 28 November 2022 Dearborn County Plan Commission Meeting Notes

Present: Dennis Kraus, Jr., Chairman, Russell Beiersdorfer, Jeff Hermesch, Mark Lehman, Joe Vogel, Jake Hoog, Dan Lansing, and Eric Lang

ABSENT: Jim Thatcher

Also Present:  Nicole Daily, Zoning Administrator, and Andy Baudendistel, Attorney.

Baudendistel read the Title VI statement as legally required.

ACTION ON MINUTES- October 24, 2022 Minutes-  Approved.

OLD BUSINESS: none

NEW BUSINESS:

  1. Vacation Plat in Yorkville, alley within Catherine Perine’s Addition to Yorkville - Applicants: JDJ Surveying and Engineering LLC - Owner: Commissioners of Dearborn County - Site Location: Off of Leatherwood Road, Sec. 10, T 6, R 2 - Parcel: #15-05-10-100-013.000-024 (East adjoining tract) - Township: York - Zoning: Community Business (B-2) - Size: 0.175 acres - this is oil teh west side of Wildoff’s Store. Dennis Kraus, Jr- had a conflict of interest so he left the room for this item. Mark Lehman took over as chair for this. Nicole Daily presented- This is different in that the entire alley will go to the platted area owner and not be split between adjoining owners. This is because the plats were done at different times and by law they cannot give land to someone in a different plat from the one that the alley was created in. There is an easement that will be set up for a septic system that is within the alley area after the vacation is filed. This will have to be forwarded to the Commissioners with a recommendation on the vacation. Jeff Stenger presented for the applicant. He was available to answer questions. No one wanted to speak during Public Discussion.The Plan Commission members basically did no see any problem with recommending the vacation to them Commissioners. They unanimously approved sending this to the commissioners with a favorable recommendation.     

2. Zone Map Amendment of property along York Ridge Road from I-2 to Agriculture - Applicant: Dan Seevers - Owner: Seevers Inc - Site Location: 9000-9100 Range of York Ridge Road, Sec. 33, T 7, R 2 - Parcel: #15-02-33-700-116.000-010 & #15-02-33-700-113.000-010 - Township: Kelso - Zoning: Moderate Industrial (I-2) - Size: 33 acres. Nicole Daily presented. The property is being used Agriculturally in this area. In 1965 is was Ag and then in 1980 it was bing used for an asphalt hauling business and that is how it became I-2. It’s not being used for that any more. There is a part in the I-2 that is someone else’s property and that I-2 will remain that way. Putting a house on this wouldn’t be permitted by code if it were I-2. That is why they are rezoning it back to the Ag of the surrounding area. The inspection pictures show that there is no business being run on the property and there were stakes there for a future house. No neighbors responded of the 13 letters sent out. The existing structures all meet Ag requirements. Dan Seevers - the owner of Seevers Inc. He is carving out 5 acres  for his home. The other parcels involved- one belongs to his sister with her home. The other is with his sister and his brother and they do not plan to do anything with it that os Industrial. No one spoke for Public discussion.  Kraus Jr. noted that there is not enough infrastructure there for Industrial uses. The Plan Commission unanimously approved a Favorable Recommendation to the Commissioners to Rezone this property back to Agriculture from I-2.  

ADMINISTRATIVE

Review and discuss proposed changes to Mylar requirements in Article 2 of the Subdivision Control Ordinance - Daily explained why they were looking at these requirements. Retracement surveys and consolidation surveys were discussed and replats. HVL is an area that has these consolidated lot situation. They will reference the zoning ordinance for public hearing procedures so that it will match up. Primary plat requirements will require best available data from the flood plain ordinance because Daily has to enforce that. Surveyors on the board and audience weighed in on these changes. Types of paper were specified. (27 lb extreme bond paper.) It’s cheaper than Mylar. So both types can be used. There are issues with streaking from the stamp ink on the Mylar. Wildlife Conservation easements, wildlife classified forests, etc. are to be added on with recorder. Variances are to be added also. Covenants are to be on the survey by reference so they should be noted by reference to the record document. The grading plans will be moved to a different article for subdivisions and any other grading plans for an acre or more. Some need to be in the design part of the subdivision ordinance also. Also cross reference them. Maybe put them into the same general section in Article 3. Condominiums and landominiums may need more discussion after the zoning maps get finished.   

Review and discuss proposed ordinance amendments and updates to the Dearborn County Zoning Ordinance, specifically with respect to the draft Zoning Map alternatives and the draft text(s) of: Articles 9 and 10, regarding Agricultural and Residential Zoning Districts; Article 25, regarding General Standards; Article 27, regarding Definitions

NOTE: If there is sufficient time the board will discuss the zoning maps for Manchester, York, and Jackson Townships. There were no people in them audience to object or affirm any of these 3. 

York Township Map was discussed- it is mostly Ag and Ag Homestead. There is some residential. The board had no suggested changes from the proposed zone map. 

Jackson Township Map was discussed- All Ag and a  couple areas of existing B-2. They did change some in Ag Homestead with smaller lot areas. The board had no suggested changes to it as proposed.

Manchester Township was discussed. There is some business in the town area itself. The area of Residential out by 48 and 148 has no sewer yet. There is a very small line up near that. The board had no suggested changes to it as proposed.

STARTING IN JANUARY THE PLAN COMMISSION MEETINGS WILL START AT 6 PM
