27 January 2020 Dearborn County Plan Commission Meeting Notes
Present: Dennis Kraus, Jr., Chairman, Russell Beiersdorfer, John Hawley, Mark Lehman,  Michael Lynch, Jake Hoog, Bill Ullrich, Jim Thatcher, and Eric Lang
Also Present: Mark McCormack, Plan Director, and Andy Baudendistel, Attorney.

ELECTION OF OFFICERS: All officers remain the same as 2019.
APPOINTMENT OF ATTORNEY: Andy Baudendistel reappointed as Attorney
ACTION ON MINUTES: December Minutes approved with amendment that Thatcher abstained on the vote. Hawley abstained on the minutes approval as he was not present in December meeting.

NEW BUSINESS: NONE
ADMINISTRATIVE:
Mark McCormack presented - Proposed changes regarding minimum square footage requirements for residential uses including Tiny Homes and Manufactured and mobile homes- Article 25, Table 25.1 and section 2564 of the zoning ordinance. The Commissioners rejected a section on tiny homes and wanting the minimum size to be 950 sq ft. Tiny homes or smaller ones would have to go to BZA to request a variance. Public declined to comment. ( As I was the only public present)  Lehman motioned and Lynch 2nded to forward with favorable recommendation the table 25.1 with revisions. Article 25 Section 2564 was also forwarded with favorable recommendation with no public discussion including amendment to change to  minimum of 950 sq ft. 
Thatcher asked to have the Residential and Ag zone ordinance updated and not the subdivision ordinance as requested by One Dearborn. Using money that was set aside for this. Trying to get 3 proposals and quotes from those firms. Have 2 consultant quotes so far. Not getting the cell tower issue covered in this 
Wanting to get a consultant to help revise this as they are too busy in the Planning Office to do this.
One R and one Ag is not working. Problems go to BZA for these multifamily units etc. 
Having a technical steering group and having more than the previous numbers o public hearings to get more public input on this Ag and Residential revisions. 
There was also update on some of the parking regulations in 2310 and 2315. Having to figure out what to do with driveways that are adding more impervious surfaces. McCormack needs some input on this as they are testing out the changes on these regulations. 
Having a lot of Tabled Plans because people are getting in a hurry. Tech review thinks they need to push pre-application meetings more so that site plan review goes better. The word encouraged is used here. Discussion of the Plan Commission was that they needed to be firmer on the process because they are wasting time in the long run and need a better plan up front. Some of them end up deficient and a lot of conditions get placed on them and then they sit for a long time trying to address conditions. Never getting revised plans from some developers. Cases in some cases go back ore than one year. Have to tell people they cannot start building until the plans are approved. PC wants McCormack to change the word to required and also rewrite the process so they know what is expected. The big developments need to meet with the executive committee of tech review up front. Also put a time limit on some of these applications. Don’t let them drag things out. McCormack is going to work on this for next meeting. 
Updates on staff- code enforcement job opening up. Hired a UC intern - best one they’ve had in a while. She’ll be working on comp plans etc. Some big projects coming in this year. 
Survey references for Right of Ways. You need a deed or condemnation proceedings to show that ROW exists. Otherwise you lose in court. Discussion was about the county having an ordinance declaring a ROW along all county roads. Drainage would be affected etc. Looks like a patchwork of rules along some roads where the property is owned from the centerline of the road. And some the county owns all the easement.
