18 March 2008 Dearborn County Commissioners Meeting Notes

Present: Hughes, Chairman, Fox, and Thompson.
Also present: Pickens, Auditor, Ewbank, Attorney, and Messmore, Administrator
A uniformed police officer was present.

Tom Orschel, D-2 Commissioner Candidate, Rick Pope, D-1 Commissioner Candidate, and Phil Darling Council Candidate were present in the audience.

1. Personnel Manual was adopted with corrections from Thompson. There are three separate personnel policies- one for sheriff, one for 911communications, and one for everyone else.

2. Ruth Ann Batta was given permission to go to Council for the Summer Art program funding. Council already appropriated money. The program is in its 21st year.

3. CASE members (Citizens Against Sewer Enforced Hookups) came for an update on Ewbank’s research. Mary Lyn Hertel (sp?) spoke for the group. Thom Hammond arrived later as the 20-minute meeting was adjourned.
Ewbank spoke to Watson and Watson concurred with CASE’s numbers and said that he must have mis-spoke. He talked to him about errors in the original letter’s terms and Leininger, the lawyer for the CASE members being sued said he was representing only 8-12people.
Hertel told Ewbank that all the members paid for the lawyer- he represents them all. Apparently, nothing is being done about the “false” statements from the sewer board as they have now corrected them.

4. Todd Listerman- Transportation Director- had the commissioners sign off on a corrected contract for Bridge 15- Bells Branch and noted that Ohio County will be paying on the invoice for their share of Triple Whipple in the next few weeks. They will cover the Bell’s Branch share this summer.
Listerman on the 31st will present a case for federal funding for three bridges on the county priority list- Cold Springs, Collier Ridge at Bonnell, and Burtzelbach.

5. Pickens- Claims and Minutes signed. The county has saved about 622 citizens $16,000 on the prescription program.

6. Bryan Messmore- NOTHING to report.

7. Ewbank- no new suits so far- insurance is reviewing claims on US 50 accidents mostly.

8. Thompson- has received a preliminary proposal from Kim Cobol (sp?) on video arraignment and will talk to Sheriff Lusby about it.

Good thing Watson did not mention that John Maxwell has yet to hook up to St. Leon's sewers, or Bob Ewbank would have torn him a new one!!!

Messmore never seems to have anything to say ON RECORD. But he must say a lot other times- else why would he have his Bluetooth ear piece molded to his ear all day? Does he sleep with that thing? I heard he's even seen with it on his lunch breaks. Maybe he thinks it's man jewelry.

As a taxpayer I'm wondering just what it is Mr Messmore is doing to earn his pay. Last couple of meetings all he has to say is "NO REPORT"

DISCRETION:
Discretion is the key word in choosing our elected Judge.
We have a choice to chose whomever we think will best represent all people.
Longivity is not conducive to being fair. There are too many aggravating ,mitigating and extenuating circumstances.

I think it is time for a change!

Well, Messmore was instrumental in permitting the taxpayers to pay for the development lobbying group of our few, chosen and politically connected county development interests, Vieste!

Brett Fehrman would take issue with such statement, he is, at this very moment in time, trying to sell homes and earn commissions on such homes who are on perfectly functioning septic systems!

It is only the percolation rate of soils nearby the proposed Gabbard Estates that do not lend themselves to septic systems and cry out for pressurized sewers!

"Percolation" rates do not impress the Board Members of the DCRSD.

They prefer the steady "drip...drip...drip" of High Ridge's sewage into Hogan's Creek until Gabbard Estates' sewers are subsidized by the taxpayer.

Why in the world is Dearborn County putting money into fixing an old iron bridge by river view cemetry. This money could be spent on the other bridges that need repaired or a gravel road that needs to be black topped that is still gravel. All of this and not even a car will able to drive on it. The county highway is taking a big hit today with all the rain I have heard on the scanner of some road slips that has happened because of this latest storm. Will some one with some commomn sense use our money more wisely.

I used to jump off this bridge over Laughery as a young kid.

We must save it for our grandkids to jump off it.

No other bridge offers the privacy an the lack of law enforcement scrutiny in jumping into Laughery as this bridge.

Save this bridge.

Let us preserve the right of our grandchildren to jump into Laughery...

Does the Republican running for Superior Court 1 against the incumbent judge, have anything to do with the fact that the challenger used to work for the Prosecutor and the the Prosecutor was overruled by the incumbent judge. And that the Judge's ruling was upheld by the Supreme Court? Could it be the Prosecutor is angry he didn't get his way. Or could it have something to do with the fact that the Judge overruled another Judge in Dearborn County and she didn't like being overruled?

The '60's and '70's in Aurora demonstrated the seated judge's very poor discretion. Have things changed?

If you are going to allude to some indiscretions of youth- please be specific- don't just state innuendo. And be FACTUAL, even if you don't want to sign your name.

From the February 19th Commissioners' Meeting:
"Donna Imfeld- spoke regarding forced sewer hook-ups. She asked the commissioners if St. Leon Sewer reps were obligate to give the commissioners accurate numbers when they present information. Hughes said that they would have to look into it if they hadn’t. Imfeld told them she didn’t live in St. Leon and that she was here because “you are my elected officials.” She gave them a packet outlining the record of deceit of the St. Leon sewer officials throughout the years."

So, are Hughes and Fox going to "look into it" now that Ewbank has confirmed what Mrs. Imfeld said is true? That St. Leon has "mispoke"? Has St. Leon simply been inaccurate or deceitful? And will Fox and Hughes support the citizens or simply continue to help St. Leons rush to the sewers??
