REMINDER: DCRSD Creates Ordinance to Enforce Hook-ups
NOTICE OF HEARING AT COUNTY ADM BLDG
THURSDAY MAY 1st at 7 PM

The Dearborn County Regional Sewer District will conduct a hearing on Thursday, May 1, 2008 at 7:00 p.m. to consider adoption of the following ordinance:DEARBORN COUNTY REGIONAL SEWER DISTRICT ORDINANCE 2008-2

AN ORDINANCE GOVERNING DISCHARGE OF SEWAGE
An Ordinance regulating connection to and the use of public sewers and drains, the installation and connection of building sewers, and the discharge of waters and wastes into the public sewers in the Dearborn County Regional Sewer District, and providing penalties for violations thereof.

NOW THEREFORE BE IT ORDAINED BY THE DEARBORN COUNTY REGIONAL SEWER DISTRICT as follows:

1. Discharge of Sewage. It shall be unlawful for any person to place, deposit or permit to be deposited in any unsanitary manner upon public or private property within the District, or in any area under the jurisdiction of said District, any human excrement, garbage or other objectionable waste.

2. Discharge within the District. Within the District, where public sewers are available and located within 300 feet of a property owner’s property line, it shall be unlawful to construct, use or maintain any privy, privy vault, septic tank, cesspool or other facility intended or used for the disposal of sewage, unless specifically permitted by the District.

3. Discharge of Water to the Sewer. No person shall discharge or cause to be discharged to any sanitary sewer, either directly or indirectly, storm water, surface water, ground water, roof runoff, subsurface drainage, water from downspouts, water from footing drains, water from garage drains, geothermal water, heating or cooling water, unpolluted water, unpolluted industrial water, or water from basement or crawl spaces.

4. Wastewater Disposal. No person shall place, deposit or permit to be deposited in any unsanitary manner on public or private property within the jurisdiction of the District, any wastewater or other polluted water.

5. Discharge to Natural Outlet. No person shall discharge or cause to be discharged to any natural outlet any wastewater or other polluted water except where suitable treatment has been provided in accordance with provisions of this Ordinance.

6. Required Connection to Public Sewer. The owner of any house, building or property used for human occupancy, employment, recreation or other purposes requiring wastewater disposal, situated within the District is hereby required to cause said property to be connected with the public sewer in accordance with the provisions of this Ordinance, within ninety (90) days after the date of official notice to do so, provided that said public sewer is within three hundred (300) feet of the property line. Such notice shall be provided in accordance with I.C. § 13-26-5-2(8).7. Civil Penalties/Civil Infraction Fines. A User who has violated or continues to violate any provision of this Ordinance will be liable for a civil penalty not to exceed Twenty-Five Dollars ($25.00) per violation. Each day during which the violation occurred or continues to occur shall be deemed a separate, distinct violation. The penalties will be collectible in the same manner as monthly sewer charges. The District may seek enforcement of such penalties in the same manner as for all other charges.C-4-15-JP-2t

is it state law that houses have to hook up if the sewer is within 300 feet, or is it just a local ordinance? Does anyone know for sure?

The state law says that the locals MAY force those hook-ups at 300 ft. if they choose.
If locals decide to they use the word SHALL - as in the ordinance above.

The only intent of this hearing is to force sewage hook ups and force the a hook up fee for the dcrsd. The dcrsd needs money! The dcrsd cannot function without financing!
Dissolve the dcrsd NOW before it a functional entity!

Give us gravity sewers and we will talk, but we are not going to be forced on expensive, pressurized sewers, that do not work when the power goes out, just because a couple of greedy politically connected developers want their profits now!!!

I wonder how our new "buckeye" dcrsd board member will vote?

After this year's elections, no one is going to front the sewer schemers any money for their crooked plans. It has already been written that the dcrsd will die a slow death once the political landscape changes, as it surely will.

Did John Zeiden, the current fair-haired poster child for the Development sewer scammers, have his septic system approved for his business before he opened it, then someone in the health department changed their mind or did he try to "sneak" something past the health department but got caught after his business was up and running?

Lawrenceburg Gives $3.8-Million To Governments
(Lawrenceburg, IN) – Lawrenceburg shares the benefit of casino gaming with other Indiana cities and counties.

The city council has approved more than $3.8-million in new grants.

$1.5-million of that will stay in Dearborn County to be used to help develop an industrial park.

Franklin County receives $875,000 to also create an industrial site.

Others receiving a share are Seymour, Bardstown, and Union County.

Someone, please ask Hughes and company about the health consequences of having entire regions on sewers that do not work when the power goes out.

What are their contingency plans for such a crisis?

No, power outages will put the citizens back in the 1800's "slop jar" era.
3,000 foot sewer lines or sewage lines over 300 feet from farm houses to the forced mains will give that sewage ample of time to rot in the lines before it hits the processing plants. We might call these lines ,in themselves,"septic systems". Why connect and pay a fee to dcrsd when the processing will be complete in your own sewage lines.

Hughes can just conduct a phone poll on how much the public is hoping and craving for unrestrained development in this county!

In fact, Hughes' poll will probably show that if someone like Maxwell or Tucker were write-in candidates they would win in a landslide!

The winter before last, my electric was out for six days. What would happen to that sewage just coagulating in my two or three inch sewer lines? How do you clean that out?

Not so if you were on pressurized sewers!

The DCRSD's Board did not even have the sense to fix High Ridge to at least permit the illusion they were acting in good faith.

Right off the bat, Board Member Dennerline got his trailer park sewered and Board Member Maxwell and his friends were doing their best to get millions more of our tax dollars for his development.

And they immediately hired flunky Benning as secretary, right after the voters threw her from office for her creation and support of the DCRSD.

The bullies on the DCRSD thought the could be politically tone-deaf because they were true-believers that development thugs would always have a strangle-hold on this County.

I usually stay out of things, but on this I must comment. It is fair to say that sewers are generally a better solution than individual sewage processing, but this must be tempered with a pragmatic and realistic assessment of the conditions of any given area. The benefits of sewer systems should not be evaluated in the absence of a consideration of the costs, public and private.

If this issue were simply one of public health, consideration would be given to the operation of cavitettes, which would produce much cleaner outputs, but these systems are forbidden in Dearborn County.

It seems to me that the wording of these ordinances betray an avarice that has long been suspected by the readers of this blog. It further reveals a Draconian willingness to inflict harm on rural citizens who will not be well served by these supposed services.

A fair ordinance would, at worst, require hookups for sources of sewage within 300 feet of the service, not merely a property line. The requirement as written would impose a huge burden on rural residences that might be thousands of feet from the nearest approach of a sewer line. Such an onerous cost burden should never be imposed on any citizen.

Consider this. How can it be considered a fair imposition to demand sewer hookups of residences that often don't even have public water sources. Will those providing sewer services be taking on the responsibility of providing water as well? How can sewer hookup be demanded of residences that don't have sufficient water sources to generate output that justifies such aggressive demands for waste treatment?

The only conclusion that can be drawn from the language of these ordinances is that there is a scheme afoot create an opportunity for high density development on the backs (and perhaps even on the property, once forfeited) of those least able to finance it, individual citizens of rural Dearborn County.

These ordinances are an abomination as written. If the citizens of Dearborn County are awake and care anything for just treatment from their government, they should be present at this meeting to ensure that no elected official dare vote for passage. If the ordinances are passed, our commissioners should be left with no doubt that they will pay for their malfeasance with their offices in the fall, to be replaced by fairer minds that will repeal them.
