21 August 2007 Dearborn County Commissioner Meeting Notes

Present: Hughes, Chairman, Fox, and Thompson
Also present: Pickens, Auditor, Ewbank, Attorney, and Messmore, Administrator
A uniformed police officer was present.

1. Harrison Fire/EMS contract tabled again at Hughes request as he is still working on it.

2. EMA- Bill Black received signatures on the $150,000 exercise grant from Homeland Security for exercises to be done at Muscatatuck on Oct 27th for Homeland Security. This is in addition to the $450-500,000 they already have in Homeland Security grants.

3. Jeff Smith- Weights and Measures- Thompson updated him on the discussion from Budget hearings this week. Pickens also worked on this issue. It was presented as putting Weights and Measures under the Building Inspector and hiring Smith as part time weights and measures and part time building inspector (at starting salary) to replace a retiring employee. Smith will be trained and certified for building inspections. This puts it all under the county. There will be a 2nd employee in the building dept. trained to do Smith’s work also- so they can cover each other.
Smith noted that equipment has all been moved to EMA building and it will be taken to Indy for recertification in Sept. He also has complaints on gas pumps (due to price increases) and has put a complaint form online as well as his 800 number for people to use.

4. GIS- Margaret Minzner introduced her intern John Huang from Washington Univ in St. Louis. He gave the presentation on the Historic Structures update (previously done in 1983) The County has 76 outstanding historic structures and 232 notable ones. This work was performed under a grant from Indiana Humanities Council. The structures were digitally photographed and logged in with GPS. Huang ended his presentation noting that updates should be done more frequently than every 24 years.

5. PAWS- Sandy Carly and Becky Foster gave presentation of their current financial status and had an outside CPA go over their financials to present to commissioners at Ewbank’s suggestion. Ewbank noted that this was the best report he’s seen and he’s seen several over his many years as attorney for government entities. PAWS needs $1.6 million. They have $800,000 from L-bg, $135,000 from individual; they’ve raised $247,000 and need another $418,000. Their architect is working with Hrezo Engineering on the plans. Mayor Cunningham was present and noted that perhaps Lawrenceburg should put their funding into an interest bearing account so that interest could be added to the funding.

6. Todd Listerman- Transportation- shaved several minutes from his usual reporting time. ( 15 minutes total :-))

a. Whippoorwill Drive from Wood’s Edge Sub’n was accepted into inventory by Commissioners. Fox asked if it was core- sampled. Listerman said they were on-site inspecting as it was paved and so that was not necessary. Its 909 ft long= 0.172 miles.

b. Wilson Creek is fixed except for the guardrail and fence repair.

c. The slip on Wilson Creek by US 50 – he is working with OKI to get fed funding on this.

d. Collier Ridge report is in on his desk- he will review and check with Sherzinger Drilling on costs if caissons are chosen as method to repair. Fox wants him to also check locally for other options and to see about costs of relocating the road.

e. Stateline and Stephens intersection work is complete and Listerman will get STOP bars painted when US 50 stripes are done. He was approved for $8,648.12 in additional on this work also. This still is under the $309,000 estimated costs. Hughes asked Listerman to give reasoning on 3:1 slope at that site to Mr. Keller – the HVL manager to post on their board for residents to understand the safety issues and why this was allowable.

f. Moreton Salt was awarded the contract for winter salt supplier at $47.06 to D-2, $45.88 to D-1, and 45.88 to D-3. The losing bid was Cargill at $51/ton to all 3 districts.

7. Pickens noted the PSEG issue was resolved finally. Claims and minutes signed.

8. Messmore- Sept 18th commissioners meeting there will have a half hour presentation from Office of Community and World Affairs Hometown Competitiveness Program for RISE 2020.

9. Ewbank- Commissioners signed a subordination for property at 27 Brown St. Greendale- this was part of a loan for rehabilitation and will be forgiven in 2008 if the owners remain there completing their 10 year residency after rehab granted.

Sheriff Work Release Fund was created officially by ordinance as requested from SBOA. This is money collected from inmates on work release. They pay to work by day and return to jail at night. Approved.

Ewbank is also working on ordinances to create funds for fees on the annual sex and violent offender’s lists, foreclosure fees for sheriff sales, and charging inmates when they break things in jail.

Sitting on DCRSD has to be frustrating. If you started there hoping to make a difference and tehn get side tracked by other members- whose names we all hear on this blog.
There are a couple members on that board who actually seem to be "neutral." We never hear their names on the blog.
But then maybe that's a problem too- perhaps they need to be more vocal.

Well, you can understand there are folks who may have to sell their homes because they cannot afford to hook-up to these proposed sewers for the benefit of a BOARD member!

And to date, they have no one, really doing anything to protect them from the likes of Fehrman.

Witness the time it is taking to put together a no forced hookups letter!

Folks around this proposed subdivision are being robbed and no one is speaking up for them!

So I can understand some of these folks are now at their wits end.

No one on the DCRSD speaks for the little guy, the non-realtor and/or developer!

Until someone truly stands up for these people, the anger and resentment can only grow!

And if angry words bruise your sensibilties, prepare yourself for a lot more when these folks are actually forced, by operation and enforcement of law, to get bank loans to pay for Fehrman's sewers!!!

Chances are, you folks already on working septic systems, could flush your commodes during last winter's electrical outages.

On Fehrman's sewers, you would have been unable to flush your toilets!

But these sewers are cheaper than gravity types and easier to initially sell to a few gullible or conflicted elected officials!

No one, who may prosper from such a setup, wishes to speak to the fact of the future costs of maintaining and replacing expensive grinder pumps or the real health issues that would arise with situations of electrical outages!

Price the grinder pumps. In the $5000.00 range! Maximum service life, under ideal conditions: 10 years!

Not to mention all the costs of excavation for existing property owners! Remember, Fehrman does not care if your home is 30 feet from his sewer line or the better part of a mile. His aim is to force every homeowner onto his sewers!

And what If you are forced by Doug Baer’s Health Department to get a compatible gas powered generator, just to flush your toilets? Those that are interconnected to your home’s electrical panel, can cost over $10,000.00!

All for the fast and initial profit of a few realtors and/or developers!

I believe the property on 50 with the big sign advertizing 120 lot subdivision, is a Fehrman Realty/Development project. But I could be wrong. However, whether Fehrman owns the property outright or stands to profit as an agent from the development of said property, is immaterial as to his conflicting interests in pushing these sewers! Remember, the DCRSD was conceived to fix the problems of High Ridge Estates, another developer nightmare left to the taxpayers to fix. Dillsboro has already offered to take on High Ridge, but since refuse to take on Fehrman's proposed subdivisions, the DCRSD balked!

I believe that both Dillsboro the SDRSD are also against the DCRSD's plan to force hook-ups of those on existing septic systems, especially in circumstances that would place these existing homeowners greatly in debt.

The DCRSD's plan would literally make existing homeowners' homes practically impossible to sell, if allowing any hope of recouping the costs of these forced hook-ups.

You know, I was wondering the same thing. It would only take the resultant sewer mess, caused by a severe ice storm or other natural or man-made disasters, resulting in week long power outages, where the Health Department would have to step in and force measures such as generators to "protect the public health!"

In reference to the 120 lot subdivision on U.S. 50.

Whether a realtor or developer or Aunt Bee is pushing the sewer or is on the board does not matter it is zoned "R" and it will be a residential development.

And even when a developer will pay for the sewer you will have still have a problem with it.

There will always be confict when it comes to development. That is a given.

But, I would posit that, at least the Fehrman proposed development, would not be on the scale that is now planned but for his ability to force others to subsidize his project!

No one, that I know of, is keeping Brett from negotiating with Dillsboro or the SDRSD, where he could negotiate impact or development fees to have sewers run to and service is proposed development!

But that would take more from his bottom line.

And of course, it is much more palatable for Brett to spread the cost of his sewers using existing homeowners' money!

I have a friend near this proposed subdivision. Because of his set back and topography between the proposed sewer line and his home, he was told by a plumper it would take at least three sets of pumps to get his waste to the sewer line!

Puting this poor guy through this, as he is rapidly approaching retirement age, is absolutely criminal on Fehrman's part!!!

It is not relavant how far your home is from the sewer line, but how far your property line is from the sewer line.

Regardless of the impending costs to the homeowner.

There is absolutely no provision written by the DCRSD, that they would entertain "any" exceptions to mandatory sewer hook-ups.

This person near Fehrman's subdivision, was told, regardless of his set back and other problems, to just get a loan to pay for the costs of the forced hook-ups.

Why do you think Ewbanks is dragging his feet relative to the "no forced hook-ups" letter?

He does not want to queer the DCRSD's attempts to force hook-ups, because more development would directly profit his legal and land title interests!

From what I have seen and heard of Hedrick, he is fair to "everyone" which is totally alien to the development crowd who want to hold all the cards!

Hedrick is a proponent of impact or development fees, so existing utility customers do not have to take big hits in their utility rates if a politically connected realtor or developer desides to build any project that would tax the already existing infrastructure!

And of course, that does not fit into the "business models" of some realtor/developers who think the rest of us should subsidize their real estate ventures!

Brett thinks impact fees are unnessary while he has his flunky Doug Baer ready and willing to send out "Forced Hook-up" letters to all those surrounding his projects!!!

Having his neighbors spending upwards of $40,000.00 to connect to his sewers sure beats him paying 3500.00 in impact fees per home!

It is better that the rest of us try to recoup these large expenditures when we try to sell our homes, than Brett having to try to sell homes with an additional $3500.00 of costs to recoup!

It would be "selfish" for the rest of us not to "bite the bullet" in order for Brett to realize as much profit as possible from his subdivision!

Why doesn't fehrman just hook up with other developers on 50 and pool their resourses. It would seem ecomomies of scale would provide them with enough capital to run sewers to their individual projects, without extorting money from those already living around where he and others intends to build?

For comparisons sake:

Let's compare the costs to 120 homes, already on functioning septic systems, Brett would coerce onto his sewers at a conservative estimate of $15,000.00 per home!

That adds up to $1,800,000.00!

How's that for fundamental fairness?

Or are only realtors and developers permitted to do a cost/benefit analysis?

His opponent is Hrezo. He owns Hrezo engineering which is working with the DCRSD and the developers.

Is this someones idea to try to discredit Hedrick to allow Hrezo to get in and tip the balance toward development?

Mayor Hedrick is good, decent man.

He is not in the pocket of any special interests.

While he believes development should be encouraged, he notes the fundamental unfairness of forcing existing property owners and untility customers to finance the development of others!
