of dollars of residents’ money unnecessarily on a lawyer, not signing a secure fair negotiated thirty-year contract with Greendale, denying my proposal for the members to get to vote on the contract issue on the recent election ballot, lack of involvement of the POA to support the members – these are the reasons I wanted to become a town. Becoming a town was only an alternative to save the integrity of Hidden Valley Lake. If the thirty-year utility contract is signed between VRUC and Greendale, I would prefer to remain a private community. I hope I have cleared the air for many curious individuals.

Yes, I have been away - my trip to Europe with my entire family was amazing.

Maria....I just read the article about you at hvlprivatecommunity.com and after reading your latest reply on this web I'm going to have to agree with hvlprivatecommunity.com. Your only in this for the attention it can bring you. I also read all the other comments and no where in any of them did I read where anyone was glad you were back.
I live in Greendale and have no real interest in what problems you or any other of the wanna be, show off snobs living in that place has.
Why don't you stay off the County website with all your little daily problems so more important COUNTY matters can be intelligently discussed.

HVL IS in the county. They are governed by county ordinances and vote in county elections. Greendale votes in county elections also.

I'm not here to bash people or their communities. I have one serious question to ask...what will Greendale stand to loose without VRUC's business? According to financial statement they stand to loose nearly $500,000. per year. Can we afford that? With this being an election year can the Mayor afford to have that black mark against him when it come campaign time? You know the opponent will use that against the incumbent. I've heard that VRUC has made a counter offer to Greendale and Greendale has yet to respond. I would suggest both sides get together and develope a plan that everyone can accept. Both sides need to give in just a little. If not, you may just see a new Mayor of Greendale come November. I may be wrong but I can't imagin a Mayor loosing that much yearly income and then getting relected. Think ahead people!

Why was Sammy Gutzweiller, who lives in HVL, actively campaigning at the poles in May with a Denoma representative - both supporting Mr. Rhezo for mayor who is an engineer involved with the Denoma project and DCRSD?

Sammy is also a partner with Jeff Bittner in a new realty company (USA Land Development) and Jeff is the head senoir VRUC board member who recently again denied the thirty-year contract after Greendale compromised VRUC's final requests. Bittner is now asking for another change once all earlier requests were compromised and satistied by Greendale and the VRUC Board. Bittner and the other 3 senoir members hypocritically reneged voting for the contract. This is typical VRUC Board behavior for the last 10 years!

It was announced at the POA meeting on 7-26-07 that VRUC made a counter proposal to Greendale. Aparently someone from VRUC was present and made the statement. No details were given.

Notice that the letter from Greendale was dated July 25, 2007 and Mr. Sypniewski supposedly made this announcement at the POA Meeting on Thursday, July 26, 2007 after he and the other 3 'senior' VRUC members had already voted NO against the final negotiated contract.

Well fool, so much for the "final negotiated contract", read the last few lines in the letter from Al Abdon. It states "if at some point in time VRUC wishes to submitt a contract proposal to Greendale, we will give it just consideration, but we will not continue down the long road already traveled."

What's so hard to understand about that, VRUC turned in a proposal at Al Abdon's request on the 26th. Now it up to Greendale to decide what they want to do. That what you call negotiating.

Since this has been asked twice before and no one will answer it, I will take my turn at asking it...what happens to Greendale when they lose $500,00. per year by not signing up VRUC.

The VRUC and the DCRSD seem to be a perfect match.

"Development at any cost" interests seem to have taken over both boards.

The individual existing homeowners are only pawns to be played by board members to subsidize personal development projects.

If realtor and developers want development they should pay for it upfront and outright, instead of all this back-room, back-office sewer board manipulations.

The way some in our local realtor/development business have so co-opted local government to enhance their portfollios at the expense of existing property owners is shameful!

These manipulators and all their enablers need to thrown out on their ears!

Profits aren't that simple. $500,000 in sales doesn't mean profits of $500,000. There's expenses. Sell a $500,000 house and your lucky as a realtor to get $50,000.
Greendales profits are encumbered by many expenses. One expense at the head of the list is lawyer fees. Keep in mind VRUC has been suing everything that moves. It's very expensive and non productive.

As one resident of Greendale I promise that at election time I will make every Greendale resident aware that our Mayor, Mr. Hedrick, allowed $500,000 per year to slip away and for no real reason other than "I'll show them who's boss!" .

Mr. Rhezo's name was mentioned earlier. I take it that he may very well be a canidate running for the office of Greendale Mayor. I'm sure at campaign time he'll have a comment or two about a Mayor losing that much income

In my opinion,the income loss will be very nominal from Greendale's view point.
The law suits and loss of time dealing with the "old order" VRUC board, will more than off set the profits.

Let VRUC build their own water plant and join hands with a "non-functional" much more expensive DCRSD. Then maybe, just maybe, the citizens of Hidden Valley Lake will understand the inept management they have had in the last 12 years.

I have seen numbers that the DCRSD would be 600% more expensive than what Greendale has offered.

But I think under the DCRSD's plan, the taxpayers get the privilege to subsidize local, down and out, realtors and developers.

To date, Greendale is just offering a good price on water and sewer without all the realtor/developer perks!

Maybe, Greendale can offer a check box on their bills that a resident can X out if the customer would like to donate 600% over their respective bills to sponsor a developer charity case.

Maybe, our local realtor/developers could get Sally Struthers to do a commerical for their cause, tears and all!!!

The VRUC silently misused the money entrusted to the VRUC gang by the residents of HVL to correctly run the utility company. The VRUC Gang did try to do this but with HVL residents' money. The HVL residents at that time (fall of 2005) DID NOT remain SILENT and DEFEATED the project. Would you believe - the VRUC Gang paid a lawyer over $500,000 to fight the residents and the residents were actually the ones paying his bill through their monthly fees?!!

The VRUC Gang wanted to service outside developments -- but Greendale who VRUC pays to transport their sewage and who VRUC pays to use their capacity (bought and built by Greendale) at SDRSD -- Greendale said NO to VRUC concerning taking on these outside entities, running it through HVL's failing sewer infrastructure, and eventually running it through Greendale facilities.

According to the POA Manager, the change in the finalized negotiated contract between Greendale and the VRUC that is being asked for by Mr. Bittner and the other 3 senior members is supposedly to have a clause in the contract giving VRUC 180-days (6 months) to cancel the contract if DCRSD becomes a viable entity!

Not true. Fixing the infrastructure is entirely different than pumping sewage to a plant to process it before sending it to the river. They are searching for the lowest cost to dispose of the sewage. Come on .. you know there is documentation stating that Greendale voted for VRUC joining SDRSD - maybe not at first, but eventually. VRUC walked away from the table when the manipulating high costing lawyer devised an innovative way to pay for your capacity build-on that was unacceptable to SDRSD entites - always trying to take advantage of the other person! - and then crying foul!

Concerning the now famous $500,000 that Greendale receives from VRUC yearly. In the Feb - Mar 2007 Echoes, the VRUC income statement states that VRUC paid Greendale for the total 2006 year - 384,494.75 for sewer treatment and 131,339.15 for water purchases. From that money, Greendale uses it for upkeep of lines and pumps, electricity, capacity build, and sewage treatment at SDRSD. Sure, Greendale makes some profit but a fraction of what you are falsely accusing.

Having attended the DCRSD Board meeting on Thursday evening, Aug 3, we are delighted to inform the residents of HVL that the DCRSD announced that they will no longer be involved with attempts to provide sewage service for HVL/VRUC. They stated they cannot provide sewage service to HVL/VRUC as economically as Greendale. Also, they do not provide water service.

Stan Beeler, VRUC Board member, also attended the meeting and was asked by the DCRSD if the VRUC Board signed the finalized contract with Greendale? Stan replied that due to the senior 4 members refusing to sign the contract, the contract was denied.

After last night’s meeting, we are encouraged that a secure economical thirty-year contract for sewage and water service can be accomplished in the near future with Greendale for the HVL/VRUC residents.

If we could get one of the senior board to understand and do his elected job instead of depending on the lawyers, the money drain and healing would begin. At the next VRUC meeting, with all the VRUC options in the open, I'd like the senior board members to explain why they are voting for or against the Greendale contract. The answer to this dilemma will become abundantly clear to everyone soon. Dearborn County has an entity (SDRSD) that has learned the ropes of running a sewer plant and what it takes to do so. DCRSD by contrast is trying to take a short- cut to become the lead dog.
DCRSD is patching things together instead of building a strong foundation. The patch job is clearly limiting their credence as big players.
County Council is on to the game- they are parcelling out the money ONLY for DCRSD to finish what their original prupose was- fix High Ridge Estates. DCRSD is not bidding out those services. Let's hope they don't waste the $116,000 for that engineering.

The SDRSD also seems to have an understanding of the fundamental unfairness of forcing existing homeowners, on working septic systems, onto sewer lines at costs greatly disproportionate to any benefits that would be received by these existing homeowners. In fact, costs they never will be able to recoup if they should try to sell their homes.

To date, all the rhetoric coming out of the DCRSD consists only of how they can set up the legal machinery of forcing sewer hook ups!

Forced hook ups are their only “plan” for financing their sewer utility.

On November 5, 2003, the SDRSD passed Resolution No. 1-2003 allowing VRUC to join the SDRSD.

The minutes from the SDRSD November 5, 2003 meeting lists all entities - Aurora, Lawrenceburg, Pernod, and Greendale. Beside each individual name their respective vote is typed - each entity voted - YES!

From what I understand, to keep up the "fiction" that these forced sewers are for the public health and not to subsidize local realtors and developers, you will have to cap your septic tank.

So, unless you have a back-up generator, no you cannot flush your toliets past whatever capacity is left in your grinder pump "crock" reservoir. Which is usually around 200 gallons, depending on the level in the "crock" when you lost power.

Most situations where septic fields have caused any measurable impact to ground water qualities have been where developers have been given free reign to over-build residential areas where sewer was not available.

Dearborn County’s septic systems, by in large, have been built on larger parcels of land, under the watchful eye of our local health departments. Where not only are there proper measures taken to assure large enough drainage fields, but also secondary sites available on the property if the first septic field should begin to fail.

A septic system, when it does fail, is a slow process of failure, allowing the homeowner ample time to fix it before his drains are backing up with raw sewage.

When a grinder pump and pressurized sewer line fails, the situation is almost immediately dire.

Raw sewage backs up through low level drains, representing an immediate health risk and requiring costly clean up.

Also, if the backup is caused by a bad pump, the homeowner is on the hook for thousands of additional dollars for a new pump and all the related costs of having a plumber replace it.

Any review of the materials in the septic vs. sewer debate, has shown at best an even trade-off between the two, in moderate to densely developed areas, which Dearborn County is neither.

Further, almost all the data involved on the sewer side of the debate concerns itself with homeowners on fairly maintenance free gravity types of sewer systems.

Not grinder pumps and pressurized sewer systems.

Such systems require more immediate maintenance and careful attention by all members of the household to keep them running effectively.

Something as simple as a child allowing dental floss to go down the drain can shut down a grinder pump.

Remember this when realtor/developer controlled sewer boards try to sell the "benefits" of grinder pumps and pressurized sewer lines, it is more than evident that each and every home on such a grinder pump system has the potential for immediate and severe health consequences and expensive repairs for the homeowners!

The HVL POA (Properity Owners Association) publishes a monthly news letter 'ECHOES' with reports from both the POA board and the VRUC board.
But as with so many people, many HVL residents don't read the news or get involved with the community. If someone says "so and so" is a crook out to screw the residents, they will believe it and vote for some other idiot with out knowing the facts.
Just look at how many people believe the lies about the senior members of the VRUC board published on this blog just because they don't like Sammy G.
And before you have a cow, I am not Sammy.

A word of advice to those who are connected to pressurized sewer lines or are down hill from the sewer line.

Most home owners insurance policies do not cover damages to sewers backing up into your home even if you are insured for flood damage.

Be sure to check with your insurance agent if you have to connect to a pressurized sewer line.

Has the VRUC offered up any thing even close to the Greendale deal?

The VRUC and those behind it, want HVL to finance development outside HVL.

Have you read the contract?
Has the VRUC offered up any thing even close to the Greendale deal? From a previous post on this blog, YES. It is now back to Greendale.

Last we heard, it concerns the viabilty of the DCRSD, who has already said they cannot come close to the Greendale offer.

Hope against hope that the development friendly DCRSD, who would be more than happy to stick it the residents of HVL to subsidize SAMMY and FRIENDS, is not a counter offer!

You mean when Chairman, Mark Mitter, at a Dearborn County Plan Commission Meeting threatened to report a high-ranked VRUC employee to the Indidana Attorney General for fraud for knowingly submitting an incomplete document indicating VRUC could supply sewage service and capacity for the planned Red Pines development (VRUC CTA area behind the HVL swimming pool) which was being sold by a realty agent/VRUC board member?

The Plan Commission wanted to go after the VRUC official for purjury; but, some of the "connected" plan Commission members wimped out or peotected their own!! Even the PC Attorney wanted to file charges!

What the citizens of Dearborn County need to remember is that DCRSD has stated it is inevitable that the entire county will be sewered. The goal of DCRSD is to take over not only VRUC and LMH; but, SDRSD, St. Leon, Dillsboro and Manchester. They have alienated the other Boards, because of their blatant attempt to bull their way into power. And as Fehrman said (see DCRSD meeting notes on this blog) "We haven't turned away a subdivision yet".

Their first action was to provide a letter of service for "Fehrman's" subdivision even before they solved the problems they were allegedly formed to solve.

Even now DCRSD is designing a system that has been set from the start to force all the residents along that part of US 50 onto the system, so that Gabbard Estates can get the sewer service they need to develop.

It seems now that Dennerline got his, he is now helping Fehrman get his, both at the expense of the citizens of the county.

As they gain more control, they will force more citizens onto their system to pay for it to be installed, ready and waiting for the developers to come along and profit!

And now that the High Ridge Estates' problem is slowing down the Board's personal agenda to feather their own beds, Dennerline has gone as far as suggesting the taxpayer just "buy out" High Ridge!

Mind you, this was the only reason the DCRSD was formed, was to "fix" High Ridge Estates!

Remember Vera Benning's "empty" promises?

And where is Benning now since she lost her reelection attempt?

Working for the very Board that now suggests the taxpayer just "buy-out" High Ridge Estates!

Earlier someone wrote the following and I think it would be wise to provide this to all residents before being coerced onto pressurized sewer lines and grinder pumps and also to all the local "politicians" who may have a hand in the "forced" hook-ups!



Most situations where septic fields have caused any measurable impact to ground water qualities have been where developers have been given free reign to over-build residential areas where sewer was not available.

Dearborn County’s septic systems, by in large, have been built on larger parcels of land, under the watchful eye of our local health departments. Where not only are there proper measures taken to assure large enough drainage fields, but also secondary sites available on the property if the first septic field should begin to fail.

A septic system, when it does fail, is a slow process of failure, allowing the homeowner ample time to fix it before his drains are backing up with raw sewage.

When a grinder pump and pressurized sewer line fails, the situation is almost immediately dire.

Raw sewage backs up through low level drains, representing an immediate health risk and requiring costly clean up.

Also, if the backup is caused by a bad pump, the homeowner is on the hook for thousands of additional dollars for a new pump and all the related costs of having a plumber replace it.

Any review of the materials in the septic vs. sewer debate, has shown at best an even trade-off between the two, in moderate to densely developed areas, which Dearborn County is neither.

Further, almost all the data involved on the sewer side of the debate concerns itself with homeowners on fairly maintenance free gravity types of sewer systems.

Not grinder pumps and pressurized sewer systems.

Such systems require more immediate maintenance and careful attention by all members of the household to keep them running effectively.

Something as simple as a child allowing dental floss to go down the drain can shut down a grinder pump.

Remember this when realtor/developer controlled sewer boards try to sell the "benefits" of grinder pumps and pressurized sewer lines, it is more than evident that each and every home on such a grinder pump system has the potential for immediate and severe health consequences and expensive repairs for the homeowners!

If our local realtor/developers desire densely populated subdivisions to bolster their profits, let them pay to sewer their respective subdivisions, instead of making the rest of us pay under the "guise" of public health!
