 1 NOVEMBER 2022 DEARBORN COUNTY COMMISSIONERS MEETING NOTES


Present: Jim Thatcher, President, Art Little, and Rick Probst


Also present: Connie Fromhold, Auditor, Andy Baudendistel, Attorney, and Sue Hayden, Administrator


TITLE VI STATEMENT FOR COMPLIANCE was read by Baudendistel as legally required.


OLD BUSINESS:

Schneider GIS Contract- Nicole Daily, Planning and Zoning Director- Daily said they were trying to get work with some of the cities with this too. They will need to do inter-local agreements later with the cities. Aurora (maybe more than one year), Greendale (one year) and Lawrenceburg (has no interest right now)

She wants to move forward with the 3 year contract with Schneider and the county. Aurora’s expense will be higher as they need to use our equipment to upload locations of utilities etc. Greendale has their own equipment to do this and can then upload that to the system. Both cities have new city managers too. Discussion with commissioners about fees and amount of staffing we need to do this. The county GIS server is probably the best place to share the storage space for all the data. The Commissioners want to be sure we do not lose money over this. So there needs to be adjustments in the contracts to account for changes in costs 

Commissioners approved $75,960/year for 3 years, pending the one edit to the contract. 


NEW BUSINESS

Request to Close Guilford Bridge 9/9/23- Tamara Taylor, Editor Bright Beacon- this is not a Beacon event. She’s see what they all give back and she wants to give back to- so she picked JCAP for the recipient  - Sept 9, 2023 for JCAP. Others are helping with the even including Miller York Fire dept.with their parking lot and kitchen facilities. And they have a lighting expert to light it for the event from Manchester. Sept 2-11 is the week needed for installation and tear down. Listerman wants to be sure the weight limit on the covered bridge is sufficient for the number of people on the bridge. Bob Hrezo has hired at his own cost to ascertain the weight issues. Tamara is devoting her money and time to set up the 501c3. She is hoping they can do a rider on the county policy to cover liability for this. Commissioners  see  no issue with closing the bridge road to the park for the week. Approval later when they get more info on weight limit and insurance liability. TABLED. 


Amendment to Article 3 Zoning Ordinance- Nicole Daily, Planning and Zoning Director- This has to do with the BZA and duties and procedures. This was forwarded from the PC. These changes have to do with procedures and speaker limits depending on amount of time needs. Included state statute for applicants that come to BZA and that they are not to speak to members outside of the meeting regarding their case. Also no new cases are heard after 10:30 PM. The BZA can waive that if they want to. The PC version of this was already approved by Commissioners. Commissioners approved the amendment for BZA rules in Article 3. 


Todd Listerman, County Highway Engineer:


On call professional Services Agreement - This is used as needed with USI with an hourly rate, which differs in amount depending on the level of service required and the professional level of the professional services. There is a whole list of fees enclosed. This is for small projects. This goes up to $25,000 for Listerman for each project. He said this is usually not that high. This contract ends mid-year 2023.  Approved.

Bid Award for Small Structure #628 Whites Hill Rd- OLCO for $271,806.80 low bidder- others were:

Paul Rohe $326,196.49

McAlister Excavation- $425,465.31

O’Mara- $434,339.84

Commissioners approved lowest bid which is below estimate- they have a 75 day closure allowed -OLCO out of Batesville IN for $271,806.80. 


Per Listerman- Today will be opening for roll call for federal fund projects. Seeking funds for bridge replacement on Konradi Rd- for 2027 or 2028. Turkeypoint will hopefully be done by Thanksgiving, 


Ordinance to Amend Chapter 90 of Code of Ordinances- Kennel License Rules- Baudendistel said that some people use these to have a bunch of dogs. They are meant to be for actual kennels. These will only be in Ag and Industrial areas in the Zoning code. It will be a $200 fee in Jan forward- up from $50. This is to get Planning codes and this code aligned. The license will be approved by Planning Dept and Animal Control. Current licenses are grandfathered but if they lapse for 6 months they start over. 10-12 existing kennels. This new code starts Jan 1, 2023. Approved


ADMINISTRATOR – Sue Hayden- ARPA Committee Recommendation to the Board of Commissioners- On behalf of the ARPA Committee would like to make a favorable recommendation to the Board of Commissioners for the Dearborn County Regional Sewer District to move forward with the portion of their application to fix a long existing problem with the sewers at Lake Dilldear. This fix would include an interlocal agreement with the Town of Dillsboro to partner in the project which would cost $2,538,289. This recommendation is contingent upon the interlocal between DCRSD and Dillsboro to be executed before the project is presented to Council for approval of funds. This will be TABLED until Nov 15th. The agreement will be a bulk sewer agreement. 


AUDITOR – Connie Fromhold  -Claims/Payroll and  October 18th Minutes approved.


ATTORNEY – Andy Baudendistel- employment separation and release agreement from a former employee. Approved.

Commissioners will meet with Daily and Perleberg and the Broadband ready projects.


COMMISSIONER COMMENTS:

Little - voted after the last meeting. It’s very important to vote,

Probst - vote- 2000 absentee votes received already. We still need Park Board members. Opened them Jim Red Elk trail at Ruhlman Park

Thatcher - Vote also. - Very important thing to do.


LATE ARRIVAL INFORMATION- Jim Meister- 5160 North Hogan Rd- purchased knowing there had to be a sewer line put in. Talked to Frank Kraemer and Aurora about annexation of the riverside of North Hogan. Aurora could bring it up to the county line and the county sewer runs it to them. This is Westside of the 350 bridge. Thatcher thought they had an agreement. Heard recently that Aurora wants to annex it. The costs will be upwards of $300,000 possibly. Looking for help from the county. It seems that Hrezo Engineering is designing things- but somehow the Meisters are to fund the DCRC portion???
