 21 DECEMBER 2021 DEARBORN COUNTY COMMISSIONERS MEETING NOTES


Present: Jim Thatcher, President, Art Little, and Rick Probst


Also present: Connie Fromhold, Auditor, Andy Baudendistel, Attorney


Absent: Sue Hayden, Administrator ( vacation)


TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.


OLD BUSINESS- none


NEW BUSINESS


Interlocal agreement for fire protection for parts of eastern Dearborn County with city of Harrison OH- Chief Hursong- one year proposal for annual cost of $133,883 for 2022. This was discussed at a previous meeting. Approved. The signed copies will be returned from the chief after Harrison’s officials sign it.


Huffman Quit Claim Deed- Ruthann Stenger ( Melissa presentded-on behalf of Greg and Carrie Huffman. This is a small triangular piece of property surveyed by Denny Kraus. It could possibly be owned by the heirs of Mr Gibson from the 1800s. Two small parcels were deeded to the county for Salt Fork work. This cleans up an area and they will proceed with a quiet title action. They will also get quit claim deeds. This is for the court. Is the county willing to pay any of the fees for this. Thatcher said the county will not as they have no interest in the piece. This quit cli helps Huffmans get the property transferred.. Baudendistel said this has come up in the past with old  pieces of property where the last heirs are long dead. This will take a couple months to get the paperwork done. Commissioners approved the quitclaim to release the parcel to the Huffmanns.


Todd Listerman- County Engineer:

Award for Bridge 135 Weisburg Road- designs and structure purchased.  Rohe is low bidder at $243,781.00.  Approved Rohe. Rack and Baller $287,403, Lykins $283,072, and McAllister $332,455.50 were higher bidders.

Starting at the end of February. Building on a precast footer to make it faster. They also have Bridge44 on Turkey Pointe to be there by March 1. Contract allows it to be done by mid May. 


Small Structure 616, Thomas Road- Temporary Right of Way- $1111.10 and .34 acres. No fencing is involved. Trees have to be cut down that the owners are agreeable to. Later will have to get permanent ROW. Approved.  


INDOT Final Inspection & Acceptance for Bridge #5 East Laughery Creek Road- needs to sign off on this. Approved and signed. Trees are already in (about a foot tall each)


INDOT Agreement for Right of Way Acquisition Funds Lower Dillsboro Road Slide $30,000 cost. $37,500 was total cost $30,000 is the 80%. Approved the agreement.


Petition to Cancel Taxes, etc- Connie Fromhold for Jared Ewbank- Aurora properties bought on tax sale. This cancels the taxes for those. These already came up under the Aurora Redevelopment . There are so many taxes on them that no one else will purchase them. Approved.  


Dog Concern- Debbie York, Moores Hill- presented a petition fro 8 residences that agree with her that these 3 dogs constantly bark. She has lived there since June 2016. She has called the Town Marshall several times and Marlene at the Animal Control Center was notified. This neighbor breeds beagles. The dogs escape their yard into her yard and pond area. They climb under his fence. Beagles and a terrier mix. Main complaint is their barking keeps her awake at night.

Marlene Underwood said they have been out there 14-15 times over the past few years. When they go out. Brent Casebolt did go out and check on them and one night there was barking so they cited them and they paid the fine on 9/13/21. Owner claims that Debbie York is out at night making them bark. She said that was not true. Conditions of the dog house etc they found some issues. Every issue was corrected. The put straw in dog houses in winter and repaired the homes. Chains were allowed. The last time we heard about loose dogs was in March. They were cited for that. 

Thatcher wanted them to check the chains to see why they are escaping. The fence needs to be fixed to keep the dogs from going under Debbie York’s fence. Probst wanted Casebolt to continue to monitor them. Debbie has been instructed to video or audio a time stamped record to submit to Marlene Underwood for investigation. They need to bring the dogs in at night perhaps.

ATTORNEY – Andy Baudendistel- Signatures for Support Letter for House Resolution 4878- for  The American Discovery Trail - approved and signed. 


COMMISSIONER COMMENTS:

Little: Remember what Christmas means

Probst:COVID back in the red again- people that are vaccinated get Covid but the don’t die. People need to get vaccinated and protect themselves 

Thatcher:Merry Christmas and Happy New Year . Hope 2022 is better than 2021.
